Strict compliance with the Huntington Beach Ordinance Code will result in a substantial economic hardship to the applicant and tenants as business has consistently been difficult for retail tenants without street exposure. 2 . The proposed signs will not adversely affect other signs in the area because the signs will not obstruct the views to the other businesses or signs. 3 . The proposed _signs will not be detrimental to property located in the vicinity and will be compatible with the surrounding area, because the proposed signs are architecturally compatible and in proportion with the buildings . 4 . The proposed signs will not obstruct pedestrian or vehicular traffic vision, because they are adequately set back from public rights-of-way. 5 . The two (2) proposed ten (10) foot high, 90 square foot signs will provide for center identification and a tenant directory for businesses without signs on Beach Boulevard or Warner Avenue . Since the proposed signage deviates from the code in terms of number of signs allowable, distance between signs, square footage of signs and type of information provided, a special sign permit is required pursuant to Section 9610 . 5(b) of the Huntington Beach Ordinance Code. The Board expressed their concern with the aesthetics- of additional signage at Guardian Center at Beach Boulevard and Warner Avenue . The Design Review Board felt that size and location of non-conformaing signage was a planning issue which the Planning Commission should act on prior to Design Review Board review of colors and materials . As such, the Design Review Board recommended the item be brought back to them after Planning Commission action. The Design Review Board did, however, go on record as stating their concern with the aesthetics of -allowing a proliferation of signage beyond what code would allow at Guardian Center . Staff Report - 8/20/91 -2- (0438d) 10 . 0 ISSUES AND ANALYSIS: Background Planned Sign Program No . 84-2, approved in 1985, established standards that governed all signs at Guardian Center (formerly Charter Centre) . The sign criteria included specifications for all freestanding and wall signs . The sign program allowed five (5) freestanding signs to be installed at approved locations . The signs currently identify the center and several of the larger tenants which include Guardian Center (2 signs) ; Holiday Health Spa (2 signs) ; and Edwards Cinemas (1 sign) . Refer to Attachment No . 2 for sign locations . In 1988, an application was filed to amend Planned Sign Program No . 84-2 . The request was to allow two (2) additional tenant identifications on existing monument signs for Tony Roma ' s . The request was denied by the Department of Community Development with findings (see Attachment No . 6) . Project Description The applicant has now requested the approval of two (2) additional freestanding signs to be erected on Beach Boulevard and Warner Avenue. . The ten (10) foot high, 90 square foot signs are to provide center identification for Guardian Center and a tenant directory for up to seven (7) businesses on each sign. The center currently complies with the Huntington Beach Ordinance Code with the exception of the distance between two (2) signs on Beach Boulevard. The proposal will require special permits for sign height, sign area, distance between signs and items of information on each sign. The applicant has received two (2) letters from tenants requesting business exposure on Beach Boulevard and/or Warner Avenue (see Attachment Nos . 4 and 5) . The applicant has also submitted a list of tenants who have since terminated their leases due to insufficient business . The applicant believes the primary reason for the high vacancy rate is the lack of signage on Beach Boulevard and Warner Avenue. In addition, the applicant has implied that increased exposure on both streets would benefit existing retail tenants and attract other businesses into the center (see Attachment No . 3) . Code Deviations The proposed ten (10) foot high, 90 square foot signs exceed various limits of the. Huntington Beach Sign Code. In addition, the area of center identification of signs and secondary business identification signs are limited to 70 square feet and 30 square feet respectively. These signs are also limited as to the type of information allowed on each sign. Staff is recommending denial of the special sign permit/planned sign program application as both staff and the Design Review Board have concern with the size of the proposed signs and the number of signs . Staff believes that two (2) additional signs will unecessarily clutter the area and limit visibility of existing signage. The Beach Boulevard superstreet improvements may also increase traffic speeds and limit the effectiveness of the proposed signage. Staff feels that the proposal for the additional signs is inconsistent with the intent of the original planned sign program and with the Huntington Beach Ordinance Code. Staff Report - 8/20/91 -4- (0438d) If the Planning Commission determines. that additional signage may be warranted, staff has provided several alternatives for consideration. As outlined in Section 12 . 0, those alternatives would include allowing the new mulit-tenant signs, but deleting the center identificaton on the base. This would lower the signs somewhat, but would still exceed code in all previously identified respects . Another alternative would be to allow the tenant panels if placed on top of existing monument signs . This would eliminate the special permit for distance between signs, but would still violate the other aspects of the code. A third alternative would be to place the tenant panels only on the corner center identification monument sign, which would still violate the sign code. Lastly, the applicant could install on-site tenant directories which would fully comply with code but would not provide street visibility of the signage. 11 . 0 RECOMMENDATION: . Staff recommends that the Planning Commission deny Special Sign Permit No . 91-6 and Planned Sign Program No. 84-2(R) with the following findings . FINDINGS FOR DENIAL - SPECIAL SIGN PERMIT NO. 91-6 : 1 . Strict compliance with Article 961 will not result in a substantial economic hardship to the applicant, since the center presently has adequate signage. 2 . The proposed freestanding signs may adversely affect other signs in the area by obstructing the view of existing signs and increasing the visual clutter in the area . 