Limited Sign Permit No. 87-1 is a request to permit a sign face change for a non-conforming freestanding sign and extend the sign's use for two years. Due to a lack of unique circumstances, the 25 foot high, 96 square foot freestanding sign's immediate removal will not result in a substantial economic hardship for the applicant. 2. The 25 foot high, 96 square foot freestanding sign will adversely affect other lawfully erected signs in the area. 3 . The 25 foot high, 96 square foot freestanding sign will be a hazardous distraction. No 5/85 t � ell, A sign permit was issued for the subject sign in 1973. According to the sign code adopted in August, 1986, Nonconforming Signs, Section 9610.8, the eventual elimination of existing signs which are not in conformance with the provisions of the sign code are as much a i subject of health, safety and welfare as is the regulation of new 1 signs. The Sanwa Bank freestanding sign did not conform to the IIII previous sign code (adopted in 1976) and it exceeds the existinq ! wign code by great proportions. Staff recommends that the City Council deny the two year extension and require the freestanding sign be modified to meet the provisions of sign code in -,ffect at this time. The sign panel for the Sanwa Bank freestanding sign, which was changed without a permit, is located in a landscape planter. There are a total of five freestanding signs along the Warner Avenue frontage which do not conform to the existing sign code. According to the provisions of the current sign code, the retail center is allowed one 15 foot high center identification freestanding sign and 5 separate 7 foot h3ah monument signs. Exceeds Code by 66 sq.ft. The prior sign code permitted a 20 foot high, 100 square foot freestanding sign. The matrix above indicates that the subject sign is 5 feet higher than the permitted height. Since the sign did not conform to the previous Sign Code, the Sanwa Bank freestanding sign should be lowered to a 7 foot high, 30 square foot monument sign now to conform with the existing sign code. The Sanwa Bank building has effective wall signage which in combination with a monument sign, will provide ample exposure for their business. Eventually, the other freestanding signs will be required to conform to the Sign Code by means of recycle or change of use. EINDTNGS EQFt APPROVAL: 1. Due to unique circumstances, the 25 foot high, 96 square foot freestanding sign's immediate removal will result in a substantial hardship for the applicant. 2. The 25 foot high, 96 square foot freestanding sign will not adversely affect other lawfully Arected signs in the area. 3. The 25 ioot high, 96 square foot freestanding sign will not be detrimental to properties located in the vicinity. j 4 . The 25 foot high, 96 square foot freestanding sign will be in keeping with the character of the surrounding area. 5. The 25 foot high. 96 square foot freestanding sign will not obstruct vehicular or pedestrian traffic visibility and will not be a hazardous distraction. ONDITIONS 0E APPROVAL: 1. The site plan and elevation dated February 4, 1987, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit to the Department of Development Services a letter from the property owner and owner of the sign agreeing with the conditions of approval. 3 . Prior to issuance of building permits, the applicant shall file T a cash bond in V!a amount of $2,000 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the sign structure. If this sign is not made to conform with the applicable provisions of the sign ordinance after two years from the date of approval, the City of Huntington Beach or its agents or employees may enter on the 1 property where said signs are located and remove said signs and the cost of removal shall be deducted from the cash bond and summarily forfeited and paid over to the City of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. We are grieving actions taken based on the followIng reasons: 1) immediate rennval of this sign will result in a substantial economic hardship for appli.cmit. Applicant has already invested thousands of dollars Lithe existing; sign and replacing it would result in spending thousands ino . 2) the _5' high 95 square foot sign does not achmersely Affect other lawfully erected signs in the center because there are none. i 3) the 25' high 96 square foot sign has not been a hazardous distraction and has not caused any liabilities thus far that we are aware of. 4) the other non-cocnformirg signs in the center have no definite tine frame to come into conformance. Allowing this extension knuld also provide-adequate tirm for city planning and the center's mner(s)/mma- ger(s) to develop a feasible sign prog atn in which all tenants would have to adhere to. We feel there are extenuating circumstances on the Space Place Mini Storage which would make our requests for variance on the sign size on [Varner, as well as an additional sign or, Magnolia , appropriate. As the City Council may recall the site had been a problem site which had been before the City Council on numerous occasions for a number of different project