The proposal is consistent with the General Plan Land 'Use designation of Visitor Serving Commercial . CONDITIONS OF APPROVAL : 1 . The site plan, Floor plans, and elevations dated April 2, 1591 shall be the conceptually approved layout . 2 . Depict all utility apparatus , such as but not limited to backflow devices and Edison transformers , on the site plan. Because of the size, configuration, shape and lack of unique topographic features of the subject property, there does not appear to be exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved that does not apply generally to property or type of uses in the same district. The site is conforming to the requirements of the Downtown Specific Plan District 10 for the construction of the pier and its related concession buildings and can meet the building height requirements with a redesign of the pierhead restaurant. 2. Granting of Conditional Exception (Variance) No. 92-23 for exceedint maximum building height would constitute a special privilege inconsistent with limitations upon properties in the vicinity. The subject property was legally subdivided and developed in a manner consistent with applicable zoning laws . 3 . The entitlements for the pier itself, Conditional Use Permit No. 89-52, Coastal Development No. 89-29, and Floodplain Variance No. 90-1, required the Planning Commission to review the proposed structures through the conditional use permit and coastal development permit process . It has been determined through the Environmental Impact Report and public hearing process that it is not feasible to replace the original pier structures back on the pier. The original pier platforms were rectangular in shape while the new platforms are a diamond shape. The old pier buildings are small enough to fit on the new platforms but aesthetically will not blend with the new structure. In addition, the original buildings would require substantial upgrades and extensive modifications to meet current electrical, sanitary and water system codes. Also, the current standards of the Orange County Health Department require larger kitchen areas to accommodate the proposed restaurant and snack shop facilities .and thus leaves minimal square footage for seating and customer area in the old buildings. Environmental Status: In accordance with the California Environmental Quality Act, Environmental Impact Report No. 89-8 was prepared to analyze the potential impacts of the new pier project. The Environmental Assessment Committee reviewed Environmental Assessment No. 91-12 and determined that EIR No. 89-8 adequately addressed any potential environmental impacts associated with the project and determined that no further environmental review is necessary. RCA 6/l/92 -2- (3331d) Appeal Mr. Watkins has appealed the Planning Commission' s approval of the pier buildings based on the following: Comment 1. The original intent of the pier was for the non-commercial enjoyment of the people who visited the beach. Commercial uses over the years have obscurred this intent. Staff Response 1. According to the Huntington Beach Pier Evaluation of Historical Significance with Treatment Recommendation prepared by LSA Associates, Inc. for Moffatt and Nichol, Engineers, five (5) Art Deco style buildings were erected on the pier in 1931-1932. Although the buildings were described as "recreational" it appears that some type of commercial bait and tackle shop has been present in the pier since the original concrete structure was constructed in 1914 . The Sun Parlor at the end of the pier was destroyed in a violent storm of 1939 and was reconstructed as a restaurant in 1940. The pierhead building has since been maintained as a restaurant except for a brief period during World War II when the Army used it as a lookout post. This building later became the site of the popular End Cafe. It is clear that the pier has long supported commercial activity and commercial uses have been present since its inception. Comment 2 . Commercial buildings limit the public access and use of the pier by restricting movement and limiting ocean views . Staff Response 2 . The Coastal Element of the General Plan states that public access shall be provided around the entire perimeter of the pier. The bermline snack shop is located flush with the edge of the pier with public doorways on either side. The Pier Design Committee, in their review of the pier structure and the buildings, determined that the snack shop is designed to allow the public to walk around the edge of the pier even though it is within an enclosed building. Windows are incorporated along the entire side of the building facing the ocean affording valuable view opportunities to the public while still providing shelter from the elements. In addition, this design of the bermline snack shop is in keeping with the original structure, Neptune's Locker, by providing windows and building squarely against the edge of the pier. Similarity in design with the