TRACT NO. 14442
Dear City Clerk:
I hereby appeal the Planning Commission' s January 23 , 1991 action to
approve Conditional Use Permit No. 90-63/Tentative Tract No. 14443 .
Specifically, I am appealing the Commission' s deletion of a
condition requiring that twenty (20) percent of the units be
affodable to low and moderate income households . The basis of the
appeal is that the property was the subject of a General Plan
Amendment and Zone Change from Commercial to Medium-High Density
Residential . Part of the rational for a change to Medium-High
Density rather than Medium Density was that the higher density,
would allow for a portion of the project to be affordable. I
believe the City Council needs to address this issue.

STATEMENT OF ISSUE•
Transmitted for your consideration is an appeal by Councilperson
Winchell of the Planning Commission' s approval of a 33 unit planned
residential development deleting a staff recommended condition of
approval which would have required 20% of the units be affordable to
low and moderate income households . The basis of the appeal is that
the property was the subject of a General Plan Amendment and Zone
Change from Commercial to Medium-High Density Residential . Part of
the rationale for a change to Medium High Density rather than Medium
Density was that the higher density would allow for a portion of the
project to be affordable.

Project Description
Conditional Use Permit No. 90-63 with Special Permits and Tentative
Tract No . 14448 is a request to subdivide one lot for condominium
purposes and construct a 33 unit planned residential development .
The site is located on the south side of Warner Avenue, west of
Leslie Lane.
In August of 1990, the City Council approved General Plan Amendment
No. 89-3, Zone Change No. 89-5, and Environmental Impact Report No.
90-1 changing the General Plan Land Use Designation on this property
from General Commercial to Medium-High Density and rezoning the site
from Office Professional (OP) to Medium-High Density Residential -
Planned Development (R3-PD) . In analyzing the proposed amendment,
staff studied a variety of land uses including Medium-Density
Residential .
In the RCA for the General Plan Amendment and Zone Change dated
August 20, 1990, staff included a list of statements setting forth
the rationale for approving the General. Plan Amendment request for
Medium-High Density Residential . Reasons to support the amendment
included conformance with the land use and housing goals and
policies, compatibility with existing uses on Warner Avenue, the
inclusion of the Planned Development (PD) Suffix, high revenue to
cost ratio, phasing with planned sewer improvements, a greater
benefit to meeting - regional .jobs/housing balance, lower trip
generation rates, elimination of curb cuts on Warner Avenue, and
affordability. The issue of affordability was addressed as Statement
No. 7:
7. The project provides an opportunity to increase the City' s
affordable housing stock. The applicant has expressed an
intent to provide 20% of the total number of units as
affordable units . (This condition has been included in
the proposed Resolution) .
Staff ' s support for the Medium-High Density (R3) designation as
opposed to a Medium-Density Residential (R2) was predicated on
developing some affordable housing opportunities .
(It should be noted that no mention of affordable housing was
contained in the Resolutions and Zone Change Ordinance adopted by
the City Council as was mentioned in Statement No. 7)
During the City Council meeting on August 20, 1990, considerable
discussion was held regarding Statement No. 7 addressing affordable
housing. Some Council members were in favor of deleting the
statement, however, it was deemed an unnecessary action by the City
Attorney. (Statement No. 7 was a rationale for approving the
General Plan Amendment . It was not a finding or a condition. To
delete Statement No. 7 would be editing the Staff Report. ) The
Director of Community Development informed the Council that the
issue of affordability would be addressed later at the Conditional
Use Permit stage.

The applicant filed for a Conditional Use Permit and Tentative Tract
Map in November of 1990, for a 33 unit condominium project. The
zoning allowed for a maximum of 33 units to be constructed on the
site. The applicant did not request a density bonus .
Staff again addressed the issue of affordability by including
suggested Condition of Approval No. 15 .
15 . The applicant shall enter into an agreement to provide 20
percent low and moderate income units in exchange for the
granting of General Plan Amendment 89-3 and Zone Change
89-5 . The applicant shall designate seven (7) units for
persons and families of low and moderate income as
stipulated in Section 65915 of the Government Code and
reflect the goals for affordable housing identified in
Section 3 .4 of the Housing Element. The applicant ' s
compliance with Section 65915 of the Government Code in
terms of type and location of affordable units, method of
income verification of buyers and sales prices shall be
set forth in the agreement which shall be reviewed and
approved as to form and content by the City Attorney.
In approving the Conditional Use Permit and Tentative Tract Map, the
Planning Commission voted to delete Condition No. 15, hence the
appeal filed by Councilperson Winchell .
FUNDING SOURCE:
This project would be financed through private resources by the
applicant .
ALTERNATIVE ACTION:
Uphold the Planning Commission' s approval of Conditional Use Permit
No. 90-63 with Special Permits and Tentative Tract No. 14448 with
findings and modified conditions of approval (deleting Condition No.
15) .

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 90-63 :
1. The location, site layout, and design of the proposed 33 unit
planned residential development with four (4) special permits
properly adapts the proposed structures to streets, driveways, and
other adjacent structures and uses in a harmonious manner. The
access to the project and the building height and bulk are
compatible with the adjacent structures and uses .
2 . The proposed 33 unit planned residential development with four (4)
special permits is compatible with surrounding properties in terms
of architecture and orientation and will not be detrimental to the
general welfare of persons residing or working in the vicinity,
nor detrimental to property and improvements in the vicinity.
3 . The access to and parking for the proposed 33 unit planned
residential development with four (4) special permits does not
create an undue traffic problem. The access point for the project
and the minimum code required parking provides adequate on-site
and off-site traffic circulation and parking .
4 . The planned residential development for a 33 unit project with
four (4) special permits conforms to the provisions contained in
Article 915 .
5 . Conditional Use Permit No. 90-63 for a 33 unit planned residential
development with four (4) special permits is consistent with the
goals and objectives of the City' s General Plan and Land Use Map
designation. The intent of the land use designation and zoning
suffix (PRD) is to provide a better living environment and promote.
aesthetically pleasing development . The project will also be
consistent with the Housing Element by providing housing
opportunities to low and moderate income families for 20% of the
project .
FINDINGS FOR APPROVAL - SPECIAL PERMITS:
1 . The following special permits for deviations to the requirements
of Article 915 of the Huntington Beach Ordinance Code promote a
better living environment and provide an improved site layout and
design.
a . To reduce the front yard setback from a 20 foot average with a
minimum dimension of 15 feet to a 13 foot average with a
minimum dimension of 10 feet.
b. To reduce the exterior side yard setback from a 20 foot average
with a minimum dimension of 15 feet to a 20 foot average with a
minimum dimension of 10 feet .
c . To reduce the required building •-separation front to side from
20 feet to 10 feet .
d. To reduce the required building separation side to side from 30
feet to 10 feet.

2. The requested special permits provide for maximum use of
aesthetically pleasing types of architecture, landscaping, design
and building layout .
3 . The approval of the special permits will not be detrimental to the
general health, welfare, safety and convenience, and not
detrimental and injurious to the value of property and
improvements of the neighborhood or of the City in general,
because they result in a project with an improved living
environment and site layout.
4 . The requested special permits are consistent with the objectives
of the Planned Residential Development standards in achieving a
development adapted to the parcel and compatible with the
surrounding environment .
FINDINGS FOR APPROVAL - TENTATIVE TRACT NO. 14448 :
1. The size, depth, frontage and other design features of the
proposed subdivision for 33 units are in compliance with the
standard plans and specifications on file with the City as well as
with the State Map Act and the supplemental City Subdivision
Ordinance.
2 . The property was previously studied for Medium-High Density
Residential development at the time the General Plan designation
was placed on the site, and will accommodate the development of 33
condominiums .
3 . The General Plan has set forth provisions for this type of land
use as well as objectives for the implementation of this type of
housing .
4 . The site is physically suitable for the proposed density of 25
units per gross acre .
5 . The tentative tract map is consistent with the goals and policies
of the Huntington Beach General Plan.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 90-63 :
1. The site plan, floor plans, and elevations received and dated
January 11, 1991 shall be the conceptually approved layout .
2 . Prior to issuance of building permits, the applicant shall submit
the following:
a . A landscape construction set must be submitted to the
Departments of Community Development Public Works, and Fire for
review and approval . The Landscape Construction Set shall
include a landscape plan prepared- and signed by a State
Licensed Landscape Architect and which includes all
Proposed/existing plant materials (location, type, size,
quantity) , an irrigation plan, a grading plan, an approved site
plan, and a copy of the entitlement conditions of approval .

