Strict compliance with the Huntington' Beach Ordinance Code will result in a substantial hardship to the applicant. 2. The proposed freestanding sign will not adversely affect other signs in the area . 3 . The proposed freestanding sign will not be detrimental to property located in the vicinity of . such region; and will be compatible with the surrounding area. 4 . The proposed sign at -the subject location will not obstructed pedestrian or vehicular traffic view. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 91-39 : 1. The 20 foot tall 175 square foot freestanding sign conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan since it would minimize blockage of views and minimize aesthetic impacts on the area. 2 The 20 foot tall, 175 square foot freestanding sign while not consistent with the Downtown Specific Plan Design Guidelines which would only allow a six (6) foot tall, 15 square foot sign at the proposed location, is consistent since the necessary findings are made for a special sign permit. 3 . The 20 foot tall, 175 square foot freestanding sign conforms with public access and recreation policies of Chapter 3 of the California Coastal Act since it would minimize obstruction of coastal views . CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO, 91-8 : 1. The sign elevations (20 feet tall, 175 square feet) dated February 18, 1992 shall be the approved layout: 2 . The approved sign will become a part of Planned Sign Program No. 90-7R. 3 . Sign colors, materials, illumination and design shall be approved by the Design Review Board prior to issuance of a building permit. 4 . Sign illumination shall be reviewed by the Director after installation in order to assure compatibility with adjacent commercial and residential tenants. 5. The City Council reserves the right to rescind this special sign permit in the event of any violation of the terms of the applicable zoning laws . [/ Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions, Attachments: STATEMENT OF ISSUE• Special Sign Permit No. 91-8 is an appeal of the Planning Commission' s approval of a 15 foot tall 130 square foot, illuminated business freestanding sign to identify major tenants at the Pierside Pavilion pursuant to Section 9610 .7 of the Huntington Beach Ordinance Code. RECOMMENDATION: Staff Recommendation: Motion to: "Deny the appeal and uphold the Planning Commission' s conditional approval of Special Sign Permit No. 91-8/Coastal Development Permit No. 91-39 to allow a 15 foot tall, 130 square foot sign, with findings and conditions as outlined in Attachment l. " Planning Commission Action on January 7, 1992 : On motion by Shomaker and second by Richardson, the Planning Commission approved Special Sign Permit No. 91-8/Coastal Development Permit No. 91-39/Planned Sign Program 90-7R with conditions that the sign be a maximum of 15 feet in height and 104 square feet in area plus two additional tenant panels totaling 26 square feet (130 square feet total) by the following vote: PIO 5/85 AYES: Shomaker, Richardson, Kirkland, Bourguignon NOES: Leipzig, Newman ABSENT: None ABSTAIN: None ANALYSIS: The applicant is requesting a freestanding sign to identify three (3) tenants of Pierside Pavilion. The tenants to be identified will be Edwards Cinemas, The Break Billiards and whichever tenant eventually occupies the vacant Pepper ' s Restaurant space. The primary purpose of the proposed sign, however, is to provide changeable copy area for movie advertisement. The proposed sign will feature Pierside Pavilion identification on top, with Edwards Cinema identification and a six (6) line changeable letter, double face cabinet below that, plus two (2) additional cabinets below that. Total proposed sign height is 24 feet and total sign area is 175 square feet. The proposed sign location is in the plaza area directly in front of the movie theater, just south of the Wherehouse, on the site of the existing six (6) foot tall theater monument sign. The following is a zoning conformance matrix which compares the proposed sign with the development standards of the Downtown Specific Plan (Design Guidelines) . Area 15 sf 175 sf 16 sf 104 sf (monument sign) 50 sf (wall sign) Staff and Planning Commission' s principle concern with the applicant ' s request is the visual impact the sign will have on Pierside Pavilion. The proposed sign is two (2) stories in height and will block from view a substantial portion of the Pierside Pavilion' s architecture and design including the movie theater area. Equally important is the concern that the proposed sign will block visibility of existing wall signage on the Pacific Coast Highway frontage of the Pavilion from northbound traffic on Pacific Coast Highway. Lastly, the proposed sign will block views of the pier and beach area from some of the condominium balconies and window areas adjacent to the