Condition No. 5 of Conditional Use Permit No. 91-30 and Conditional Exception No. 91-44 requires that a six (6) month review be conducted to verify compliance with all conditions of approval and, "if, at that time, there is a violation of these conditions of code sections, Conditional Use Permit -No. 91-30 (.Revised) and Conditional Exception No. 91-44 may become null and. void. " After review of the conditions., the City Council finds that the following conditions have not been complied with: A. Condition No . 1 - A parking lot security guard shall be on duty during all dancing events to monitor parking, trash and noise. Staff visits on March 13, May 10 and June -20, 1992 and on March 10 and March 31, 1993 to the subject restaurant revealed that no. parking lot security guard had been on duty monitoring the parking area while dancing and live entertainment activities were taking placed. B. Condition No. 2 - Stated that hours of dancing and live entertainment shall be: Sunday - Thursday 9 : 00 PM. - 12 : 00 AM Friday - Saturday 9 : 00 PM - 1:30 PM Phone conversations with the restaurant staff and the planning staff revealed that dancing and live entertainments takes place until 1: 00 AM on Thursday evenings one (1) hour later than the condition' s permit . In addition, a staff visit to the subject site on March 10, 1993 revealed live entertainment commencing at 8 :30 PM, one-half hour prior to the permitted hours . 2 . The applicant has failed to comply with Condition No . 1 and Condition No. 2 of Conditional Use Permit No. 91-30 and Conditional Exception No . 91-44 which has resulted in adverse impacts to nearby residential properties including . noise, police calls and loitering in the parking lot . " ANALYSIS• On April 6, 1993 , the City Council revoked Conditional Use Permit No. 91-30/Conditional Exception (Variance) No. 91-44 for dancing and live entertainment at Sakura Japanese Restaurant due to findings that Sakura management failed to comply with conditions of approval set forth in the above entitlements . At the April 6, 1993 meeting, the City Council requested that staff return with findings for revocation on April 19, 1993 . The findings that the Planning Commission utilized in their revocation action of July 7, 1992 have been included as an attachment to this report. Environmental Status : The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. D Plo 5/85 FUNDING SOURCE: Not applicable. Sakura filed an appeal to the Planning Commission' s action on July 20, 1992 . _ The appeal came before the City Council on October 5, 1992 . The Council suspended the revocation proceedings for six (6) months and requested that the project return for deliberation on April 5, 1993. RECOMMENDATION: Motion to: "Continue the appeal of the Planning Commission' s decision to revoke Conditional Use Permit No. 91-30/Conditional Exception 91-44 for a sixty (60) day period" . ANALYSIS: On April 7, 1992, the Planning Commission conducted a six ( 6) month review of Conditional Use Permit No . 91-30 and Conditional Exception (Variance) No . 91-44 to permit dancing and live entertainment at Sakura Japanese Restaurant . At that meeting the Planning Commission voted to have the item scheduled for a revocation hearing on May 19 , 1992 because the applicant had failed to comply with hours of operation as well as to provide a security guard in the parking %1• lot . The permit for live entertainment and dancing was revoked by the Planning Commission on July 7, 1992 . The following matrix depicts the history of the site and the public hearings regarding live entertainment and dancing since the project was approved in September of 1991 . PI O 5/85 Site History: Date Action 9-4-91 Conditional Use Permit 91-30 approved by Planning Commission for live entertainment without dancing and including a six (6) month review. 10-8-91 Conditional Use Permit 91-30 (Revised) and Conditional Exception (Variance) 91-44 approved by Planning Commission to add dancing and grant a three (3) space parking reduction. 4-7-92 Planning Commission disapproves 6 month review due to non-compliance with conditions of approval by failing to provide a parking lot security guard and allowing live entertainment later than the permitted hours . Planning Commission schedules revocation hearing within 45 days . 5-19-92 Staff recommends that the Planning Commission allow Sakura to continue operating due to the limited number of times live entertainment and dancing were provided. Planning Commission continues revocation hearing for one month with the added condition that the security guard remain on duty until one hour past closing. 7-7-92 Planning Commission revokes Conditional Use Permit 91-30 and Conditional Exception (Variance) 91-44 after applicant fails to provide security guard during live entertainment and an altercation breaks out in the parking lot during a staff inspection at the site. 7-21-92 Applicant appeals Planning Commission revocation action to City Council claiming they do indeed provide security during live entertainment, live entertainment ceases at the prescribed hour, and that ' the majority of police calls and noise complaints were due to disturbances at the adjacent restaurant, Crazy Burro . 