The landscape plans shall be in conformance with the Ordinance
Code. "Drought tolerant" plants and turf shall be specified
for all common area landscaping. In addition, intensified
landscaping shall be provided between the dwelling units and
the private street to provide visual relief . The landscape
plans must be approved by the three departments prior to
issuance of building permits . All landscape shall be installed
prior to final inspection.
b. Rooftop Mechanical Equipment Plan. Said plan shall indicate
screening of any rooftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment .
c. Elevations shall depict colors and building materials proposed.
d. The site plan or reference page shall include all conditions of
approval imposed on the project printed verbatim.
e. All applicable Public Works fees shall be paid.
f . A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on-site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities .
g . A grading plan shall be submitted to and approved by the
Department of Public Works .
h. Complete detail of security gate configuration shall be
submitted for review and approval by Departments of Public
Works, Fire and Community Development .
i . All utility apparatuses such as, but not limited to, backflow
devices and Edison transformers, shall be depicted on the site
plan, and shall not be located in the front yard setback, where
feasible. All such equipment shall be screened with
landscaping or in another manner approved by Community
Development Department .
j . Final Tract Map No . 14448 shall be accepted by the City
Council . It shall be recorded with the County Recorder ' s
Office prior to Certificate of Occupancy or final inspection of
first unit .
k. Floor plans shall depict natural gas outlets at the locations
of cooking facilities, water heaters, and central heating
units, low-volume heads on all spigots and water faucets, and
natural gas and 220V electrical.---utlets at the location of
clothes dryers .

1 . If foil-type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Department and
indicated on the floor plans .
m. A lighting plan for all stationary outdoor lighting fixtures on
the site which includes high-pressure sodium vapor lamps or
metal halide for energy savings shall be approved by the
Department of Community Development to insure that lighting
will be directed only to desired areas, and that no lighting
fixtures shall be mounted facing adjacent residential areas .
Illumination levels at the project perimeter adjacent to
residential properties shall not exceed 2 . 0 foot candles . *
3 . Fire Department requirements are as follows :
a . Automatic sprinkler systems will be installed throughout to
comply with Huntington Beach Fire Department and Uniform
Building Code Standards . Shop drawings will be submitted to
and approved by the Fire Department prior to installation.
b. A Class III wet standpipe system (combination) will be
installed to comply with Huntington Beach Fire Department and
Uniform Building Code Standards . Shop drawings will be
submitted to and approved by the Fire Department prior to
installation.
c. A fire alarm system will be installed to comply with Huntington
Beach Fire Department and Uniform Fire Code Standards . Shop
drawings will be submitted to and approved by the Fire
Department prior to installation. The system will provide the
following :
- Water flow, valve tamper and trouble detection
- 24 hour supervision
- Smoke Detectors
- Annunciation throughout
- Audible Alarms throughout
- Graphic Display
- Manual Pulls
d. Fire extinguishers will be installed and located in areas to
comply with Huntington Beach Fire Code Standards .
e. One (1) fire hydrant will be installed prior to combustible
construction. Shop drawings will be submitted to the Public
Works Department and approved by the Fire Department prior to
installation.
f . Elevators will be sized to accommodate an ambulance gurney.
Minimum 6 ' 8" wide by 4 ' 3" deep with minimum 42" opening .
*Indicates a mitigation measure contained in Environmental Impact
Report No. 90-1 .

g . Fire lanes will be designated and posted to comply with City
Specification No. 415 .
h. Security gates will be designed to comply with City
Specification No. 403 .
i . Address numbers will be installed to comply with City
Specification No. 428 . The size of .the numbers will be the
. following :
1 . The number for the building will be sized a minimum of ten
(10) inches with a brush stroke of one and one-half (1-1/2)
inches .
2 . Individual units will be sized a minimum of four (4) inches
with a brush stroke of one-half (1/2) inch.
j . Submit a fire protection plan to the Fire Department for
approval containing requirements of Fire Department
Specification No. 426 .
k. Installation or removal of underground flammable or combustible
liquid storage tanks will comply with Orange County
Environmental Health and Huntington Beach Fire Department
requirements .
1 . Fire access roads will be provided in compliance with the
Huntington Beach Fire Code and City Specification No. 401.
Include the circulation plan and dimensions of all access roads .
m. Exit signs and exit path markings will be provided in
compliance with the Huntington Beach Fire Code and Title 24 of
the California Administrative Code.
n. The project will comply with all provisions of the Huntington
Beach Fire Code and City Specification Nos . 422 and 431 for the
abandonment of oil wells and site restoration.
o . The project will comply with all provisions of Huntington Beach
Municipal Code Title 17 . 04 . 085 and City Specification No . 429
for new construction within the methane gas overlay districts .
4 . The development shall comply with all applicable provisions of the
Ordinance Code, Building Division, and Fire Department .
5 . All building spoils, such as unusable lumber, wire, pipe and other
surplus or unusable materials, shall be disposed of at an off-site
facility equipped to handle them.
6 . The applicant/owner shall be responsible for paying the Traffic
Impact Fee prior to issuance of a Certificate of Occupancy and/or
final building permit approval .

7 . The developer shall be responsible for payment of any additional
fees adopted in the upcoming Water Division Financial Master Plan.
8 . Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units .
9 . During cleaning, grading, earth moving or excavation the applicant
shall : *
a . Control fugitive dust by regular watering, paving construction
roads, or other dust preventive measures in compliance with
SCAQMD Rule 403 (Fugitive Dust Emissions) .
b. Maintain equipment engines in proper tune.
10 . During construction; the applicant shall : *
a . Use water trucks or sprinkler systems to keep all areas where
vehicles move damp enough to prevent dust raised when leaving
the site .
b. Wet down areas in the late morning and after work is completed
for the day in compliance with SCAQMD Rule 403 (Fugitive Dust
Emissions) .
c. Use low sulfur fuel ( . 05% by weight) for construction equipment .
d. Phase and schedule construction activities to avoid high ozone
days (first stage smog alerts) .
e. Discontinue construction during second stage smog alerts .
11. Construction shall be limited to Monday - Saturday 7 : 00 AM to
8 : 00 PM. Construction shall be prohibited Sundays and Federal
holidays . Construction activities shall comply with Chapter 8 .40
of the Huntington Beach Municipal Code. *
12 . Prior to initiation of construction, Police and Fire Department
shall be notified and the Department shall be kept informed about
duration and extent of construction throughout the process .
13 . The developer shall participate in the City' s Green Acres project
by installing separate water lines per Public Works standards , to
allow for use of reclaimed water for irrigation on. the site. *
14 . An acoustical analysis must be conducted to guarantee compliance
with the State Noise Insulation Standard of 46 db CNEL interior
(habitable rooms) and the City of Huntington Beach Guidelines of
60 db CNEL exterior noise level for residential areas . *

CONDITIONS OF APPROVAL - TENTATIVE TRACT NO. 14448 :
1 . The tentative tract map received and dated November 15, 1990,
shall be the approved plan, subject to the following modifications :
a . Leslie. Lane may be vacated from 30 . 00 feet to 27 . 00 feet .
Additional land shall become part of the project landscape.
2 . CC&Rs shall be submitted to and approved by the City Attorney and
the Department of Community Development at least 60 days prior to
recordation of the final tract map in accordance with Article 915
of the Huntington Beach Ordinance code. CC&Rs shall reflect the
.common driveway access easements, and maintenance of all common
landscape areas, project amenities and walls .
3 . Full Public works improvements are required to the centerline of
Leslie Lane.
4 . Water system shall be located in vehicular travelways and
dedicated to the city. The developer/homeowner ' s association
shall be responsible for repairing any enhanced pavement, if the
water facilities need to be maintained or repaired.
5 . Water system shall be looped. No dead ends shall be allowed. The
water system shall be installed per the Public Works Department ' s
Standards, Ordinances and Policies .
6 . Developer shall be responsible for the payment of any additional
fees adopted in the Water Division Financial Master Plan and
payment of the Traffic Impact Fees at the time building permits
are issued.
7 . The on-site sewer and water system shall be shown on a City
approved utility plan.
8 . The on-site sewer mains shall remain private .
9 . Hydrology and hydraulic calculations shall be submitted per the
latest edition of the Orange County E.M.A. Manual and City
Requirements .
10 . A soils report and grading plan shall be submitted for Public
Works approval .

