Transmitted for City Council consideration is an appeal by Hugh
Hewitt, Attorney for Pacific Enviro and Coastal Magnolia Group of
the Planning Commission' s approval of Conditional Use Permit No.
92-1 and Negative Declaration No. 92-7 to develop a Wetlands
Information and Wildlife Care Center at Pacific Coast Highway and
Newland Street.
The Planning Commission approved the Huntington Beach Wetlands
Conservancy' s request to develop the Wildlife Center on August 4,
1992 . The appellant is seeking to overturn the Planning
Commission' s approval based on non-notification of the public
hearing and failure of the Negative Declaration to properly address
drainage issues .

The American Trader accident proved how critical it is to have a facility to treat birds, to have
trained volunteers, and to have a staff of local professionals to deal with oil spills and other wildlife
disasters. This year's events of birds and mammal illnesses points up another good reason why
a treatment facility is urgently needed locally.
Huntington Beach with its miles of beaches, Huntington Beach Wetlands, Bolsa Chica Wetlands,
and oil tanker traffic and other oil extraction operations is strategic located for such a rescue
center. Oil operations located close by in Long Beach, marinas and wetlands along the Santa Ana
River give further testimony as to why such a regional facility is needed.
Amigos de Bolsa Chica supports the agreement reached by the County of Orange, the Wildlife
Treatment facility operators, Huntington Beach Wetlands Conservancy, Southern California Edison
Company and the City of Huntington Beach to bring such a facility to Huntington Beach.
We urge the City Council's approval of the plans and encourage this unique agreement to move
forward to quickly bring about the development of the Wildlife Rescue Center on the designated
Southern California Edison Company property.

Dear Jack;
As you may remember, I am a partner in The Coastal Magnolia Group and
Pacific Enviro Design. I am a home owner, taxpayer, and voting citizen of the City of
Huntington Beach. I did serve on the Pacific Coast Highway Coalition during its short
existence. I would like to thank you for the encouragement you have given me and my
family over the past twelve years.
The subject of this letter is the activity of the Huntington Beach Wetlands
Conservancy, which has successfully promoted much of the special interest group
adversity against landowner rights In Huntington Beach, and has used the political
objectives of the civic government to do it. They have nothing invested in the parcel of
land held hostage for many years in Huntington Beach, in study after study.
Through the years this group of wetland weepers has meticulously followed
every movement and comment in the landowner's efforts to seek responsible action
from the City Council and Planning Department of Huntington Beach. Mr. Gorman is
not naive about the process, yet he has recently plead ignorance of those policies and
procedures that follow any and all developmental activities and land actions in the.City
of Huntington Beach. The requirements of the due process that applies to every one
else in the lineup regarding this parcel of ex-whitehole land are being waived for the
Huntington Beach Wetlands Conservancy. No permit, no mitigation, no application, no
public hearing, no waiting -- not liable nor punishable for illegal actions under the
guise of conservancy activities!
In doing their project, the Huntington Beach Wetlands Conservancy has
damaged the property of our partnerships. When they moved the first wheel barrel of
fill dirt to build up the land under their project, they completely ignored the effects on
other property in the flood plain. Any raising of the ground level causes a change in
the flow of water in a drainage basin. Mitigation would necessitate installation of sump
pumps to remove the water. Is it an accident that this wetlands agency achieved their
raised landscape claiming ignorance of procedure?

The reaction of Council to the illegal activities of the Wetlands Conservancy
should be to disqualify the project for a term of one year and require an EIR report and
mitigation plan.
In all likelihood, council does not keep apprised of the progress of the huge
lawsuit the City is defending as a result of Council's alignment with state agencies and
special interest groups against the landowners rights. It is possible yoU don't know
that Mr. Caufman, Attorney for the.Coastal Commission.is.directing.Judge Leonard
Goldstein's court to release the State from liability, placing all blame on the City of
Huntington Beach for downgrading the property from*R5 zoning.
Huntington Beach is my city, too. It needs tax revenues. Yet its council has .
positioned itself as a "protector" of the Coastal Commission, rather than allowing us to
confront that obstacle in our effort to provide the city with positive revenues. This
parcel as the Gateway to Huntington Beach can be a bread-winning asset instead of a
liability of continual expense far beyond the pocket books of its taxpaying community.
The City can return the R-5 zoning that existed prior to 1977. My partners and I may
then focus on the real culprit, the Coastal Commission.
Huntington Beach has an environmental crown in the Bolsa Chica Reserve,
spanning over 30% of its shoreline. There is no crown for freezing development on a
degraded patchland that harbors vagrants, illegals, and thieves and preserves a
bonus sunset for a small, privileged neighborhood and provides victory for a special
interest group who have paid no royalties for passive space. When wetland weepers
have to qualify their projects, the term "wetlands" gets revised to be "passive space",
but regardless of what you name it, if it steals the land and violates a landowner's
rights, it isn't rightl Let's clear up this 30-year old problem and acknowledge that the
landowner in this State does have rights under The Fifth #m The Fourteenth
Amendments. RHD

Project Background:
The Huntington Beach Wetlands Conservancy is proposing to develop a
Wetlands Information and Wildlife Care Facility on a 1.73 acre site
located along Pacific Coast Highway in front of the Southern
California Edison Generating Station just .east of Newland Street.
The Subject site is zoned M2-0-FP2-CZ (Heavy Industrial-Oil-
Floodplain-Coastal Zone) and the General Plan land use designation
is Industrial Resources Production. An animal hospital or surgery
center is an unclassified use pursuant to Section 9630.K. of the
Huntington Beach Ordinance Code and is permitted in any zone, except
residential, subject to conditional use permit approval by the .
Planning Commission. The subject site is in an area of the coastal
zone that the Coastal Commission has final approval. If the project
is approved by the City, a Coastal Development Permit must then be
approved by the Coastal Commission prior to development.
The Wetlands and Wildlife Care Center is an educational visitor
center and animal hospital for the care of birds and animals injured
in the wild. The goal of the non-profit organization is to
rehabilitate the sick and injured wildlife until they can return to
nature. The center will not offer care to domestic animals, such ' as
cats and dogs, and therefore will not act as a typical veterinary
hospital .
The applicant is proposing the facility as a 3 year temporary use.
Edison discourages any permanent improvements such as concrete
paving, retaining walls, or permanent building construction on the
vacant site because of the possible future expansion opportunities.
Therefore, the applicant is proposing modular buildings and crushed
asphalt ground cover.

Coastal Status :
The City will be reviewing the project as "approval in concept" only
as the project is located in the Original Permit Jurisdiction Area
and is subject to final action by the Coastal Commission. The
applicant will be required to obtain a Coastal Development Permit
from the California Coastal Commission.
Wetland Status :
The project location has been designated not-restorable former
(historic) wetlands by the California State Department of Fish and
Game. The Department of Fish and Game reviewed the development
proposal during the public comment period for Negative Declaration
No. 92-7 and declared that the project is not anticipated to have
negative impacts on any of the surrounding land uses . The Coastal
Element adopted by the City of Huntington Beach requires a one
hundred (100) foot buffer between any development and adjacent
wetlands area. The application for Conditional Use Permit No. 92-1
meets the 100 foot separation between the animal enclosures and the
wetlands property on the southeast end of the parcel . A siltation
pond system is designed within the 100 foot buffer zone between the
wildlife cages and -the wetlands but is not considered
"development. " The siltation system acts as the drainage facility
for the project and consists of a series of ponds designed to
collect and filter sediment out of the water when it reaches the end
of the project area. Eventually, clean water will be piped from the
last sedimentation pond to the adjacent wetlands . The sedimentation
pond system is subject to final approval by the California Coastal
Commission as is the entire project.
Recent Grading Activity:
The vacant 1. 73 acre site has sustained quite a bit of activity
since late 1991 involving the applicant, the property owner, a
previous tenant, the California Coastal Commission, and the City.
In December of 1991, 4, 590 cubic yards of imported dirt was
illegally dumped at the site. The applicant proposed to stockpile
the fill to be used to establish the future grade when the Wetlands
and Wildlife Care Center was developed. Stockpiling such a large
amount of dirt however, requires review and permits, including
grading and environmental documentation, by both the City and the
California Coastal Commission.
A temporary trailer was installed at the site without permits at the
same time that the dirt was deposited. The applicant proposes to
utilitze the trailer as the visitor ' s center but must obtain permits
for the installation.
The California Coastal Commission cited the Huntington Beach
Wetlands Conservancy for illegal dumping of soil and the Wetlands
Conservancy responded to the violation by submitting Conditional Use
Permit No. 92-1 and Environmental Assessment No. 92-7 for the
development of the site. As stated in the request, the project lies

