Conditional Use Permit No. 92-31 allows the installation of an eighty-five (85) foot tall electronic message center sign for off premise advertising pursuant to Code Amendment No. 92-1. The sign is proposed to be located along the San Diego Freeway, west of Beach Boulevard. Code Amendment No. 92-1 was approved by the City Council on August 3, 1992. Several conditions of approval were imposed in the Planning Commission' s approval of Conditional Use Permit No. 92-31 including Condition of Approval No. 3 which prohibits all businesses, merchants, and organizations participating in advertising on the. electronic message center from utilizing all temporary signage such as banners, flags, and pennants. The Huntington Beach Automobile Dealer ' s Association and the representative of the sign company contracted for the installation of the sign have appealed this condition of approval. The code amendment was then approved by the City Council on August 3, 1992. One of the provisions established in the code amendment requires all requests for off-premise electronic message centers to be reviewed by the Planning Commission through the Conditional Use Permit process. Conditional Use Permit No. 92-31 was submitted by the co-applicants - Rod Wilson of Electra Media Signs and the City of Huntington Beach Redevelopment Agency. The Planning Commission on August 4, 1992, approved the request with Condition No. 3 . Project Description The proposed electronic message center sign is an 85 foot tall, double faced 1,200 square foot sign. It includes two (2) , three (3) sided changeable copy panels totaling 300 square feet and a 418 square foot electronic readerboard. The proposed sign location is on a remnant portion of City owned land between Center Avenue and the Beach Boulevard Freeway off-ramp. The height and size of the sign are designed to be visible from the freeway and to act as a directional enticement to automobile dealers on Beach Boulevard. The City of Huntington Beach, as property owner, will lease the parcel to the City of Huntington Beach Redevelopment Agency who is a co-applicant on the project. The Redevelopment Agency will in turn sub-lease the land to the Huntington Beach Auto Dealers Association. The Auto Dealers Association has made agreements with the Agency to install, operate, and maintain the sign while the City maintains the surrounding landscaping. Appeal: The appellants are to appealing only Condition of Approval No. 3 of Conditional Use Permit No. 92-31 based on the following grounds: Comment The City of Huntington Beach Ordinance Code currently allows the use of non-permanent signage. The Auto Dealers Association stated to the Planning Commission that non-permanent signage is a very important part of our total advertising program. RCA 9/8/92 -3- (4247d) Staff Response Staff concurs that Section 9610.9(a) , Signs, of the Huntington Beach Ordinance Code currently permits the automobile dealerships on Beach Boulevard to fly 18 inch non-metallic helium balloons and large metallic inflatables on the weekends and to display flags, pennants, banners and car-top signs throughout the year. All other business in the city are permitted to display banners, flags and pennants on a temporary basis, subject to approval of a temporary sign permit. The temporary signs are limited to a maximum three (3) times a year for a total of 90 days, much less than the year round signage permitted for the auto dealers . The off-premise electronic message center will offer more than sufficient advertising opportunities for the businesses that participate in its signage. In addition to the electronic readerboard portion that will announce sales, specials, and promotional events, the sign also includes two (2) , three (3) , sided changeable copy panels to display the auto dealer' s logos on a continual basis. The three (3) sided panels are designed to exhibit 3 logos on each side for a total of 18 logos on the two panels . In addition, the vehicles displayed at each dealer ' s site also act as advertising. It is obvious to the motorists on Beach Boulevard that such businesses are car dealerships especially when the business name and type of vehicle sold are typically displayed on a free/standing sign at the curb and through signage on the building wall. Almost all of the automobile dealers on Beach Boulevard currently take full advantage of the flags, banners, pennants, and car top signs and display such signage on a continual basis . The signage results in visual clutter and an assault to the eye as each business tries to out-do their neighbor and gain the attention of prospective buyers . The advertisements on the electronic readerboard will provide enough exposure to auto dealers so that motorists can identify Beach Boulevard as the Boulevard of Cars and then find each dealer by the typical free standing signs and wall signs afforded to each business. In some cases, removal of the flags, balloons, and pennants will even increase exposure of the business because the street is so cluttered