SUBJECT: APPEAL -CUP 93-34 -COUNCILMAN SILVA
f
DATE: October 29, 1993
The City Clerk's office is again informing the Planning Department that the City Clerk's office
will not mail out legal notices based on the Planning Department's contention that the City has no
obligation to verify whether the title company utilized the latest equalized assessment rolls. It
appeared this situation had been resolved over a year ago when the Planning Department agreed
not to provide the City Clerk's office with incorrect property owners lists.
Prior to that agreement the City Clerk's staff, in order to comply with State Government Code
Section 65091, spent many hours updating or correcting public hearing property owners lists
which were provided by the Planning Department as being correct, but in fact were not. Also
lists were often provided to the Clerk's office which contained many labels lacking street
numbers, street names or city names.
Public Hearing Anneal By Councilman Silva
The City Clerk's office requested the Planning Department to verify the title company's list
against the equalized assessors rolls, which are in the Planning Department, as the Clerk's office
noticed that the title company had not used the latest available equalized assessors rolls. The
Planning Department refused and instead returned the public hearing notice and mailing labels
to the City Clerk's office.
State Government Code requires that the latest equalized assessment roll be used by the City.
First American Title Company verified that they have not yet entered into their system the latest
equalized assessor's rolls, however they will sometime in November.
The Planning Department must provide verification to the City Clerk that parcels have not
changed and the list is correct. If the Planning.Department does not want to conform this title
company's list, please obtain permission from the City Attorneys office. Also this title company
list of 232 labels should not contain 200 owners of condominium units in Anaheim., Cypress and
Stanton.

I am requesting that the City Administrator's office submit to the City Council an ordinance
amending Division 9 to give the Planning Department the responsibility of mailing legal notices
on City Council land use hearings, as the Planning Department now does for the Planning
Commission.

Attention: Connie Brockway, City Clerk
Reference: Appeal - Conditional Use Permit Number 93-34
Hearing Date: January 3 , 1994
Dear Honorable Mayor Moulton-Patterson and City Council:
SPEEDY CIRCUITS, INC. , located at 5332 Commercial Drive in
Huntington Beach hereby expresses its opposition to granting the
Conditional Use Permit Number 93-34 to the party seeking to
establish a church in a building zoned M1-A, restricted
manufacturing, and adjacent to our building (see enclosed site
map) .
SPEEDY CIRCUITS, INC. is a manufacturer of printed circuits which
involves the use of chemistry to produce its products. The
company is subjected to numerous environmental regulations,
including Proposition 65, requiring "clear and reasonable
warning" as regulated by the Health and Safety Code, Section
25249.6. In addition to this State statutory law, there is the
Federal requirement of SARA Title III, Community Right-to-Know
Act of 1986, (42 U.S.C. Sections 11001-11050) , Public L. No. 99-
499.
SPEEDY CIRCUITS, INC. operates its manufacturing facility seven
(7) days a week, 24-hours a day on numerous occasions; therefore,
we feel that if the City Council grants this Conditional Use
Permit Number 93-34, it would be placing women and children in
harms way, should an accidental incident occur.
We believe the City Council should inform the individuals of the
church of the potential risk they would assume should this
Conditional Use Permit Number 93-94 be approved.

SPEEDY CIRCUITS, INC. has operated its manufacturing facility at
this location for over ten (10.) years, and has taken great care
to insure its environmental compliance with all agencies, both
State and Federal, for the benefit of its employees and
neighbors. Allowing a church to exist in an industrial zone
where women and children will be present while manufacturing
processes are being conducted, will create a higher degree of
liability and risk for all in the event of an incident.
We are NOT in favor of seeing the City Council approve this
appeal petition, no more than we favor the potential risk to
women and children.
We applaud the responsible, negative ruling of the Council at the
Pubic Hearing held on October 5, 1993 on this issue, and wish to
see this ruling upheld during this appeal.
Your kind consideration regarding this matter will be
appreciated.
Sincerely,
SPEEDY CIRCUITS, INC.