within the original permit jurisdiction area of the coastal zone and
requires final action by the Coastal Commission by separate
application. The City is reviewing the Coastal development portion
of the project as "approval in concept" only.
Floodplain Requirements:
The site is located in the flood plain, specifically, flood zone AE
which requires new construction to be elevated eleven (11) feet
above sea level. The parcel ' s current grade varies between four (4)
and six (6) feet above sea level, therefore, the finished floor of
the modular units must be raised approximately five (5) to seven (7)
feet. The applicant proposes to grade the imported soil to nine
feet above sea level and install the modular building on two (2)
foot high blocks screened with a decorative wooden skirt. The
remainder of the site, such as the parking and animal enclosures
will be graded with a gradual one (A) percent slope to eight (8)
feet above sea level . A flood elevation certificate prepared by a
registered engineer will be required as a condition of approval of
the project in order to verify compliance with the flood plain
regulations .
APPEAL:
Hugh Hewitt, representing Coastal Magnolia, has appealed the
Planning Commission' s approval based on the following grounds: -
Comment (from appeal letter) :
Pacific Enviro Design and Coastal Magnolia Group (collectively,
"Coastal Magnolia") own adjacent property but apparently received no
notice of the hearing.
Staff Response:
The applicant prepared a mailing list for all property owners within
three hundred (300) feet of the Southern California Edison property
for the Planning Commission public hearing. The mailing list was
prepared from the latest available assessor tax rolls . Both Pacific
Enviro Design and Coastal Magnolia Group were included on the
mailing list and the public hearing notices were not returned from
the post offfice to the Planning Division.
Comment (from appeal letter) :
While Coastal Magnolia supports reasonable development in the area,
it cannot condone such development without mitigation of its
negative impacts to neighboring property. Specifically, Coastal
Magnolia objects to the Planning Commission' s negative declaration
associated with its decision to approve the Animal Hospital without
any mitigation requirements addressing drainage problems.
Coastal Magnolia ' s property and the property to be occupied by the
Animal Hospital lie in a flood hazard zone, an area without a
pumping district. The Animal Hospital will fill land and cause the

discharge of additional water onto Coastal Magnolia "s property.
This will ultimately increase the wetland character of Coastal
Magnolia ' s property. Although enhancement of wetlands might be a
worthy goal in and of itself, Coastal Magnolia does not desire that
its property be so enhanced.
Staff Response:
Mitigated Negative Declaration No. 92-7 did in fact identify a
mitigation measure addressing drainage on the site which was
repeated in Condition of Approval No. 3(b) . Condition of Approval
No. 3(b) states that "Prior to issuance of building permits, the
applicant/owner shall complete the following:
The project shall comply with mitigation measures identified
in Mitigated Negative Declaration No. 92-7 by obtaining design
approval of the drainage culvert and siltation pond system by
the Department of Fish and Game and the Department of Public
Works . The project shall also maintain a minimum one hundred
(100) foot buffer between the project development and any
wetlands area" .
The applicant ' s conceptually approved plan identifies the natural
drainage from the site being drained towards Southern California
Edison property and not property owned by either Pacific Enviro
Design or Coastal Magnolia Group.

The Public Works Department has indicated that if vacant undeveloped
property naturally drains to an adjacent property, the site may be
developed so that water continues to drain in its natural
direction. The drainage may not be concentrated in one area if the
water was not previously deposited at one specific site and the
total water run-off may not be substantially increased. The Public
Works Department will require the applicant to submit topographical
maps to comply with Mitigation Measure No. 1 and Conditions of
Approval No. ' s 3b, 3e, and 3f which discuss approval of the drainage
system and submittal of hydrology studies.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development advertised draft Mitigated
Negative Declaration No. 92-7 for thirty (30) days, and three
written comments were received. The comments and their responses
have been included as attachments to this report. The staff, in its
initial study of the project, has recommended that a mitigated
negative declaration be issued. Prior to any action on Conditional
Use Permit No. 92-1, it is necessary for the Planning Commission to
review and act on Negative Declaration No. 92=7.
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
The City Council may overturn the Planning Commission' s action on
August 4, 1992 by denying Conditional Use Permit No. 92-1 and
Negative Declaration No. 92-7.