that the name of each business is blocked and unidentifiable. Comment It is respectfully suggested that if the Planning Commission would like to propose a change in the city code relative to the use of non-permanent signs by auto dealerships on Beach Boulevard that it be processed as an item independent and separate from CUP 92-31. By doing this the proposed change would be advertised and notice given to all the auto dealerships on Beach Boulevard as is legally required for a proposed ordinance change. RCA 9/8/92 -4- (4247d) Staff Response The purpose of conditional use permits is to allow the Planning Commission to approve projects subject to certain requirements or conditions. In this case, Conditional Use Permit No. 92-31 for the installation of an eighty-five (85) foot tall electronic readerboard sign was approved with findings and conditions of approval . prohibiting the businesses participating in the sign from utilizing temporary signage. The implementation and monitoring of Conditional Use Permit No. 92-31 through the City' s Code Enforcement Division will ensure that all conditions of approval are complied with. A code amendment is not required as there are some auto dealers who will not participate in advertising on the readerboard sign and are therefore entitled to the provisions allowed for banners, flags, balloons, and pennants . Section 9610.9 (a) of the Huntington Beach Ordinance Code currently permits sites with electronic readerboards to display temporary signs a maximum of fifteen (15) calendar days per year. The intent of this section of the code is to restrict temporary signage at businesses with electronic readerboards because the size and type of an electronic message center is sufficient to advertise year round and provide exposure to passing motorists. FUNDING SOURCE: Not Applicable ALTERNATIVE ACTION: A. The City Council may approve the appeal and amend Condition of Approval No. 3 by permitting all businesses participating in advertising on the electronic measage center sign to display temporary signs, flags, pennants and banners a maximum fifteen (15) days per calendar year subject to issuance of a temporary sign permit. B. The City Council may approve the appeal and delete Condition of Approval No.3 of Conditional Use Permit No. 92-31 with all other findings and conditions of approval to remain in effect. The location, site layout, and design of the proposed 85 foot tall electronic message center properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The structure is at a sufficient height to be visible from the I-405 (San Diego) Freeway and does not block visibility of any adjacent signage or structures in the area. 2. The combination and relationship of one proposed use to another on a site are properly integrated. While no other uses are present on the remnant parcel of land, the sign will be integrated into the existing tree and shrubbery landscaping. 3 . The lease and/or sale of the city owned property to the City of Huntington Beach Redevelopment Agency for the installation of the electronic message center is consistent with the following goals and policies of the General Plan: a. Circulation: Develop a system of streets and highways that ensures the safe and efficient movement of people and goods . The subject remnant parcel is not required for the Center Avenue/Beach Boulevard freeway off-ramp and may properly be disposed of without affecting the efficiency of effectiveness of the arterial highway system. b. Land Use: Continuing to diversify the economic base of the City and increasing the tax base. The approval of Conditional Use Permit No. 92-31 will increase consumer awareness of automobile dealerships on Beach Boulevard and other participating businesses and thus increase tax revenue to the City. c. Land Use: To continue to promote development of commercial centers . The approval of Conditional Use Permit No. 92-31 will increase the livelihood of existing and future businesses that participate in advertising on the sign. 4 . The granting of Conditional Use Permit No. 92-31 for an 85 foot tall electronic message center will not adversely affect the General Plan of the City of Huntington Beach. 5. The access to and parking for the proposed 85 foot tall electronic message center does not create an undue traffic problem because no parking is necessary for the implementation of the readerboard sign. AT NO. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 92-31: 1. The site plans and elevations received and dated July 27, 1992 shall be the conceptually approved layout with the following modifications: a. Revise the site plan to depict the correct project address, 7991 Center Avenue, in the lower right hand corner. b. The elevations shall depict anti-graffiti finish, if available, which shall be compatible with the proposed sign materials and applied to a minimum distance of ten (10) feet above the base of the sign. 2. The sign shall be operated in conformance with the provisions specified in Section 9610 .9(e) of the Huntington Beach Ordinance Code. 3 . All businesses, merchants and organziations participating in advertising on the electronic message center shall be prohibited from flying, displaying, or utilizing all temporary banners, flags, pennants, car top signs, balloons, or other non-permanent signage otherwise permitted under Section 9610 . 