porposals. Due to the sensitivity of the single family residential neighborhood to the west of the subject property a number of previous proposals for this site had been turned down. The single family neighborhood was adamant that they did not want Connor Street opened up to additional single family development, tior to any other proposed development on t`r. site. floe lscher/Guggenheim's original desire was to build an apartment project on the entire site, however we were advised that the adjacent neighborhood had adamantly opposed every apartment project that had been proposed for this site. Specifically, the residential neighborhood had requested some sort of: buffer between any apartment project and their single family homes. As a buffer we proposed the mini storage, due to the fact that it would c-encrate less traffic than most alternatives and it would provide full security to the back yards of the single family neighborhood. To provide a secondary access, off. Warner to both the mini storage and the apartments, we built a double box culvert over the flood control channel at an expense of $940 ,000, which allowed Connor Street :o remain closed. Providing a dual use to the site, rather than the single apartment use, however, resulted in the mini storage being land locked with no visibility from either Magnolia or Warner. Thus, signage from Warner and Magnolia are extremely important , particularly in the light of the quasi-commercial nature of the mini storage business. Additionally, our entrance on Warner being only forty (40) feet wide, and the fact that the other commercial establishments along Warner between our entrance and Magnolia have sizable signs, in most cases two or three times that which was alotted to us by the Planning Commission, in addition to ` considerable landscaping, high foliate, etc. , further minimizes the visibility of our signage on Warner. Thus, we would like to 4j request that in lieu of the 5 ' by 6 ' sign, which was approved by the Planning Conunission, that a h ' by 8 ' sign would be more appropriate. Since the Planning Commission approved a partial variance in allowing us to have a maximum height of twelve ( 12) feet on our sign, we could live within the height restriction and are only requesting that the length of the sign be increased to a total of eight ( 8) feet. r; In denying our request for any signage for the mini storage, on Magnolia, the Planning Commission voiced the concern of traffic I and wanted us to maintain Warner as our only access for the mini storage. I should point out that our ads in the yellow pages describe the location as Magnolia and Warner, and all of our directions over the phone will obviously use the easy access points of Magnolia and Warner. Thus, with any prospective tenants who are looking for the location of our mini storage, if they are coming north or south on Magnolia they will be slowing down and craning their necks trying to find some directional signs to the mini storage, which would appear to me would cause greater traffic hazards than if we actually had a sign on Magnolia alerting them to the fact that that is one of the entrances to the mini storage. The sign we had proposed was certainly not designed for marketing, or attracting new customers, since it was only 2 ' by 2 ' to begin with, but merely a directional sign to alert prospective tenants looking for our location. We feel this small sign would reduce traffic congestion rather than hinder it. There is necessity for storage facility identification on Warner Avenue, Magnolia Street and the freeway because of its limited visibility. Staff is recommending approval with modifications. Visibility on Warner Avenue is limited due to street trees and landscaping on adjacent properties. Therefore, Sign `A" need only be large enough for motorists to recognize the sign early enough for adequate movement onto the site. Reducing the proposed sign size to 5 feet x 6 feet will allow for 10 inch letters which are visible up to 450 feet. A pole sign is recommended by the Engineering Division with a minimum 7 foot clearance from sidewalk to bottom of sign for Staff Report -- 9/3/86 -2- (6077d) I I visibility from vehicle to pedestrian, bikes, etc. on Warner. Avenue sidewalk. An identification sign on the office building (Sign B) is recommended for identification of the complex to new customers driving on Riverbend rrive. Only one sign with channelized letters is recommended for the rear building wall facing the freeway; either sign C or D shall be eliminated. Sign E would be permitted if it were double faced, not V-shaped. Staff feels this configuration is compatible with the apartment architecture. Traffic Division recommends a 3 foot setback from property line. RCA - 1/21/86 -3- (4068d) ANALYSIS: On January 61 1986, the City Council sustained Planning Commission 's decision to permit a 20 foot high Nissan freestanding sign; a 5 foot high, used car monument sign; and directed staff to work out a compromise on a third Campbell sign. The City Council stated that the Campbell freestanding sign shall be a maximum of 10 feet