Consideration of eliminating the CUP requirement was brought up due to the costs associated with applying for a CUP. After discussion of the issue, the City Council directed staff to further review the subject and present options for the City Council's consideration. Funding Source: Not applicable Recommended Action: The City Council may make one of the following motions: 1. Direct staff to eliminate the zoning entitlement processing fee for a Conditional Use Permit (public notification: 500-foot radius) for large family day care uses in residential zones that are subject to review and approval by the Zoning Administrator (no change to existing process except the filing fee is eliminated); or 2. Direct staff to initiate a Zoning Text Amendment to amend the Huntington Beach Zoning and Subdivision Ordinance so that large family day care uses in residential zoning districts shall obtain an Administrative Permit (Neighborhood Notification: 300-foot radius) with no applicable fee required (reduces processing time and the filing fee is eliminated); or 3. Direct staff to initiate a Zoning Text Amendment to amend the Huntington Beach Zoning and Subdivision Ordinance so that large family day care uses in residential zoning districts are a permitted use (eliminates processing time and no notification or filing fee is required). REQUEST FOR ACTION MEETING DATE: June 5, 2006 DEPARTMENT ID NUMBER:PD 06-10 Alternative Action: Do not take action on any of the above recommendations and provide direction to staff. Analysis: Currently, a large family day care, allowing up to 12 children plus two additional children if they are over the age of six and reside in the home, requires a CUP from the Zoning Administrator. The fee for this type of CUP is $3,568. The process generally takes about 2 - 3 months and requires a 500-foot radius notification and a public hearing. A small family day care, defined as up to six (6) children plus an additional two (2) children if they reside in the home, is permitted by right and does not require any planning entitlements or fees. Additionally, the California State Department of Social Services, Community Care Licensing Division, regulates the licensing of small and large family day care homes. In comparison with other Orange County cities, the City of Huntington Beach has one of the highest zoning entitlement fees for large family day care uses according to a survey conducted by the Orange County United Way Local Investment In Child Care (LINCC) Project (see attached). However, most cities do require planning review and approval of a large family day care permit (or modified use permit) either administratively or through a discretionary action. This allows for a review and analysis of a proposed large family day care use but removes the burden of an expensive CUP fee on the applicant. Because the costly CUP process may deter a potential large family day care operator from applying to provide childcare services in the City, three alternative actions are presented to modify the current requirements. A description of each of the three alternatives as well as the current requirements is provided in Table 1 below. Action by the Zoning Administrator could be appealed to the Planning Commission. Alternative action #2 provides for planning review and approval through an Administrative Permit (AP). This process includes planning review only and does not require a staff report, conditions, and findings. A 300-foot neighborhood notification is included but no public hearing. No fee is proposed for the Administrative Permit although a typical Administrative Permit fee is $937. An Administrative Permit can be appealed to the Planning Commission. It should be noted that for both alternative actions #1 and #2, an applicant will incur costs related to the preparation of site and floor plans, radius map, and mailing labels. Alternative action #3 does not require planning review or approval, and does not have any associated fees as the use would be permitted by right. All three alternative actions propose to eliminate the Planning Department entitlement fee while providing for varying degrees of review and approval. Other City departments such as the Fire and Business License Departments require fees related to the processing of their permits and approvals. The cost for this application is$3,668.00. In comparison with other cities, the city of Huntington Beach's requirement and cost is several times greater. This cost can make or break day care centers since they operate on a very narrow financial margin. Since day care centers already need a business license and are subject to inspections a by the state and the city's Fire Department, we are recommending that the Conditional Use Permit process be eliminated. Medical check: $50 licensee,$50 aide* Yearly fees State License: $115 CPR and First Aid Cert: $90 licensee, $90 aide* Fire Servicing: $35 Disaster supplies: $75 Daycare Insurance: $657 *Aide processing and yearly fees repeated with any new assistant Required equipment Fire extinguishers: $60 Detectors: Smoke: $40 Carbon monoxide: $50 Fire warning: $50 First aid kits(home, cars): $125, $25, $25 Disaster and earthquake supplies:$150 Electrical safety(outlet locks,cord covers): $100 Door and drawer locks: $27, $42 Straps and tip resistance: $56 Booster seats for car: $40 each Gates: $60 This is a conservative estimate to qualify for a school age daycare.Any watching toddlers and babies must have safe car seats, play pens, diapering and bath equipment,sleep area safety(including monitors),strollers, potty safety equipment. I would estimate at least another$700-800 for their investment.This must all be done before you are approved. Neither estimate includes all the educational, craft and play equipment invested for the children's enrichment along with the larger safer car. A start up cost of$7126. 1 don't know anyone who could or would consider this to start a home daycare. The issue of safety is thoroughly handled through the state and duplicated by city fire.Any complaints about a daycare can be made directly to the state who are fastidious about unannounced onsite checks.They do regular thorough reviews of every facility, regardless; checking all the above requirements and the mounds of paperwork we must update and keep on file.