Pierside Pavilion. * Planning Commission allowed 26 additional square feet for a total of 130 square feet. RCA 2/18/92 -2- (2232d) In recognition that additional movie theater signage is desirable, staff formulated two (2) alternatives which would have less visual impact on the Pavilion project. The first alternative (Alternative A) would be to retain the existing code permitted six (6) foot monument sign and gain additional signage through the use of a wall sign on the front stairway tower. A Pepper' s Restaurant/Golden Bear marquee was previously attached at that location. Staff believes that a 50 square foot changeable copy sign could be constructed on the tower which would provide theater and show identification to motorists on Pacific Coast Highway without blocking architecture, signage or views . Due to the setback of the tower and presence of palm trees in the plaza, visibility would be limited to a location directly in front of the theater on Pacific Coast Highway rather than from locations further north and south on Pacific Coast Highway. A second alternative (Alternative B) would be to allow a new freestanding sign much as requested by the applicant, but reduced in height and area. Staff has attached a sign elevation to this report depicting a 15 foot tall sign with 104 square feet of sign area . The sign would be limited to theater and movie information only and would not allow Pavilion or other tenant identification. This sign would still block building visibility, but would be less obtrusive than the proposed sign, while providing identification from points north and south on Pacific Coast Highway. Approval of a coastal development permit is required for this alternative. On January 7, 1992, the Planning Commission approved staff Alternative B for a 15 foot tall sign. The Commission further allowed the addition of two tenant panels totaling 26 square feet to be added at the bottom of the sign. The Commission' s action therefore, was to allow a 15 foot tall, 130 square foot sign in lieu of the requested 24 foot tall, 175 square foot sign. Appellant ' s Statement of -An peal : In their appeal letter dated January 16, 1992, the applicant indicates that the staff ' s recommended 15 foot tall sign refutes the architectural integrity of the proposed site. They further indicate that the Planning Commission' s allowance of the two requested additional tenant panels at the bottom of the sign brings the sign to within 21 inches of grade and invites vandalism. Therefore, they are requesting the original 24 foot tall sign. Staff Response: Staff maintains that the proposed 24 foot (two-story sign) at the proposed location more approximately constitutes a billboard and will in itself degrade the architectural integrity of the Pavilion building. It will do so by occupying an inordinate amount of the front plaza area and obstructing views both to and from the Pavilion and condominium project . The proposed sign will render existing wall signage ineffective by blocking it out from the view of northbound traffic on Pacific Coast Highway, will block views of the building architecture (including the theater area) and will block views of the pier and beach area from the first, second and third floor condominium units adjacent to the Pavilion. Even the 15 foot alternative recommended by staff will block views, but will do so to a lesser extent, thereby providing greater architectural integrity. RCA 2/18/92 -3- (2232d) Regarding the additional lower tenant panels approved by the Planning Commission, staff concurs that they may be within reach of vandals . However, the applicant is incorrect in stating they would be within 21 inches of grade. The intent was they that be two feet in depth and be added to the bottom of the sign identified as Staff Alternative B. This would place the bottom of the panels at 5 feet above grade, not 21-inches as stated by the applicant. They would have to be encased in a locked plexi-glass case to prevent vandalism. Staff would prefer not to have them added to the bottom of the sign at all, but feels that such location is preferable to adding additional sign height to accommodate them. Staff would further note that the reason the additional panels were requested for the 24 foot tall sign is likely due to the fact that the taller sign would block existing wall signs located on the elevator tower behind the sign, which previously advertised those tenants . Summary: In conclusion, staff feels that the proposed 24 foot tall sign is of inappropriate height and area for the prominent location it would occupy on Pacific Coast Highway. Movie locations are more typically found by reviewing the movie listings in the newspaper than by responding to roadside signs. Staff believes that the 15 foot tall alternative sign approved by the Planning Commission is the maximum which can be approved on the site without significantly degrading the appearance of the Pavilion. Staff further believes it will provide more than adequate theater advertisement. FUNDING SOURCE• No funds required. ALTERNATIVE ACTIONS: . 