11. The developer shall submit water improvements plans, on a separate
utility plan, showing service connections to all lots, fire
hydrants and other appurtenances in accordance with applicable
U.P.C. , Ordinances and Public Works Standards . These plans shall
be approved by the Public Works Water Division.
12 . The developer shall submit mitigation measures for approval by the
City which will address the following deficiencies in the water
system.
- Reducing the peak hour demands .
- Increasing the water supply sources (wells and importing
facilities) .
- Increasing the water storage facilities (reservoirs) .
The above deficiencies are either inadequate or cannot be met for
existing/ultimate demands, unless the mitigation measures
identified in the 1988 Water System Master Plan are addressed.
13 . No combustible construction shall occur until an approved water
system is installed.
14 . Drainage flows from adjacent properties shall not be obstructed.
Flows shall be accommodated per Public Works Department
requirements .
15 . On-site drainage shall not be directed to adjacent properties, but
shall be handled by a Public works Department approved method.
16 . All vehicular access rights to Warner Avenue shall be released and
relinquished to the City. *
17 . The developer shall replace the existing eight (8) inch water
distribution pipes which serve the project site with 12 inch
pipes . *
11 . 0 ALTERNATIVE ACTION:
The Planning Commission may deny Tentative Tract No . 14448 and
Conditional Use Permit No . 90-63 with Special Permits with findings .

aesthetically pleasing development . The project will also be
consistent with the Housing Element by providing housing
opportunities to low and moderate income families for 20% of the
project .
FINDINGS FOR APPROVAL - SPECIAL PERMITS :
1 . The following special permits for deviations to the requirements
of Article 915 of the Huntington Beach Ordinance Code promote a
better living environment and provide an improved site layout and
design.
a . To reduce the front yard setback from a 20 foot average with a
minimum dimension of 15 feet to a 13 foot average with a
minimum dimension of 10 feet .
b. To reduce the exterior side yard setback from a 20 foot average
with a minimum dimension of 15 feet to a 20 foot average with a
minimum dimension of 10 feet .
c . To reduce the required building separation front to side from
20 feet to 10 feet .
d. To reduce the required building separation side to side from 30
feet to 10 feet .
2 . The requested special permits provide for maximum use of
aesthetically pleasing types of architecture, landscaping, design
and building layout .
3 . The approval of the special permits will not be detrimental to the
general health, welfare, safety and convenience, and not
detrimental and injurious to the value of property and
improvements of the neighborhood or of the City in general ,
because they result in a project with an improved living
environment and site layout .
4 . The requested special permits are consistent with the objectives
of the Planned Residential Development standards in achieving a
development adapted to the parcel and compatible with the
surrounding environment .
FINDINGS FOR APPROVAL - TENTATIVE TRACT NO . 14448 :
1 . The size, depth, frontage and other design features of the
proposed subdivision for 33 units are in compliance with the
standard plans and specifications on file with the City as well as
with the State Map Act and the supplemental City Subdivision
Ordinance .

2 . The property was previously studied for Medium-High Density
Residential development at the time the General Plan designation
was placed on the site, and will accommodate the development of 33
condominiums .
3 . The General Plan has set forth provisions for this type of land
use as well as objectives for the implementation of this type of
housing .
4 . The site is physically suitable for the proposed density of 25
units per gross acre .
5 . The tentative tract map is consistent with the goals and policies
of the Huntington Beach General Plan.
CONDITIONS OF APPROVAL - -CONDITIONAL USE PERMIT NO. 90-63 :
1 . The site plan, floor plans , and elevations received and dated
January 11, 1991 shall be the conceptually approved layout .
2 . Prior to issuance of building permits , the applicant shall submit
the following :
a . A landscape construction set must be submitted to the
Departments of Community Development Public Works , and Fire for
review and approval . The Landscape Construction Set shall
include a landscape plan prepared and signed by a State
Licensed Landscape Architect and which includes all
proposed/existing plant materials ( location, type, size,
quantity) , an irrigation plan, a grading plan, an approved site
plan, and a copy of the entitlement conditions of approval .
The landscape plans shall be in conformance with the Ordinance
Code. "Drought tolerant" plants and turf shall be specified
for all common area landscaping . In addition, intensified
landscaping shall be provided between the dwelling units and
the private street to provide visual relief . The landscape
plans must be approved by the three departments prior to
issuance of building permits . All landscape shall be installed
prior to final inspection.
b. Rooftop Mechanical Equipment Plan. Said plan shall indicate
screening of any rooftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment .
c . Elevations shall depict colors and building materials proposed,
including the patio walls which shall be a combination of three
(3) feet of block and three (3) feet of plexiglass .
d . The site plan or reference page shall include all conditions of
approval imposed on the project printed verbatim.
e . All applicable Public Works fees shall be paid .

f . A detailed soils analysis shall be prepared by a registered
Soils Engineer . This analysis shall include on-site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties , foundations , retaining walls , streets , and
utilities .
g . A grading plan shall be submitted to and approved by the
Department of Public Works .
h. Complete detail of security gate configuration shall be
submitted for review and approval by Departments of Public
Works , Fire and Community Development .
i . All utility apparatuses such as, but not limited to, backflow
devices and Edison transformers , shall be depicted on the site
plan, and shall not be located in the front yard setback, where
feasible. All such equipment shall be screened with
landscaping or in another manner approved by Community
Development Department .
j . Final Tract Map No . 14448 shall be accepted by the City
Council . It shall be recorded with the County Recorder ' s
Office prior to Certificate of Occupancy or final inspection of
first unit .
k. Floor plans shall depict natural gas outlets at the locations
of cooking facilities , water heaters , and central heating
units , low-volume heads on all spigots and water faucets, and
natural gas and 220V electrical outlets at the location of
clothes dryers .
1 . If foil-type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Department and
indicated on the floor plans .
m. A lighting plan for all stationary outdoor lighting fixtures on
the site which includes high-pressure sodium vapor lamps or
metal halide for energy savings shall be approved by the
Department of Community Development to insure that lighting
will be directed only to desired areas , and that no lighting
fixtures shall be mounted facing adjacent residential areas .
Illumination levels at the project perimeter adjacent to
residential properties shall not exceed 2 . 0 foot candles . *
3 . Fire Department requirements are as follows :
a . Automatic sprinkler systems will be installed throughout to
comply with Huntington Beach Fire Department and Uniform
Building Code Standards . Shop drawings will be submitted to
and approved by the Fire Department prior to installation.

b. A Class III wet standpipe system (combination) will be

5 . Water system shall be looped. No dead ends shall be allowed. The
water system shall be installed per the Public Works Department ' s
Standards , Ordinances and Policies .
6 . Developer shall be responsible for the payment of any additional
:fees adopted in the Water Division Financial Master Plan and
payment of the Traffic Impact Fees at the time building permits
are issued .
7 . The on-site sewer and water system shall be shown on a City
approved utility plan.
8 . The on-site sewer mains shall remain private .
9 . Hydrology and hydraulic calculations shall be submitted per .the
latest edition of the Orange County E.M.A. Manual and City
Requirements .
10 . A soils report and grading plan shall be submitted for Public
Works approval .
11 . The developer shall submit water improvements plans , on a separate .
utility plan, showing service connections to all lots , fire
hydrants and other appurtenances in accordance with applicable
U. P.C. , Ordinances and Public Works Standards . These plans shall
be approved by the Public Works Water Division.
12 . The developer shall submit mitigation measures for approval by the
City which will address the following deficiencies in the water
system.
- Reducing the peak hour demands .
- Increasing the water supply sources (wells and importing
facilities) .
- Increasing the water storage facilities (reservoirs) .

