The granting of Variance No. 98-6 for a third story addition would constitute'a grant of special privilege inconsistent with limitations placed upon other properties in the vicinity and under an identical zone classification. Variances to the maximum 25 foot height limit within the rear 25 feet of the property and to the maximum floor area ratio have not been granted to properties under a similar zoning classification. 2. There are no special circumstances applicable to the subject property, including size, shape, topography and location or surroundings. The strict application of the zoning ordinance is not found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The subject property is flat and rectangular in shape, with street frontage and alley access. 3. The granting of a variance is not necessary to preserve the enjoyment of one or more substantial property rights. The property owner currently has a third story, as well as a third story deck which enables him to enjoy views from the third story, as well as increased function of the home with a third story, which many of the two story property owners within the general vicinity are not able to enjoy. 4. The granting of the variance would be materially detrimental to the public welfare or injurious to property in the same zone classification. The proposed third story addition, if approved, would set precedence for other property owners to exceed the floor area ratio and maximum heights which have been established to reduce the massing and bulk of structures, creating a less imposing streetscape and a more livable environment. 5. The granting of the variance would adversely affect the General Plan. It is inconsistent with the Land Use Element designation of Residential High Density on the subject property. The deck enclosure will be not architecturally compatible with the existing home and adjacent residences and is not consistent the following goals and policies of the General Plan: a. The enclosure of the third story deck will be compatible with the existing residence and the neighborhood character. SUGGESTED FINDINGS FOR APPROVAL-VARIANCE NO. 98-6: 1. The granting of Variance No. 98-6 for a 320 sq. ft. third story addition that exceeds the maximum allowable height (30 feet in lieu of a maximum 25 feet) and exceeds the maximum floor area ratio (1.11 in lieu of a maximum 1.0) will not constitute a grant of special privilege inconsistent with limitations placed upon other properties in the vicinity and under an identical zone classification. 2. There are special circumstances applicable to the subject property, including size, shape, topography and location or surroundings. The strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The subject property is long and narrow which constrains conventional development practices. r 3. The granting of a variance is necessary to preserve the enjoyment of one or more substantial property rights. The property owner currently has a third story with an open deck area which would be enclosed. Enclosing the deck would enable the property owner to enjoy the views from the third story while still providing protection from adverse weather conditions. 4. The granting of the variance would not be materially detrimental to the public welfare or injurious to property in the same zone classification. The proposed third story addition is minimal in area (320 square feet), and would not create any additional bulk to the existing residence. The additional height will be added to the alley frontage which is not visible from the street adjacent to the structure. 5. The granting of the variance would not adversely affect the General Plan. It is consistent with the Land Use Element designation of Residential High Density on the subject property. The deck enclosure will be architecturally compatible with the existing home and adjacent residences and consistent the following goals and policies of the General Plan: a. (LU 9.2.1) SUGGESTED CONDITIONS OF APPROVAL— CONDITIONAL USE PERMIT NO. 98-20 AND VARIANCE NO. 98-6: 1. The site plan, floor plans and elevations received and dated July 6, 1998 shall be the conceptually approved layout. 2. Prior to submittal for building permits, zoning entitlement conditions of approval shall be printed verbatim on the second page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). 3. Prior to final building permit inspection and approval the following shall be completed: a. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Community Development Department. b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. 4. The Community Development Director ensures that all conditions of approval herein are complied with. The Community Development Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Community Development Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Conditional Use Permit No. 98-20 and Variance No. 98-6 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Community Development a minimum 30 days prior to the expiration date. 2. The Planning Commission reserves the right to revoke Conditional Use Permit No. 98- 20 and Variance No. 98-6, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 3. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 4. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 5. The request is for a third story addition which, when added to the existing structure, exceeds the maximum floor area ratio of 1.0 and would exceed the maximum height of 25 feet within the rear 25 feet of the property. The applications were originally heard and denied by the Zoning Administrator and then heard by the Planning Commission on appeal. The variance application was denied by both hearing bodies because there are no unique characteristics at the subject property and the granting of the variance would constitute a grant of special privilege to the property owner. The conditional use permit was referred back to the Zoning Administrator by the Planning Commission. The subject property is located in the first block of 11`h Street and is zoned District No. 2 (residential) of the Downtown Specific Plan. The appeal asserts the project should be approved (Alternative Action No.1) for the following reasons: 1) The design of the addition is not detrimental to the neighborhood; 2) Other homes in the vicinity have.had exceptions granted that are over the maximum floor area ratio, have similar additions and are over the height limit. Staff recommends the variance and conditional use permit be denied with findings (Recommended Action). Funding Source: Not applicable. Tustin Ave., Ste. 118, Orange, CA 92865 CD98-34 -2- 09/11/98 11:18 AM REQUEST FOR COUNCIL ACTION MEETING DATE: September 21, 1998 DEPARTMENT ID NUMBER: CD 98-34 Appellant/ Property Owner: Mr. Ron Anton, 113 11" Street, Huntington Beach, CA .92648 Location: 113 111h Street (east of PCH and west of Walnut Avenue) Conditional Use Permit No. 98-20 and Variance No. 98-6 represent requests to construct a third story addition (enclosure of an existing third level open deck) to an existing three story single family dwelling. The variance requests are to exceed the permitted maximum floor area ratio and to exceed the maximum height of 25 feet by five (5) feet within the rear 25 feet of the property. The appellant is requesting this project due to the asthma and hay fever from which he and his wife suffer. The enclosing of the deck would enable them to enjoy views from the third floor deck enclosure, while limiting their exposure to the outside elements. B. BACKGROUND On May 20, 1998, the Zoning Administrator denied the project with findings for denial. The Zoning Administrator found nothing unusual about the configuration or topography of the subject lot and found the variances to constitute a grant of special privilege to the property owner. In addition, there have been no similar variances approved in District No. 2 (residential) of the Downtown Specific Plan. The Zoning Administrator determined that the design of the glass enclosed addition was not compatible with the single family residential development in the area because of the bulk and massing. C. PLANNING COMMISSION MEETING SUMMARY AND RECOMMENDATION: Mr. Ron Anton appealed the Zoning Administrator's denial to the Planning Commission (Attachment No. 2). During the July 21, 1998 Planning Commission meeting, the applicant and two property.owners spoke in support of the project. No persons spoke in opposition of the project. The Planning Commission denied the project with findings by a 4-2 vote, and then voted to reconsider the item. The motion was made to deny the variance, and refer the conditional use permit back to the Zoning Administrator for redesign. The conditional use permit is required for a third story residential addition. The intent of the action was to enable the applicant to construct a third story addition that would comply with the maximum height and maximum floor area ratio permitted within the Downtown Specific Plan, without having to submit a new conditional use permit application. D. APPEAL: An appeal to the Planning Commission's denial was filed by the property owner, Ron Anton on July 28, 1998 (Attachment No. 2). STAFF ANALYSIS OF APPLICANT'S APPEAL: The project proposal is fully analyzed in the attached Planning Commission Staff Report dated July 21, 1998 (Attachment No. 3). The major issues with respect to this request include compliance with the General Plan, the Downtown Design Guidelines and the Downtown Specific Plan. The General Plan and Downtown Design Guidelines recommend extensive mass and facade modulation and articulation. The proposed deck enclosure would offer little modulation and articulation of the facade, and would not, be architecturally compatible with the existing home. The project is not in compliance with the Downtown Specific Plan requirements of a maximum floor area ratio (FAR) of 1.0 and the maximum permitted height of 25 feet within the rear 25 feet of the property. The 320 square foot addition would increase the FAR on the property to 1.11, and exceed the maximum height of 25 feet within the rear 25 feet of the property by five (5) feet. The Zoning Administrator and the Planning Commission found that there are no unique characteristics applicable to the subject property which would justify the granting of a variance. The following is an analysis in response to the appeal of the project: "My time was cut-off to present the facts" Staff has been working with the applicant in reviewing the proposed plans as well as plans of several homes in the immediate area. The applicant believes that other homes in the area exceed the standards which his home is being