FINDINGS AND CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT NO. 92-1/NEGATIVE DECLARATION NO. 92-7
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 92-1:
1. The location, site layout, and design of the proposed Wetlands
Information and Wildlife Care Center properly adapts the
proposed structures to streets, driveways, and other adjacent
structures and uses in a harmonious .manner. Adequate access
from Newland Street is provided to the site.
2 . The combination and -relationship of the proposed use to another
on a site are properly integrated. The visitors cente'r, animal
hospital and rehabilitation enclosures are designed' to be
compatible with each other and with surrounding land uses .
There is a 100 foot buffer between the use and the wetlands
property to the southeast.
3 . The access to and parking for the proposed Wetlands Information
and Wildlife Care Center does not create an undue traffic
problem. The development project meets the parking requirements
for automobiles and provides two (2) bus parking spaces .
4 . The proposed Wetlands Information and Wildlife Care Center is
consistent with the General Plan designation of Industrial
Resource Production and the zone designation of M2=0-FP2
(Industrial-Oil-Floodplain) as this type of development is a
permitted use in any zone subject to conditional use permit
approval by the Planning Commission.
5 . The project will comply with migitation measures outlined in
Mitigated Negative Declaration No. 92-7 by incorporating a
minimum 100 foot buffer from the wetlands property to the
southeast and by obtaining approval for the proposed drainage
culvert and siltation pond system by the Department of Fish and
Game and the Department of Public Works .
6 . The proposed Wetlands Information and Wildlife Care Center
conforms with the Coastal Development Permit requirements as
follows :
a. The proposed Wetlands Information and Wildlife Care Center
development conforms with the plans, policies, requirements
and standards of the Huntington Beach Coastal Element of the
General Plan.
b. The proposed Wetlands Information and Wildlife Care Center is
consistent with the CZ (Coastal Zone) suffix, the M2-0-FP2
(Industrial-Oil-Floodplain) zone as well as other provisions
of the Huntington Beach Ordinance Code applicable to the
property. This use is permitted in any zone as an
unclassified use subject to conditional use permit approval
by the Planning Commission.
c. At the time of occupancy, the proposed Wetlands Information
and Wildlife Care Center development, can be provided with
infrastructure in a manner that is consistent with the
Huntington Beach Coastal Element and Coastal Land Use Plan of
the General Plan.
d. The proposed Wetlands Information and Wildlife Care Center
development conforms with the public access and public
recreation policies of Chapter 3. of the California Coastal
Act.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-1:
1. The site plan, floor plans, and elevations received and dated
July 15, 1992 shall be the conceptually approved layout with the
following modifications :
a." Handicapped access shall be provided to all buildings .
b. Secondary access from Pacific Coast Highway. shall be gated
and posted "Emergency Access Only" subject to review and
approval by the Fire Department.
c. Replace the existing chain link fence.
d. Designate an area to accomodate a minimum of ten (10) bicycle
parking spaces .
e. Designate ultimate right-of-way line for Newland Avenue and
Pacific Coast Highway including the corner radius . All
property improvements including signage and landscaping shall
be located within the project boundaries.
f . Relocate bus parking spaces to run parallel with Pacific
Coast Highway.
2 . Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Applicant shall obtain approval from Caltrans for
construction of a secondary emergency access only from
Pacific Coast Highway to the site.
b. The site plan (or reference page) shall include all
conditions of approval imposed on the project printed
verbatim.
3 . Prior to issuance of building permits, the applicant/owner shall
complete the following:
a. Submit written evidence of project approval by the California
Coastal Commission.
b. The project shall comply with mitigation measures identified
in Mitigated Negative Declaration No. 92-7 by obtaining
design approval of the drainage culvert and siltation pond
system by the Department of Fish and 'Game and the. Department
of Public Works . The project shall also maintain a minimum
one hundred (100) foot buffer between the project development
and any wetlands area.
c. A $500. 00 cash bond shall be posted with the city for each
modular building or temporary structure to guarantee removal
of all trailers at the time Conditional Use Permit No. 92-31
expires .
d. A Landscape Construction Set must be submitted to the
Departments of Community Development and Public Works and
must be approved. The Landscape Construction Set shall
include a landscape plan prepared and signed by a State
Licensed Landscape Architect and. which includes all
proposed/existing plant materials (location, type, size,
quantity) , an irrigation plan, a grading plan, an approved
site plan, and a 'copy of the entitlement conditions of
approval . The landscape plans shall be in conformance with
Section 9607 of the Huntington Beach Ordinance Code. The set
must be approved by both departments prior to issuance of
building permits .
e. A grading plan shall be submitted to the Department of Public
Works for review and it must be approved (by issuance of a
grading permit) . 'A plan for silt control for all water
runoff from the property during construction and initial
operation of the project- may be required if deemed necessary
by the Director of Public Works .
f . Hydrology and hydraulic studies shall be submitted for Public
Works approval.
g. All applicable Public Works fees shall be paid.
h. Perimeter fencing plans for review and approval which depict
decorative materials .
i . Submit copy of completed FEMA Elevation Certificate prepared
by a registered engineer.
j . Elevations depicting colors and materials of all structures
shall be reviewed and approved by Department of Community
Development staff.
4 . Fire Department Requirements are as follows:
a . Two (2) fire hydrants will be installed prior to combustible
construction. Shop drawings will be submitted to the Public
Works Department and approved by the Fire Department prior to
installation.
b. Fire lanes will be designated and posted to comply with City
Specification No. 415 .
c. Address numbers will be installed to comply with City
Specification No. 428 . The size of the numbers will be the
following:
o The number for the building will be sized a minimum of
ten (10) inches with a brush stroke of one and one-half
(1-1/2) inches.
d. Fire access roads will be provided in compliance with the
Huntington Beach Fire Code and City Specification No. 401.
Include the circulation plan and dimensions of all access
roads (24 ' or 27 ' fire lanes, turnarounds and 17 ' by 45 '
radius turns . )
e. Length of lot requires second access to property on Pacific
Coast Highway.
f. Parking lot and fire access lanes shall be paved with all
weather driving surface.
5 . All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off-site facility equipped to handle them.
6 . Installation of required landscaping and irrigation systems shall
be completed within twelve (12) months from approval of this
entitlement.
7. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers .
8 . During construction, the applicant shall :
a. Use water trucks or sprinkler systems in all areas where
vehicles travel to keep damp enough to prevent dust raised
when leaving the site;
b. Wet down areas in the late morning and after work is
completed for the day;
c. Use low sulfur fuel ( . 05% by weight) for construction
equipment;
d. Attempt to phase and schedule construction activities to
avoid high ozone days (first stage smog alerts) ;
e. Discontinue construction during second stage smog alerts .
9 . Prior to final building permit approval or issuance of a
Certificate of Occupancy, the following shall be completed:
a. The applicant shall obtain the necessary permits from the
South Coast Air Quality Management District and submit a copy
to Community Development - Department.
b. All improvements (including landscaping) to the property
shall be completed in accordance with the approved plans and
conditions of approval specified herein.
c. Compliance with all conditions of approval specified herein
shall be accomplished.
10 . Building permits shall be obtained for the modular trailer
installed without permits.
11. At the time of additional entitlement, proper. dedication shall be
required.
12 . A review of the use shall be conducted in one (1) year of the
issuance of Certificate of Occupancy to verify compliance with
all conditions of approval and applicable Articles of the
Huntington Beach Ordinance Code. If, at that time, there is a
violation of these conditions or code sections or adverse
impacts, Conditional Use Permit No. 92-1 may become null and void.
13 . The Planning Commission reserves the right to revoke this
Conditional Use Permit No. , 92-1 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs .
14 . This conditional use permit shall not become effective for any
purpose until the ten (10) day appeal period has elapsed, until
coastal development permits have been obtained from the Coastal
Commission and written evidence submitted to this department, and
until an "Acceptance of Conditions" form has been properly
executed by the applicant and an authorized representative 'of the
owner of the property, recorded with County Recorder ' s Office,
and returned to the Planning Division.

15. Conditional Use Permit No. 92-1 shall become null and void unless
exercised within one (1) year of the date of final approval by
the California Coastal Commission, or such extension of time as
may be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days
prior to the expiration date.
16 . This conditional use permit shall expire three (3) years from the
date of Coastal Commission approval, or expiration of the
existing County E.M.A. lease from Southern California Edison,
whichever comes first.

held a hearing (the "Hearing") on whether or not to grant
conceptual approval of a temporary use .permit for the
construction and operation of a wildlife center (the "Animal
Hospital") which is intended to serve as a care facility for
wildlife on property leased from the Southern California Edison
Company. I am further informed that the applicant, the
Huntington Beach Wetlands Conservancy, received this approval in
the form of two actions, C.P No. 52-1 and Neg. Dec. No. . 92-7
(collectively, the "Decision") . This news disappoints me for two
reasons.
First, my clients, Pacific Enviro Design and Coastal
Magnolia Group (collectively, "Coastal Magnolia") own adjacent
property but apparently received no notice of the Hearing.
Second, despite the undeniably noble cause of building and
operating the Animal Hospital, the Decision is unfair and

While Coastal Magnolia supports reasonable development
in the area, it cannot condone such development without
mitigation of its negative impacts to neighboring property.
Specifically, Coastal Magnolia ,objects to the Planning.
Commission' s negative declaration associated with its decision to
approve the Animal Hospital without any mitigation requirements
addressing drainage problems.
Coastal Magnolia ' s property and the property to be
occupied by the Animal Hospital lie in a flood hazard zone, an
area without a pumping district. The .Animal Hospital will fill
land and cause the discharge of additional water onto Coastal
Magnolia' s property. This will ultimately increase the wetland
character of Coastal Magnolia ' s property. Although enhancement
of wetlands might be a worthy goal in and of itself, Coastal
Magnolia does not desire that its property be so enhanced.
Coastal Magnolia has sued the City of Huntington -Beach
and other state agencies for their unconstitutional conduct vis-
a-vis its property, including actions geared toward enhancing the
property' s wetlands character and disparate treatment as compared
to other similarly situated land owners. The Decision only
aggravates the situation. Accordingly, Coastal Magnolia appeals
the Decision and requests a hearing on 'said appeal unless and
until the Planning Commission imposes appropriate conditions on
the Animal Hospital to eliminate the adverse effects it will have
on Coastal Magnolia' s property.