Specifically, I am appealing the Commission' s deletion of a
condition requiring that twenty (20) percent of the units be
affodable to low and moderate income households . The basis of the
appeal is that the property was the subject of a General Plan
Amendment and Zone Change from Commercial to Medium-High Density
Residential . Part of the rational for a change to Medium-High
Density rather than Medium Density was that the higher density,
would allow for a portion of the project to be affordable. I
believe the City Council needs to address this issue.

archaeological resources . The environmental impact report did not
identify any significant adverse environmental impacts which could
not be mitigated to a level of insignificance. All applicable
mitigation measures as identified in Environmental Impact Report
No. 90-1 have been incorporated as conditions of approval for this
project.

8 . 0 SUBDIVISION COMMITTEE:
On January 10, 1990, the Subdivision Committee reviewed Tentative
Tract No. 14448 . The Public Works Department noted that at the
present time, vehicles exiting the project northbound on Leslie Lane
can make left hand turns onto Warner Avenue. Because the entrance
to the subterranean parking structure is approximately 90 feet from
the intersection of Warner Avenue and Leslie Lane, this will allow
for the stacking of four (4) vehicles on Leslie Lane. Should this
become a problem during the morning peak hours, Public Works will
recommend that only right hand turns be allowed onto Warner Avenue.
With the future development of the Meadowlark site, the existing
median configuration on Warner Avenue will be modified so that left
hand turns from Warner Avenue onto Leslie Lane are permitted, but
left hand turns from Leslie Lane onto Warner Avenue will be
prohibited. Given the present median configuration, it is likely
that motorists who wish to travel westbound on Warner Avenue during
the morning peak hours will take Dunbar Drive to Bolsa Chica Street
which is signalized at Warner Avenue.
The Subdivision Committee also discussed a potential vacation of
three (3) feet of Leslie. Lane that could be added to the project as
additional landscape area.
After discussion among the applicant, City staff and the Committee
regarding the project, the Subdivision Committee recommended
approval to the Planning Commission by a unanimous vote.
It should be noted that the Subdivision Committee review is limited
to subdivision issues such as vehicular access, the availability of
sewer and water services, potential impacts on Police and Fire
services, etc. Although the Subdivision Committee has recommended
approval of Tentative Tract No. 14448, the recommendation does not
include a recommendation on Conditional Use Permit No. 90-63 which
is for the actual project .
9 . 0 ISSUES AND ANALYSIS:
Background Information:
The proposed 33 unit condominium project is located on the south
side of Warner Avenue, west of Leslie Lane. The site is rectangular
in shape, and has approximately 313 feet of frontage along Warner
Avenue and 172 feet of frontage along Leslie Lane.
In August, 1990, the City Council approved General Plan Amendment
No. 89-3, Zone Change No. 89-5 and Environmental Impact Report No .
90-1 changing the General Plan Land Use Designation from General
Commercial to Medium-High Density and the zoning from Office
Professional (OP) to Medium-High Density Residential-Planned
Development (R3-PD) for this site.

The General Plan Amendment and Zone Change included this 1.24 acre
site located at the southwest corner of Warner Avenue and Leslie
Lane and the 1.36 acre site located at the southeast corner of
Warner Avenue and Leslie Lane. This proposal for a 33 unit
condominium development covers only the 1.24 acre site on the
southwest corner.
Due to concerns over land use compatibility, traffic volumes, fiscal
and sewer service impacts, the Planning Commission considered
maintaining the commercial zoning east of Leslie Lane and
redesignating the property west of Leslie Lane as Medium Density.
However, the motion failed to receive a second, and the Planning
Commission then took action to recommend the City Council deny the
project.
After a public hearing on August 20, 1990, the City Council took
action to approve the General Plan Amendment, Zone Change and
certify the Environmental Impact Report. Mitigation measures
included in the environmental impact report have been included as
conditions of approval for the development of the 33 unit
condominium project.
Project Description:
The proposed project consists of a two (2) to three (3) story "U"
shaped building constructed above a subterranean parking garage. A
total of five unit plans are provided, ranging in size from
1,215-1, 810 square feet. Four of the plans feature two (2) bedrooms
and two (2) bathrooms, and one (1) plan features two (2) bedrooms, a
den and two (2) bathrooms . Each unit is provided with a fully
enclosed two (2) car parking space in the subterranean garage.
Additionally, 17 code required guest spaces are provided in the
garage for a total of 83 spaces . Sliding gates within the parking
structure separate the guest parking from the resident parking.
Guests denied access into the project have adequate turn around area
within the garage to exit the structure.
The code requires a total of 19, 800 square feet of open space for
the project. As indicated on the attached Open Space Plan, the
project includes a total of 26, 870 square feet of open space,
approximately 7, 000 square feet in excess of code requirements . A
main recreation area of 7, 292 square feet is located on the ground
level and features a recreation building, sunning area, swimming
pool and barbecue/social area.
A 24 foot wide open space area which will also serve as an emergency
fire access lane has been provided along the entire western
perimeter of the site. This area is contiguous to the main
recreation area and will be developed for passive recreation use.
No structures will be allowed in this area due to it ' s fire lane
designation. The applicant will be required to submit landscape
plans for this area for review and approval of the both the Planning
Division and Fire Department.

Additional open space area is provided in the central courtyard and
along the Warner Avenue and Leslie Lane frontages . Private open
space is provided in the form of ground level patios and upper level
balconies . The code requires a minimum patio size of 250 square
feet . The plan provides patios ranging in size from 444 to 1, 144
square feet, with an average size of 627 square feet. Upper level
balconies range in size from 120 to 205 square feet.
The architecture of the project is a contemporary Mediterranean
style featuring lightly colored stucco and a traditional tile roof .
The building mass is broken up with a mixture of two (2) and three
(3) story building elements, offsets between the units themselves,
and a combination of hip and gable roof forms . Windows are
accentuated with pot shelves and plant-ons and the upper level
balconies are trimmed with painted metal railings .

Special Permits :
The applicant is requesting four (4) special permits as listed in
Section 2 .0 of this report. The Planning Commission may grant special
permits which allow deviation from the provisions of Article 915 in
order to achieve a development that creates a better living
environment and better land planning techniques with maximum use of
aesthetically pleasing types of architecture, landscaping, site layout
and design.
The following is a discussion of the special permits requested and
staff ' s recommendation:
Special Permits Nos . 1 and 2 - are requests to deviate from the code
requirement that structures exceeding 42 inches in height be setback
20 feet from a public street. The code allows the setback to be
reduced to 15 feet provided that the reduction is for a maximum of 50
percent of the total building frontage for each building and that a 20
foot average setback is maintained. This code requirement effects the
Warner Avenue and Leslie Lane frontages of the project .
As shown on the site plan, the units themselves are setback 20-24 feet
from Warner Avenue and Leslie Lane. The private patio walls, which
consist of a three foot stucco wall with three feet of plexiglass
material on top, encroach into the required setbacks . These patio
walls are setback an average of 13 feet from Warner Avenue and an
average of 20 . 5 feet from Leslie Lane. The minimum setback for the
walls is 10 feet .