ANALYSIS:
Project Description:
Conditional Use Permit No. 93-34 is a request to establish a 2,000 square foot church in
an existing 23,873 square foot industrial building. The industrial use would continue to
operate on weekdays, and the church would use a small portion of the building for
services on Sundays and weeknights, during non-business hours. The church anticipates
that approximately 70 to 150 people would attend a regular Sunday worship service.
Approximately 5 to 40 people would attend informal gatherings on weeknights.
The shared uses necessitate joint use of the parking lot. The church use will require 58
parking spaces on nights and weekends, while the industrial use requires 48 spaces on
weekdays. The parking lot currently has 51 designated spaces. The church proposes to
utilize 15 additional temporary spaces that are normally used for truck turning
movements and storage during the weekdays, for a total of 66 spaces. Therefore, each use
will have an adequate number of parking spaces for its own needs, since the parking lot is
used on different days and different hours for each use. Section 9606.1 of the Huntington
Beach Ordinance Code allows the Planning Commission to grant a joint use of parking
request under such circumstances.
Issues:
A petition in opposition to the proposed church use was submitted to the Planning
Commission. The petition was signed by the operators of 32 nearby businesses, and
stated that their businesses could not co-exist in an M1-A zone with a church(Attachment
4). An adjacent property owner expressed concern that the noise and normal operations of
an industrial use would not be compatible with a church.
The Planning Commission denied Conditional Use Permit No. 93-34 based on findings
that the proposed church use would be incompatible with the surrounding industrial uses.
They determined that it would not be appropriate to allow for assembly of people in an
area subject to noise or where hazardous materials may be nearby. They also found that
the parking layout was insufficient to meet the needs of the church because of the use of
some temporary spaces.
Staff supports the applicant's request because the hours of operation for the industrial user
and the church will not overlap, and a condition of approval is suggested to require
recordation of a joint use of parking agreement. The temporary (weekend and evening)
parking spaces will be adequate to meet code requirements for the church. Staff also
believes that, due to the permitted uses and the performance standards required of
industries located in the M1-A zone, there will be no serious conflicts between the
applicant's proposed request and the surrounding industrial uses. The proposal allows for
RCA 11/15/93 -2-
l ►
a beneficial community use of the building while allowing the existing industrial use to
continue.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the
California Environmental Quality Act.
FUNDING SOURCE:
Not Applicable.
ALTERNATIVE ACTION:
The City Council may grant the appeal and approve Conditional Use Permit No. 93-34
subject to the suggested findings and conditions of approval contained in Attachment 3 to
this report.

SUBJECT; APPEAL OF PLANNING COMMISSION ACTION CONDITIONAL USE
PERMIT 93-94 (STONEBRIDGE CHRISTIAN CHURCH)
I wish to appeal the Planning Commission's action of October 5, 1993, regarding Conditional Use
Permit No. 93-94 for Stonebridge Christian Church. The Planning Commission denied the
request for a new church and joint use of parking to share a building with an existing industrial
use. The denial was based on incompatibility of the church use with the surrounding industrial
uses and the proposed joint use of parking. However, I believe that the proposed church use will
not interfere with the existing industrial use of the building or with surrounding properties, and
that the proposed joint use of parking will meet the needs of both users of the building.

APPROVAL: October 5, 1993
FINDINGS FOR -DENIAL - CONDITIONAL USE PERMIT NO, 93-34 :
1 . The proposed establishment of a church within an industrial
-building is incompatible with the surrounding industrial uses .
The surrounding industrial .uses generate noise and contain
storage of hazardous material . Assembly of people in an
industrial zone exposes them to undesirable conditions . In
addition, a petition in opposition to the chu-rch use signed by
33 individuals was -presented to the Planning Commission stating
-that the surrounding indu-strial businesses cannot co-exist in an
industrial zone with the proposed church.
2 . The proposed parking layout is not adequate to meet the needs of
the church because 19 spaces are temporary.
I hereby certify that Conditional Use Permit No . 93-34 was denied by
the Planning Commission of -the City of Huntington -Beach on
October 5, 1993 upon the foregoing findings .