10-5-92 City Council holds revocation hearing and continues action of the item for an additional six (6) month review to further monitor the live entertainment and dancing permit . As stated in the above analysis, Sakura Japanese Restaurant has a chronic history of non-compliance with the conditions of approval regarding live entertainment and dancing . Planning staff has maintained and the Planning Commission has upheld that the provision of a uniformed security officer in the parking lot during hours of operation is imperative to reduce the potential noise and disturbance of peace impacts to the nearby residents of the RCA 4/5/93 -2- ( 6275d) Seabridge Specific Plan. The applicant has repeatedly failed to comply with this condition of approval. On Wednesday, March 10, 1993, at approximately 8 :30 p.m. , a Code Enforcement officer conducted an inspection at Sakura Japanese Restaurant that revealed non-compliance with two (2) conditions of approval . Sakura again violated the terms of Conditional Use Permit 91-30 by failing to provide a security guard in the parking lot while live entertainment was taking place. Sakura also violated the Conditional Use Permit by allowing the live entertainment to take place prior to the 9 : 00 p.m. starting time. The Police Department has logged two calls to the subject site since October 5, 1992 . Both calls were regarding an audible burglar alarm. Staff does not have information of whether or not Sakura had live entertainment at that time and therefore staff does not know whether or not a security officer would have been required at the time and could have prevented the disturbance (see Attachment No . 3) . Code Enforcement has not received any complaints at the subject site in the previous six (6) months . Code Enforcement has issued a Notice of Violation to the applicant for the March 10, 1993 violation. Staff recommends that the City Council continue action for sixty (60) days so that the applicant can comply with the Notice of Violation. If approved by the City Council, staff will continue to monitor the live entertainment and dancing and will report back to the Council after the two (2) month period. CITY OF HUNTINGTON 13EACH INTER-DEPARTMENT COMMUNICATION HUNTINGTON BEACH TO: Jane Madera Assistant Planner FROM: Margaret Riley Environmental Officer SUBJECT: SIX (6) MONTH REVIEW TO CONDITIONAL USE PERMIT NO. 91-30 _ (SAKURA RESTAURANT) DATE: March 18, 1993 On Wednesday, March 10, 1993 , at approximately 8 :30 p.m. , I conducted an inspection at 8052 Adams Avenue (Sakura Restaurant) to verify compliance to Conditional Use Permit No. 91-30 . I observed that Sakura was violating the two conditions stated in Conditional Use Permit No. 91-30 by failing to provide a security guard in the parking lot while live entertainment (Professional Karoke Performer) was taking place. This is a violation of Condition #1. Sakura also violated the Conditional Use Permit by allowing the live entertainment to take place before 9 : 00 p.m. This is a violation of Condition No . 2 . Other visits on April 11 ( 12 : 30 AM) , April 15 (11 : 30 PM - 12 : 00 AM) and April 18 (10 : 00 PM) revealed that there was no dancing or live entertainment at Sakura Japanese Restaurant , therefore, a security guard was not required in the parking lot . P TMCA W,t4T �A D �} Plo 5/85 On May 22, 1992 a revocation hearing was held in which the Planning Commission continued the action and advised staff to monitor the situation through the month of June and present their findings at the July 7, 1992 Planning Commission meeting . On June 20, 1992, at approximately 12: 00 AM, Code Enforcement conducted an inspection of the parking lot area . At approximately 12 : 30 AM a group of male and female Sakura patrons left the restaurant and began fighting near a row of vehicles in the parking lot. The uniformed security guard from the Crazy Burro as well as the owner of the Crazy Burro, LeRoy Stone responded to the disturbance and ordered the patrons on numerous occasions to leave the property. After ten minutes of creating the disturbance, the -patrons left . It should be noted that it is Condition No. 5 of Conditional Use Permit No. 91-30 and Conditional Exception No . 91-44 -which requires that a six ( 6) month review be conducted to verify compliance with all conditions of approval and, "if, at that time, there is a violation of these conditions or code sections , Conditional Use Permit No . 91-30 (Revised) and Conditional Exception No . 91-44 may become null and void. " On July 7, 1992 , the Planning Commission revoked Sakura ' s dancing and live entertainment variance based on non-compliance to the following conditions : A. Condition No . 