STATEMENT OF ISSUE•
Transmitted for City Council consideration is a request by the
Economic Development Department to amend the Huntington Beach
Ordinance Code, Article 961, Signs, to allow off-premise signs which
are designed as multiple user readerboard signs adjacent to the 405
(San Diego) Freeway.

FINDINGS FOR APPROVAL - CODE AMENDMENT:
1. Code Amendment No. 92-1 will establish provisions to allow
signage that will diversify the economic base of the City and
increase the tax base.
2 . Code Amendment No. 92-1 will esablish the conditional use
permit process as a means to evaluate a sign' s compliance with
the provisions of Article 961.
3 . Code Amendment No. 90-1 will establish provisions to allow
signage that will promote the development of services and
facilities necessary to support tourist industry.
ANALYSIS•
Project Description:
Code Amendment No. 92-1 is a request by the City of Huntington Beach
Economic Development Department to amend Article 961, Sign Code, to
allow off-premise signs which are designed as multiple user
readerboard signs and establish specific provisions to regulate same.
The provisions will allow a sign that is maximum 85 feet high and
1,200 square foot in area (sign face) . The sign must be within 200
feet of a freeway and cannot be closer than 250 feet from another
multiple user readerboard sign. This basically restricts the
potential sign locations to one area of the City (see map at the end
of Attachment No. 3) .
Other requirements include:
Messages shall be no faster than one (1) message every four (4)
seconds and shall have a minimum internal period of one (1)
second between messages.
20% of the message time shall be used for public service
announcements .
- Maximum measurable light output shall be of 50 candles at a
distance of 50 feet.
Reduced intensity of lighting required at night .
Off-site electric readerboards pursuant to these provisions
must be mulitple user.

This code amendment is designed specifically to allow one multiple
user readerboard sign to be placed near the San Diego Freeway and
Beach Boulevard. The intent is to advertise for businesses (auto
dealerships) off-site. Currently, the Sign Code prohibits off-site
signs . (An off-site sign is a sign installed for the purpose of
advertising a project or subject or business unrelated to the
premises upon which the sign is located. ) Only subdivision
directional signs are allowed provided they are a maximum of 15 feet
high and 64 square feet in area.
Location•
One commercial area complies with the locational criteria
established by the proposed code amendment (see map at the end of
Attachment No. 2) . The area is adjacent to the San Diego Freeway
(405) within the Huntington Center Redevelopment Project Area.
Placement will be limited to the Huntington Beach Mall area adjacent
to the southern portion of Center Avenue or to the landscaped areas
between Center Avenue and the freeway ramps . This proposed area is
within the Beach Boulevard/Freeway interchange area, the gateway to
Huntington Beach. Signs within the gateway area should enhance the
aesthetic value of the area. The potential site areas contain tall
trees, and construction of a maximum 85 foot tall multiple user sign
that is up to 1,200 square feet in size will detract and impact the
visual beauty created by the surrounding landscaping . Multiple user .
readerboards will not be compatible with signs and buildings located
adjacent to or within the potential site area; the aesthetic value
of the gateway will be diminished.
Sign Size:
Maximum height for signs in Huntington Beach is generally 15 . 5 feet
with a maximum sign area of 80 square feet. A recent amendment to
the sign code allows electronic readerboards at 25 foot height and
115 square feet of sign area to be located only on Beach Boulevard.
The proposed code amendment includes provisions to allow a height of
85 feet and 1200 square feet of sign area. The amendment will allow
a sign more than three times the height and ten times the area
permitted on Beach Boulevard. This is excessive signage and would
not be compatible with existing signs in the community or the intent
of the sign code.
The sign copy may identify more than one business located off-site.
The advertising time will be allocated for public services (20%) and
off-site businesses (80%) . Light intrusion restrictions onto
residential properties have been included.