Staff supports these two special permit requests because the added
height of the patio walls (from three [31 feet to six [61feet) will
provide sound attenuation from Warner Avenue and Leslie Lane and help
create a pleasant outdoor living environment. In addition, the ground
level patios are well in excess of code requirements in terms of size,
ranging from 444 to 1, 144 square feet . The use of a clear material
for the top three feet of the wall will serve to reduce the building
mass on the ground level . A condition of approval has been included
that requires intensified landscaping be provided between the units
and the public streets .
Special Permits Nos . 3 and 4 - are requests to reduce the required
building separation from front to side from the required 20 feet to 10
feet, and to reduce the building separation side to side from the
required 30 feet to 10 feet.
The side to front deviation occurs on the second level of the
structure on the Leslie Lane frontage above the building lobby. Staff
supports the special permit request because there are no windows on
the two walls which are separated by a 10 foot wide staircase. The
walls on either side of the staircase will be required to have a Sound
Transmission Class (STC) rating of 50 or better.
The side to side deviation occurs in the southwestern corner of the
site on the first and second level of the building where Plans 1 and 3
are separated by a 10 foot wide staircase. Again, staff supports this
request for a special permit because there are no windows located on
the opposing sides of the floor plans .
Affo dable Housing:
In preparing the analysis for General Plan Amendment No. 89-3 and Zone
Change No . 89-5, which redesignated this site from Commercial to
Medium-High Density Residential, staff addressed the issue of
affordable housing. One of the primary reasons staff supported the
redesignation of this property at an R3 density versus an R2 density
was that the developer would be better able to provide affordable
housing units .
The staff report for the General Plan Amendment and Zone Change,
prepared in July of 1990 states "The applicant has expressed an intent
to provide 20 percent of the residential units as affordable units,
which complies with the City' s policies to encourage the provision of
housing opportunities for all economic segments of the community" .
Staff has included a condition of approval of the conditional use
permit that the developer provide 20 percent of the units (7 units) as
affordable units to persons of low and moderate income.
10 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Conditional Use
Permit No. 90-63 with Special Permits and Tentative Tract No. 14448
with the following findings and suggested conditions of approval :

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 90-63 :
1. The location, site layout, and design of the proposed 33 unit
planned residential development with four (4) special permits
properly adapts the proposed structures to streets, driveways, and
other adjacent structures and uses in a harmonious manner. The
access to the project and the building height and bulk are
compatible with the adjacent structures and uses .
2 . The proposed 33 unit planned residential development with four (4)
special permits is compatible with surrounding properties in terms
of architecture and orientation and will not be detrimental to the
general welfare of persons residing or working in the vicinity,
nor detrimental to property and improvements in the vicinity.
3 . The access to and parking for the proposed 33 unit planned
residential development with four (4) special permits does not
create an undue traffic problem. The access point for the project
and the minimum code required parking provides adequate on-site
and off-site traffic circulation and parking .
4 . The planned residential development for a 33 unit project with
four (4) special permits conforms to the provisions contained in
Article 915 .
5 . Conditional Use Permit No. 90-63 for a 33 unit planned residential
development with four (4) special permits is consistent with the
goals and objectives of the City' s General Plan and Land Use Map
designation. The intent of the land use designation and zoning
suffix (PRD) is to provide a better living environment and promote
aesthetically pleasing development. The project will also be
consistent with the Housing Element by providing housing
opportunities to low and moderate income families for 20% of the
project .
FINDINGS FOR APPROVAL - SPECIAL PERMITS:
1. The following special permits for deviations to the requirements
of Article 915 of the Huntington Beach Ordinance Code promote a
better living environment and provide an improved site layout and
design.
a. To reduce the front yard setback from a 20 foot average with a
minimum dimension of 15 feet to a 13 foot average with a
minimum dimension of 10 feet.
b. To reduce the exterior side yard setback from a 20 foot average
with a minimum dimension of 15 feet to a 20 foot average with a
minimum dimension of 10 feet.
c. To reduce the required building separation front to side from
20 feet to 10 feet.
d. To reduce the required building separation side to side from 30
feet to 10 feet.

2. The requested special permits provide for maximum use of
aesthetically pleasing types of architecture, landscaping, design
and building layout.
3 . The approval of the special permits will not be detrimental to the
general health, welfare, safety and convenience, and not
detrimental and injurious to the value of property and
improvements of the neighborhood or of the City in general,
because they result in a project with an improved living
environment and site layout.
4 . The requested special permits are consistent with the objectives
of the Planned Residential Development standards in achieving a
development adapted to the parcel and compatible with the
surrounding environment .
FINDINGS FOR APPROVAL - TENTATIVE TRACT NO, 14448 :
1. The size, depth, frontage and other design features of the
proposed subdivision for 33 units are in compliance with the
standard plans and specifications on file with the City as well as
with the State Map Act and the supplemental City Subdivision
Ordinance.
2 . The property was previously studied for Medium-High Density
Residential development at the time the General Plan designation
was placed on the site, and will accommodate the development of 33
condominiums .
3 . The General Plan has set forth provisions for this type of land
use as well as objectives for the implementation of this type of
housing.
4 . The site is physically suitable for the proposed density of 25
units per gross acre.
5 . The tentative tract map is consistent with the goals and policies
of the Huntington Beach General Plan.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 90-63 :
1. The site plan, floor plans, and elevations received and dated
January 11, 1991 shall be the conceptually approved layout.
2 . Prior to issuance of building permits, the applicant shall submit
the following:
a. A landscape construction set must be submitted to the
Departments of Community Development Public Works, and Fire for
review and approval . The Landscape Construction Set shall
include a landscape plan prepared and signed by a State
Licensed Landscape Architect and which includes all
proposed/existing plant materials (location, type, size,
quantity) , an irrigation plan, a grading plan, an approved site
plan, and a copy of the entitlement conditions of approval .

The landscape plans shall be in conformance with the Ordinance
Code. "Drought tolerant" plants and turf shall be specified
for all common area landscaping. In addition, intensified
landscaping shall be provided between the dwelling units and
the private street to provide visual relief . The landscape
plans must be approved by the three departments prior to
issuance of building permits . All landscape shall be installed
prior to final inspection.
b. Rooftop Mechanical Equipment Plan. Said plan shall indicate
screening of any rooftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment.
c. Elevations shall depict colors and building materials proposed.
d. The site plan or reference page shall include all conditions of
approval imposed on the project printed verbatim.
e. All applicable Public Works fees shall be paid.
f . A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on-site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities .
g. A grading plan shall be submitted to and approved by the
Department of Public Works .
h. Complete detail of security gate configuration shall be
submitted for review and approval by Departments of Public
Works, Fire and Community Development.
i . All utility apparatuses such as, but not limited to, backflow
devices and Edison transformers, shall be depicted on the site
plan, and shall not be located in the front yard setback, where
feasible. All such equipment shall be screened with
landscaping or in another manner approved by Community
Development Department .
j . Final Tract Map No. 14448 shall be accepted by the City
Council . It shall be recorded with the County Recorder' s
Office prior to Certificate of Occupancy or final inspection of
first unit.
k. Floor plans shall depict natural gas outlets at the locations
of cooking facilities, water heaters, and central heating
units, low-volume heads on all spigots and water faucets, and
natural gas and 220V electrical outlets at the location of
clothes dryers .