1 - A parking lot security guard shall be on duty during all dancing events to monitor parking , trash and noise. Staffs visits on Friday, March 13 , Sunday, May 10 , and Saturday, June 20, 1992 to the subject restaurant revealed that no parking lot security guard had been on duty while dancing and live entertainment were taking place . B. Condition No . 2 - Stated that the hours of dancing and live entertainment shall be: Sunday - Thursday 9 : 00 PM - 12 : OO AM Friday - Saturday 9 : 00 PM 1 : 30 PM Phone conversations with Sakura restaurant staff and City planning staff revealed that dancing and live entertainment takes place until 1 : 00 AM on Thursday evenings one ( 1) hour later than the condition ' s permit . In summary, the applicant had failed to comply with Condition No . 1 and 2 of Conditional Use Permit No . 91-30 and Conditional Exception No . 91-44 which has resulted in adverse impacts to nearby residential properties including noise, police calls and loitering in the parking lot . On July 28 , 1992 , Code Enforcement received a citizen ' s complaint that Sakura failed to comply with their dancing and live entertainment variance by having a live band perform at the restaurant on July 25 , 1992 without providing a parking lot security guard . RCA 10/5/92 -2- (4493d) 1 . On August 1, 1992, at approximately 10 : 30 PM, Code Enforcement went to the Sakura Restaurant located at 8052 Adams in response to the citizen' s complaint dated July 28, 1992, and did not observe any dancing or live entertainment taking place. On August 4 , 1992, Code Enforcement had received a citizen' s complaint that Sakura patrons had created a large disturbance in the parking lot area at approximately 12 : 00 PM while waiting for a live performance to take place at 6 : 00 PM. It should be noted that police records confirm that on July 31, 1992, patrol officers went to - 8052 Adams in response to "disturbing the peace" complaints . When officers arrived at the subject location they observed approximately fifty (50) Sakura patrons congregating in the parking lot area while awaiting entry into. Sakura Restaurant for a live performance. Officers later confirmed with Sakura management that a live entertainment event had been planned which would attract approximately 200 customers into the restaurant . The officers advised Sakura management that the event would have to be cancelled because proper permits (i . e . entertainment permit) were never obtained— Sakura complied with the request by cancelling the event and the customers left the property in an orderly manner . On August 19 , 1992, Code Enforcement received a citizen' s complaint regarding live entertainment which took place at Sakura without security present in the parking lot on August 14 , 1992 and August 16, 1992 respectively. An alternative action has been included which would allow for Sakura restaurant to continue its live entertainment for six months . At the end of that time period, a re-evaluation of the use would occur . FUNDING SOURCE: Not applicable . Planning Commission continues revocation hearing for one month with the added condition that the security guard remain on duty until one hour past closing. 7-7-92 Planning Commission revokes Conditional Use Permit 91-30 and Conditional Exception (Variance) 91-44 after applicant fails to provide security guard during live entertainment and an altercation breaks out in the parking lot during a staff inspection at the site. 7-21-92 Applicant appeals Planning Commission revocation action to City Council claiming they do indeed provide security during live entertainment, live entertainment ceases at the prescribed hour, and that the majority of police calls and noise complaints were due to disturbances at the adjacent restaurant, Crazy Burro. 10-5-92 City Council holds revocation hearing. and continues action of the item for an additional six (6) month review to further monitor the live entertainment and dancing permit . As stated in the above analysis, Sakura Japanese Restaurant has a chronic history of non-.compliance with the conditions of approval regarding live entertainment and dancing. Planning staff has maintained and the Planning Commission has upheld that the provision of a uniformed security officer in the parking lot during hours of operation is imperative to reduce the potential noise and disturbance of peace impacts to the nearby residents of the RCA 4/5/93 -2- (6275d) Seabridge Specific Plan. The applicant has repeatedly failed to comply with this condition of approval. On Wednesday, March 10, 1993, at approximately 8 :30 p.m. , a Code Enforcement officer conducted an inspection at Sakura Japanese Restaurant that revealed non-compliance with two (2) conditions of approval . Sakura again violated the terms of Conditional Use Permit 91-30 by failing to provide a security guard in the parking lot while live entertainment