held to. All information was presented to the Planning Commission and the Zoning Administrator, both in written and verbal form. In reviewing the process, Staff believes that the applicant was given every opportunity to submit information he felt was pertinent to the project. In addition, the applicant was given the necessary time at the public hearing to present slides and an oral argument for the project. "Letters from my surrounding neighbors were never read" The applicant submitted four letters from surrounding property owners (Attachment No. 4) in support of his project. These letters were not included in the Staff report to the Planning Commission, however, several of the property owners spoke in favor of the project at the meeting. The variance granted at 302 20th Street is not relevant in this circumstance, as the variance request made by the applicant and the variance approved at 302 20th Street are for different development standards (lot coverage vs. floor area ratio). The home at 112 21s' Street is not relevant as it did not receive any variances. "Only one other private dwelling in our neighborhood" The intent of this statement is to imply that there is only one single family residence in the general area, as there are several apartment complexes and a hotel in the immediate vicinity. In fact, there is a single family home directly adjacent to the subject property, as well as several other single family homes in the general vicinity, although not directly adjacent to the project area. This statement is not relevant to the granting of a variance," as the adjacent land uses can not be used to justify the granting of a variance. In consideration of a variance request, the City Council must make the following findings; 1) That there are unique characteristics applicable to the subject property; 2) The granting of the variance will not constitute a grant of special privilege; 3) The variance is not necessary to preserve the enjoyment of one or more substantial property rights; and 4) The granting of the variance will not be materially detrimental to the public welfare or injurious to property in the same zone classification. An Affirmative Action on a variance can not be based on the surrounding land uses. "We are not blocking views" Following field visits to the site, Staff determined that existing or future views may be blocked by the addition. The added height of the structure at the rear of the property would diminish views from the adjacent single family dwelling (111 13th Street) to the north. It is also important to note that the proposed addition would reduce light and ventilation to adjacent properties and will eliminate all outdoor area on the upper level deck. "The design of the addition is not detrimental to the neighborhood" The Downtown Design Guidelines and the General Plan set forth specific parameters with the intent of creating an inviting, pedestrian friendly environment in this district. The proposed addition would be detrimental to the surrounding neighborhood as the increased height would increase the bulk of the existing dwelling creating a more imposing streetscape and a less livable environment. F. SUMMARY The project includes a request for two variances; one to exceed the maximum permitted FAR of 1.0 by .11, and one to exceed the maximum height of 25 feet within the rear 25 feet of the property. Staff is recommending denial of the appeal as there is no justification to grant either one of these variances. Specifically, there are no special circumstances applicable to the subject property, the granting of the variances would constitute a grant of special privilege, and the variances are not necessary to enjoy one or more substantial property rights. The variance and conditional use permit were denied by the Zoning Administrator and the variance was denied by the Planning Commission for the following reasons: The expansion of the existing single family residential structure will be detrimental to the general welfare of persons working or residing in the vicinity and detrimental to the value of the property and improvements in the neighborhood as the usable outdoor area on the upper level deck will be reduced and the bulk and mass of the structure would increase. The proposed third story addition is inconsistent with the Downtown Design Guidelines which encourages that upper stories be setback from the first story fagade. Existing views, light and ventilation on adjacent properties would be reduced. The granting of the Variance to exceed the maximum FAR of 1.0 and the maximum height of 25 feet within the rear 25 feet of the property will constitute a grant of special privilege inconsistent with limitations upon other properties within the same development and under identical zone classifications. The request is inconsistent with the Downtown Specific Plan which establishes the maximum height and floor area ratio for the district. There are no special circumstances applicable to the subject property which justify the granting of a variance to the maximum FAR and the maximum height of 25 feet within the rear 25 feet of the property. The request is inconsistent with the General Plan which encourages new residential development to be compatible with existing structures. The proposed addition would not comply with the provisions of the DTSP-2 (Downtown Specific Plan District No.2) base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The third story deck enclosure would exceed the maximum height of 25 feet within the rear 25 feet of the property by 5 feet and would exceed the maximum floor area ratio of 1.0 on the subject property. 