Staff recommends the City Council approve the request because the modifications remain consistent with the City's previous approval of amendments to the HBZSO. Financial Impact: Not Applicable. Recommended Action: Motion to: A) Adopt Resolution No. 2013-27, "A Resolution of the City Council of the City of Huntington Beach Which Acknowledges Receipt of the Coastal Commission Action and Accepts and Agrees to Local Coastal Program Amendment No. 2-11 As Modified;" and, B) Approve for introduction Ordinance No. 3981, "An Ordinance of the City Council of the City of Huntington Beach Amending Section 233.10 of the Huntington Beach Zoning and Subdivision Ordinance Thereof to Conform to LCP Amendment No. 2-11 Made By the California Coastal Commission." PROJECT PROPOSAL: Applicant: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA 92648 Location: Citywide — Coastal Zone Local Coastal Program Amendment No. 2-11 is being brought to the City Council for acceptance of the California Coastal Commission's suggested modifications to previously approved zoning text amendments related to the City's sign code. The Coastal Commission is recommending modifications to Section 233.10 — Prohibited Signs of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO). All of the modifications are presented in the approval letter from the Coastal Commission and are included in Attachment No. 1, Exhibit A. The process for approving the modifications involves: 1) a resolution to accept and agree to the California Coastal Commission's suggested modifications to the LCPA; and 2) an ordinance to approve and incorporate the Coastal Commission's modifications into the HBZSO. Upon transmittal of Attachments 1 and 2 to the Coastal Commission, the Executive Director of the Commission will determine if the City has complied with the Commission's action. The LCPA is not effectively certified until such determination is made. B. BACKGROUND: On December 19, 2011, the City Council approved Local Coastal Program Amendment No. 11-001 to transmit nine zoning text amendments and one zoning map amendment that were previously approved by the City Council to the California Coastal Commission. The LCPA was forwarded for consideration to the Coastal Commission as Local Coastal Program No. 2-11 on December 20, 2011. On April 10, 2013, the Coastal Commission certified LCPA No. 2-11, which included seven zoning text amendments and one zoning map amendment, with suggested modifications. It should be noted that two zoning text amendments were removed from the LCPA request. One zoning text amendment (ZTA) related to medical marijuana dispensaries was removed from the LCPA as it was repealed by the City and never incorporated into the City's certified Local Coastal Program. Another ZTA related to flood ordinance revisions was withdrawn from the LCPA request and will be submitted to the Coastal Commission separately. The revisions are already in effect for the majority of the City's floodplain areas. Section 13537 of the California Code of Regulations states that the local government must accept and agree to the modifications by resolution within six months (by October 10, 2013) of Coastal Commission approval or the Coastal Commission's approval expires. C. STAFF ANALYSIS AND RECOMMENDATION: All of the suggested modifications are to the City's sign code. The purpose of the suggested modifications is to ensure that the list of prohibited signs expressly includes those signs within the coastal zone that would limit public access or impede public views HB -1 53- Item 11. - 2 Dept. The modifications also include language to address coastal development permit requirements for signs located on public property or within the public right-of-way that are approved by the City Council. Staff has evaluated the suggested modifications and determined that they are consistent with the City's approach in evaluating projects or would not create an undue burden on development within the Coastal Zone. Staff recommends the City Council approve the modifications. Environmental Status: All of the entitlements included in the subject LCPA have been previously analyzed per the California Environmental Quality Act. Acceptance and approval of the Coastal Commission modifications does not require additional environmental review and is exempt from the requirements of CEQA, pursuant to Section 21080.9 of CEQA and Sections 15251(f) and 15265 of Title 14, California Code of Regulations. Canvas signs, banners, pennants, streamers, balloons or other temporary signs except as provided in Sections 233.08 (Exempt Signs), 233.16 (Subdivision Directional Signs) or 233.18 (Promotional Activity Signs). B. Mobile, A-frame, and portable signs and those of a similar nature which are not permanently attached to the ground or building except as provided in Section 233.18 or 233.20. C. Roof signs except those permitted under Section 233.18(D). D. Signs which resemble any official marker erected by the city, state, or any governmental agency, or which, by reason of position,shape, color or illumination would conflict with the proper functioning of any traffic sign or signal or would be a hazard to vehicular or pedestrian traffic.