For more than thirty years, the City has limited the type of
permitted signs and advertising devices to those which only carry
advertisements incidental to a lawful premises upon which the sign
is located. More recently, the City has required a sign design to
be compatible with the building design, limited to sign message to
the name of the business or premises, and restricted the size to a
seven foot high monument sign or 15 . 5 foot pole sign when the site
meets specific locational and size criteria. The proposed code
amendment is a step backwards. It increases the possibility of
adverse impacts to the City by containing provisions for off-site
advertising signs 250 feet apart and adjacent to the freeway. The
quality of the City' s appearance may not be maintained or enhanced
by construction of signs in compliance with the proposed code
amendment .
Caltrans •
Signs located within 660 feet of, or visible from, interstate
highways (San Diego - 405 Freeway) are subject to the Outdoor
Advertising Act administered by Caltrans . If the sign identifies
the occupant or premises, the sign is exempt from the Act. The Act
defines the proposed multiple user readerboard sign as a "message
center display" and includes specific limitations as to sign area,
frequency of message change and location. No message center shall
be placed within 1, 000 feet of another message center display or on
the same side of the freeway 500 feet from any other advertising
sign.
When a sign is located within a redevelopment project area and
advertises businesses and activities within the project area with
consent of the redevelopment agency, the sign is considered by the
Act to be an "on-premises" sign. An annual permit issued by
Caltrans is required for all signs adjacent to the freeway. The
City of Huntington Beach Redevelopment Agency was issued an
"on-premises" permit on March 18, 1992 for a 14 foot by 30 foot
message center display.
Single Interest Group Sign:
To qualify as an "on-premise" sign according to Caltrans, the
businesses being advertised must be located within the project
area. The Redevelopment Agency has been working with the Huntington
Beach Automobile Dealers Association to allow the multiple user
readerboard sign in an effort to improve the sales tax revenue for
the City. To meet the "on-premises" requirement of the Act, the
association will have an office within the Redevelopment Project
Area.

During 1991, the Huntington Beach Auto Dealers Association
successfully processed Code Amendment No. 90-8 which allows flags,
pennants, banners and car top signs year round, small helium
balloons on weekends, and large inflatibles 12 weekends per year.
The code amendment created regulations to allow the temporary signs
(not permanently affixed to the ground or building) to generate
attention getting devices necessary for impulse -buying.
Recognizing the importance of automobile dealerships to city, the
Economic Development Department has requested Code Amendment
No. 92-1 to create provisions that will allow a permanent sign
structure for multiple users . This sign structure would attract the
freeway traveler to Huntington Beach, thereby making the automobile
dealers competitive with dealers in other cities . Should the
alternative action be approved, staff recommends the sign code be
amended to- disallow temporary or promotional activity signs on each
auto dealership site.
Environmental Status :
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development posted draft Negative
Declaration No. 92-17 for thirty days . Written comments were
received from Caltrans, however, they are not related to
environmental issues . Prior to City Council action on Code
Amendment No. 92-1, the City Council must review and act on Negative
Declaration No. 92-17.

AMENDING CHAPTER 9610 .4 OF THE
HUNTINGTON BEACH ORDINANCE CODE PERTAINING
TO BILLBOARDS AND ADVERTISING STRUCTURES.
WHEREAS, the City Council wishes to clarify and update the
definition and composition of the Ordinance Code of the City of
Huntington Beach as it relates to billboards and advertising
structures, and more specifically, multiple users of electronic
reader board signs .
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby ordain as follows :
SECTION 1. That Section 9610 .4 of the Huntington
Beach Municipal Code is hereby amended to read as follows:
9610 .4 Prohibited signs .
(k) Billboards or advertising structures, including any
off-site signs installed for the purpose of
advertising a project, subject or business unrelated
to the premises upon which the sign is located, except
subdivision directional signs pursuant to section
9610 . 9 (c) , and multiple users of electronic reader
board signs pursuant to Section 9610. 9(e) .
SECTION 2. This ordinance shall take effect thirty
(30) days after its passage.