1 . If foil-type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Department and
indicated on the floor plans .
m. A lighting plan for all stationary outdoor lighting fixtures on
the site which includes high-pressure sodium vapor lamps or
metal halide for energy savings shall be approved by the
Department of Community Development to insure that lighting
will be directed only to desired areas, and that no lighting
fixtures shall be mounted facing adjacent residential areas .
Illumination levels at the project perimeter adjacent to
residential properties shall not exceed 2 . 0 foot candles . *
3 . Fire Department requirements are as follows :
a. Automatic sprinkler systems will be installed throughout to
comply with Huntington Beach Fire Department and Uniform
Building Code Standards . Shop drawings will be submitted to
and approved by the Fire Department prior to installation.
b. A Class III wet standpipe system (combination) will be
installed to comply with Huntington Beach Fire Department and
Uniform Building Code Standards . Shop drawings will be
submitted to and approved by the Fire Department prior to
installation.
c. A fire alarm system will be installed to comply with Huntington
Beach Fire Department and Uniform Fire Code Standards . Shop
drawings will be submitted to and approved by the Fire
Department prior to installation. The system will provide the
following:
- Water flow, valve tamper and trouble detection
- 24 hour supervision
- Smoke Detectors
- Annunciation throughout
- Audible Alarms throughout
- Graphic Display
- Manual Pulls
d. Fire extinguishers will be installed and located in areas to
comply with Huntington Beach Fire Code Standards .
e. One (1) fire hydrant will be installed prior to combustible
construction. Shop drawings will be submitted to the Public
Works Department and approved by the Fire Department prior to
installation.
f . Elevators will be sized to accommodate an ambulance gurney.
Minimum 618" wide by 4 ' 3" deep with minimum 42" opening.

approval containing requirements of Fire Department
Specification No. 426.
k. Installation or removal of underground flammable or combustible
liquid storage tanks will comply with Orange County
Environmental Health and Huntington Beach Fire Department
requirements .
1 . Fire access roads will be provided in compliance with the
Huntington Beach -Fire Code and City .Specification No. 401.
Include the circulation plan and dimensions of all access roads .
m. Exit signs and exit path markings will be provided in
compliance with the Huntington Beach Fire Code and Title 24 of
the California Administrative Code.
n. The project will comply with all provisions of the Huntington
Beach Fire Code and City Specification Nos . 422 and 431 for the
abandonment of oil wells and site restoration.
o. The project will comply with all provisions of Huntington Beach
Municipal Code Title 17. 04 . 085 and City Specification No. 429
for new construction within the methane gas overlay districts .
4 . The development shall comply with all applicable provisions of the
Ordinance Code, Building Division, and Fire Department.
5 . All building spoils, such as unusable lumber, wire, pipe and other
surplus or unusable materials, shall be disposed of at an off-site
facility equipped to handle them.
6 . The applicant/owner shall be responsible for paying the Traffic
Impact Fee prior to issuance of a Certificate of Occupancy and/or
final building permit approval .

7. The developer shall be responsible for payment of any additional
fees adopted in the upcoming Water Division Financial Master Plan.
8 . Natural gas shall be stubbed in at the locations of cooking

shall: *
a. Control fugitive dust by regular watering, paving construction
roads, or other dust preventive measures in compliance with
SCAQMD Rule 403 (Fugitive Dust Emissions) .
b. Maintain equipment engines in proper tune.
10 . During construction; the applicant shall : *
a. Use water trucks or sprinkler systems to keep all areas where
vehicles move damp enough to prevent dust raised when leaving
the site.
b. Wet down areas in the late morning and after work is completed
for the day in compliance with SCAQMD Rule 403 (Fugitive Dust
Emissions) .
c. Use low sulfur fuel ( .05% by weight) for construction equipment.
d. Phase and schedule construction activities to avoid high ozone
days (first stage smog alerts) .
e. Discontinue construction during second stage smog alerts .
11. Construction shall be limited to .Monday - Saturday 7: 00 AM to
8 : 00 PM. Construction shall be prohibited Sundays and Federal
holidays . Construction activities shall comply with Chapter 8.40
of the Huntington Beach Municipal Code. *
12 . Prior to initiation of construction, Police and Fire Department
shall be notified and the Department shall be kept informed about
duration and extent of construction throughout the process .
13 . The developer shall participate in the City' s Green Acres project
by installing separate water lines per Public Works standards, to
allow for use of reclaimed water for irrigation on the site. *
14 . An acoustical analysis must be conducted to guarantee compliance
with the State Noise Insulation Standard of 46 db CNEL interior
(habitable rooms) and the City of Huntington Beach Guidelines of
60 db CNEL exterior noise level for residential areas . *

15 . The applicant shall enter into an agreement to provide 20 percent
low and moderate income units as in exchange for the granting of
General Plan Amendment 89-3 and Zone Change 89-5 . The applicant
shall designate seven (7) units for persons and families of low
and moderate income as stipulated in Section 65915 of the
Government Code and reflect the goals for affordable housing
identified in Section 3 .4 of the Housing Element . The applicant ' s
compliance with Section 65915 of the Government Code in terms of
type and location of affordable units, method of income
verification of buyers and sales prices shall be set forth in the
agreement which shall be reviewed and approved as to form and
content by the City Attorney.
CONDITIONS OF APPROVAL - TENTATIVE TRACT NO, 14448 :
1. The tentative tract map received and dated November 15, 1990,
shall be the approved plan, subject to the following modifications :
a. Leslie Lane may be vacated from 30 .00 feet to 27. 00 feet.
Additional land shall become part of the project landscape.
2 . CC&Rs shall be submitted to and approved by the City Attorney and
the Department of Community Development at least 60 days prior to
recordation of the final tract map in accordance with Article 915
of the Huntington Beach Ordinance code. CC&Rs shall reflect the
common driveway access easements, and maintenance of all common
landscape areas, project amenities and walls .
3 . Full Public works improvements are required to the centerline of
Leslie Lane.
4 . Water system shall be located in vehicular travelways and
dedicated to the city. The developer/homeowner ' s association
shall be responsible for repairing any enhanced pavement, if the
water facilities need to be maintained or repaired.
5 . Water system shall be looped. No dead ends shall be allowed. The
water system shall be installed per the Public Works Department ' s
Standards, Ordinances and Policies .
6 . Developer shall be responsible for the payment of any additional
fees adopted in the Water Division Financial Master Plan and
payment of the Traffic Impact Fees at the time building permits
are issued.
7 . The on-site sewer and water system shall be shown on a City
approved utility plan.
8 . The on-site sewer mains shall remain private.
9 . Hydrology and hydraulic calculations shall be submitted per the
latest edition of the Orange County E.M.A. Manual and City
Requirements .
10. A soils report and grading plan shall be submitted for Public
Works approval .

11. The developer shall submit water improvements plans, on a separate
utility plan, showing service connections to all lots, fire
hydrants and other appurtenances in accordance with applicable
U.P.C. , Ordinances and Public Works Standards . These plans shall
be approved by the Public Works Water Division.
12 . The developer shall submit mitigation measures for approval by the
City which will address the following deficiencies in the water
system.
- Reducing the peak hour demands .
- Increasing the water supply sources (wells and importing
facilities) .
- Increasing the water storage facilities (reservoirs) .
The above deficiencies are either inadequate or cannot be met for
existing/ultimate demands, unless the mitigation measures
identified in the 1988 Water System Master Plan are addressed.
13 . No combustible construction shall occur until an approved water
system is installed.
14 . Drainage flows from adjacent properties shall not be obstructed.
Flows shall be accommodated per Public Works Department
requirements .
15 . On-site drainage shall not be directed to adjacent properties, but
shall be handled by a Public works Department approved method.
16 . All vehicular access rights to Warner Avenue shall be released and
relinquished to the City. *
17. The developer shall replace the existing eight (8) inch water
distribution pipes which serve the project site with 12 inch
pipes . *
11. 0 ALTERNATIVE ACTION:
The Planning Commission may deny Tentative Tract No. 14448 and

CITY COUNCIL MEETING
Mayor Green: Those are all the people who have requested to speak
on this item so I will close the public hearing . Council comments .
Councilwoman Winchell : I think we have to deal with the
environmental impact report first.
Mayor Green: That is correct .
Councilwoman Winchell : I make a motion to approve the Environmental
Impact Report No. 91 with the mitigation measures by adopting
resolution 6205 .
Councilman Second
Mayor Green: Call for the Vote
City Clerk: All Ayes
Councilwoman Winchell : I would to make a motion to uphold the
Planning Commission recommendation by denying General Plan Amendment
No. 89-3 and deny Zone Change No. 85-9 with findings .
Mayor Green: Second
Councilman MacAllister: I am going to speak in defeat of the motion
on the floor. I feel that we should override and go with the staff
recommendation. As staff indicated that this project would help us
meet our critical housing needs that we are under state and federal
laws to meet . Also, I have been up in the area and seen the large
amount of commercial that is there that is about 30% empty now and
is going stay empty up there and from all of the reports that I have
read it does not have that great of impact in the area. The whole
area is going to continue grow out and this one project is not going
to effect anything that much. So, if this motion does not pass, I
will be making a motion to go with staff ' s recommendation.
Councilman Erskine: Thank you Mr. Mayor. I wanted to ask the staff
if I could, Mr . Uberuaga, there has been reference by several
speakers to the Commission' s position on this . I see that there
were four votes to deny, three votes no on the motion to deny. One
of the affirmative votes, Burguignon, has indicated that if there
was rehearing he would be in favor of the proposed General Plan
Amendment . Is that correct?
Mike Adams : Yes, that is correct.
Councilman Erskine: So, in essence, four of the Planning
Commissioners have stated their support for the General Plan
Amendment?
Mike Adams : Three have voted that way and one has sent a letter
indicating that, so that would add up to four . That is correct .

