Council approved Conditional Use Permit No. 05-18 to permit six-foot high view fencing and pilasters within an exterior side yard (zero setback) in lieu of the maximum allowable height of 42 inches along the Newman Avenue frontage. Sincerely, Joan L. y n ji") City Clerk Enclosure: Action Agenda Page 7-8 Findings and Conditions of Approval cc: Howard Zelefsky, Planning Director Herb Fauland, Principal Planner Paul Da Veiga, Associate Planner (Telephone:714536-5227) SUGGESTED FINDINGS AND CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 05-18 FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Planning Commission finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act(CEQA)pursuant to section 15301 of the CEQA Guidelines,because the establishment and maintenance of view fence and pilasters involves negligible or no expansion of use beyond that previously existing,therefore no further environmental review is necessary. FINDINGS FOR APPROVAL- CONDITIONAL USE PERMIT NO. 05-18: 1. Conditional Use Permit No. 05-18 for the establishment and maintenance of a six- foot high view fence and pilasters, in lieu of the maximum height of 42 inches allowed within the 10-foot setback,will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The fence is proposed with quality materials including split face concrete block and a decorative view fence design which will be aesthetically appealing when viewed from the street. 2. The conditional use permit will be compatible with surrounding uses since 710 lineal feet of the Newman Avenue frontage(970 lineal feet)will be provided with a 20-foot landscape setback. Two feet of landscaping located within the City's right-of way will be located in front of the proposed view fencing which will soften the appearance of the fencing when viewed from Newman Avenue. 3. The proposed conditional use permit will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance(HBZSO). The HBZSO allows for a deviation to the maximum height requirements within required setbacks with the approval of a conditional use permit. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Public on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Include building materials, colors, and construction elements that do not visually dominate their setting and do not contrast significantly with the character of the neighborhood(LU 9.1.2.b). b. Include an adequate landscape setback along the street frontage that is integrated with abutting sidewalks and provides continuity throughout the neighborhood. (LU 9.2.1.e) The majority of the Newman Avenue frontage will be developed with a 20-foot landscape setback, which will improve the aesthetics along the frontage of the property and soften the appearance of the proposed wall. In addition the use of split- face block combined with a decorative view fencing will allow for view corridors onto the subject site. CONDITIONS OF APPROVAL-CONDITIONAL USE PERMIT NO.05-18: The site plan, floor plans, and elevations received and dated June 1, 2005 shall be the conceptually approved design. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. This action declared the City's intention to levy an assessment for the Huntington Beach Auto Dealers Business Improvement District for 2005-2006 and authorized the City Clerk to schedule a public hearing to be held on September 6, 2005. Copies of the Resolution, BID Boundary Map and assessment formula were sent to each business to be assessed. On March 21, 2005, the City Council approved Conditional Use Permit No. 00-63, on appeal by the applicant, to allow the expansion of Good Shepherd Cemetery including the phased construction of a three-story mausoleum, a maintenance facility, one-story garden crypt buildings, and construction of perimeter fencing. The project was approved with modifications to the design of the detention basins. These modifications result in detention basins that occupy a larger area. The result is that perimeter fencing around the basins are located within the required ten-foot setback along Newman Avenue. Since the request to place six-foot high fencing within a required setback requires a conditional use permit, the City Council requested that the item be brought directly to the City Council for consideration. The proposed fencing will surround two detention basins with approximately 200 feet and 60 feet of frontage respectively, along Newman Avenue, which measures approximately 970 feet in total length. The proposed fencing material will consist of aluminum view fencing with split-face block pilasters placed intermittently around the perimeter of the detention basin. B. STAFF ANALYSIS AND RECOMMENDATION: Land use compatibility was analyzed based on the request to construct a six-foot high view within the required ten-foot setback. The visual impacts to adjacent residential properties located across Newman Avenue will be minor based on the proposed landscaped setbacks along the Newman Avenue frontage, and proposed fencing material. The cemetery has approximately 970 feet of frontage along Newman Avenue with 710 feet of this frontage area provided with a sloped landscape planter. The remaining frontage is occupied by two detention basins with 200 feet and 60 feet of frontage respectively. Although the detention basins are located within the required ten-foot setback, they will have earthen slopes and will be screened by a subsantial number of trees and shrubs around the perimeter of the basins and along the sloped banks. The proposed fencing will be composed of quality materials including split-face block and and aluminum view fencing. The Building and Safety Department is requiring a fenced enclosure along the perimeter of the detention basins for safety reasons based on their proximity to a public sidewalk. Although the view fencing will be placed at a zero setback, it will allow view corridors into the cemetery site and will be consistent with fencing proposed along the Beach Boulevard and Talbert Avenue frontages. In addition, a two-foot landscaped planter will be located directly in front of the fencing within the City's right-of-way to allow for an additional landscape buffer in front of the fencing. Staff supports the conditional use permit based on the overall landscape setbacks along the Newman Avenue frontage and the proposed view fencing which allows for view corridors onto the subject site. Summary ' As part of an overall Master Plan of expansion and improvement to the exteriorof its:...:• property, the Good Shepherd Cemetery is seeking the Huntington Beach City r3ound's approval of a Conditional Use Permit (CUP) for the installation of a six-foot high'fence..:. along 30% of the Cemetery's Newman Avenue