TO ELECTRONIC READER BOARD SIGNS.
WHEREAS, the City Council wishes to clarify and update the
definition and composition of the Ordinance Code of the City of
Huntington Beach as it relates to multiple users of electronic
reader board signs .
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby ordain as follows :
SECTION 1. That Section 9610 . 9 of the Huntington
Beach Municipal Code is hereby expanded by adding
subsection (e) , which subsection reads as follows :
(e) Reader Board Signs - Multiple Vser.s . Off site electronic
reader board signs may be permitted subject to the approval
of a conditional use permit by the Planning Commission.
Approval of electronic reader board signs shall be subject
to the following :
(1) Findings : Prior to approving a conditional use permit
to allow a multiple user electronic reader board sign,
the Planning Commission shall make the following
findings :
The proposed electronic reader board sign conforms
with the standards and criteria as set forth in the
Huntington Beach Ordinance Code;
The proposed electronic sign will not adversely impact
traffic circulation in adjacent right-of-way or create
a hazard to vehicle or pedestrian traffic. The sign
shall be a minimum distance of 600 feet from
residential areas .
(2) Permitted signs :
Multiple user electronic reader board signs may be
located at a site which is not the location of any of
the parties using the sign for advertising.
Multiple user electronic reader board will be
freestanding .

The maximum sign area shall be twelve hundred (1200)
square feet.
The maximum -height of a multiple user reader board
sign shall be eighty-five (85) feet .
- - The multiple user reader board shall have cylinders or
directional incandescent lamps and have a shade screen
or louver system, a shade screen and a photocell for
reducing the intensity of lighting at night.
(3) Lighting Standards
The maximum night time light intensity and illuminance
shall conform to the following:

The maximum night time illuminance shall be measured
at the receptor site, at ground level, by a direct
reading, portable light meter. Measurements shall not
be made within one hour after sunset or before sunrise.
Illuminance shall be determined by the difference
between a reading taken with the sign on and another
reading taken within three minutes with the sign off .
An illuminance chart shall be prepared by a licensed
engineer and submitted to the Director of Community
Development for approval prior to installation.
Conformance with this ordinance shall be verified by
actual measurements made, as specified herein, after
installation. The method of measurement and results
shall be subject to approval of the Director of
Community Development.

(4) -Location Requirements :
A multiple user reader board shall be located no
farther than two hundred (200) feet from a freeway.
The minimum distance between multiple user reader
boards shall be one thousand . (1, 000) feet.
(5) Other Standards :
_No off site electronic reader board will be permitted
except for multiple users.
At least twenty (20) percent of the message time, or
any percentage deemed necessary by the city for
emergency conditions shall be used for public service
announcements.
Messages in a multiple user sign shall be no faster
than one message every four .(4) seconds and the
minimum interval between messages shall be at least
one second.
Light intensity changes (other than between day and
night uses) are not permitted.
SECTION 2. This ordinance shall take effect thirty
(30) days after its passage.

Code Amendment No. 92-1 is a request by the City of Huntington Beach
Economic Development Department to amend Article 961, Sign Code, to
allow off-premise signs which are designed as multiple user
r6aderboard signs . The provisions will allow placement of an 85
foot high, 1,200 square foot sign within 200. feet of a freeway in
one (1) commercial area of the city. Specific locational, size and
operational criteria are included. The advertising time will be
allocated for public services (20%) and off-site businesses (80%) .
The code amendment will .require a conditional use permit be approved
for any proposed sign. ' In addition, Caltrans must approve and issue
a separate permit for any proposed sign in compliance with the
Outdoor Advertising Act.
Staff is recommending denial of the request because the code
amendment will create provisions that would allow signage that will
be incompatible with existing signage in the community, inconsistent
with other sign provisions of the code, detract and impact the
visual beauty and scenic values of landscaping areas, and diminish
the aesthetic value of the gateway to. Huntington Beach. In
addition, the request proposes a sign for a single interest group.
This may spur other requests for similar type signs along the
freeway to advertise, as an example, the downtown merchants, the
waterfront resort area and the Huntington Beach Mall tenants .