was taking place. Sakura also violated the Conditional Use Permit by allowing the live entertainment to take place prior to the 9 :00 p.m. starting time. The Police Department has logged two calls to the subject site since October 5, 1992 . Both calls were regarding an audible burglar alarm. Staff does not have information of whether or not Sakura had live entertainment at that time and therefore staff does not know whether or not a security officer would have been required at the time and could have prevented the disturbance (see Attachment No. 3) . Code Enforcement has not received any complaints at the subject site in the previous six (6) months . Code Enforcement has issued a Notice of Violation to the applicant for the March 10, 1993 violation. Staff recommends that the City Council continue action for sixty (60) days so that the applicant can comply with the Notice of Violation. If approved by the City Council, staff will continue to monitor the live entertainment and dancing and will report back to the Council after the two (2) month period. Environmental Status : The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. FUNDING SOURCE: Not Applicable. RECOMMENDATION: Motion to : "Uphold the Planning Commission ' s decision to revoke Conditional Use Permit No . 91-30/Conditional Exception 91-44" . ANALYSIS. On April 7, 1992, the Planning Commission conducted a six (6) month review of Conditional Use Permit No . 91-30 and Conditional Exception (Variance) No . 91-44 to permit dancing and live entertainment at Sakura Japanese Restaurant . At that meeting the Planning Commission voted to have the item scheduled for a revocation hearing on May 19 , 1992 because the applicant had failed to comply with hours of operation as well as to provide a security guard in the parking lot . On May 10, 1992, at approximately 12 : 00 - 12 : 30 AM a staff visit to the site revealed that there was dancing and live entertainment ' being provided, however, no uniformed security guard was in the parking lot . Other visits on April 11 (12 : 30 AM) , April 15 (11 :30 PM - 12 : 00 AM) and April 18 (10 : 00 PM) revealed that there was no dancing or live entertainment at Sakura Japanese Restaurant, therefore, a security guard was not required in the parking lot . AcTvmA W NT i� D. 44 PI0 5/85 On May 22, 1992 a revocation hearing was held in which the Planning Commission continued the action .and advised staff to monitor the situation through the month of June and. present their findings at the July 7, 1992 Planning Commission meeting . On June 20 , 1992, at approximately 12 : 00 AM, Code Enforcement conducted an inspection of the parking lot area . At approximately. 12 : 30 AM a group of male and female Sakura patrons left the restaurant and began fighting near a row of vehicles in the parking lot . The uniformed security guard from the Crazy Burro as well as the owner of the Crazy Burro, LeRoy Stone responded to the disturbance and ordered the patrons on numerous occasions to leave the property. After ten minutes of creating the disturbance, the patrons left . It should be noted that it is Condition No . 5 of Conditional Use Permit No . 91-30 and Conditional Exception No . 91-44 which requires that a six (6) month review be conducted to verify compliance with all conditions of approval and, "if, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No . 91-30 (Revised) and Conditional Exception No . 91-44 may become null and void. " On July 7, 1992, the Planning Commission revoked Sakura ' s dancing and live entertainment variance based on non-compliance to the following conditions : A. Condition No . 1 - A parking lot security guard shall be on duty during all dancing events to monitor parking, trash and noise. Staffs visits on Friday, March 13 , Sunday, May 10, and Saturday, June 20 , 1992 to the subject restaurant revealed that no parking lot security guard had been on duty while dancing and live entertainment were taking place. B. Condition No . 2 - Stated that the hours of dancing and live entertainment shall be: Sunday - Thursday 9 : 00 PM - 12 : 00 AM Friday - Saturday 9 : 00 PM - 1: 30 PM Phone conversations with Sakura restaurant staff and City planning staff revealed that dancing and live entertainment takes place until 1 : 00 AM. on Thursday evenings one (1) hour later than the condition' s permit . In summary, the applicant had failed to comply with Condition No . 1 and 2 of Conditional Use Permit No . 91-30 and Conditional Exception No . 