Approval was conditioned upon the liquor store being designed as one store rather than two. Councilman Bannister has appealed the approval in order for the Council to further review the applicant ' s reasons for expansion. New information has also come to light regarding the Alcoholic Beverage Control Board ' s (ABC' s) - requirements for the liquor license. Liquor stores are a permitted use subject to approval of a conditional use permit pursuant to Section 4 . 5 . 01(b)L of the Huntington Beach Ordinance Code (Downtown Specific Plan) . The applicant is requesting to expand his existing market/liquor store (El Don Liquor) located at 470 Pacific Coast Highway into the adjacent retail space located at 414 Pacific Coast Highway (currently occupied by a surfboard shop) . The expansion would increase the square footage of the market/liquor store from 1,422 square feet to 2, 044 square feet. The principle issue with this request is whether or not the applicant is expanding a liquor store, or creating a second liquor store adjacent to the existing one. The applicant ' s written narrative indicates that the intent is to expand rather than create a second store. The Planning Commission and staff, however, were concerned that the applicant' s plans did not depict a connection between the two stores. Since it was felt that two separate liquor stores side by side would not be desirable, the applicant was conditioned to provide a revised floor plan depicting one integrated liquor store. After the Planning Commission approved the request with the additional condition for integration of the uses, Councilman Bannister appealled the approval to further review whether one or two liquor stores were being proposed by the applicant. After the appeal had been filed, the applicant submitted a letter requesting continuance to November 5, 1990 as he would be out of town during the month of September and October. Staff honored his request in scheduling this item. RCA - 11/5/90 -2- (7590d) In the ensuing time, staff received a communication from the Department of Alcoholic Beverage Control (ABC) regarding the requirements of the applicant ' s liquor license. That information is attached to this staff report. What the ABC has explained is that under their regulations, Mr. Bagstad is required to operate two separate and distinct businesses, with no direct public access between the two businesses for customers of either licensed premises . According to the documents, Mr. Bagstad signed his agreement to abide by that requirement. In summary, the ABC's requirements for Mr. Bagstad' s liquor license are in direct conflict with the staff and Planning Commission' s condition of approval for the project. Unless the City Council deletes the condition for integrating the uses, ABC will revoke Mr. Bagstad' s new liquor license. Since staff does not believe that two separate liquor stores located side by side are desirable, staff does not recommend that the condition be eliminated. Rather, in recognition of the insurmountable conflict with ABC' s requirements, staff recommends that the Planning Commission' s approval of this item be overturned and the application denied. FUNDING SOURCE: N/A ALTERNATIVE ACTION: 1. The City Council may deny the appeal and uphold the Planning Commission' s action of July 24, 1990, with all conditions intact. The ABC will then act to revoke the applicant' s second liquor license and the City' s approval will be met. 2. The City Council may deny the appeal and modify condition of approval number one and allow two separate liquor stores with no internal connection. ABC will then honor the second liquor license. The expansion would increase the square footage of the market/liquor store from 1,422 square feet to 2, 844 square feet . The E1 Don Liquor building is a two story structure of approximately 5, 700 square feet . The first level is devoted to retail uses with the second level containing rental units . Total site area is approximately 5, 500 square feet with parking accessed through the alley to the rear . A total of five parking spaces are available. Pursuant to Section 4 . 2 . 01(d) of the Downtown Specific Plan a legal non-conforming use or structure is exempt from meeting current code requirements if "any building alteration, rehabilitation or facade improvement . .does not exceed ten (10) per cent expansion of existing floor area; does not increase the height; or result in an increase in permitted density" . The proposed expansion of the market/liquor store into the current surfboard outlet has been interpreted as a continuation of a retail use activity that has similar parking requirements . Therefore, no additional parking or in-lieu parking fees are required. The applicant has owned the property and operated the existing market/liquor store for the past seventeen (17) years . The .Alcoholic Beverage Control Office has no record of offenses . The Police Department has indicated that liquor related offenses in the beach area have shown an increase in the last two years; however, they have no specific concern with this applicant . 10 . 0 RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No . 90-14 with the following findings and conditions of approval . FINDINGS FOR APPROVAL: 1.