An environmental assessment was- conducted for the proposed code
amendment . It has been determined that the amendment could not have
a significant effect on the environment, therefore, a negative
declaration has been prepared.

5.0 RECOMMENDATION:

Declaration No. 92-17 and deny Code Amendment No. 92-1 with the
following findings :
FINDINGS FOR DENIAL - CODE AMENDMENT NO, 92-1: .
1. The Code Amendment to permit 1,200 square foot, 85 foot high
multiple user electronic readerboard signs will allow signs that
detract and impact the visual beauty and scenic values created by
the freeway and commercial landscaping improvements; and,
therefore, will not be in compliance with the Scenic Highways
Element of the General Plan.

2 . The Code Amendment will allow signs that will not maintain or
enhance the community' s appearance; and therefore, will not be in
compliance with the Open Space and Conservation Element and Land
Use Element of the General Plan.
3 . The Code Amendment will establish sign separation provisions
contrary to the Outdoor Advertising Act.
4 . Since the Huntington Beach Ordinance Code, Article 961 allows
adequate opportunities for advertising through various types of
signage, Code Amendment No. 92-1 to allow multiple user
readerboard signs is not necessary for the preservation and
enjoyment of substantial property rights.
5. Multiple user readerboard signs, if permitted by Code Amendment
No. 92-1, will be incompatible with surrounding existing and
proposed development.
6 . Multiple user readerboard signs visible from streets and highways
would have the potential of slowing traffic and distracting to
j passing motorists.
7. Code Amendment No. 92-1 to permit 85 foot high, 1,200 square foot
signs .would be incompatible with the majority of existing signs
constructed throughout the city since 1986, date of adoption of
Article 961.
8. The code amendment will allow signs that will diminish the
aesthetic values at the gateway to Huntington Beach.
6 . 0 ALTERNATIVE. ACTION:
The Planning Commission may approve Code Amendment No. 92-1 and
forward to the City Council for adoption with findings.

Discussion: The proposed code will allow for the operation of additional electronic signs at specified
areas in the City. These additional electrical signs will contribute to the generation of off site air
emissions associated with power generation facilities. However, the contribution to power usage and the
emissions of additional air pollutants is anticipated to be negligible. No significant adverse impact is
anticipate.

Discussion: The proposed project establishes a procedure for permitting multiple user electronic reader
board signs in limited areas in the City. Potential future sign sites are primarily developed and occupied
by paved surfaces. However, one area is located within a freeway landscaping area and is not currently
overcovered by paved surfaces. Construction of sign structures in this area will increase impervious
surfaces and runoff.
The amount of paving associated with individual sign development is not considered substantial and will be
subject to additional review through the Conditional Use Permit process. No significant adverse impacts are
anticipated.
C. Alterations to the course or flow of flood waters? X
Discussion: One area which meets the locational criteria contained in the proposed code is located within
the floodplain; see attachment #2 for location of subject area. However, structures constructed in the area
will be subject to compliance with Federal Flood Insurance Standards. No significant adverse flood related
impacts are anticipated.

plant or animal resources. One area located in the northern portion of the City between Center Drive and
the 405 freeway, is not occupied by commercial structures. The area is located within a freeway landscape
easement and is occupied by various landscaping plant species including mature trees. However, due to the
level of vehicular traffic and noise in the area it is not anticipated to be used as a habitat by any
sensitive animal species. Development of a sign in this area may require the removal of mature trees .
However, sign development will be subject to Conditional Use Permit approval as well as compliance with
standard conditions of approval requiring maintenance of mature trees if feasible or replacement at a two tc
one ratio. No significant adverse impact is anticipated.