The Huntington Beach Wetlands Conservancy proposes to develop a
Wetlands. Information and Wildlife Care Center on a vacant 1.73 .acre
site.. at. Newland Street and Pacific Coast Highway. . The project will be
open to the public but will consist primarily of surgical and
rehabilitation care for local sick and injured wildlife.
The property owner, Southern California Edison, is leasing the site to
the Wetlands Conservancy for a temporary, three (3) year period in .
order to retain the land for future use. The applicant, therefore, is
proposing . temporary modular buildings and a crushed aggregate ground
cover in-lieu of permanent buildings and standard paving.
This project was continued at staff ' s request from the July 21, 1992
Planning Commission meeting due to incomplete public notification.
Staff 'has completed the public notification requirements for the
August 4, 1992 meeting.
Planning staff recommends approval of Conditional Use Permit No. 92-1
and Negative Declaration No. 92-7 for a maximum three . (3) year period
subject to a review of 'the use in one -(1) year as the project complies

9 . 0 ISSUES AND ANALYSIS:
Proiect Description.
The Huntington Beach Wetlands Conservancy is proposing to develop a
Wetlands Information and Wildlife Care Facility at a 1. 73 acre site
in . Huntington Beach. The site is located along Pacific Coast
Highway in front of the Southern California Edison Generating
Station just east of Newland Street. Southern California Edison has
leased the -property to the Wetlands Conservancy on a temporary basis
to be renewed after three (3) years .
The subject site is zoned M2-0-FP2-CZ (Industrial-Oil-Floodplain-
Coastal Zone) and is general planned for industrial resources
production. An animal hospital or surgery center is an unclassified
., use pursuant to .Section 9630 .K. of the Huntington Beach Ordinance
Code and is permitted in any zone, except residential, subject to
conditional use permit approval by the Planning Commission.
The Wetlands and Wildlife Care Center is an educational visitor
center and animal hospital for the care of birds and animals injured
in the wild. The goal of the non-profit organization is to
rehabilitate the sick and injured wildlife until they can return to
nature. The center will not offer care to domestic animals, such as
cats and dogs, and therefore will not act as a typical veterinary
hospital .
The applicant is proposing a temporary use on the site because
Southern California Edison is offering the County of Orange
Environmental Managment Agency, who is in turn sub-leasing the
property to the Wetlands Conservancy, a renewable three (3) year
lease. Edison discourages any permanent improvements such as
concrete paving, retaining walls, or permanent building construction
on the vacant site because of the possible future expansion
opportunities . Therefore, the applicant is proposing modular
buildings and crushed asphalt ground cover.
Staff Report - 8/4/92 -3- (4016d)
The project location has been designated. not-restorable former
(historic) wetlands by the California State Department of Fish and
Game. The Department of Fish and Game reviewed the development ,
proposal during the public comment period for Negative Declaration
No . 92-7 and declared that the project is not anticipated to have
negative impacts on any of the surrounding land uses . The Coastal
Element adopted by the City of Huntington Beach requires a one
hundred (100) foot buffer between any development and adjacent
wetlands area . The application for Conditional Use Permit No. 92-1
meets the 100 foot separation between the animal enclosures and the
wetlands property on the southeast end of the parcel. A siltation
pond system is designed within the 100 foot buffer zone between the
wildlife cages and the wetlands but is not considered
"development . " The siltation system acts as the drainage facility
for the project and consists of a series of ponds designed to
collect and filter sediment out of the water' when it reaches the end
of the project area. Eventually, clean water will be piped from the
last sedimentation pond to the adjacent wetlands . The sedimentation
pond system is subject to final approval by the California Coastal
Commission as is the entire project .
Recent Grading Activity:
The vacant 1. 73 acre site has sustained quite a bit of activity
since late 1991 involving the applicant, the property owner, a
previous tenant, the California Coastal Commission, and the City.
In December. of 1991, 4 , 590 cubic yards of imported dirt was
illegally dumped at the site. The applicant proposed to stockpile
the fill to be used to establish the future grade when the Wetlands
and Wildlife Care Center was developed. Stockpiling such a large
amount of dirt however, requires review and permits, including
grading and environmental documentation, by both the .City and the
California Coastal Commission.
A temporary trailer was installed at the site without permits at the
same time that the dirt was deposited. The applicant proposes to
utilitze the trailer as the visitor ' s center but must obtain permits
for the installation.
The California Coastal Commission cited the Huntington Beach
Wetlands Conservancy for illegal dumping of soil and the Wetlands
Conservancy responded to the violation by submitting Conditional Use
Permit No. 92-1 and Environmental Assessment No. 92-7 for the
development of the site. As stated in the request, the project lies
within the original permit jurisdiction area of the coastal zone and
requires final action by the Coastal Commission by separate
application. The City is reviewing the Coastal development portion
of the project as "approval in concept" only.

Prior Use of Property:
• The subject parcel .has been used as temporary seasonal beach - parking
for the past several years by a separate tenant lease with Edison.
Staff has found records of the proper administrative review
applications and coastal development permit waivers to operate the
beach parking lot for the years 1983-1988.
This season, however, the Kar Kare Company of America made inquiries
to. the City regarding the beach parking lot because . the stockpiled
dirt prohibited the parking of 'cars. The Kar Kare Company was
informed that grading permits, an administrative review, and coastal
development permits would be required to re-establish the seasonal
parking lot. The parcel was then graded illegally, changing the
drainage pattern once again and the lot began operating as overflow
parking for the beach. The Kar Kare Company was cited by both the
City and the California Coastal Commission for running a seasonal
parking lot without permits. and was required to cease operation
until permits were obtained. An application has subsequently been
submitted to the City and was recently approved by the Zoning
Administrator. The temporary parking lot- is subject to final action
by the Coastal Commission as well. .
Floodplain Requirements:
The site is located- in- the flood plain, specifically, flood zone AE
which requires new construction to be elevated eleven (11) feet
above sea level. The parcel ' s current grade varies between four (4)
and six (6) feet above sea level, therefore, the finished .floor of .
the modular units must be raised approximately five (5) to seven (7)
feet. The applicant proposes to grade the imported soil to nine
feet above sea .level and install •the modular building on two (2)
foot high blocks screened with a decorative wooden skirt. The
remainder of the site, such as the parking and animal enclosures
will be graded with a gradual one (A) percent slope to eight (8).
feet above sea level . A flood elevation certificate prepared by a
registered engineer will be required as a condition of approval of
the project in order'. to verify compliance with the flood plain
regulations.
Street Dedication:
The City of Huntington. Beach Ordinance Code requires . property
dedication to the City when necessary for street widening and public
improvements for all development projects, except when the
development is considered non=permanent or temporary. In this case,
the City has adopted a street widening plan for Newland Street with
an ultimate goal of an eighty (80) foot right-of-way. Because the
subject vacant property is not a separate parcel in relation to the
entire Edison plant, approximately twenty (20) additional feet along
the entire length of the Edison property must be dedicated to the
City to meet that goal. However, the city, the applicant, and the
property owner- have determined that the project is . a temporary use
for a maximum three (3) year period and not subject to dedication at
this time.

