It appeared this situation had been resolved over a year ago when the Planning Department agreed not to provide the City Clerk's office with incorrect property owners lists. Prior to that agreement the City Clerk's staff, in order to comply with State Government Code Section 65091, spent many hours updating or correcting public hearing property owners lists which were provided by the Planning Department as being correct, but in fact were not. Also lists were often provided to the Clerk's office which contained many labels lacking street numbers, street names or city names. Public Hearing Anneal By Councilman Silva The City Clerk's office requested the Planning Department to verify the title company's list against the equalized assessors rolls, which are in the Planning Department, as the Clerk's office noticed that the title company had not used the latest available equalized assessors rolls. The Planning Department refused and instead returned the public hearing notice and mailing labels to the City Clerk's office. State Government Code requires that the latest equalized assessment roll be used by the City. First American Title Company verified that they have not yet entered into their system the latest equalized assessor's rolls, however they will sometime in November. The Planning Department must provide verification to the City Clerk that parcels have not changed and the list is correct. If the Planning.Department does not want to conform this title company's list,please obtain permission from the City Attorneys office. Also this title company list of 232 labels should not contain 200 owners of condominium units in Anaheim., Cypress and Stanton. Mayor Moulton-Patterson called the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 5:00 p.m. PRESENT: Silva, Bauer, Robitaille, Moulton-Patterson, Leipzig, Sullivan ABSENT: Winchell (City Council) CONTINUED FROM DECEMBER 6, 1993 PUBLIC HEARING -CONDITIONAL USE PERMIT NO. 93-34-STONEBRIDGE CHRISTIAN CHURCH -APPEAL BY COUNCILMEMBER SILVA OF PLANNING COMMISSION DENIAL OF A REQUEST TO ESTABLISH A CHURCH AS A SHARED USE IN AN EXISTING INDUSTRIAL BUILDING WITH JOINT USE OF PARKING -APPROVED AS AMENDED (420.40) The City Clerk presented a communication from the City Administrator regarding an appeal filed by Councilmember Silva of the Planning Commission's denial of Conditional Use Permit No. 93-34 regarding a proposal to allow a church to utilize 2,000 square foot of an existing 23,873 square foot industrial building during non-business hours, with joint use of the parking lot. A motion was made by Bauer, seconded by Leipzig, to grant the appeal of Conditional Use Permit No. 93- 34 based on the findings and conditions, as follows: FIN INGS FOR APPROVAL-CONDITIONAL USE PERMIT NO.93-34 1. The location, site layout, and design of the proposed 2,000 square foot church with joint use of parking properly adapts the proposed use to adjacent structures and uses in a harmonious manner because the church will utilize the existing industrial layout of the building and parking lot. 2. The granting of Conditional Use Permit No. 93-34 to establish a church in an existing industrial building in an industrial zone will not be materially detrimental to the public health, safety and welfare, or injurious to the property in the neighborhood, because the church will operate when most adjourning businesses are closed, and will have adequate off-street parking. 3. The conditional use permit to establish a church with joint use of parking in consistent with the goals and objectives of the City's General Plan and Land Use map designation of General Industrial, because churches may be permitted in any district. 4. The access to and parking for the proposed church does not create an undue traffic problem because the joint use of parking agreement will ensure that parking is provided for both uses. There will be no conflict in operating hours for the church and industrial use. 5. The applicant recognizes the development standards and nature of the existing industrial area and agrees to accept noise levels. CONDITIONAL OF APPROVAL-CONDITIONAL USE PERMIT NO. 93-34 1. The site plan and floor plans received and dated September 13, 1993 shall be the conceptually approved layout with the following modifications: a. A second exit corridor shall be provided in accordance with the Uniform Building Code. Page 2-Statement of Action -01/03/942 b. Modify site plan to reflect 66 parking spaces and looped circulation system in parking area. 2. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised floor plans pursuant to Conditional No. 1 for review and approval and inclusion in the entitlement file. b. All applicable Public Works fees shall be paid. c. A covenant shall be recorded on the property assure joint use of the parking area. The agreement shall specify hours of operation and required parking for each use, which shall not overlap. Said covenant shall remain in effect for the life of the church use on the site. A copy of the legal instrument shall be approved by the Community Development Department and the City Attorney as to form and content and, when approved, shall be recorded in the Officer of the County Recorder. a cup shall be filed with the Department of Community Development. 3. Fire Department requirements are as follows: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. b. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installations. The system will provide the following: 1. Water flow, valve tamper and trouble detection. 2. Twenty-four(24) hour supervision. 3. Annunciation. 4. Audible alarms. c. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. d. One (1)fire hydrant will be installed prior to combustible construction. Shop drawings will be submitted to the Public Works Department and approved by the Fire Department prior to installations. e. Fire lanes will be designated and posted to comply with City Specification No. 415. f. Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be the following: 1. The number for the building will be sized a minimum of six(6) inches with a brush,stroke of one and one-half(1-1/2) inches. g. Exit signs and exit paths markings will be provided in compliance with the Huntington Beach Fire Code and Title 24 of the California Administrative Code. Page 3 -Statement of Action -01/03/943 4. The use shall conform to the following: a. The Church use shall not operate during any hours of the industrial business. b. The gates along the rear fence shall be open for access to parking during the weekend hours of the church use. 5. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 6. This conditional use permit shall become null and void unless exercised within one (1)year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. The conditional use permit shall also be null and void at such time as the industrial business vacates the site or the building is sold. SPEEDY CIRCUITS, INC. is a manufacturer of printed circuits which involves the use of chemistry to produce its products. The company is subjected to numerous environmental regulations, including Proposition 65, requiring "clear and reasonable warning" as regulated by the Health and Safety Code, Section 25249.6. In addition to this State statutory law, there is the Federal requirement of SARA Title III, Community Right-to-Know Act of 1986, (42 U.S.C. Sections 11001-11050) , Public L. No. 99- 499. SPEEDY CIRCUITS, INC. operates its manufacturing facility seven (7) days a week, 24-hours a day on numerous occasions; therefore, we feel that if the City Council grants this Conditional Use Permit Number 93-34, it would be placing women and children in harms way, should an accidental incident occur. Allowing a church to exist in an industrial zone where women and children will be present while manufacturing processes are being conducted, will create a higher degree of liability and risk for all in the event of an incident. We are NOT in favor of seeing the City Council approve this appeal petition, no more than we favor the potential risk to women and children. We applaud the responsible, negative ruling of the Council at the Pubic Hearing held on October 5, 1993 on this issue, and wish to see this ruling upheld during this appeal. P10 5185 >-_ -- ANALYSIS: Project Description: Conditional Use Permit No. 93-34 is a request to establish a 2,000 square foot church in an existing 23,873 square foot industrial building. The industrial use would continue to operate on weekdays, and the church would use a small portion of the building for services on Sundays and weeknights, during non-business hours. The church anticipates that approximately 70 to 150 people would attend a regular Sunday worship service. Approximately 5 to 40 people would attend informal gatherings on weeknights. The shared uses necessitate joint use of the parking lot. The church use will require 58 parking spaces on nights and weekends, while the industrial use requires 48 spaces on weekdays. The parking lot currently has 51 designated spaces. The church proposes to utilize 15 additional temporary spaces that are normally used for truck turning movements and storage during the weekdays, for a total of 66 spaces. Therefore, each use will have an adequate number of parking spaces for its own needs, since the parking lot is used on different days and different hours for each use. Section 9606.1 of the Huntington Beach Ordinance Code allows the Planning Commission to grant a joint use of parking request under such circumstances. Issues: A petition in opposition to the proposed church use was submitted to the Planning Commission. The petition was signed by the operators of 32 nearby businesses, and stated that their businesses could not co-exist in an M1-A zone with a church(Attachment 4). An adjacent property owner expressed concern that the noise and normal operations of an industrial use would not be compatible with a church. The Planning Commission denied Conditional Use Permit No. 93-34 based on findings that the proposed church use would be incompatible with the surrounding industrial uses. They determined that it would not be appropriate to allow for assembly of people in an area subject to noise or where hazardous materials may be nearby. They also found that the parking layout was insufficient to meet the needs of the church because of the use of some temporary spaces. Staff supports the applicant's request because the hours of operation for the industrial user and the church will not overlap, and a condition of approval is suggested to require recordation of a joint use of parking agreement. The temporary (weekend and evening) parking spaces will be adequate to meet code requirements for the church. Staff also believes that, due to the permitted uses and the performance standards required of industries located in the M1-A zone,there will be no serious conflicts between the applicant's proposed request and the surrounding industrial uses. The proposal allows for RCA 11/15/93 -2- l ► a beneficial community use of the building while allowing the existing industrial use to continue. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. FUNDING SOURCE: Not Applicable. (also doing business as Gibo/Kodama Chairs) would be conducting their business for inventory, manufacturing, and distributing material handling equipment and technical seating. The building is in an industrial park where the neighbors are all businesses. On Sundays, there are few people or cars in the vicinity of the building. McFadden Avenue is a 2 lane street where the building is located. As immediate neighbors to the property involved, we are strongly opposed to its use as anything other-than that which it is zoned for , which according.to our zoning definition is " (restricted manufacturing use district) of the City of Huntington Beach. The purpose of the restricted manufacturing use district is to encourage the establishment of limited manufacturing facilities in areas where such uses are deemed appropriate and to-establish design standards and limitations on permitted uses... and minimize detrimental effects to the-public health, safety and welfare." We have :contacted many of the other businesses around us and find that virtually all agree with us. We all feel that an area zone M1-A which is basically for manufacturing and industry should be devoted solely to that use. Because of its nature. this zone is noisy, smelly and dangerous because of the extensive use of machinery, heavy equipment, lift-trucks, etc. There is also the danger of large semis and vans backing up and being loaded in the streets. Fortunately, the mayor of our fair city agrees with us as evidenced in the letter written to us earlier this year and in her introduction to the Huntington Beach Industrial Directory. (copies of which are attached). According to their application, Stonebridge Christian Church intends to operate "during non-business hours" . In a M1-A zone there is no such thing. The area is set aside for twenty-four hour use. Ours is a case in point. We have a noisy metal stamping plant, which is well within the acceptable levels for the area and zoning right behind 5331 McFadden , which sometimes operates virtually continuously 7 days a week. Of course the sound of the presses is music to our ears after many years of labor building the business but I would not like to live nor attend church next to it. That is why we put it in a M1-A zone!!! Eventhough it is the stated contention of the church to hold sessions on "off hours", parking and pedestrian traffic will be a problem for itself and a probable liability to our city. As you are aware McFadden is a designated truck route with no parking in the 5300 block and the building in question does not have near enough parking to accommodate enough cars to carry up to 150 people, thus creating a potential safety problem. Because of the short notice we have and.the desire to inform you of our strong opposition to this application, we are forwarding this letter without the signed petition which is being circulated to show that the majority of the businesses around us agree that spot zoning is not acceptable.