9(a) of the Huntington Beach Ordinance Code. 4 . Prior to submittal for building permits, the applicant/owner shall complete the following: a. Elevations shall depict colors and building materials proposed. b. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 5. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. 6 . The Planning Commission reserves the right to revoke this Conditional Use Permit No. 92-31 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 7. Conditional Use Permit No. 92-31 shall not become effective until Code Amendment No. 92-1 has been approved by the City Council and is in effect. 8. Conditional Use Permit No. 92-31 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. Staff also feels the proposed 85 foot tall sign is not compatible with other signage in the area , that it will detract and impact the visual beauty and scenic values of landscaping areas, an diminish the aesthetic value of the gateway to Huntington Beach. The Huntington Beach Auto Dealer' s Association fully supported Code Amendment No . 92-1 with the contention that this type of very recognizable signage would increase sales to -the dealers and in turn, tax revenues to the city. Caltrans ' s Requirements The State Department of Transportation Outdoor Advertising Division imposes restrictions and requires a permit for all signs located within 660 feet of, or visible from, interstate highways. The permit is renewable through Caltrans on a yearly basis . When a sign is located within a Redevelopment Project area and advertises businesses and activities within the project area with consent of the Redevelopment Agency, the sign is considered by the Outdoor Advertising Act to be an "on-premise" sign. In this case, the Huntington Beach Auto Dealers Association propose a small office within the Redevelopment Project area in order to satisfy the "on-premise" criteria . Staff Report - 8/4/92 -3- (3992d) The City of Huntington Beach Redevelopment Agency was issued an "on premise" sign permit from Caltrans on March 18 , 1992 for a 14 foot by 30 foot message center display. The two (2) , .three (3) sided changeable copy panels are exempt from Caltrans permitting requirements because the turning or flipping motion of the panels are mechanically operated rather than electrical . Only the electronic readerboard portion of the message center is subject to the Outdoor Advertising Act . The three (3) sided panels are intended to advertise participating dealership ' s logos . General Plan Conformity Part of the Planning Commission' s review of the proposed 85 foot tall electronic message center is to consider conformity of the parcel with the General Plan. As discussed above, this remnant portion of the Center Avenue Street alignment is owned by the City of Huntington Beach and will be leased and possibly sold to the Redevelopment Agency. The property in question was not given a zone or general plan designation when the San Diego Freeway (I-405) and its associated off-ramps were created. The Huntington Beach Ordinance Code states that all zoning and general plan designations extend to the centerline of all right-of-ways within the city. The subject property, therefore, is zoned C2 (Community Business) and general planned General Commercial consistent with surrounding land use designations . If the Planning Commission approves the proposed project it will include a finding that the long term lease and/or sale of city owned property to the Redevelopment Agency, for the use of advertising purposes, conforms to the goals and policies outlined in the General Plan. Design Review Board The Design Review Board reviewed a colored rendering and a materials palette board for the proposed electronic message sign on July 23 ; 1992 . The applicant presented a metal frame sign painted with off-white stucco and red and blue plexiglass channel letters . The electronic readerboard portion itself will be a black background with white lighted squares to convey the various letters, words, and messages . The two (2) , three (3) sided changeable copy panels are proposed as a similar black background with individual auto dealer ' s logos in white lettering . Three (3) logos are proposed for each 'side of the two panels for a total of 18 logos . At the Design Review Board meeting, the applicant indicated his desire to change the proposed off-white stucco to a pure white stucco, which the Board approved. The Board discussed landscaping beneath the sign and stipulated that plant material be trimmed to clear the bottom sign panels . The board also recommended that, if available, an anti-graffiti finish be applied to the base of the sign poles, ten (10) feet above the ground. Staff Report - 8/4/92 -4- (3992d) While the Department of Community Development recognizes the importance of the automobile dealerships to the city, Planning staff feels the risk to the visual integrity of the area far outweighs the possible benefits of the proposed sign. Staff is concerned that approval of this request may spur similar interest in off-premise advertising for other businesses and sections of the city. An 85 foot tall electronic message center sign is simply not compatible with adjacent signage and acts as an intrusion on adjacent properties . Other Requirements Section 9610 . 