high, 36 square foot sign. The Council expressed concern regarding the proposed freestanding sign not blocking the view of the veterinary hospital freestanding sign which is located immediately south of the car dealership. The veterinary sign is approximately 15 feet high. The proposed 10 foot high Nissan sigh would be situated below the veterinary sign. Staff met with the appellant and the appellant's sign company on January 9, 1986 in order 4o discuss and work out an acceptable proposal for the City Council . Campbell Nissan indicated that they would agree to a 10 foot high freestanding sign at the proposed location and has submitted revised elevations depicting a ten foot high Campbell sign. Also, the Planning Division has received a letter from the veterinarian string that he agrees to a ten foot high Campbell sign. it is staffs position that the ten foot high Campbell sign is acceptable if the leading edge of the sign copy panel is set back six feet from the ultimate right of way (back of sidewalk ) and that the support pylon be set back a distance of nine feet from the back of sidewalk . The proposed location for the Campbell sign is situated at the north side of the southern driveway entrance/exit for the new car lot. Staff perceives a potential vehicular/pedestrian traffic hazard, if the proposed sign is located adjacent to the ultimate right of way. Staff feels that locating the sign back six feet will eliminate any potential visual problems. Locating the support pylon nine feet back from the ultimate right of way will preserve a clear space for total visibility of pedestrians and vehicles that are proceeding southbound on Beach Boulevard. In addition, setting the Campbell sign back will negate any possibility of blocking the veterinary sign located to the south of Campbell Nissan's operation. ENVIRONMENTAL STATUS: The proposed sign is categorically exempt pursuant to Class 11 (e) Section 15311 from the California Rnvironmental Quality Act. FUNDING SOURCE: Not applicable. On November 15, 1985, staff met PIo 4/a4 1 r with the applicant and attempted to produce a sign proposal which would be acceptable to the applicant, staff and th:. Planning Commission. On November 19, 1985, staff recommended to the Planning Commission a combination of freestanding signs which represented less signage compared to the original proposal but still required a special sign permit. Staff also included an alternate action which permitted two freestanding signs and a wall sign. On November 19, 1985, the Planning Commission approved a sign proposal which permitted three freestanding signs and an alternative monument sign or tall sign for the dealer identification sign. Attached is a letter dated December 21 1985, which states the applicant's grievance with condition of approval number 2. In gathering research for this proposal, staff visited other nearby cities in order to verify permitted auto dealership signage. In most cases, the product (Nissan, Ford, Toyota ) identification sign was a low profile monument sign near the street. The dealer identification sign in most cases was relegated to the face of the building that is set back from the street. This arrangement prevents oversigning a site while maintaining market exposure for the business. in addition, auto dealerships in Huntington Beach, located along Beach Boulevard, exhibit similar arrangements with the product freestanding signs, sear the street, and the dealer identification on wall signs. However, in this particular cases a wall sign would need to be quite large in order to afford visibility from. Beach Boulevard. The nature of construction and building materials of the showroom would prohibit an appropriate wall sign and the building of masonry materials which would be appropriate for a wall sign, is set back a significant distance from Beach Boulevard. This setback would require a very large sign in order to a visible from Beach Boulevard. Therefore, staff recommends a freestanding dealer identification monument sign of 36 square feet. The applicant requested a 25 foot high Nissan sign and staff concurred with the requested heights because the applicant initially r stated the lights standard would block the sign at 20 feet. However, a field research revealed that a sign 20 feet in height may be more visible from the number 3 lane on Beach Boulevard than one at 25 feet. Grounds for Grievance in Action (A) . 1. Sign is the property of Nissan and comes in a 25 ft. height and 96 sq. ft. configuration. The reason for this configuration came after an extensive study which produced complete graphic guidelines for Nissan signage. To reduce the sign height would produce disproportionate relationship between sign size and sign height. After reviewing these considerations and alternatives available, the Huntington Beach Planning Deptartment staff con- j curred with Nissan graphic guidelines and therefore recommend to the Planning Commission that they approve the 25' height as the best solution. 