3 . The proposed signs may be detrimental to property located in the vicinity and will not be compatible with the .surrounding area . The excessive height, sign area and tenant panels do not meet the requirements or intent of the Huntington Beach Sign Code. 4 . The proposed signs along Beach Boulevard and Warner Avenue may obstruct pedestrian or vehicular traffic vision. The excessive height, sign area, tenant .panels and close proximity between signs has the potential to require motorists to slow down to properly see the monument signs and tenant panels, thereby, causing a traffic and pedestrian conflict along Beach Boulevard and Warner Avenue . FINDINGS FOR DENIAL - PLANNED SIGN PROGRAM NO 84-2(R) : 1 . The request to permit two (2) addition monument signs with variance to height, sign area, number of tenant panels, location and amend the planned sign program does not reflect the requirements of a planned sign program or the intent of the sign code by the use of excessive height, sign area, tenant panels, and the unnecessary duplication of signage. Staff Report - 8/20/91 -5- (0438d.) 2 . The request to permit two (2) additional monument signs with variance to height, sign area, number of tenant panels, location and amend the planned sign program does not provide signs that will be compatible with the existing on-site signs or the requirements and intent of a planned sign program and sign code. 12 . 0 ALTERNATIVE ACTION: A. The Planning Commission may approve Special Sign Permit No. 91-6 and Planned Sign Program No . 84-2(R) as requested with findings and conditions of approval . B. The Planning Commission may approve Special Sign Permit No . 91-6 and Planned Sign Program No . 84-2(R) to allow the two additional signs without the center identification. C. The Planning Commission may approve Special Sign Permit No. 91-6 and Planned Sign Program No. 84-2(R) to allow tenant panels on top of two (2) existing monument signs . D. The Planning Commission may approve Special Sign Permit No . 91-6 and Planned Sign Program No . 84-2(R) to allow tenant panels on the existing corner monument sign. E. As part of the application a written narrative highlighting specific reasons for the application, as well as a descriptive site analysis are required. Following is our information. Completed in 1984 , Guardian Center is a truly mixed use project containing high rise offices; movie theatres, restaurants , retail shops , parking structure and a large health and fitness facility. The market area for Guardian Center consists of both neighboring housing developments as well as considerable transient and tran- sitory traffic flow on both Beach and Warner Avenues . The area serves a combined potential user population of approximately 175 , 000 individuals . Guardian Center is surrounded on all corners; north, south, east, and west, by other commercial and retail uses . While the main tenants in the professional tower, restaurants , movie theatres and health club experience satisfactory patronage, the interior retail tenants. have experienced severely limited success . Of the orginal 90% retail occupancy, that number has now dwindled to 20% occupancy. While some of the tenants were new "start up" businesses, others were established businesses with existing clientele. Without properly identifying the interior retail tenants, the revolving door of failed businesses will continue to occur. We ask that this unusual architectural circumstance be given special consideration so that all of Guardian Center can become a completely successful and robust retail and commercial develop ment. The sign criteria included specifications for all freestanding and wall signs . The sign program allowed five (5) freestanding signs to be installed at approved locations . The signs currently identify the center and several of the larger tenants which include Guardian Center (2 signs) ; Holiday Health Spa (2 signs) ; and Edwards Cinemas (1 sign) . Refer to attachment no. 5 for sign locations . In 1988, an application was filed to amend Planned Sign Program No . 84-2 . The request was to allow two (2) additional tenant identifications on existing monument signs for Tony Roma ' s . The request was denied by the Department of Community Development with findings . The applicant has now requested the approval of two (2) additional freestanding signs to be erected on Beach Boulevard and Warner Avenue. The ten (10) foot high, 90 square foot signs are to provide center identification for Guardian Center and a tenant directory for up to seven (7) businesses on each sign. Over the past few years, the applicant has received letters from tenants requesting business exposure on Beach Blvd. and Warner Ave. The applicant expressed his concern over the lack of exposure for smaller businesses and associates this problem with the center ' s high rate of turnover and current vacancy rate. As described in the appellant ' s letter of appeal (attachment no. 3) , the lack of street exposure for businesses located on the interior has resulted in a substantial economic hardship for the applicant and tenants . Design Review Board Staff presented the applicant' s proposal before the Design Review Board on August 1, 1991 for their recommendation to the Planning Commission. The Board recommended the item be acted upon by the Planning Commission prior to review of colors and materials by the Board. The Design Review Board did, however, go on record as stating their concern with the aesthetics of allowing a proliferation of signs beyond what code would allow at Guardian Center. Planning Commission Discussion On August 20, 1991, the Planning Commission discussed the sign proposal for the two additional freestanding signs as outlined in the Staff Report dated August 20, 1991 (see attachment no. 5) . RCA 10/7/91 -2- (0705d) After hearing testimony from four (4) public speakers who spoke in favor of the proposal, the Planning Commission concluded that additional signs would not solve the vacancy problems at the center. The applicant testified that several tenants including Chili ' s and Tony Roma ' s, which currently have street exposure, had expressed interest in obtaining additional street exposure through the requested new signage. In addition, businesses located on the interior of the center would have priority for street exposure. The commission discussed the issue of additional signs on site and the use of tenant panels and concluded that tenants could advertise the location of their businesses by identifying Guardian Center. Although sympathetic to small businesses at the center, the Commission recognized the fact that virtually everyone in the area was familiar with Guardian Center and that the applicant and tenants should explore other alternatives for business identification. Alternative Action Motion to: 1. "Overturn the Planning Commission' s action and approve Special Sign Permit No. 91-6 and Planned Sign Program No. 84-2(R) with findings and conditions of approval .