The conditions of approval stipulate that Conditional Use Permit No.
92-31 shall expire three (3) years from the date of final approval.
If the operator wishes to continue the use beyond that time frame, a •
new conditional use permit must be obtained. Therefore, dedication
of property along Newland Street shall not be required until deemed
necessary by the Department of Public Works. The Caltrans widening
project along Pacific Coast Highway does not require any additional
dedication for this project.
Parking and Landscaping:
The Wetlands Information and Wildlife Care Center complies with
parking requirements as follows:

A separate staff parking area has been designated on the site and will
accommodate approximately six (6) vehicles. The site requires a ten
(10) foot wide landscape buffer along all st.reetside property lines •
and a total of eight (8) percent of the site to be landscaped. The
landscape development plans of the project meets code requirements and
creates a pleasing buffer between Pacific Coast Highway and the animal
hospital. Additional landscaping is provided on the south side of
the modular buildings and the animal enclosures for a total of
thirteen (13) percent of the site as landscaping.
Summary:
The proposed information/visitors center and animal care facility is
compatible with the surrounding land uses of the Edison Generation
Station to the north, a mobilehome storage and residence park to the
west, Pacific Coast Highway and State Beach to the South, and
historical wetlands to the east. It provides code required parking
and landscaping, and will become a valuable asset to the community as
a whole.
Planning staff recommends approval of Conditional Use Permit No. 92-1
and Negative Declaration No. 92-7 for a maximum three (3) year period
with the stipulation that the entitlements be reviewed at the end of a
one (1) year period. The one (1) year review gives staff an
opportunity to analyze the permanence of the use and the structures
and require improvements or upgrades when necessary. The one (1) year
period should commence at the time of issuance of a certificate of
occupancy and the three (3) year period should commence at the time 'of

final project approval by the Coastal Commission. If the expiration
of the tenant ' s lease for the property expires before the end of the :
three (3) year period, then the approval period shall be considered
- completed and the use of the Wetlands Information and Wildlife Care
Center shall cease.
10 .0 RECOMMENDATION:
Staff recommends that the Planning Commission approve .Conditional Use
Permit No. 92-1 and Negative -Declaration No. 92-7 with the following
findings and suggested conditions of 'approval :
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 92-1:
1. The location, site layout, and design of the proposed Wetlands
Information and Wildlife Care Center, properly adapts the proposed
structures to- streets, driveways, and other adjacent structures
and uses in a harmonious manner. Adequate access from Newland
Street is provided to the site.
. 2. The combination and relationship of the proposed use to another
on a site are properly integrated. The visitors center, animal
hospital and rehabilitation- enclosures are designed to be
compatible with each other and with surrounding land uses. There
is a 100 foot buffer between the use and the wetlands property to
the southeast.
3 . The access to and parking for the proposed Wetlands Information
• and Wildlife Care Center does not create an undue traffic
problem. The development project meets the parking requirements
for automobiles and provides two (2) bus parking spaces.
4 . The proposed Wetlands Information and Wildlife Care Center is
consistent with the General Plan designation of Industrial
Resource Production and the zone designation of M2=0-FP2
(Industrial-Oil-Floodplain) as this type of development is a
permitted use in any zone subject to conditional use permit
approval by the Planning Commission.
5 . The project will comply with migitation measures outlined in
Mitigated Negative Declaration No. 92-7 by incorporating a
minimum 100' foot buffer from the wetlands property to the
southeast and by obtaining approval for the proposed drainage
culvert and siltation pond system by the Department of Fish and
Game and .the .Department of Public Works.
6. The proposed- Wetlands Information and Wildlife Care Center
conforms with the Coastal Development Permit requirements as
follows:
a. The proposed Wetlands Information and Wildlife Care Center
development conforms with the plans, policies, requirements
and standards of the Huntington Beach Coastal Element of the
General Plan.

b. The proposed Wetlands Information and Wildlife Care Center _is
consistent with the CZ (Coastal Zone) suffix, the M2-O-FP2
(Industrial-Oil-Floodplain) zone as well as other provisions •
of the Huntington Beach Ordinance Code applicable to .the
property. This use is permitted in any zone as an
unclassified use subject to conditional use permit approval
by the Planning Commission.
c. At the time of occupancy, the proposed Wetlands Information
and Wildlife Care Center development can be provided with
infrastructure in a manner that is consistent with the
Huntington Beach Coastal Element and Coastal Land Use Plan of
the General Plan.
d. The proposed Wetlands Information and Wildlife Care Center
development conforms with the public access and public .
recreation policies of Chapter 3 of the California Coastal
Act.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 92-1:
1. The site plan, floor plans, and elevations received and dated
July 15, 1992 shall be the conceptually approved layout with the
following modifications:
a. Handicapped access shall be provided to all buildings.
b. Secondary access from Pacific Coast Highway shall be gated
and posted "Emergency Access Only" subject to . review and •
approval by the Fire Department.
c. Replace the existing chain link fence and relocate to
interior side of landscaping.
d. Designate an area to accomodate a minimum of ten .(10) bicycle
parking spaces.
e. Reduce parking drive aisle width to 26 feet and increase
landscaping area along Pacific Coast Highway.
f . Designate ultimate right-of-way line for Newland Avenue and
Pacific Coast Highway including the corner radius. All
property improvements including signage and landscaping shall
be located within the project boundaries .
g. Relocate bus parking spaces to run parallel with Pacific
Coast Highway.
2 . Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Applicant shall obtain approval from Caltrans. for
construction of a secondary emergency access only from
Pacific Coast Highway to the site. •

b.. The site plan (or reference page) shall include all
conditions of approval imposed on the project printed
verbatim.
3 . Prior to issuance of building permits, the applicant/owner shall '
complete the following:
a. Submit written evidence of project approval by the California
Coastal Commission.
b. The project shall comply with mitigation measures identified
in Mitigated Negative Declaration No. 92-7 .by obtaining
design approval of the drainage culvert and siltation pond
system by the -Department of Fish and Game and the Department
of .Public Works. The project shall also maintain a minimum
one hundred (100) foot buffer between the project development
and any wetlands area.
c. A $500 .00 cash bond shall be posted with the city for each
modular building or temporary structure to guarantee removal
of all trailers at the time Conditional Use Permit No. 92-31
expires.
d. A Landscape Construction .Set must be submitted to the
. . Departments of Community Development and Public Works and .
must be approved. The Landscape Construction Set shall
include a landscape plan prepared and signed by a State .
Licensed Landscape Architect and which includes all
• proposed/existing plant materials (location, type, size,
quantity) , an .irrigation plan, a grading plan, an approved
site. plan, and a. copy of the entitlement conditions of
approval.. The landscape plans shall be in conformance with
Section 9607 of the Huntington Beach Ordinance Code. The set
must be approved by both departments prior to issuance of
building permits.
e. A grading plan shall be submitted to the Department of .Public
Works for review and it must be approved (by issuance of a
grading permit) . A plan for silt control for all water
runoff from the property during construction and initial
operation of the project may be required if deemed necessary
by the Director of Public Works.
f. Hydrology and hydraulic studies shall be submitted for Public
Works approval.
g. All applicable Public Works fees shall be paid.
h. Perimeter fencing plans for review and approval which depict
decorative materials.
i . Submit copy of completed FEMA Elevation Certificate prepared
by a registered engineer.