2. In addition, if the sign height was lowered to 20 ft. it would interfere visually with light standards which are also at that height presently. It is for this same reason that we requested a dealer sign to be at 15 ft. high - to avoid visual clutter with the satre light standards. The staff also concurred with this point. The original proposal for Special Sign :permit No. 85-9 requested four ( 4) freestanding signs at a site which only permitted one per Section 9760.7, Sign 'Code. In the staff report dated November 5, 1985, staff recommended combining two of the proposed signs. This would reduce the number of signs along Beach Boulevard and also create an undulating effect with a low sign at the north end of the property; a 20 foot high freestanding sign at the center of the property; and a low sign at the south end of the property. The applicant indicated at the November 5, 1965 Planning Commission meeting that Nissan requires a separate sign and that Mr. Campbell, the owner of Campbell Nissan, needed a dealer identification sign at the street also. Staff Report - 11/19/85 -2- (3722d) Based on the meeting of November 15, 1985, staff and the applicant arrived at a proposal that modifies the original request but still requires a special sign permit. The applicant has presented a proposal which includes: (a) One (1) monument "Used Carl sign at the north end of the property which will be 5 leet in height and 58 square feet of cign area. (h) one (1) freestanding "Nissan" sign in the center of the site which will be 25 feet high and 92 square feet of sign area. (c) One (1) freestanmding "Campbell" sign at the southern end of ' the property which will be 15 feet in height and 36 square feet of sign area. it was, agreed in the meeting that the service directory sign which is only 3 feet in height and only 3 square feet of sign area would not adversely impact the site. The new proposed sign combination would be the only signage for the site. The applicant agreed to the exclusion of any wall signs, flags, and banners. All signs are to be placed in a landscape Planter and it would be encouraged to impose a condition that the landscape planter on the used car lot be widened to match the adjacent planter which will be required from Use Permit No. 85--71 . 10.0 RECOMMENDATION: Staff recommends that the Planning Commission approve Special sign. Permit No. 85-9 based on the following findings and conditions: FINDINGS FOR APPROVAL: 1 . The proposed combination of signs would not adversely affect other signs in the area. 2. The proposed combination of signs would not be detrimental to � property located in the vicinity. 3. The proposed combination of signs will be in keeping with the character of the commercial area. 4. The proposed combination of signs will not obstruct the vision of vehicular or pedestrian traffic. 5. The canopy in front of the exterior wall presents poor visibility for wall signage. SUGGESTED CONDITIONS OF APPROVAL I. A site plan and elevation dated November 15, 1985 shall be the approved layout. 2. The proposed combination of sighs shall be subject to the review and appxovZ1 of the Director of Development services. 3. All illegal banners and flags sh311 be removed. This would reduce the number of signs to three. This would also create an undulating effect with a low monument at the north end of the property; a twenty foot high sign in the center of the property; and a low sign at the south end of the property. As an alternate action, staff would recommend combining two signs into one sign that would be twenty feet in height plus a low profile monument and a service directory sign. 10.0 RECO14MENDATION: Staff recommends that the Planning Commission deny Special Sign Permit No. 55-9 based on the following findings: ) . The proposed four freestanding signs will adversely affect other signs in the area. 2. The proposed four freestanding signs will be detrimental t•.o property located in the vicinity. 3. ANALYSIS: At the October 21, 1985, City Council meeting, the Council directed staff to work with the applicant to resolve the problem pertaining to the size and copy for a ground sign for the retail center located at 7011 Warner Avenue. On November 6, 1985, staff met with the applicant in order to work out a proposal that would be acceptable to both the applicant and the City Council. An agreement was not reached and the applicant stated he needed time to redesign a ground sign. On January 6, 1986, staff received an elevation and = memo from the applicant regarding the size and copy of the proposed ground sign. Staff has evaluated the proposal and it is staff's position that the proposed six and one-half (6.