1. The City Council may approve the appeal and overturn the Planning Commission' s conditional approval of the sign. This would allow the requested 24 foot tall, 175 square foot sign. In that case, the findings and conditions outlines in Attachment 1 should be modified to reflect the larger sign. 2 . The proposed 24 foot tall 175 square foot freestanding sign does not conform with the plans, policies, requirements and standards of the Coastal Element of the General Plan since it wuld block views and create aesthetic impacts on the area. 2 . The proposed 24 foot tall, 175 square foot freestanding sign is not consistent with the Downtown Specific Plan Design Guidelines which would only allow a six (6) foot tall, 15 square foot at the proposed location. 3 . The proposed 24 foot tall, 175 square foot freestanding sign does not conform with public access and recreation policies of Chapter 3 of the California Coastal Act since it would obstruct coastal views and block views of coastal structures . The tenants to be identified will be Edwards Cinemas, The Break Billiards and whichever tenant eventually occupies the vacant Pepper ' s Restaurant space . The primary purpose of the proposed sign, however, is to provide changeable copy area for movie advertisement . The proposed sign will feature Pierside Pavilion identification on top, with Edwards Cinema identification and a six (6) line changeable letter, double face cabinet below that, plus two (2) additional cabinets below that . Total proposed sign height is 24 feet and total sign area is 175 square feet . The proposed sign location is in the plaza area directly in front of the movie theater, just south of the Wherehouse, on the site of the existing six (6) foot tall theater monument sign. The following is a zoning conformance matrix which compares the proposed sign with the development standards . of the Downtown Specific Plan (Design Guidelines) . The proposed sign is essentially two (2) stories in height and will block from view a substantial portion of the Pierside Pavillion' s architecture and design including the movie theater area . Equally important is the concern that the proposed sign will block visibility of existing wall Staff Report 1/7/92 -4- (1842d) signage on the Pacific Coast Highway frontage of the Pavilion from northbound traffic on Pacific Coast Highway. Lastly, the proposed sign will block views of the .pier and beach area from some of the condominium balconies and window areas adjacent to the Pierside Pavilion. In recognition that additional movie theater signage is desirable, staff has formulated two (2) alternatives which would have less visual impact on the Pavilion project . The first alternative (Alternative A) would be to retain the existing code permitted six (6) foot monument sign and gain additional signage through the use of a wall sign on the front stairway tower . A Pepper ' s Restaurant/Goldenbear marquee was previously attached at that location. Staff believes that a 50 square foot changeable copy sign could be constructed on the tower which would provide theater and show identification to motorists on Pacific Coast Highway without blocking architecture, signage or views .. Due to the setback of the tower and presence of palm trees in the plaza, visibility would be limited to a location directly in front of the theater on Pacific Coast Highway rather than from locations further north and south on Pacific Coast Highway. A second alternative (Alternative B) would be to allow a new freestanding sign much as requested by the applicant, but reduced in height and area . Staff has attached a sign elevation to this report depicting a 15 foot tall sign with 104 square feet of sign area. The sign would be limited to theater and movie information only and would not allow Pavilion or other tenant identification. This sign would still block building visibility, but would be less obtrusive than the . proposed sign, while providing identification from points north and south on Pacific Coast Highway. Approval of_ a coastal development permit is required for this alternative. A third possibility not identified in the zoning conformance matrix above would be to permit an electronic readerboard. The sign area on such a readerboard could be limited to as little as 36 square feet . 11 . 0 RECOMMENDATION: Staff recommends that the Planning Commission deny Special Sign Permit No . 91-8, Coastal Development Permit No. 91-39 and Planned Sign Pro.gram'No . 90-7R and require that additional theater signage be provided with a 50 square foot wall sign on the stairway tower consistent with existing Planned Sign Program No . 90-7R.