j . Elevations depicting colors and materials of all structures
shall be reviewed and approved by Department of. Community
Development staff. •
4 . Fire Department Requirements are as follows: .
a. Two (2) fire hydrants will be installed prior to combustible
construction. Shop drawings will be submitted to the Public
Works Department and approved by the Fire Department prior to
installation.
b. Fire lanes will be designated and posted to comply with City
Specification No. 415.
c. Address numbers will be installed to comply with City
Specification No. 428. The size of the numbers will be the
following:
o The number for the building will be sized a minimum of
ten (10) inches with a brush stroke of one and one-half
(1-1/2) inches.
d. Fire access roads will be provided in compliance with the
Huntington Beach Fire Code and City Specification No. 401.
Include the circulation plan and dimensions of all access
roads (24 ' or 27' fire lanes, turnarounds and 17' by 45 '
radius turns. )
e. Length of lot requires second access to property on Pacific •
Coast Highway.
f . Parking lot and fire access lanes shall be paved with all
weather driving surface.
5 . All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off-site facility equipped to handle them.
6 . Installation of required landscaping and irrigation systems shall
be completed within twelve (12) months from approval of this
entitlement.
7. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers .
8 . During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where
vehicles travel to keep damp enough to prevent dust raised
when leaving the site;
b. Wet down areas in the late morning and after work is
completed for the day;

c. Use low- sulfur fuel ( .05% by weight) for construction
equipment;
d. Attempt to phase and schedule construction activities to
avoid high ozone days (first, stage smog alerts) ;
e.. Discontinue construction during second stage smog alerts.
9 . Prior to final building permit approval or issuance of a
Certificate of Occupancy, the following shall be completed:
a. The applicant shall obtain the necessary permits from the
South Coast Air Quality Management District and submit a copy
to Community Development Department.
b. All improvements (including landscaping) to the property
shall .be completed in accordance with the approved plans and
conditions of approval specified herein.
c. Compliance with all conditions of approval specified herein
shall be : accomplished.
10 . Building permits shall be obtained for the modular trailer
installed without permits.
11. At the time of additional entitlement, proper dedication shall be
required.
12. A review- of the use shall be conducted in one (1) .year of the
issuance. of Certificate of Occupancy to verify compliance with .
all conditions of approval and applicable Articles of the
Huntington-Beach Ordinance .Code... If, at that time, there is a
violation. of these conditions or . code sections or adverse
impacts, Conditional Use Permit No. 92-1 may become null and void.
. 13 . The Planning, Commission reserves . the right to revoke this
Conditional- Use Permit :No. 92-1 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
14 . This conditional use permit shall not become effective for any
purpose until the ten (10) day appeal period has elapsed, until
coastal development permits have been obtained from the Coastal
Commission. and written evidence submitted to this. department, and
until an "Acceptance of Conditions" form has been properly
executed by the applicant and an authorized representative of the
owner of the property, recorded with County Recorder' s Office,
And returned to the Planning Division.
15. This project shall be valid for a maximum three (3) year period
from date of final project approval to coincide with the County
Environmental Management Agency lease from Southern California
Edison.

16 . Conditional Use Permit No. 92-1 shall become null and void unless
exercised within one (1) year of the date of final approval by
the California Coastal Commission, or such extension of time as
may be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days
prior to the expiration date.
CODE INFORMATION:
A. Construction shall be limited to Monday .- Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.
B. The property owner shall dedicate land necessary for the ultimate
right-of-way width of Newland Street for the entire length of the
parcel at the time of any additional entitlements.
C. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
11. 0 ALTERNATIVE ACTION:
The Planning Commission may deny Conditional Use Permit. No. 92-1 and
Negative Declaration No. 92-7 with findings.-

Dear Chairman Shoemaker and Commissioners:
The County of Orange requests your Commission's approval of the Site Permit for
the Wetlands and Wildlife Care Center of Orange County. The proposed center is
a cooperative project involving the County, Southern California Edison Company,
Huntington Beach Wetlands Conservancy,and Alliance for Wildlife. The purpose
of the center will be to provide care to injured wildlife, particularly birds,
and to increase public awareness of injured birds and other wildlife, the
reasons they are injured, the value of their habitat and the need to preserve
the habitat.
The County has leased the two acre site from Southern California Edison and
intends, to grant to the Huntington Beach Wetlands Conservancy a license to use
the site for the proposed project. We believe it affords an excellent link to
the existing wetland habitats and emerging wetlands and wildlife opportunities
in this portion of the Orange County coastline. As you know, the City and
County, along with other state and federal agencies, have several projects in
the planning or implementation stage which will provide refuge for wildlife .
These include the Bolsa Chica Regional Park and the Local Coastal Program
efforts, Santa Ana River Marsh restoration and Talbert/Fairview Regional Park
native habitat enhancement project. These projects augment the significant
coastal resources existing in the area including the Talbert Marsh, Bolsa Chica
Ecological Reserve and the National Wildlife Refuge.
Because of the County's substantial involvement in regional parks and resource
enhancement activities along the Orange County coastline, the Orange County
Board of Supervisors recently initiated a comprehensive program of wetlands and
wildlife preservation, enhancement and restoration in the northern area of the

As you know, the County of Orange .supports the development of the Wetlands
and Wildlife Care Center of Orange County proposed by the Huntington Beach
Wetlands Conservancy. (Please refer to Supervisor Harriett M. Wieder's
July 17, 1992 letter. ) The purpose of this letter is to clarify the County's
role in the proposed project, specifically as it relates to the control and
conveyance. of the project site at Pacific Coast Highway .and Newland Street.
The July 21 staff report to the Commission indicates that the landowner, •
Southern California Edison, has leased the property to the Wetlands Conservancy.
Please be advised that . SCE has issued a license for the site to the County of
Orange. The County in turn intends to license the site to the Conservancy upon
its acquisition of all required development permits. County Harbors, Beaches
and Parks funds are being used to cover the cost of the license (i.e. annual
rent). As proposed, the Conservancy will _be able to use the site at no cost.
The SCE-County license runs through March, 1995. The pending County
Conservancy license will expire at the same time. For your information, the
licensing mechanism (versus a lease) ensures SCEs ability to revoke the site .
use arrangement if necessary for critical SCE business or emergencies.
Under the terms of the two licenses, the County has the right to store emergency
supplies at the subject site and to use the facilities during .emergency
operations at nearby beaches or on flood control facilities in the area. The
availability of this property constitutes a valuable opportunity to help protect
public safety in the event of an emergency in the Huntington Beach area.
We appreciate the City's support of our efforts to enhance wetlands and wildlife
activities in the northern coastal area of the county. Your approval of the
Conservancy's proposal will be greatly appreciated.

Discussions: The proposed project involves importing approximately 4,590 cubic yards of fill to elevate the
• proposed structures above the flood plain as required by federal flood insurance requirements. The maximum
fill height will be 5.5 feet in height. The project will be subject to standard conditions of approval
requiring submittal of soils studies to verify that the soil imported to the site has been analyzed for
suitability and to provide specifications so that soil will be adequately compacted for development of the
proposed project. No significant earth impacts are anticipated.