frontage. The standard s4tVoalong....' the Cemetery's Newman frontage is 10 feet. For most of the frontage, approximately.,. ;•; 70%, or 700 feet, the Cemetery's buildings will beset back twice as far as required, at•• ' 20 feet. For the remaining approximately 30%, or 260 feet, in front of the detention basins, the Cemetery requests that a six-foot high ornamental metal fence with stuccoed block pilasters be placed at the right-of-way line. Background During the course of entitlement processing for the Cemetery's expansion, the Cemetery and the City's Department of Public Work agreed on the basic parameters for the size, location, and operations of the temporary detention basins, but were unable to reach agreement on the design. The City's design called for 5:1 slopes, while the Cemetery preferred vertical walls in order to minimize the amount of land taken to accommodate the basins. In essence, the City's design required 50% more land than the Cemetery's solution. On November 9, 2004, the Huntington Beach Planning Commission separated Negative Declaration 03-08 (Neg Dec) from CUP 00-63, and approved the Neg Dec for the expansion of the Good Shepherd Cemetery. This approval included a requirement that the detention basins be designed with 5:1 sloped sides, instead of the Cemetery's preferred vertical wall alternate. On November 19, 2004, the Cemetery appealed the Planning Commission's approval of the Neg Dec, on the grounds that the 5:1 slopes encumbered too much of the Cemetery's limited developable property. On December 7, 2004, the Planning Commission approved CUP 00-63; this decision was not appealed. After additional discussions between the City and the Cemetery, the Cemetery agreed to the Public Work's proposal of 2:1 slopes for the basins. In the exhibits submitted to support the Neg Dec Appeal Hearing, the Cemetery proposed that the edge of the basins and the ornamental metal six-foot high fence be placed at the right-of-way line. In review, Public Works supported the Cemetery's fencing proposal, but the Planning Department indicated that placing a fence over 42 inches in height at the right-of-way line would require an additional public hearing. After several continuances at the Cemetery's request, on March 21, 2005, the City Council approved the appealed Neg Dec for the Cemetery with 2:1 slopes for the basins. In front of the Garden Crypt gardens, there is a six-foot high ornamental metal fence, set 20 feet from the right-of-way, with minimal landscaping and shrubs,.creating a minimum density landscaping visibility screen. The Garden Crypt gards break up the massing of the buildings, and create windows of visibility from the street into the Cemetery. The purpose of this CUP is to allow the installation of a six-foot high fence along small portions of the Cemetery's Newman Avenue frontage. Approximately 30% of the remaining Newman frontage, or 260', consists of the temporary detention basins. The Cemetery proposes to place the top edge of the 2:1 detention basin slopes, as well as a six-foot high ornamental metal fence with stuccoed block pilasters, at the right-of-way line. The landscaping against the street and building side of the basins will contain groundcover and scattered trees, creating a medium density landscaping screening. The bottom of the basins will consist of turf block. Along the far, inner Cemetery edge of the basins, the plans call for a solid block wall with significant landscaping consisting of smaller and taller shrubs, and numerous trees of vaeious';species and heights, creating a high density landscaping visibility screening. The intent of the basins'landscaping design is to create the image from the street of small open meadows that be glimpsed into in between the trees. In all other regards, the project is consistent with City codes. The project is not located within a Hazardous Waste and Substance site, pursuant to Section 65962.5 of the Government Code. Although the proposed development will not generate a.substantial increase in water runoff, the historical volume of runoff detained in the two natural drainage swales during a large storm currently exceeds the capacity of the downstream storm drain system. The existing on-site drainage pattern will be altered based on the proposed improvements and therefore is required to mitigate the potential impact. A mitigation measure was proposed to provide two on-site detention basins with earthen slopes at a ratio not to exceed 5 to 1. The final size and design of the detention basins.are subject to the review and approval of the Public Works Department. B. PLANNING COMMISSION MEETING: The Planning Commission held a public hearing on November 9, 2004. There were five residents who spoke at the public hearing. Three of the five residents who live to the north of the cemetery expressed concerns regarding flooding that has historically occurred in their neighborhood during large storms. These residents also raised concerns regarding` the aesthetics along Newman Avenue with the proposed detention basins. The other neighborhood concerns regarding the project were considered in relation to the CUP. The applicant preferred vertical concrete walls and contested the mitigation measure that required detention basins to be designed with earthen slopes at a 5 to 1 slope ratio. The applicant stated the earthen slope design would require more land on-site and reduce the land available for future internment. The Planning Commission approved. The possible repair of the concrete walls could be difficult based on the location of the proposed improvements. Subsequent to appealing the MND, the applicant met with staff on December 6, 2004. Several design solutions were discussed which represented a compromise between the design criteria outlined by the mitigation measure and the vertical concrete walls that were proposed by the applicant. The applicant has revised the design of the detention basins to incorporate earthen slopes at a 2 to 1 slope ratio in an effort to comply with the mitigation measure and the engineering requirements of the City. The revised proposal consists of two detention basins in approximately the same location but at a minimum code required setback of 10 feet in lieu of the originally proposed 20 feet. The detention basins have increased in size to accommodate the 2 to 1 earthen slopes. The basins now measure approximately 197 ff. by 90.ft. and 60 ft. by 132 ft. respectively. The. depth of'the. basins range between approximately 6.5 feet to 6.7 feet. As .a result of the depths of the.;.basins, 'a six-foot high wrought iron fence is required around the perimeter of. the detention basins in accordance with the Uniform Building Code.