-1/2) foot high sign and two (2) tenant panel sign copy is ac-ceptable. Based on our evaluation of the sign, staff recommends that the City Council approve Special Sign Permit No. 85--8. ENVIRONMENTAL STATUS: The proposed sign is categorically exempt pursuant to Class 11 (e) Section 15311 from the California environmental Quality Act. ANALYSIS: On September 17, 1985, the Planning Commission denied Special Sign Permit No. 85--8. Special Sign Permit No. 85-8 originally requested the approval of a 20 foot high, 99 square foot internally illuminated freestanding sign (Attachment 3) within 330 feet of an existing freestanding sign located at 7011 Warner Avenue approximately 500 feet rest of Goldenwest Street. The proposed sign contained 28 tenant copy panels and was to be located in a landscaped area. The retail center is governed by Planned Sign Program No. 83-2 and only one, 25 foot high freestanding sign is allowed along the Warner Avenue frontage. r ` VI O 4184 - 1 The applicant initiated a special sign permit because the proposed sign did not comply with the Huntington Beach ordinance Code Article 976 Sign Code, in the following area: 1. section 9760.7(c) specifies that sites in the C2, C31 C4 , and R5 Districts with a minimum of seven hundred (700 ) feet of street frontage on any single street may be permitted un additional freestanding sign for every six hundred (G00) feet of street frontage in excess of the r minimum seven hundred (700) feet, provided further that the minimum distance between such signs shall be six hundred (600) feet. The location of the proposed sign would be approximately 330 feet away from an existing freestanding sign, which is approximately 260 feet less than the code requires for the minimum distance between freestanding signs. The distance between the proposed freestanding sign and an existing freestanding sign is approximately 260 feet less than the sign Code requires. Also, the proposed freestanding sign does not meet the intent of the planned sign program that governs the shopping center. All the approved freestanding signs at the shopping center advertise major tenants only and multiple tenant identification signs are not permitted. The close proximity of the retail stores to Warner Avenue does not justify a 20 foot high freestanding sign with 28 tenant copy panels. At the August 20, 1985 Planning Commission meeting, Special Sign Permit No. 85-8 was continued in order to allow staff to work with the applicant and try to design a low profile monument sign which would serve the advertising needs of the tenants that do not, have direct street exposure along Warner Avenue. A low monument sign was suggested as an alternative action by staff for consideration at the September 17, 1985 Planning commission meeting (see Attachment 4 ) . The applicant did not agree with the staff version and instead presented a 9 foot high, 48 square foot sign (see Attachment 5 ) . Staff presented graphics and photographs which demonstrates that all the tenants have street exposure for advertising purposes. The Planning Commisston agreed with staff's analysis and recommendation and denied the applicant 's request. The applicant has resubmitted his original proposal for your consideration. The proposed location for the subject sign is in a redevelopment area. The Redevelopment Agency made the following comments: In order to be consistent with the Planned Sign Program No. 83-2 Freestanding signs should be reserved for major tenants only. All the approved freestanding signs at the shopping center advertise major tenants only and multiple tenant identification signs are not permitted. Staff originally recommended denial of Special Sign Permit No. 85-8 because they di6 not feel that the center, with close proximity to Warner Avenue, justified a 20 too►. hi.gb freestanding sign with 28 tenant copy panels. All but two businesses in the center have sufficient exposure on Warner Avenue fcr identification purposes. Staff has worked with the applicant over the past several weeks to denign a sign that would fulfill the tenants ' needs and meet the requirements of the code ar;d Planned Sign Program 83-2. The applicant's most recent proposal is for a 9 foot high sign with 6 tenant panels (see attached sketch ) . Staff still feels that this sign would not comply with the requirements. Instead, staff is recommending a 6 foot high monument sign with only 2 tenant panels, to accommodate the 2 tenants that do not have exposure on Warner Avenue. STATUS: Pursuant to Section 15311 , Class 11 (a ) of the California Environmental Quality Act Law and Guidelines 1984, the proposed project is rategorically exempt. 4 .0 REDEVELOPMENT STATUS: The proposed location for the subject sign is located in a redevelopment area and the Redevelopment Agency made the following comments: In order to be consistent with the Planned Sign Program No. 83-2 freestanding signs should he reserved for major tenants only. Since the new center does not contain any major tenants an addiLional freestanding sign should not be allowed. If the new l center had a different name or other identity than that may be reason for a separate freestanding sign, but in no case should individual tenants be identified on such a sign. The location of and proximity to arterial highway allows for sufficient visibility of tenant wall sign identification. 5.0 ISSUES AND ANALYSIS: The aistance between the proposes freestanding sign and an existing freestanding sign is approximately 260 feet less than the sign code requires. Also, the proposed freestanding sign does not meet the � intent of the planned sign program that governs the shopping center .