Discussion: The proposed code provisions will restrict multiple user readerboard signs to the area at the
intersection of the I-405 freeway and Center Drive. This area presently has a large amount of ambient night
lighting due to freeway traffic headlights , arterial street lighting, illuminated commercial signage and
commercial lighting in the area.
Due to the intensity of existing light in the area, combined with the limited number of signs .✓,ich could be
constructed in the area (as restricted by minimum sign separation requirements of the proposed :ode)
increases in the ambient lighting of the area is not anticipated to b significant.
Furthermore, the subject area is not located in the vicinity of any light sensitive uses (such zs
residences, schools, hospitals) . Pursuant tothe provisions of the proposed sign code, m(-ltiple user reader
boards must be setback a minimum of 600 feet from any residentially zoned property and light o,,-put from the
sign at such residential property line shall not exceed 0.3 candle (which is the equivale-nt out.:,ut of
residential street lighting at its dimmest point in the City of Huntington Beach) .
8. !-and Use. Will the proposal result in a substantial alteration of the present or planner ' `
land use of an area? — X
Discussion: The proposed code restricts the location of multiple user reader board signs to ccmaiercially
zoned properties located within 200 feet of the freeway and a minimum 600 feet from resident;ai - y zoned
property. Please see Attachment #2 for potential sign sites which comply with the locational c-iteria of
the proposed code.
The proposed signs are commercial signs operated in conjunction with a commercial use operating in the
city. As such, the proposed code amendment is considered to be consistent with the existing or planned land
uses at the sites which meet the proposed locational requirements.
9. Natural Resources. Will the proposal result in:
a. Increase in the rate of use of any natural resources? _ _ X
Discussion: The proposed code will allow for operation of additional electronic reader board signs in
limited areas in the city. The additional electric signs will increase the use of electrical power
resources in the City. However, electrical use generated by the sign is anticipated to be negligible and
will not require the creation of any new resources or facilities. The proposed code will not effect any
other non-renewable resource. No significant adverse impact is anticipated.

traffic circulation or create a hazard to vehicle or pedestrian traffic. Therefore, subsequent signs are
not anticipated to have a significant impact on traffic circulation in the area.

DRAFT CODE AMENDMENT NO. 92-1
MULTIPLE USER READER BOARD SIGNS
The City of Huntington Beach Economic Development Department is requesting to amend Article 9161 , "Signs," of the
Huntington Beach Ordinance Code to establish provisions for permitting multiple user reader bard signs.
The Cade Amendment proposes to allow for multiple user freestanding reader board signs with a maximum sign area
of 1 ,200 square feet and a maximum height of 85 feet. The signs will be limited to commercially zoned property
located within 200 feet of the freeway and a minimum of 600 feet from any residential zoned property. Signs must
also maintain a minimum setback of 250 feet from any other multiple user reader board sign. The cc—ne amendment
establishes a maximum allowable light output of 50 candles at 50 feet as well as a maximum output c .3 candles
at a residential property line. Hours of operation are limited to 5:00 a.m. through 12:00 midniyh.: .
The proposed amendment allows for these signs subject to Design Review Board review and Conditiona: Use Permit
approval . Specific sign development will also be subject to environmental review pursuant to the c-avisicns o s
California Environmental Quality Act. In addition, since the signs are located adjacent to the fry✓ay, they
will be subject to Caltrans review and approval pursuant to Section 5405 of the Business and Professions Code.
(Note: The City has obtained an outdoor advertising permit for 1992; the permit is subject do annual renewal by

AMENDING CHAPTER 9610 .4 OF THE
HUNTINGTON BEACH ORDINANCE CODE PERTAINING
TO BILLBOARDS AND ADVERTISING STRUCTURES.
WHEREAS, the City Council wishes to clarify and update the
definition and composition of the Ordinance Code of the City of
Huntington Beach as it relates to billboards and advertising
structures, and more specifically, multiple users of electronic
reader board signs .
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby ordain as follows :
SECTION 1. That Section 9610 .4 of the Huntington
Beach Municipal Code is hereby amended to read as follows :
9610 .4 Prohibited signs .
(k) Billboards or advertising structures, including any
off-site signs installed for the purpose of
advertising. a project, subject or business unrelated
to the premises upon which the sign is located, except
subdivision directional signs. pursuant to section
9610 . 9(c) , and multiple user reader board signs
pursuant to Section 9610 . 9(e) .
SECTION 2 . This ordinance shall take effect thirty
(30) d-ays after its passage.