(740ld-2)
The parking lot currently has 51 designated spaces . The churc
proposes to utilize 19 additional temporary spaces (see Atta ent No .
3) on Sundays and weeknights for a total of 70 spaces . The areas
are normally used on weekdays for truck turning movements access to
truck doors in the building, and storage (see Attachmen o . 2, Site
Plan) . Staff recommends that four (4) temporary space at the rear of
the site be eliminated in order to provide a looped rculation system.
Section 9606 . 1 of the Huntington Beach Ordinance de allows the i
Planning Commission to grant a reduction in the ota] n>>mher. ,f
required spaces as part of the entitlement fo ses when the various
uses have divergent needs in terms of dayti versus nightime hours or
weekday versus weekend hours . Joint use. o parking approvals are
subject to the foll-owing criteria:
A) The maximum -distance between the ilding or use and the nearest
point -of the parking spaces sha be 250 feet .
B) There shall be no conflict i he operating hours based on the
parking space requirements r the different uses on the parcel .
C) Evidence of an agreement -or joint use of parking must be recorded
in the Office of the C my Recorder prior to issuance of the
Certificate of Occupa y.
The applicant will mee these conditions since the parking lot is
located on the same reel as the building, and the hours of operation
for the industrial er and the church will not overlap . A condition
of approval is su s.ted to require recordation of a joint use of
parking agreemen
Staff support he applicant ' s request because it is .compatible with
surrounding operty uses, provides for acceptable- access and parking,
and allows or beneficial use of the building while allowing the
existing ' dustrial use to continue.
10 .-0 AFF RECOMMENDATION:
/Sta -recommends that the Planning Commission approve Conditional Use

Protect Description
The church would use 2, 000 square feet of the 23, 873 square foot
building during non-business hours . During business hours, (Monday
through Friday, 8 : 00 AM to 5 :00 PM) the existing industrial use,
Intra Storage Systems, Inc. , would conduct their business . The
2, 000 square foot area would be used as a showroom. The church
would ,use the facilities on Sundays and occasionally on weeknights
after close of business . The church is newly established, and the
shared use of facilities will allow them to keep expenses low. The
church anticipates that approximately 70 to 150 people would attend
a regular Sunday worship service. Approximately five (5) to 40
people would attend informal gatherings on weeknights .
Joint -Use of Parking
The shared uses necessitate joint use of the parking lot. The
church use will require 58 parking spaces, while the industrial use
requires 48 spaces . The parking requirements for the industrial and
church uses are calculated as follows :
Use Ratio Square Footage Required Parking
Industrial 1 per 500 sf 23 , 873 48
Church 1 per 35 sf 2, 000 58
Staff Report - 10/5/93 -2- (7384d)
The parking lot currently has 51 designated spaces . The church
proposes to utilize 19 additional temporary spaces (see Attachment No .
3) on Sundays and weeknights for a total of 70 spaces . These areas
are normally used on weekdays for truck turning movements , access to
truck doors in the building, and storage (see Attachment No . 2, Site
Plan) . Staff recommends that four (4) temporary spaces at the rear of
the site be eliminated in order to provide a looped circulation system.
Section 96.06 . 1 of the Huntington Beach Ordinance Code allows the
Planning Commission to grant a reduction in the total number of
required spaces as part of the entitlement for uses when the various
uses have divergent needs in terms of daytime versus nightime hours or
weekday versus weekend hours . Joint use of parking approvals are
subject to the following criteria:
A) The maximum distance between the building or use and the nearest
point of the parking spaces shall be 250 feet .
B) There shall be no conflict in the operating hours based on the
parking space requirements for the different uses on the parcel .
C) Evidence of an agr-eement for joint use of parking must be recorded
in the Office of the County Recorder prior to issuance of the
Certificate of Occupancy.
The applicant will meet these conditions since the parking lot is
located on the same parcel as the building, and the hours of operation
for the industrial user and the church will not overlap. A condition
of approval is suggested to -require recordation of a joint use of
parking agreement .
Staff supports 'the applicant ' s request because it is compatible with
surrounding property uses, provides for abceptable access and parking,
and allows for beneficial use of the building while allowing the
existing industrial use to continue.
10 .-0 STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Conditional Use
Permit No. 93-34 with t-he following findings and suggested conditions
of approval :
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 93-34 :
1 . The location, site layout, and design of the proposed 2, 000 square
foot church with joint use of parking properly adapts the proposed
use to adjacent structures and uses in a harmonious manner because
the church will utilize the existing industrial layout of the
building and parking lot .
Staff Report - 10/5/93 -3- (7384d)
2 . The granting of Conditional Use Permit No . 93-34 to establish a
church in an existing industrial building in an industrial zone
will not be materially detrimental to the public health, safety
and welfare, or injurious to the property in the neighborhood,
because the church will operate when most adjoining businesses are
closed, and will have adequate off-street parking .
3 . The conditional use permit to establish a church with joint use of