91-44 which . has resulted in adverse impacts to nearby residential properties including noise, police calls and loitering in the parking lot.. On July 28, 1992, Code Enforcement received a citizen' s complaint that Sakura failed to comply with their dancing and live entertainment variance by having a live band perform at the restaurant on July 25 , 1992 without providing a parking lot security guard. RCA 10/5/92 -2- (4493d) 1 On August 1, 1992, at approximately 10 :30 PM, Code Enforcement went to the Sakura Restaurant located at 8052 Adams in response to the citizen' s complaint dated July 28, 1992, and did not observe any dancing or live entertainment taking place. On August 4 , 1992, Code Enforcement had received a citizen' s complaint that Sakura patrons had created a large disturbance in the parking lot area at approximately 12 : 00 PM while waiting for a live performance to take place at 6 : 00 PM. It should be noted that police records confirm that on July 31, 1992, patrol officers went to 8052 Adams in response to "disturbing the peace" complaints . When officers arrived at the subject location they observed approximately fifty (50) Sakura patrons congregating in the parking lot area while awaiting entry . into Sakura Restaurant for a live performance . Officers later confirmed with Sakura management that a live entertainment event had been planned which would attract approximately 200 customers into the restaurant . The officers advised Sakura management that the event would have to be cancelled because proper permits (i . e. entertainment permit) were never obtained. Sakura complied with the request by cancelling the event and the customers left the property in an orderly manner. On August 19 , 1992, Code Enforcement received a citizen' s complaint regarding live entertainment which took place at Sakura without security present in the parking lot on August 14 , 1992 and August 16, 1992 respectively. An alternative action has been included which- would allow for Sakura restaurant to continue its live entertainment for six months . At the end of that time period, a re-evaluation of the use would occur . FUNDING SOURCE: Not applicable. Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE• On July 7, 1992, the Planning Commission revoked the Sakura Restaurant dancing and live entertainment Conditional Use Permit/Conditional Exception due. to staff ' s findings that Sakura management had failed to comply with certain conditions set forth in Conditional Use Permit No. 91-30/Conditional Exception 91-44 . Sakura filed an appeal to the Planning Commission's action on July 20, 1992. RECOMMENDATION: Motion to: "Uphold the Planning Commission's decision to revoke Conditional Use Permit No, 91-30/Conditional Exception 91-44" . ANALYSIS• On April 7, .1992, the Planning Commission conducted a six (6) month review of Conditional Use Permit No. 91-30 and Conditional Exception (Variance) No. 91-44 to permit dancing and live entertainment at Sakura Japanese Restaurant. At that meeting the Planning Commission voted to have the item scheduled for a revocation hearing on May 19, 1992 because the applicant had failed to comply with hours of operation as well as to provide a security guard in the parking lot. On May 10, 1992, at approximately 12:00 - 12:30 AM a staff visit to the site revealed that there was dancing and live entertainment being provided, however, no uniformed security guard was in the parking lot. Other visits on April 11 (12:30 AM) , April 15 (11:30 PM - 12: 00 AM) and April 18 (10 :00 PM) revealed that there was no dancing or live entertainment at Sakura Japanese Restaurant, therefore, a security guard was not required in the parking lot. PIO 5/85 On May 22, 1992 a revocation hearing was held in which the Planning Commission continued the action and advised staff to monitor the situation through the month of June and present their findings at the July 7, 1992 Planning Commission meeting. On June 20, 1992, at approximately 12 : 00 AM, Code Enforcement conducted an inspection of the 'parking ' lot area. At approximately 12 :30 AM a group of male and female Sakura patrons left the restaurant and began fighting near a row of vehicles in the parking lot. The uniformed security guard from the Crazy Burro as well as the owner of the Crazy Burro, LeRoy Stone responded to the disturbance and ordered the patrons on numerous occasions to leave the property. After ten minutes of creating the .disturbance, the patrons left. It should be noted that it is Condition No. 5 of Conditional Use Permit No. 91-30 and Conditional Exception No. 91-44 which requires that a six (6) month review be conducted to verify compliance with all conditions of approval and, "if, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No. 91-30 (Revised) and Conditional Exception No. 91-44 may become null and void. " On July 7, 1992, the Planning Commission revoked Sakura ' s dancing and live entertainment variance based on non-compliance to the following conditions: A. Condition No. 1 - A parking lot security guard shall be on duty during all dancing events. to monitor parking, trash and noise. Staffs visits on Friday, March 13, Sunday, May 10,, and Saturday, June 20, 1992 to the subject restaurant revealed that no parking lot security guard had been on duty while dancing and live entertainment were taking place. B. Condition No. 2 - Stated