9 (a) , Signs, of the Huntington Beach Ordinance Code currently permits the automobile dealerships on Beach Boulevard to fly 18 inch non-metallic helium balloons -and large metallic inflatibles on the weekends and to display flags, pennants, banners and. car-top signs throughout the year . All other business in the city are permitted to display banners, flags and pennants on a temporary basis, subject to approval of a temporary sign permit . The temporary signs are limited to a maximum three (3) times a year for a total of 90. days, much less than the year round signage permitted for the auto dealers . If Conditional Use Permit No. 92-31 is approved it is recommended that a provision be included which prohibit the participating dealerships from the use of all non-permanent signage. This will reduce visual clutter along Beach Boulvard. Summary The sign as proposed conforms with the proposed code amendment . Code Amendment No. 92-1 is scheduled for the August 3 , 1992 City Council Meeting . , Because the current code does not permit this type and-size of readerboard sign until approved by the City Council , Planning staff recommends denial of the proposed sign. Should the code .amendment be approved by the City Council, then the alternative recommendation will be recommended at the Planning Commission meeting . Staff has received two (2) letters in response to the sign proposal, one (1) from a City of Huntington Beach resident, Barbara Conklin, and one (1) from Donald S. COASTAL STATUS: Not applicable Legal notice as provided to the City Clerk' s Office by staff had been mailed, published, and posted. No communications or written protests were received on the matter. The Community Development Director presented a staff report. The City Attorney reported on the process to modify the ordinance. The Mayor declared the public hearing open. Rick Evans, appellant, Sign Committee for Huntington Beach Automobile Dealers ' Association Chairman; stated he would be willing to meet with a committee comprising of staff and Council to discuss the issue in the future but that he did not believe it belonged as part of the Conditional Use Permit No. 92-31 . There being no one present to speak further on the matter and there being no further protests filed, either oral or written, the hearing was closed by the Mayor. A motion was made by MacAllister, seconded by Kelly, to approve the appeal and delete Condition of Approval No. 3 of Conditional Use Permit No. 92-31 with all other findings and conditions of approval to remain in effect as follows: Findings for Approval - Conditional Use Permit No. 92-32 1 . The location, site layout, and design of the proposed 85 foot tall electronic message center properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The structure is at a sufficient height to be visible from the I-405 (San Diego) Freeway and does not block visibility of any adjacent signage or structures in the area. 2. The combination and relationship of one proposed use to another on a site are properly integrated. While no other uses are present on the remnant parcel of land, the sign will be integrated into the existing tree and shrubbery landscaping. 3. The lease and/or sale of the city owned property to the City of Huntington Beach Redevelopment Agency for the installation of the electronic message center is consistent with the following goals and policies of the General Plan: a. Circulation: Develop a system of streets and highways that ensures the safe and efficient movement of people and goods. The subject remnant parcel is not required for the Center Avenue/Beach Boulevard freeway off-ramp and may properly' be disposed of without affecting the efficiency of effectiveness of the arterial highway system. b. Land Use: Continuing to diversify the economic base of the City and increasing the tax base. The approval of Conditional Use Permit No. 92-31 will increase consumer awareness of. automobile dealerships on Beach Boulevard and other participating businesses and thus increase tax revenue to the City. The approval of Conditional Use Permit No. 92-31 will increase the livelihood of existing and future businesses that participate in advertising on the sign. 4. The granting of Conditional Use Permit No. 92-31 for an 85 foot tall electronic message center will not adversely affect the General Plan of the City of Huntington Beach. 