4. The granting of the Conditional Use Permit would adversely affect the General Plan. It is inconsistent with the Land Use Element Designation of Residential High Density on the subject property. The enclosure of the third story deck would exceed the height and floor area allowed for the structure, and is not compatible with the existing residence and the neighborhood character. Height is measured from the top of curb directly adjacent to the structure to the highest roof peak of the structure. The property owner has indicated the desire to enclose the existing third story deck due to the fact that he and his wife suffer from hay fever and asthma. The enclosing of the deck area would enable him to enjoy views from the roof;while limiting his exposure to the outside.elements. (see Attachment No. 2) Zoning Administrator Action: The Zoning Administrator reviewed the.request on May 20, 1998. The item was continued for two weeks to allow Staff and the Zoning Administrator the opportunity to research the information submitted by the applicant and review the development in the immediate and surrounding area. The project was subsequently denied by the Zoning Administrator on June 3, 1998, with findings for denial (see Attachment No. 3). The Zoning Administrator found nothing unusual about the configuration or topography of the subject lot as required in order to justify approving a variance. In addition, there have been no similar variances approved in District No. 2 of the Downtown Specific Plan. The Zoning Administrator determined that the design of the addition was not compatible with the single family residential development in the area and found the variances to constitute a grant of special privilege to the property owner. Appeal: The decision of the Zoning Administrator was appealed by the property owner on June 8, 1998 (see Attachment No. 4). The property owner has indicated in his appeal letter that he feels that all of the facts presented were not properly examined. He has submitted examples of other properties in the general vicinity which he believes are existing in a similar configuration to what he has proposed to construct on his property. ISSUES: General Plan Conformance: . The proposed project is inconsistent with the goals and objectives of the City's General Plan and the Land Use Element designation of Residential High Density on the subject property. Criteria in the General Plan for Subarea 3 of the Land Use Element recommends that residential development within the area adjacent to Pacific Coast Highway incorporate extensive mass and fagade modulation and articulation. The proposed deck enclosure would offer little modulation and articulation of the fagade, and would not be architecturally compatible with the existing home. In addition, the proposed third story expansion is inconsistent with the following goals and policies of the General Plan: a. Require that all new residential development within existing neighborhoods be compatible with existing structures. (LU 9.2.1) b. Require that single-family residential units be designed to convey a high level of quality and character. Coastal Status: The proposed project is within a non-appealable portion of the Coastal Zone. Design Revieiv Board: The Design Review Board reviewed the proposed deck enclosure on April 9, 1998. The Board recommended that the elevations be revised to match the existing tile mansard roof of the existing dwelling. The plans have been revised to reflect the Board's recommendation. Environmental Board: Not applicable Other Department Concerns: The Building Division, Public Works Department, Fire Department and the Park,Tree and Landscape Division reviewed the proposed deck enclosure. There were no.concerns expressed from any departments with respect to the project Public Notification: Legal notice was published in the Huntington Beach/Fountain Valley Independent on July 9, 1998. Notices were sent to all property owners of record within a 300 foot radius of the property and interested parties. ANALYSIS: The existing residence was constructed with 2,875 square feet of floor area, the maximum permitted with a 1.0 floor area ratio (FAR), as the lot is 2,875 square feet in area. The residence also includes a 320 square foot roof deck. The purpose of the FAR is to regulate building bulk and to allow for variety in the roofline by use of open deck areas. The proposed addition would increase building bulk, create a box-shaped building, and would be incompatible with the adjacent residences. The increase in the floor area ratio would also constitute a grant of special privilege as there have been no variances granted to FAR in the vicinity or under the same zoning classification. The majority of the single family homes in the area and under the same zoning classification are two story. Although the existing dwelling is currently three stories, the increased bulk and mass of the third story addition, which would encroach into the maximum height of 25 feet within the rear 25 feet of the property would be inconsistent with the character of development downtown, which encourages second and third stories to be setback from the first floor fagade. Staff Report—7/21/98 5 (98SR38) The applicant has submitted several boards with photographs of homes that in the applicant's opinion have been granted approval to construct additions similar to the proposed project. Staff has researched the addresses submitted and the structures in question. Of the ten addresses submitted, Staff was able to confirm that two of the residences (309 and 313 2 1" Street) exceed the current maximum floor area ratio. However, these two homes were built in 1981, prior to the requirement of a maximum floor area ratio of 1.0 which was implemented in 1986. One of the homes.