that the hours of dancing and live entertainment shall be: Sunday - Thursday 9 : 00 PM - 12 : 00 AM Friday - Saturday 9 :00 PM - 1:30 PM Phone conversations with Sakura restaurant staff and City planning staff revealed that dancing and live entertainment takes place until 1: 00 AM on Thursday evenings one (1) hour later than the condition' s permit. In summary, the applicant had failed to comply with Condition No. 1 and 2 of Conditional Use Permit No. 91-30 and Conditional Exception No. 91-44 which has resulted in adverse impacts to nearby residential properties including noise, police calls and loitering in the parking lot. On July 28, 1992, Code . Enforcement received a citizen' s complaint that Sakura failed to comply with their dancing and live entertainment variance by having a live band perform at the restaurant on July 25, 1992 without providing a parking lot security guard. RCA 10/5/92 -2- (4493d) On August 1, 1992, at approximately 10 :30. PM, Code Enforcement went to the Sakura Restaurant located at 8052 Adams in response to the citizen' s complaint dated July 28, 1992, and did not observe . any dancing or live entertainment taking place. .On August 4, 1992, Code Enforcement had received a citizen' s complaint that Sakura patrons had created a large disturbance in the parking lot area at approximately 12 : 60 PM while waiting fo r a live performance to take place at 6: 00 PM. It should be noted that police records confirm that on July 31, 1992, patrol officers went to 8052 Adams. in response to "disturbing the peace" compla.ints . . When officers arrived at the subject location they observed approximately fifty (50) Sakura patrons congregating in the parking lot area while awaiting entry into .Sakura Restaurant for a live performance. Officers later confirmed with Sakura management that a . live entertainment event had been planned which would attract approximately 200 customers into the restaurant. The officers advised Sakura management that the event would have to be cancelled because proper permits (i .e. entertainment permit) were never obtained. Sakura complied with the request by cancelling the event and the customers left the property in an .orderly manner. On August 19, 1992, Code Enforcement received a citizen' s complaint regarding live entertainment which took place at Sakura without security present in the parking lot on August 14, 1992 and August 16, 1992 respectively. . An alternative action has been included which would allow for Sakura restaurant to continue its live entertainment for six months . At the end of that time period, a re-evaluation of the use would occur. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: Motion to: "Suspend the revocation for six months and schedule a six month ' review to determine compliance with Conditional Use Permit No. 91-30/Conditional Exception (Variance) No. 91-44 . For the remaining 30 minutes after contacting Ms . Lin, Code Enforcement never observed the Sakura security guard station himself outside . S atus of Compliance - There is no parking security guard on-duty .,. during dancing or live entertainment . Condition No . 2 - The hours for dancing and live entertainment were approved as follows : Sunday - Thursday 9 : 00 PM - 12 : 00 AM Friday - Saturday 9 : 00 PM - 1 : 30 PM Status of Compliance - General phone inquiries by staff revealed the hours. for dancing and live entertainment on Thursdays are 9 : 00 PM to 1 : 00 AM which is one hour later than the conditions of approval t permit . Other Information In addition to the applicant ' s failure to comply with the conditions of approval , there have been 14 police responses ranging from bar checks to disturbing the peace and vehicle burglary. A bar check is simply a police check of the bar and does not necessarily indicate a call or complaint . Attachment No . 5 provides . a list of the incidents , the type and the date on which they occurred . It -is important to note that some of the calls , such. as bar checks may have been initiated by the Police and others . by Sakura . Others , however, may have been avoided had a security guard been on duty. On Friday, March 13 , 1992 , Code Enforcement section visited the. establishment at approximately 9 : 00 - 10 : 00 PM and found there to be no security guards placed outside to control parking lot noise . In addition., the front door of the building was left open, which results in increased outdoor noise. In addition, the Code Enforcement staff visited the Seabridge The Lakes development to observe what , if any, noises could be heard from the night club . Staff Report - 4/7/92 -2- ATTACHMENT No.( Z Although no noise readings were taken, staff could easily hear the live entertainment . Staff recommends that the following condition be added immediately: "All doors and windows shall be kept closed during all dancing and live entertainment events . " 3 . 