Discussion: The project site displays signs of previous use of minor soils dumping; however, the site is
primarily flat and does not contain any unique geologic or physical features. No significant impact is

Discussion: Short—Term: Site preparation and construction phases may result in temporary increases of. wind
and water erosion on the site. However, the proposed project will be subject to standard conditions of
approval which require watering of the site, submittal of a drainage/hydrology plan, and provision of a silt
control plan to control runoff from the property during site preparation, and construction. No significant
impact is anticipated.
Long Term: The project does not propose any on—site drainage system. Uncontrolled drainage may result in
. erosion and drainage of oil contaminated runoff into the adjacent wetlands area. Drainage of parking areas
into wetlands area may result in adverse impacts to the area. However, several streets in the City
currently drain into wetland areas and provide water sources to these areas. However with implementation of
the mitigation measures identified below, requiring drainage to be designed in a method acceptable to the
Department of Fish and Game and Public Works, and maintenance .of a 100 foot buffer as required by the City's
Coastal Element and specified in mitigation contained under #4 (a—d), no significant adverse impacts are
anticipated.
Mitigation:
1. Prior to issuance of grading permit the applicant shall modify plans to incorporate a method to
accommodate the quantity and quality of runoff of the site. Proposed drainage shall be designed
in a method acceptable to the Department of Fish and Game and Public Works approval .
f. Changes in deposition or erosion of beach sands, or changes in siltation, deposition
or erosion which may modify the channel of a river or stream or the bed of the ocean
or any bay, inlet or.lake? X .
g. Exposure of people or property to geologic hazards such as earthquakes, landslides,

Discussion: The proposed project is not located in the vicinity of the Alquist—Priolo Zone, but is in an
area of moderate.to high expansive soils. However, the project is subject to standard conditions of
approval requiring provision of a soils study which specifies recommendations for foundations, retaining
walls, etc.; therefore, no significant impact is anticipated.

Short—term: Grading and construction activities associated with the.proposed project will generate dust and
construction equipment emissions which may result in short—term ambient air quality impacts. However, the
project is not located adjacent to any sensitive uses and will be subject to standard conditions of approval
which require, dust control.measures and use of properly tuned equipment. No significant short—term air
quality impacts are anticipated.
Long—Term: The proposed facility has a total of three employees. Employee and visitor/car center activity
is anticipated to generate approximately 20 average daily trips. These vehicle trips may contribute to the
cumulative degradation of air quality in the area. However, due to the low number of trips the project's
contribution is considered negligible. No significant air quality impacts are anticipated.
b. The creation of objectionable odors? _ X _
Discussion: The presence of animal enclosures on the site may result in the creation of objectional odors
� on—site. However, the project site is located adjacent to Pacific Coast Highway and the Huntington Beach
Generating Station and is not in the vicinity of any occupied structures.
C. Alteration of air movement, moisture, or temperature, or any change in climate, either

3. Water. Will the proposal result in:
a. Changes in currents, or the course of direction of water movements, in either marine or
fresh waters? X
Discussion: The site will not drain directly into any marine or freshwaters and does not propose any
activities which will alter water movements.
b. Changes in absorption rates, drainage patterns, or the rate and amount of surface runoff? X
Discussion: The proposed project will result in approximately 20% site coverage by the proposed
structures. The project does not propose paving of parking areas. Parking areas will be covered.with
crushed asphalt which allow moisture to percolate through soils and should not substantially increase
surface runoff from the site. However, the proposed project site presently does not have .adequate
drainage. The site currently floods during the rainy season. However, with implementation of mitigation
measures identified under item #le, no significant adverse impacts are anticipated.
C. Alterations to the course or flow of flood waters? X
Discussion.: The proposed project site is located within the floodplain and proposes to elevate project
structures above anticipated flood levels to comply with federal flood insurance requirements. In addition,
federal flood insurance. regulations also require submittal of a hydrology study to verify that elevation of
the site will not significantly impact flood flows on adjacent properties. With implementation of standard
conditions of approval, which require compliance with Federal Flood Insurance regulations, no significant
impacts are anticipated.

Huntington Beach Geotechnical Inputs Report, groundwater quality impacts are anticipated to be negligible.
g. Change in the quantity of ground waters, either through direct additions or withdrawals,
or through interception of an aquifer by cuts or excavations? _ _ X

Discussion: The proposed project will require the installation of water line connections to serve the
proposed facility. Water required to serve the site's restroom, and animal hospital facilities are not

Sensitive habitats (Coastal Salt Marsh) have previously been identified to the south of the property.
However, the project is located within the coastal zone and will be subject to the sensitive habitat
protection.policies identified in the City of Huntington Beach Coastal Element and implementation the
mitigation provided below with implementation of the mitigation measures identified under item #l.e and
below, no significant adverse impacts are anticipated.
Mitigation:
1 . Prior to issuance of building permit, the .applicant shall modify plans to incorporate a minimum
100 foot setback from the adjacent wetland. If the site configuration precludes a 100 foot
setback, the buffer shall be of sufficient width and design to insure that the Coastal Salt Marsh
area will not be disturbed by the proposed project. The buffer shall be subject to approval by
the Dept. of Community Development.
5. Animal Life. Will the proposal result in: .
a. Change in the diversity of species,.or numbers of any species of animals (birds, land
animals including reptiles, fish and shellfish, benthic organisms or insects)? _ X

structures in the project vicinity are part of at the Generating Station and are unoccupied. No significant
noise impacts are anticipated.

outdoor lighting primarily will- be for illumination of parking areas and security lighting..and is not

vicinity of any uses (such as residences, hospitals or sensitive habitats) which may be sensitive to an
increase in light and glare. In addition, the project will be subject.to standard conditions of approval
requiring submittal of a lighting plan to insure that lighting will not spill onto adjacent properties. No,
significant impact is anticipated.
8. Land Use. Will the proposal result in a substantial alteration'of the present or planned
land use of an area? X
Discussion: The project site is designated as Open Space Recreational on the General Plan and zoned
M2-0-CZ-FP2 (Industrial-Oil-Coastal Zone-Floodplain district 2). These designations allow for wilflife care
related operations which will be conducted on the site subject to conditional use permit approval . The
project site is adjacent to the SCE generating plant to the northeast, PCH to the southwest, Newland St. to .
the northwest and coastal salt marsh areas to the southeast. With implementation of mitigation contained
under items #le and 4(a-d), the proposed project can be compatible with the existing land uses in the area.
No significant adverse land use impacts are anticipated.
9. Natural Resources. . Will the proposal result in:
a. Increase in the rate of use of any natural resources? _ X

Discussion: The applicant has indicated that the proposed project will generate a maximum of 20 vehicle
trips per day for staff and visitor center activities. Based upon the size of the structures and proposed
activities on the site, the City anticipates that this projection is reasonable; and even if doubled, still
would not have a significant impact on circulation in the area. Pacific Coast Highway and Newland Street
currently operate at adequate levels of service in the project vicinity and .can accommodate the additional
trips without any significant changes in the levels of service on those arterials.

Discussion: The proposed project will provide parking located on a crushed asphalt surface which does no to
allow for marking of parking space locations. Staff has determined that due to the relatively.low volume of
vehicular activity associated with the project, the proposed parking area is of adequate size to accommodate
the proposed project. (Parking space designation will be addressed through the design phase).
The area was previously identified as a public parking source in the City's Coastal Element. Construction
of the facility will eliminate these spaces. However, the proposed facility is considered a coastal related
use and does provide adequate facility parking. In addition the project site is .privately owned and,
therefore, public access to the site was never guaranteed. The City of Huntington Beach Coastal Zone Suffix
ordinance which requires one to one replacement of public coastal parking opportunities only applies to
property on the ocean side of PCH. No significant adverse impact is anticipated. .