Councilman Erskine: I assume the letter is written indication of
his position though to be trusted. We have two petitions; one that
was handed out - it was stapled but it seemed to be copies of the
same page. Is that correct? Did others get that? It is signed by
a dozen or so and we have another petition again by homeowners, it
appears to be about 25 in support of the General Plan Amendment . Is
that correct?
Mike Adams : I do not have a copy of either of those.
Councilman Erskine: Can somebody verify that? That is all I needed
to know.
Mayor Green: Call for the question if there are no other lights
on. There are no other lights, lets call the question.

Councilman MacAllister: Thank you, Mayor Pro Tem. I would like to
move staff recommendation that we override the Planning Commission
and adopt Report No. 90-1 Resolution 6025, approve General Plan
Amendment No . 89-3 , Resolution 6026, approve Zone Change No. 89-5
and Ordinance No. 3073 .
Councilman Silva: Silva
Councilman Bannister: One correction I want to make is that you
said Resolution 6026 instead of 6206 .
Councilman MacAllister: I 'm sorry.
Councilwoman Winchell : Before the Council votes on this motion, I
would like to raise a few items because what you are voting on is to
go to R3 in this area from the Office Professional and Commercial .
I would like to suggest, if you do feel that residential is what we
should do there, you should consider R2 rather R3 . The reason I
raise this, is that the area all around it is R2 except on one side
it is R1 and it seems to me to go to R3 is excessive for the area
when you look at the map behind us and see intensity of use out in
that area . I would also bring your attention to page 73 of the
staff report that indicates that the medium high density has a lower
revenue yield for the City and that you are better off with medium
density or low density in terms of cost revenue ratio. So I would
really urge you to consider if not the whole piece in R2 rather than
R3 at least a part of it in R2 and maybe a piece of it left in
Office Professional that is closest to the Commercial . It does not
have to be one or another here, you could break the piece at Leslie
and have R2 adjacent to the R1 and then let the other go Office
Professional and still do what I think would be a better rational
planning job. If there is any interest in some kind of compromise.
City Attorney Hutton: I just wanted to inquire whether Councilman
MacAllister also added the proposed findings that Mr. Adams had
suggested.
Councilman MacAllister: Thank you, I always forget that`, but it
does include the findings .

Councilman Bannister: Yes, Mr. Mayor. Under the conditions of
approval recommended by staff, item number 7 (the project provides
an opportunity to increase the City' s affordable housing stock. The
applicant is requesting an intent to provide 25% of the total number
of the units as an affordable unit. ) , we talked once before, Mr.
Uberuaga, I think Mike and I talked about a provision where there is
a second trustdeed which goes to the Redevelopment Agency which
mandates that the affordable housing units stay affordable. Is that
built into this provision as a condition?
Mike Adams : No, we talked about this quite a bit at the Planning
Commission - how to address the affordable issue. This evenings
action will not be addressing affordablity at all, other than the
fact that you are recommending rezoning to a higher density.
Typically you get with higher density projects more affordable
units . At the time a project comes forward with a conditional use
permit, then we will be recommending conditions on affordability and
we will recommend, such as you have suggested here actually a
program for affordability. But that is not part of your action this
evening.
Councilman Bannister: OK, but you intend to do that?
Mike Adams: We intend to do that at the conditional use permit
stage.
Councilman Have you worked out that program Mike,
with the deed of trust?
Mike Adams : I do not believe we have all the details worked out, we
have had a number of discussions on it .
Councilwoman Winchell : I have one last comment. By up-zoning like
this, you are increasing the value of that land which to me is just
spiraling the problem we are having in terms of providing affordable
housing. It is quite an up-zone. The value of this land is going
to go up very high and the action that we are taking tonight, as
Mike has said, really is not assuring anything about affordable
housing because that comes at the conditional use permit level .
This is merely a zone change not merely, this is a zone change and
the general plan amendment which adds the value to that property
forevermore and if it is your desire to have affordable housing, the
better route to take is to leave at R2 and then when it comes at a
CUP level, allow a density bonus and then you haven' t inflated your
land as you do by doing this . So, I think that is a good point, Mr .
Bannister.
Councilman Silva: Yes, I know that we have voted on issues like
this many times and Madame City Attorney, if we were to delete
number 7 as a finding, there should be no problem with that . If I
can get the maker of the motion to go along with me that 7 be
deleted.
Councilman MacAllister : I would rather have that as a separate
motion to see where it stands with everybody else. You can make
that as a separate amendment motion to see where it stands .

Councilman : I would second that if you are making
that a a motion, I would second the amendment.
Councilman Silva: I feel that there is no way right now that we can
control the 20% affordable housing on the first go around it is
affordable and after that it is not . I feel the City is giving up
something for the added density but it doesn' t stay affordable that
long . So, for that reason, I would like to see it taken out .
Councilman Erskine: I will be voting against the amendment . That
is a radical change to housing policy that is pursued up and down
the state.
Councilman Silva: I do not think that one mile from the ocean would
really be an area for affordable housing.
Mayor Green: There are no more questions or lights, let ' s call for
the vote on the amendment .
Mike Adams : Mr . Chairman, before you vote on the amendment, I can
explain something. There are ten items starting on page four are
actually rationales for staff ' s recommendation. By deleting the
last sentence on item number seven, I think you still have the same
staff rationale. Those are not findings for your zone change. I
have yet to read those to you. Maybe I will just take a second to
read three findings for this project. But that is just part of the
staff analysis, that is not part of your action either. The
findings that staff would suggest would read as follows :
1. That Zone Change No. 89-5 from Office Professional and QC4
Qualified Highway Commercial to R3PD 25 units to the acre is
consistent with the City' s General Plan of land use which is
medium high density residential .
2 . That the zone change implements the goals and policies .
3 . That the zoning designation of R3PD medium high density
residential planned development will allow for development that
is compatible with surrounding residential units .
Now to act on these findings, you need to take action first on the
General Plan Amendment, second on the Zone Change.
Councilman Erskine: I was going to comment on Grace' s discussion
regarding the cost of the land. I have not seen to many situations
in my experience where a potential developer has acquired property
at given price and that price floats based on the zoning. I would
assume that whoever the project developers are, I assume that is Mr.
Terriosian has locked in the price and is in escrow contingent upon
approval of this R3 and is going to make the project more or less
affordable depending on what density he gets . The Government Code
and State Housing and Community Development policies are replete
with directive to local government that density is key factor in the
affordability of units . It typically assumes that land owners paid
"X" for a piece of property and it is not a floating price. There
are some escrows that are very exotic and have a lot of
contingencies that if the developer gets "X" amount of density then
the price is "X" plus something. I find that is the atypical
situation.