(2) Permitted signs:
Multiple use electronic reader board signs may be
located at a site which is not the location of any of
the parties using the sign for advertising .
Multiple user electronic reader board will be
freestanding.

The maximum sign area shall be twelve hundred (1200)
square feet.
The maximum height of a multiple user reader board
sign shall be eighty-five (85) feet.
The multiple user reader board shall have cylinders or
directional incandescent lamps and have a shade screen
or louver system, a shade screen and a photocell for
reducing the intensity of lighting at night .
(3) Lighting Standards
The maximum night time light intensity and illuminance
shall conform to the following:

The maximum night time illuminance shall be measured
at the receptor site, at ground level, by a direct
reading, portable light meter . Measurements shall not
be made within one hour after sunset or before sunrise.
Illuminance shall be determined by the difference
between a reading taken with the sign on and another
reading taken within three minutes with the sign off.
An illuminance chart shall be prepared by a licensed
engineer and submitted to the Director of Community
Development for approval prior to installation.
Conformance with this ordinance shall be verified by i
actual measurements made, as specified herein, after
installation. The method of measurement and results
shall be subject to approval of the Director of
Community Development.

farther than two hundred (200) feet from a freeway.
The minimum distance between multiple user reader

Regarding 85 Ft. Electronic Reader Board Sign

I understand the Redevelopment Agency is involved in the "Reader
Board" City Code amendment. As a Huntington Beach resident of ]cam �►
years, I oppose this amendment for the following reasons:
The new and used car business owners have requested the Planning
Commission and City Council to amend a City Code that will allow
the installation of an 85 ft. electronic "Reader Board" sign to
be installed on the 405 freeway near Beach Boulevard in
Huntington Beach.
1) This 85 ft. electronic "Reader Board" sign will benefit no
one but the owners of the new and used car companies strung
out along Beach Boulevard. They could not care less about
the repercussions this sign would create to our beautiful
city as long as it increases their business.
2) You say it will bring in the extra revenue we so badly need
in these crucial times. Yes, it will do that for a short
time. But these hard times will pass. This would be just a
band aid, a quick fix. We won't always be in a financial
bind. And when we are back to good times, we will still be
stuck for 30 years with the ugly towering monstrosity that
will mar our beautiful Huntington Beach city. It will be
the biggest eye sore, a monster, a beacon seen for miles and
miles. It will loom out like a giant in the middle of the
street, devouring you as you drive Beach Boulevard to the
freeway.
3) And how could the Planning Commission dare deny any business
owner a permit for another 85 ft. sign, and another, and
another, etc. , until we are so lined up with 85 ft. signs
that Huntington Beach looks like a cheap and sleazy Las
Vegas.
To deny a permit to another for such a sign would be a
scream for "discrimination" and that screaming
discrimination will be heard all the way to the courts.
Huntington Beach could end up paying multi-millions of
dollars in settlement fees.

4) Consider too the major traffic accidents that this sign
would create as motorists slow down to read the electronic
"Reader Board" sign.
5) How could anyone even consider an important issue such as
this, being published in the Independent newspaper with a
circulation of 51, 000 when Huntington Beach has a population
of 200, 000.
I request advertising to be in major newspapers such as the
orange County Register, Los Angeles Times, as well as the
Independent, and that such be placed in display pages of the
newspapers and not buried under legal. It should not be
shoved under the table. I request all neighboring cities
such as. Fountain Valley, Newport Beach, Costa Mesa,
Westminster, and Seal Beach be informed also. I believe
every resident of Huntington Beach be informed and aware of
this amendment and suggest bulk mail notices be sent to
every resident. I would be willing to pay my fair share for
that.
6) In regard to the .backlash of this sign, property values
would depreciate. They literally would plummet, for who
would want to live in a town with scores of towering
electronic signs, jutting up over buildings, along our
streets giving a .look of cheap and sleazy .Las Vegas. Should
that happen, will the automobile owners still be willing to
stick around and pay the city their taxes when the city has
lost their affluent residents?
We are no longer the sleepy little ramshackle town we once were.
We are an up and coming beauty, the renovation of Old Town
Huntington Beach, the expensive beautiful new homes, our new
majestic pier, our constant upgrade of our existing homes--all
that shows the pride of ownership in a city in which people from
all over would love to live.
The car companies are not the only ones in financial troubles.
Everyone is--i.e. , the builders, plumbers, electricians,
carpenters, appliance manufacturers, carpet people, etc. , etc. ;
these people would also have a legitimate reason for 85 ft. signs
to help stimulate their business.
Our reputation is abounding. We are as much sought after and as
desirable as Newport Beach on a smaller scale.
I urge you, my city officials, please! please! deny this permit
for the 85 ft. sign.