Conditional Use Permit Application
Applicant : Stonebridge Christian Church
Requirement 13
Stonebridge Christian Church desires a Conditional Usc. Faraiit tP hold church meetings.
The church would utilize a portion of the industrial building (5331 McFadden Ave) during
non-business hours. During business hours, Intra Storage Systems, Inc. (also doing
business as Gibo/Kodama Chairs) would be conducting their business for inventory,
manufacturing, and distributing material handling equipment and technical seating. The
building is in an industrial park where the neighbors are all businesses. On Sundays, there
are few people or cars in the vicinity of the building. McFadden Avenue is a 2 lane street
where the building is located.
Because Stonebridge is a new church, we hope to keep expenses down by sharing the
facility with Intra Storage Systems, Inc. during their non-business hours. The facility will
only be used for church •purposes DURING THE NON-BUSINESS HOURS. Since
Stonebridge would be a new church, the number of attendees would be hard to estimate.
Regular Sunday worship service attendance might number from 70- 150 people including
children. Informal gatherings that occur during the weeknights may number from 5 - 40
people. We will focus on those who are currently not attending a church.

Dear Mr. Hess:
We are in receipt of your notice of a-Public Hearing on conditional use permit
No. 93-34 ( a copy of which is attached).
As immediate neighbors to the property involved, we are strongly opposed to its
use as anything other-than that which it is zoned for , which according.to our zoning
definition is " (restricted manufacturing use district) of the City of Huntington Beach.
The purpose of the restricted manufacturing use district is to encourage the
establishment of limited manufacturing facilities in areas where such uses are deemed
appropriate and to-establish design standards and limitations on permitted uses... and
minimize detrimental effects to the-public health, safety and welfare." We have
:contacted many of the other businesses around us and find that virtually all agree with
us.
We all feel that an area zone M1-A which is basically for manufacturing and
industry should be devoted solely to that use. Because of its nature. this zone is noisy,
smelly and dangerous because of the extensive use of machinery, heavy equipment,
lift-trucks, etc. There is also the danger of large semis and vans backing up and being
loaded in the streets.
Fortunately, the mayor of our fair city agrees with us as evidenced in the letter
written to us earlier this year and in her introduction to the Huntington Beach Industrial
Directory. (copies of which are attached).
According to their application, Stonebridge Christian Church intends to operate
"during non-business hours" . In a M1-A zone there is no such thing. The area is set
aside for twenty-four hour use. Ours is a case in point. We have a noisy metal
stamping plant, which is well within the acceptable levels for the area and zoning right
behind 5331 McFadden , which sometimes operates virtually continuously 7 days a
week. Of course the sound of the presses is music to our ears after many years of
labor building the business but I would not like to live nor attend church next to it. That
is why we put it in a M1-A zone!!!
Eventhough it is the stated contention of the church to hold sessions on "off
hours", parking and pedestrian traffic will be a problem for itself and a probable liability
to our city.
As you are aware McFadden is a designated truck route with no parking in
the 5300 block and the building in question does not have near enough parking to
accommodate enough cars to carry up to 150 people, thus creating a potential safety
problem.
Because of the short notice we have and.the desire to inform you of our strong
opposition to this application, we are forwarding this letter without the signed petition
which is being circulated to show that the majority of the businesses around us agree
that spot zoning is not acceptable.
Thank you in advance for your consideration and assistance in this matter.