(302 20"' Street) received a variance to lot coverage. In review of the plans for all of the examples submitted by the applicant, no homes were permitted to have a structure over 25.feet within the front or rear 25 feet of the property and all homes built after 1986 have complied with the FAR standard of 1.0. The applicant's property has no unique characteristics, including unusual topography, shape or configuration. In review of the surrounding residences, it is evident that no exceptions have been granted for similar requests. The granting of these variances would be_a grant of special privilege to the property owner. Staff has analyzed the applicant's request and does not support the variance request. A variance to maximum FAR has not been granted for similarly zoned properties in the vicinity. The strict application of the zoning ordinance does not deprive the property owner of privileges enjoyed by other properties in the vicinity. All other properties maintain a FAR of no greater than 1.0. SUMMARY: Staff recommends denial of the conditional use permit.and.the variance based on the-following: • The expansion of the existing single family residential structure will be detrimental to the general-welfare of persons working or residing in the vicinity and detrimental to the value of the property and improvements in the neighborhood as the usable outdoor area on the upper level deck will be reduced and the bulk and mass of the structure would increase. • The proposed third story addition is inconsistent with the Downtown Design Guidelines which encourages that upper stories be setback from the first story fagade. Existing views, light and ventilation on adjacent properties would be reduced. The granting of the Variance to exceed the maximum FAR of 1.0 and the maximum height of 25 feet within the rear 25 feet of the property will constitute a grant of special privilege inconsistent with limitations upon other properties within the same development and under identical zone classifications. • The request is inconsistent with the Downtown Specific Plan which establishes the maximum height and floor area ratio for the district. • There are no special circumstances applicable to the subject property which justify the granting of a variance to the maximum FAR and the maximum height of 25 feet within the rear 25 feet of the property. • The request is inconsistent with the General Plan which encourages new residential development to be compatible with existing structures. The proposed design would not be consistent with the Downtown Design Guidelines which encourage stepping back the building facade as the number of floors increases. 3. The proposed addition would not comply with the provisions of the DTSP-2 (Downtown Specific Plan District No.2) base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The third story deck enclosure would exceed the maximum height of 25 feet within the rear 25 feet of the property by 5 feet and would exceed the maximum floor area ratio of 1.0 on the subject property. 4. The granting of the Conditional Use Permit would adversely affect the General Plan. It is inconsistent with the Land Use Element Designation of Residential High Density on the subject property. The enclosure of the third story deck would exceed the height and floor area allowed for the structure, and is not compatible with the existing residence and the neighborhood character. The subject property is flat and rectangular in shape, with street frontage and alley access. 3. The granting of a variance is not necessary to preserve the enjoyment of one or more substantial property rights. The property owner currently has a third story, as well as a third story deck which enables him to enjoy views from the third story, as well as increased function of the home with a third story, which many of the two story property owners within the general vicinity are not able to enjoy. 4. The granting of the variance would be materially detrimental to the public welfare or injurious to property in the same zone classification. The proposed third.story addition, if approved, would set precedence for other property owners to exceed the floor area ratio and. maximum heights which have been established to reduce the massing and bulk of structures, creating a less imposing streetscape and a more livable environment. 5. The granting of the variance would adversely affect the General Plan. It is inconsistent with the Land Use Element designation of Residential High Density on the subject property. This glass patio enclosure has no unsightly beams to block ones view.