Do not let the glitter of a few shining coins blind you and
overshadow your thinking. Look ahead ten years down the road.
Look closely at the repercussion that can occur. It would take
years to repair, if ever.

Dear Ms . Osugi:
Thank you for the opportunity to review and comment on the
Negative Declaration Amendment to Article 961 "Signs " of the
Huntington Beach Ordinance Code . This project proposes to
establish provisions for permitting multiple user reader board
signs in the City. Caltrans has the following continents for your
consideration.
Caltrans does not agree with the Negative Declaration, there
are major conflicts with regulatory functions and these functions
need to be addressed in the Negative Declaration. Specifically;
there should be a discussion that pertains to standards such as,
legal distance for signs to be placed in or near State Right of
Way and the hours of operation of those signs .
In addition, Caltrans is concerned about the potential
impacts the project may have on the San Diego Freeway ( I-405) and
with maintaining standards for signage. Our concern is that this
project has major conflicts with the State of California
Advertising Act especially attachment #1 regarding the signs
being located within 200 feet of the freeway, and the hours of
operation. Therefore, a copy of this document has been forwarded
to the State of California Outdoor Advertising Department for
their review.
Attachment 2B, indicates potential sign sites , and shows an
area approximataely 90% of which is within State Right-of- Way.
Any time a project crosses over under or in any way infringes on
State Right-of -Way an Encroachment Permit is required. Caltrans
will be a responsible agency at various times over the
development phase of this project.

The Traffic Operations Branch at Caltrans must review each
sign and sign location that is scheduled for development,
especially at the I-405 at Beach Boulevard and Center Avenue
int.erchange. That is a complex and congested interchange with
many regulatory, warning and guide signs already in place .
Therefore, for public health and safety purposes the Traffic
Operations Branch will not condone any sign visible from the
freeway which may distract the motorist.
Any changeable message signs within 500 feet of the freeway
right-of-way must have an "Outdoor Advertising permit" per the
California Administrative Code Title 4 chapter 6 . For further
information on this contact Stan Lancaster at ( 916 ) 654-2848 .
We appreciate the opportunity to comment on this document
and wish to contunue close coordination with the City on this
project. If you have any questions concerning these comments

DRAFT CODE AMENDMENT NO. 92-1
MULTIPLE USER READER BOARD SIGNS
The City of Huntington Beach Economic Development Department is requesting to amend Article 961, "Signs," of the
Huntington Beach Ordinance Code to establish provisions for permitting multiple user reader board signs.
The Code Amendment proposes to allow for multiple user freestanding reader board signs with a maximum sign area
of 1,200 square feet and a maximum height of 85 feet. The signs will be limited to commercially zoned property
located within 200 feet of the freeway and a minimum of 600 feet from any residential zoned property. Signs must
also maintain a minimum setback of 250 feet from any other multiple user reader board sign. The code amendment
establishes a maximum allowable light output of 50 candles at 50 feet as well as a maximum output of .3 candles
at a residential property line. Hours of operation are limited to 5:00 a.m. through 12:00 midnight.
The proposed amendment allows for these signs subject to Design Review Board review and Conditional Use Permit
approval . Specific sign development will also be subject to environmental review pursuant to the provisions of
California Environmental Quality Act. In addition, since the signs are located adjacent to the freeway, they
will be subject to Caltrans review and approval pursuant to Section 5405 of the Business and Professions Code.
(Note: The City has obtained an outdoor advertising permit for 1992; the permit is subject to annual renewal by
Caltrans.)