0 RECOMMENDATION: After careful consideration of the status of compliance with conditions of approval , complaints from the neighbors and the number' of responses from the Police Department , staff recommeds that the Planning Commission schedule a revocation hearing in forty-five (45) days for the conditional use permit for dancing and live entertainment . This will give the applicant sufficient time to implement all conditions of approval and establish a track record of compliance and compatibility. Staff would further recommend that conditions be added at this time that Sakura Restaurant participate with Crazy Burro in establishing a combined valet parking plan, that the condition for the security guard be revised to- clarify the purpose and duties and that all doors and windows be kept closed . 4 . 0 ALTERNATIVE ACTION: An alternative action that the Planning Commission may take would be to' revoke the conditonal use permit at this time rather than scheduling a revocation hearing in forty-five (45) days . STAFF RECOMMENDATION: Based on the fact that staff did observe Sakura to have a uniformed security guard present who failed to properly monitor the parking lot area during the prime closing time, staff recommends that the Planning. Three (3) reasons were stated for the revocation of the referenced permits. See, attached Exhibit "A". A. "Staff Visits on March 13, May 10, and June 20, 1992 to the subject restaurant revealed that no parking lot security guard has been on duty monitoring the parking area while dancing and live entertainment activities were taking place." It was the understanding of Sakura Japanese Restaurant that it was sharing security arrangements with the Crazy Burro which shares its common parking lot. Appellant is aware of no actions taken against Crazy Burro for any lack of security on these dates. See, attached Exhibit 11B" incorporated at this point. Sakura Japanese Restaurant is willing to comply with any requirements in order to provide evidence that security is being provided at the location during all applicable business hours. B. 'Phone conversations with the restaurant staff then the planning staff revealed that Dancing and live entertainment takes.place until 1:00 a.m. on Thursday evenings one (1) hour than the condition's permit." The City Council City of Huntington Beach City Clerk's office July 20, 1992 Page 2 Sakura Japanese Restaurant vigorously disputes this allegation. While the restaurant is open until 1:00 a.m., live entertainment stops during the week at 12:00 midnight, pursuant to the permit which it was granted. Moreover, because many of the staff of the restaurant have very limited English language facility, the management believes that the information which the planning staff purports to have received may have been the result of miscommunication or language barrier. C. "The applicant has failed to comply with Condition No: 1 of Conditional Use Permit Number 91-30 and Conditional Exceptional No: 91-44 which has resulted in adverse impacts to nearby residential properties including noise, police calls and loitering in the parking lot." The overwhelming majority of police calls and noise are a result of the clientele of the Crazy Burro, where disturbances and police calls have out-numbered those logged to the Sakura Restaurant by at least four to one. No action, to the knowledge of appellant, has been taken against Crazy Burro, and therefore appellant seriously questions the validity of the accusations contained in this basis for revocation. One of those conditions was that "A parking lot security guard shall be on duty during. all entertainment/dancing events to monitor parking, trash and noise" . It was also mandated by the City that the Sakura and Crazy Burro Restaurants share the cost of such security. To quote one Member of the Planning Commission during the July 7th meeting, Sakura has been getting a FREE RIDE at the expense of the Crazy Burro". As we agreed during our conversation last evening, and subsequent to the Planning Commission meeting, it was agreed that Sakura would compensate Crazy Burro for its proportionate share of the costs of the parking lot security guard. From October 1991 to date, Crazy Burro has expended nine thousand eight hundred sixty dollars ( $9, 860. 00) for a parking lot security guard to meet the requirements of the City of Huntington Beach for BOTH Restaurants. In summary, Sakura has not provided security nor provided any monetary contribution for such. Sakura, during 1991 and early 1992, had entertainment approximately the same number of days per week as Crazy Burro. Subsequently, Sakura has not had entertainment to the same extent as Crazy Burro. As it would be impossible or impractical to ascertain the exact number of days Sakura had dancing and/or entertainment during . this time frame, it is hereby stated that thirty percent ( 30%) is an equitable amount of compensation to Crazy Burro as reimbursement for those services as provided.