I . INTRODUCTION
This document serves as the Response to Comments on the Draft
Mitigated Negative Declaration No. 92-7 . This document
contains all information available in the public record related
to the Draft Mitigated Negative Declaration as of May 12, 1992
and responds to comments in accordance with Section 15088 of
the California Environmental Quality Act .(CEQA) Guidelines .
This document- contains six sections. In addition to this
Introduction, these sections are Public Participation and
Review, Comments, Responses to Comments, Errata to the Draft
Mitigated Negative Declaration, and Appendix A.
The Public Participation section outlines the methods the City
of Huntington Beach has used to provide public review and
solicit input on the Draft Mitigated Negative Declaration. The
Comments section contains those written comments received from .
agencies, groups , organizations, and individuals as of May 12,
1992 . The Response to Comments section contains individual
responses to each.. comment. The Errata to the Draft Mitigated
Negative Declaration is provided to show corrections of errors
and inconsistencies in the Draft Mitigated Negative Declaration.
It is the intent of the. City of Huntington . Beach to include
this document in the official public record related to the
. Draft Mitigated Negative Declaration. Based. on the information .
contained in the public record the decision makers will be
provided with an accurate and complete record of all.,
information related to the environmental consequences of the
project .
II . PUBLIC PARTICIPATION AND REVIEW
The City of Huntington Beach notified all responsible and
interested agencies and interested groups, organizations, and .
individuals that a Draft Mitigated Negative Declaration had
been prepared for the proposed project . The City also used
several methods to solicit .input during the review period for
the preparation of the Draft Mitigated Negative Declaration.
The following is a list' of actions taken during the
preparation, distribution, and review of the Draft Mitigated
Negative Declaration.
1 . A cover letter and copies of the Draft Mitigated
Negative Declaration were filed with the State
Clearinghouse on April 9 , 1992 . The State
Clearinghouse assigned Clearinghouse Number 92041029 to
the proposed project . A copy of the cover letter and
the State Clearinghouse distribution list is available
for review and inspection at the City of Huntington
Beach, Planning Department, 2000 Main Street,
Huntington Beach, California 92648 .

2 . An official thirty (30) day public review period for
the Draft Mitigated Negative Declaration was
established by the State Clearinghouse. It began on
April 9 , 1992 and ended on May 8, 1992. Public comment
letters were accepted by the City of Huntington Beach
through May 12, 1992 .
3 . Notice of the Draft Mitigated Negative Declaration was
published on the Huntington Beach Independent on April
9, 1992 . Upon request, copies of the document were
distributed to agencies, groups, organizations, and
individuals .
III . COMMENTS
Copies of all written comments received as of May 12, 1992 are
contained in Appendix A of this document . All comments have
been numbered and are listed on the following pages . All
comments from letters received have been retyped verbatim in a
comment-response format for clarity. Responses to Comments for
each comment which raised an environmental issue are contained
in this document.
IV. RESPONSE TO COMMENTS
The Draft Mitigated Negative Declaration No. 92-7 was
distributed to responsible agencies, interested groups,
organizations , and individuals . The report was made available
for public review and comment for a period of thirty (30)
days . The public review period for the Draft Mitigated
Negative Declaration established by the State Clearinghouse
commenced on April 9 , 1992 and expired on May 12, 1992 . The
City of Huntington Beach accepted comment letters through May
12, 1992 .
Copies of all documents received as of May 12; 1992 .are
contained in Appendix A of this report . Comments. have been
numbered with responses correspondingly numbered. Responses
are presented for each comment which raised a significant
environmental issue.
Several comments do not address the completeness or adequacy of
the Draft Mitigated Negative Declaration, do' not raise
significant environmental issues, or request additional
information. A substantive response to such comments is not
appropriate within the context of the California -Environmental
Quality Act (CEQA) . Such comments are responded to with a
"comment noted" reference. This indicates that the comment
will be forwarded to all appropriate decision makers for their
review and consideration.

it may not be zoned residential, it appears that some "residents"
are short-term while others are not, based on discussions .at the RV
Park. It would seem that the site is functioning as a quasi
multi-family residential/motel site. This neighboring use should be
more clearly described in the Negative Declaration as should any
potential impacts to the residents .as a result of the wildlife
center being developed.

development . A mitigation and motoring plan subject to DFG approval

. not necessarily limited to, freshwater marsh, riparian. woodland, oak
woodland and riparian scrub .vegetation.

3 . Watercourses . The DFG opposes the elimination of watercourses
and/or their conversion into subsurface drains . All watercourses,
whether intermittent or perennial, must be retained and provided
with setback buffers appropriate to preserve the riparian and
aquatic habitat values . Earthen channels should be interconnected
with adjacent large open space areas to increase their effectiveness
as wildlife corridors in urban surroundings . The DFG has direct
jurisdiction under Fish and Game Code sections 1601-03 in regard to
any proposed activities that would divert or obstruct the natural
flow or change the bed, channel, or bank of any river, stream, or
lake. We recommend early consultation since modificat.ion .of the
proposed project may be required to avoid impacts to fish and
wildlife resources . Formal notification (with fee) under Fish and
Game Code Section 160.3 should be ;made after all other permits and
certifications have . been obtained. -Work cannot be initiated until a
stream bed alteration agreement is executed.

filed, the fee is $850 . It is our assessment that this project will
result in cumulative loss of fish and wildlife resources and is not

Discussion: The presence of animal enclosures on the site
may result in the creation of objectionable odors .
However, the project proposes to locate the enclosures
along the southern most portion of the site as far away as
possible from 'any habitable structures . The nearest
residences to the enclosures will be located to the
northeast of the subject site across Newland Street . No
significant odor impacts are anticipated.
6b. Exposure of people to sever noise levels?
Discussion (a, b) : The proposed project will result in
short-term increases in noise levels during the site
preparation and construction phases due to heavy equipment
used during these phases . The proposed project may also
increase noise levels over that generated by the existing
vacant site. However, the site is not located in the
immediate vicinity of any sensitive uses (such as schools
or hospitals) . The nearest residential units are mobile
homes located to the northeast of the project site across
Newland Street . Project related noise increases to these
residences over existing traffic noise from PCH and the
generating station is anticipated to be negligible. No
significant noise impacts are anticipated.

7 . Light and Glare. Will the proposal produce new light or
glare?
• Discussion: The proposed project may increase the light
and glare generated by the site. However, the outdoor
lighting primarily will be for illumination of parking
areas and security lighting and is not anticipated to be
substantial . - The site is located adjacent to the
generating station and is anticipated to have a negligible
increase in light and glare in the area. In addition, the
project will be subject to standard conditions of approval
requiring submittal of a lighting plan to insure that
lighting will not spill onto adjacent properties . No
significant impact is anticipated.

from the Department of Fish and Game (DFG) pursuant to Fish
and Game Code Section 2081.
2 . Wetlands. Compliance with the DFG's Wetland Policy requires
that there should be no net loss of wetland acreage or
wetland habitat values, either on or off project . site, due t
project development. A mitigation and monitoring planDFG-3
subject to DFG approval should be required for loss of
sensitive habitats including, but not necessarily limited to,
freshwater marsh, riparian woodland, oak woodland, and
riparian scrub vegetation.
3 . Watercourses. The DFG opposes the elimination of
watercourses and/or their conversion into subsurface drains.
All watercourses, whether intermittent or perennial, must be
retained and provided with setback buffers appropriate to
preserve the riparian and aquatic habitat values. Earthen FG-4
channels should be interconnected with adjacent large open
space areas to increase their effectiveness as wildlife
corridors in urban surroundings. The DFG has direct
jurisdiction under Fish and Game Code Sections 1601-1603 in
regard to any proposed activities that would divert or
obstruct the natural flow or change the bed, channel , or ban

payable to the County Clerk at the time of or prior to filing
the Notice of Determination by the lead agency. If a DFG-5
Negative Declaration is filed, the user fee is $1, 250. If an
Environmental Impact Report is filed, the fee is $850. It is
our assessment that this project will result in cumulative
loss of fish and wildlife .resources and is not exempt from.
the user fee.
In conclusion, if your analysis reveals that the above-mentioned
concerns have been fully addressed throughout your
decision-making process, we would not object .to the project