4) Consider too the major traffic accidents that this sign
would create as motorists slow down to read the electronic
"Reader Board" sign.
5) How could anyone even consider an important issue such as
. this, being published in the Independent newspaper with a
circulation of 51,OOO when Huntington Beach has a population
of 200, 000.
I request advertising to be in major newspapers such as the
orange County Register, Los Angeles Times, as well as the
Independent, and that such be placed in display pages of the
newspapers and not buried under legal. It should not be
shoved under the table. I request all neighboring. cities
such as Fountain Valley, Newport Beach, Costa Mesa,
Westminster, and Seal Beach be informed also. I believe
every resident of Huntington .Beach be informed and aware of
this amendment and suggest bulk mail notices be sent to
every resident. I would be willing to pay my fair share for
that.
6) In regard to the .backlash of this sign, property values
would depreciate. They literally would plummet, for who
would want to live in a town with scores of towering
electronic signs, jutting up over buildings, along our
streets giving a look of cheap and sleazy Las Vegas. Should
that happen, will the automobile owners still be willing- to
stick around and pay the city their taxes when the city has
lost their affluent residents?
We are no longer the sleepy little ramshackle town we once were.
We are an up and coming beauty, the renovation of Old Town
Huntington Beach, the expensive beautiful new homes, our new
majestic pier, our constant upgrade of our existing homes--all
that shows the pride of ownership- in a city in which people from
all over would love to live.
The car companies are not the only ones in financial troubles.
Everyone is--i.e. , the builders, plumbers, electricians,
carpenters, appliance manufacturers, carpet people, etc. , etc. ;
these people would also have a legitimate reason for 85 ft. signs
to help stimulate their business.
Our reputation is abounding. We are as much sought after and as
desirable as Newport Beach on a smaller scale.
I urge you, my city officials, please! please! deny this permit
for the 85 ft. sign.

I understand the Redevelopment Agency is involved in the "Reade
Board" City Code amendment. As a Huntington Beach resident of J9LT
years, I oppose this amendment for the following reasons: c—
The new and used car business owners have requested the Planning
Commission and City Council to amend a City Code that will allow .
the installation of an 85 ft. electronic "Reader Board" sign to
be installed on the 405 freeway near Beach Boulevard in
Huntington Beach.
1) This 85 ft. electronic "Reader Board" sign will benefit no
one but the owners of the new and used car companies strung
out along Beach Boulevard. They could not care less about
the repercussions this sign would create to our beautiful
city as long as it increases their business.
2) You say it will bring in the extra revenue we so badly need
in these crucial times. Yes, it will do that for a short
time. But these hard times will pass. This would be just a
band aid, a quick fix. We won't always be in a financial
bind. And when we are back to good times, we will still be
stuck for 30 years with the ugly towering monstrosity that
will mar our beautiful Huntington Beach city. It will be
the biggest eye sore, a monster, a beacon seen for miles and
miles. It will loom out like a giant in the middle of the
street, devouring you as you drive Beach Boulevard to the
freeway.
3) And how could the Planning Commission dare deny any business
owner a permit for another 85 ft. sign, and another, and
another, etc. , until we are so lined up with 85 ft. signs
that Huntington Beach looks like a cheap and sleazy Las
Vegas.
To deny a permit to another for such a sign would be a
scream for "discrimination" and that screaming
discrimination will be heard all the way to the courts.
Huntington Beach could end up paying multi-millions of
dollars in settlement fees.

Do not let the glitter of a few shining coins blind you and
overshadow your thinking. Look ahead ten years down the road.
Look closely at the repercussion that can occur. It would take
years to repair, if ever.