original structures is an identifiable goal of Environmental impact Report No. 89-8 . RCA 6/l/92 -3- (3331d) The Downtown Specific Plan, District 10 is less restrictive than the Coastal Element as the standards only require that no more than 25% of the pier perimeter be covered by building. The design of the bermline snack shop, the lifeguard tower, the bait and tackle shop, -the restrooms, and the pierhead restaurant all meet this requirement as well as the stipulation to limit site coverage in relation to the pier deck to 25%. In fact, only 8.8% of the pier deck is covered by structures, allowing more than sufficient pedestrian access. Comment 3 . The aesthetic value of an ocean pier is in its sense of relaxation and leisure. Commercial structures lend a notion of stress and business activity inconsistent with a relaxed atmosphere. Staff Response 3 . Planning staff feels that the pier and its associated buildings offer a pleasing mix of divergent recreational activities. The commercial structures are proposed for low-intensity uses to enhance view opportunities from inside the buildings as well as provide services such as the bait and tackle shop for fishing. Staff does not concur that commercial services are conducive to stress and are inconsistent with relaxation. Comment 4 . Insufficient benefit would come to the State of California from the commercial project built on the public domain. Staff Response 4 . The State of California adopted the Coastal Act for the regulation and preservation of California coastal lands. Coastal Development Permit No. 91-9, for the construction of the five (5) new pier buildings, has been found by the Planning Commission to be in conformance with the Coastal Act as well as the Coastal Element of the City of Huntington Beach General Plan. Both coastal documents allow for and promote development of maximum recreational activities including piers and commercial uses along city and state beaches . The pier and any commercial activity on it will be operated as a- public facility open to all community members and available to benefit all citizens. RCA 6/l/92 -4- (3331d) The following are comments made by the applicant to address the possibility that the City Council may approve the new pier buildings. The comments are opinion oriented and do not require a response in relation to this appeal but have been included for their informational content. 1. Buildings should be small scale with nominal services and wide access around the outside of the building, to allow fishing and fishing poles and pedestrian traffic at the same time. 2 . No commercial buildings should be constructed until the pier itself is paid for. 3 . Access to the pier surface should be limited to pedestrian and emergency vehicles only to protect the pier structure. The pier is only supported by friction on the pilings in the sand. The Downtown Specific Plan, District 10 designates a maximum height of 25 feet with an exception granted for lifeguard towers or other facilities necessary for public safety. The 25 feet is measured to the midpoint of the roof slope with an additional 10 feet in height allowed for roof line treatment or architectural features . All the buildings except the pierhead restaurant, which is designed at 30 feet to the midpoint and 45 feet to the maximum peak and the lifeguard tower, are under the 25 foot height limit. Planning staff recommended to the Planning Commission that the pierhead restaurant plans be revised to conform to the proper height limitations by reducing the midpoint roof slope height to 25 feet and architectural projections of no more than 10 feet above the midpoint. Staff also recommended that the total maximum roof height shall be no more than 35 feet to the highest roof peak. The Planning Commission approved the plans as submitted by the architect at the 30 foot midpoint roof height and 45 feet to the roof peak when the project was acted upon on April 7, 1992. Planning staff has designated and advertised Conditional Exception (variance) No. 92-23 to address the roof height variance for the pierhead restaurant. Planning staff, however, continues to recommend that the pierhead restaurant plans be revised to conform to the maximum building height of 25 feet to the midpoint. The plan, as approved, permits a building that is massive, bulky and inappropriate for the end of the pier. FUNDING SOURCE: The Public Works staff presently has plans to proceed only with construction of the lifeguard tower and the public restroom building. The funding source for these two buildings has been approved by the City Council in the form of a one year extension of the beach parking surcharge. The funding source for the remaining three buildings has not yet been identified. RCA 6/l/92 -5- (3331d) ALTERNATIVE ACTION: The City Council may overturn the Planning Commission' s action on April 7, 1992 by denying Conditional Use Permit No. 91-19 and Coastal Development Permit No. 91-9 with findings .