Councilman MacAllister: Mr. Uberaga, I wanted to ask Mike Adams on
7 here, the motion that is on the floor. These are just the reasons
for your rationale as you say, but at the same time the first part,
of course, rather than deleting all of it, because it says project
provides not to increase the City' s affordable housing stock - which
is true and the applicant has expressed the intent to do the 20%.
If the applicant desires to do this, are we going to say we are not
going to allow him to do it. That is the intent of the motion on
the floor . Other than you say this condition has been included in
the proposed resolution. If we just don' t have it the resolution
and the applicant still desires to do it, are we going to deny him
of it . I guess that is what I would worry about. How can we do
that.
Mike Adams : You simply would be postponing that decision to the
conditional use permit stage. You are saying, by your action on the
zoning this evening, you would be encouraging that or accommodating
him to do that but you are not requiring him to do any affordable at
this time. We can simply delete that from the discussion page, you
can delete that line and still have the same intent .
Councilman MacAllister: Just the last line that is in parenthesis?
Mike Adams : Yes
Councilman MacAllister : Would that be your intent, Jim? Just
reduce the last line rather than the whole item 7.
Jim Silva: That would be OK.
Councilwoman Winchell : Two sentences or one?
Jim Silva: Just the one sentence in parenthesis .
Councilwoman Winchell : I really have to differ with Councilman
Erskine, because it is my belief and I think it would hold out that
the zoning on the land is really going to determine the price.
While this escrow, you have greatly increased the value of that
property, and he can turn around and sell it. You have no guarantee
of what is going to go on there or how much they are going to cost.
I really think it is basic to land value, what a local government
puts on there.
Councilman Erskine: That is true over time. But it is not true in
one development application case. I realize that we do not have
that .
Councilwoman Winchell : But this is at the general plan level and
anything can change after you do it . So I 'm still very opposed to
it .
Councilman Bannister: Yes, I would agree with Grace. John, I think
what she is saying and you said too is that escrow is probably
contingent upon this being zoned R3 so the price that it is being
purchased for is probably at R3 zone. And if it doesn' t go R3, the
escrow would fall out .

Councilman Erskine: I think the point is if we were to reduce it R2
or R1 the deal could fall through possibly.
Mayor Green: Call for the question on the amendment which is
removing the last sentence in parenthesis .
Connie Brockway: This is on the General Plan Amendment only - we
are taking them separate. Mike, is that what you want?
Mike Adams : Actually, what you are voting on editing the staff
report . There is no need for taking action on this .
Attorney Hutton: Excuse me, I think you have a motion first on the
floor that was never completed. The motion was seconded to reverse
the Planning Commission and to adopt the General Plan Amendment and
.Zone Change and you all ready did the Environmental Impact Report.
Mayor Green: Well, we will vote on that after we vote on the
amendment that was offered by Mr . Silva.
Attorney Hutton: OK
Mayor Green: Call for the question on the amendment.
Councilwoman Winchell : Excuse me, I think what the Attorney is
pointing out is what we are voting on with Silva amendment really
wasn' t in the motion because it is not part of general plan
amendment or the zone change rather that it is part of the staff
report.
Mike Adams : That is correct.
Councilwoman Winchell : So it wasn' t included in the motion.
Councilman Erskine: The amendment becomes moot doesn' t it?
Councilwoman Winchell : Because it is not a finding and it wouldn' t
go in with the approval . Is that correct?
Attorney Hutton: I believe your analysis is correct. What Mr.
Adams, Development Services Director, outlined to you were the
findings that he had prepared. The 7, 8 or 9 rationales presented
by the staff are not included in the motion. They were rational
basis for their conclusions to adopt the EIR.

Councilman MacAllister reported on the PCTA fees received from Paragon Cable.
He stated that the operating policy for Channel 3 was adopted on May 5, 1989.
He stated that he is on the subcommittee with Councilman Silva and that they
had met. with staff in regard to revising the policy; it is in final draft form
and will return to Council for review.

Scott Hess , Senior Planner/Advanced Planning, presented a staff report on the
Environmental Impact Report and mitigating measures using a wall map to iden-
tify the zoning.
The Mayor Pro Tempore declared the public hearing open.
Robert Coutts spoke in opposition to Zone Change No. 89-5 and stated he
believed the additional parking would adversely affect him and his opportunity
for resale.
Mark Browning, speaking for his neighborhood on Roosevelt Lane and the people
of Fernhill , requested denial of Zone Change No. 89-5. He stated he did not
believe it to be desirable to mix commercial , single-family R1 residential ,
and medium high density on the same side of the street.
George Arnold spoke in opposition to Zone Change No. 89-5 until a parking
study is completed.
Mary Ota (and daughter) distributed to Council an informal petition listing
approximately 18 signatures of persons opposed to Zone Change No. 89-5. She
stated she believed the zone change would cause sewer problems, a water
shortage, and congestion.
Art Torosian stated . he believed the proposed project would enhance the neigh-
borhood and improve local property values. He stated that the project is
owned by Art Torosian and David Czaja and has nothing to do with J. T. Moody.
In answer to Councilmember Winchell ' s inquiry, Art Torosian stated the
Guardian Building would remain and that the complex would be designed to
provide privacy for the adjacent residents.
Steve Mann stated he was representing the twenty-five persons who signed an
informal petition given to Council in support of General Plan Amendment No.
89-5. He read the letter listing the reasons for support.
Steve Downs stated he owns the professional building 100' west of the proposed
project and supports the area remaining office commercial .
Sally Graham urged Council to deny Zone Change No. 89-5. She stated she did
not believe there was aneed for additional housing with proposed developments
at Bolsa Chica and Meadowlark.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the
Mayor.
A motion was made by Winchell , seconded by Erskine, to adopt and certify as
adequate Environmental Impact Report No. 90-1 with mitigation measures, by
adopting Resolution No. 6205. The motion carried by the following roll call

WHEREAS, the City Council of the City of Huntington Beach,
California desires to update and refine the General Plan in keeping
with changing community needs and objectives; and
A public hearing on adoption of General Plan Amendment No . 89-3
was held by the Planning Commission on July 17, 1990; and
Thereafter the City Council, after giving notice as prescribed
by Government Code §65355 , held at least one public hearing to

Subject: Low Income and Affordable Housing, C.U.P. No. 90-63 / Tentative

Dear Mayor Green,
This letter is in response to the appeal filed on Conditional Use Permit No. 90-
63/Tentative Tract No. .14448 and will explain our company's position on the
issue of affordable housing with regard to this project and future developments in
Huntington Beach.
As a matter of background information, in August of 1990 the City Council
amended the General Plan and rezoned the subject property to medium/high
density residential. Members of the Council were concerned about the affordable
housing issue and were told by the staff that it was not a condition placed on the
project but simply one of ten items to be looked into. Based on the staffs
comments and the Council's action, which placed no conditions on this site, we
have designed a luxury condominium project.
The project consists of 33 units which have an average size of 1500 sq.ft. and a
projected average value -of $285,000.00 . In addition, the project exceeds the
city's requirements for open space and recreational area.
We would like to bring to the attention of the Council that the project is not
designed as affordable housing. Our company had numerous meetings with staff
concerning the overall design of this project, and at no time did the staff raise the
issue of affordable housing. The first time we were informed of the request for
the affordable housing was when we received the Staff Report to the Planning
Commission the day prior to our hearing before the Planning Commission.
Engineering and architectural plans are virtually complete. In order to
accommodate the revision requested at this late date, a complete redesign would
be required which would introduce significant delays. This would clearly
jeopardize our ability to proceed with the project.

After hearing of the proposed recommendation for affordable housing we
checked to determine where the 20% affordable originated. We found no
published, information in the General Plan, in the form of an ordinance or as a
policy statement, which provides clear direction to an applicant in the preparation
of a project or anything which supports the percentage recommended by staff.
The Redevelopment Agency staff and the City's planning staff have discussed
options under which our company could propose development of affordable
housing units. Based on these discussions we have now contacted the Department

development company we understand the City's long-range plans and have a
commitment to support the City in achieving its goals. We are not adverse to
building an affordable product. It must however, be economically viable.
Currently, we have targeted sites in Huntington Beach which the Redevelopment
Agency staff agrees could be good future affordable housing projects.

The Documentary Stamp Act of California (Part 6.7 of Division 2 of the Revenue and Taxation Code) authorizes
any county, or city and county, to impose on,each deed, instrument or writing conveying real property when the
consideration or value of the interest or property conveyed exclusive of the value of any lien or encumbrance
remaining thereon at the time of sale exceeds $100, a tax at the rate of 55¢ if the consideration or value does not
exceed $500, and 55¢ for each additional $500 or fraction thereof.