5. The access to and parking for the proposed 85 foot tall electronic message center does not create an undue traffic problem because no parking is necessary for the implementation of the readerboard sign. Conditions of Approval - Conditional Use Permit No. 92-31 1 . The site plans and elevations received and dated July 27, 1992 shall be the conceptually approved layout with the following modifications: a. Revise the site plan to depict the correct project address, 7991 Center Avenue, in the lower right hand corner. b. The elevations shall depict anti-graffiti finish, if available, which shall be compatible with the proposed sign materials and applied to a minimum distance of ten (10) feet above the base of the sign. 2. The sign shall be operated in conformance with the provisions specified in Section 9610.9(e) of the Huntington Beach Ordinance Code. 3. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Elevations shall depict colors and building materials proposed. b. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 4. Prior to issuance of building permits, the applicant/owner shall complete the. fol.lowing: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. 5. The Planning Commission reserves the right to revoke this Conditional Use Permit No. 92-31 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 6. As a Huntington Beach resident of 15L years, I oppose this amendment for the following reasons: The new and used car business owners have requested the Planning Commission and City Council to amend a City Code that will allow the installation of an 85 ft. electronic "Reader Board" sign to be installed on the 405 freeway near Beach Boulevard in Huntington Beach. 1) This 85 ft. electronic "Reader Board" sign will benefit no one but the owners of the new . and used car companies strung out along Beach Boulevard. They could not care less about the repercussions this sign would create to our beautiful city as long as it increases their business. 2) You say it will bring in the extra revenue we so badly need in these crucial times . Yes, it will do that for a short time. But these hard times will pass . This would be just a band aid, a quick fix. We won' t always be in a financial bind. And when we are back to good times, we will still be stuck for 30 years with the ugly towering monstrosity that will mar our beautiful Huntington Beach city. It will be the biggest eye sore, a monster, a beacon seen for miles and miles. It will. loom out like a giant in the middle of the street, devouring you as you drive Beach Boulevard to the freeway. 3) And 'how could the Planning Commission dare deny any business owner a permit for another 85 ft. sign, and another, and another, etc. , until we are so lined up with 85 ft. signs that Huntington Beach looks like a cheap and sleazy Las Vegas . To deny a permit to another for such a sign would be a scream for "discrimination" and that screaming discrimination will. .be heard all the way to the courts . Huntington Beach could end up paying multi-millions of dollars in settlement fees . "Reader Board" sign. 5) How could anyone even consider an important issue such as this, being published in the Independent newspaper with a circulation of 51, 000 when Huntington Beach_ has a population of 200, 000 . I request advertising to be in major newspapers such as the orange County Register, Los Angeles Times, as well as the Independent, and that such be placed in display pages of the newspapers and not buried under legal . It should not be shoved under the table. I request all neighboring cities such as Fountain Valley, Newport Beach, Costa Mesa, Westminster, and Seal Beach be informed also. I believe every resident of Huntington Beach be informed and aware of this amendment and suggest bulk mail notices be sent to every resident. I would be willing to pay my fair share for that. 6) In regard to the backlash of this sign, property values would depreciate. They literally would plummet, for who would want to live in a town with scores of. towering electronic signs, jutting up over buildings, along our streets giving a look of cheap and sleazy Las Vegas . Should that happen, will the automobile owners still be willing to stick around and pay the city their taxes when the city has lost their affluent residents? We are no longer the sleepy little ramshackle town we once were . We are an up and coming beauty, the renovation of Old Town Huntington Beach, the expensive beautiful new homes, our new majestic pier, our constant upgrade of our existing homes--all that shows the pride of ownership in a city in which people from all over would love to live. The car companies are not the only ones in financial troubles . Everyone is--i . e. , the builders, plumbers, electricians, carpenters, appliance manufacturers, carpet people, etc. , etc. ; these people would also have a legitimate reason for 85 ft.. signs to help stimulate their business. Our reputation is abounding. We are as much sought after and as desirable as Newport Beach on a smaller scale. I urge you, my city officials, please! please! deny this permit for the 85 ft. sign.
