STATEMENT OF ISSUE•
Transmitted for your consideration is Code Amendment No. 90-8 . This
is an amendment to Article 961, Signs, to allow automobile
dealerships on Beach Boulevard to fly 18 inch helium balloons on all
weekends, large inflatables for a maximum of twelve weekends per
year, and to display flags, banners, pennants and car top signs year
round pursuant to Section 9610 .9 of the Huntington Beach Ordinance
Code.

ANALYSIS•
Code Amendment No. 90-8 is intended to amend the sign regulations,
Article 961, of the Huntington Beach Ordinance Code, to allow the
automobile dealerships located on Beach Boulevard to display 18"
helium balloons on all weekends, large inflatables for a maximum of
twelve weekends per year, and flags, pennants, banners and car-top
signs year round. The code amendment has been requested by the
Huntington Beach Automobile Dealers Association.
There are presently a total of thirteen new car dealerships located
on Beach Boulevard, including Huntington Beach Chrysler-Plymouth,
Huntington Beach Dodge, Campbell Nissan, Huntington Jeep Eagle,
Maxey Toyota, Beach Lincoln Mercury, Huntington Beach Acura, Delillo
Chevrolet, Performance Mitsubishi, York Ford, Roger Miller Honda and
Beach Motors, and South County Volkswagon. In addition, this
proposed code amendment would affect three used car dealerships
located on Beach Boulevard.
Temporary banners, flags, or pennants are presently permitted for
all businesses for a maximum of three (3) times per year for a total
of ninety' (90) days each calendar year to identify a special event
such as a grand opening or anniversary sale. A cash bond to
guarantee removal of the temporary signs is required. Sites with
electronic readerboards are permitted to have temporary signs
displayed a maximum of fifteen (15) days per calendar year.
Automobile dealerships are presently subject to a six-month maximum
time period for display of temporary signs provided that a planned
sign program for the site has been approved by the City. Balloons
are not presently allowed by the City' s Sign Ordinance. Large
inflatables are only allowed in conjunction with a special event
permit .
The automobile dealers are a significant source of revenue for the
City of Huntington Beach. Each year, the City receives
approximately 2 .7 million dollars of sales tax revenue from the
dealers . Recognizing the importance of automobile dealerships to
the City, the Economic Development Department is presently exploring
long-term permanent solutions which will enable the automobile
dealers to be competitive with dealers in other cities . The City
will also be preparing an Urban Design Element of the General Plan
which will look at future design criteria for Beach Boulevard. This
code amendment is intended to assist in the promotion of the
automobile dealerships until such time as a permanent arrangement
for auto dealers is implemented.
According to the Huntington Beach Automobile Dealers Association,
seventy percent (70%) of their sales come from the "impulsive
buyer. " Balloons, flags, pennants, banners and car-top signs are
important advertising and attention-getting devices used by the
automobile dealers to generate walk-in traffic.

Proposed Code Amendment No. 90-8 would grant time and temporary
signage to the new and used car dealerships located on Beach
Boulevard. Specifically, the code would be amended to allow these
businesses to fly 18" helium balloons on all weekends and large
inflatables for a maximum of twelve weekends per year provided that
they do not project over the public right-of-way. In addition, the
new and used car dealerships would be permitted to display flags,
pennants, banners and car-top signs throughout the year.
The proposed code amendment also deletes the requirement that
automobile dealerships prepare a Planned Sign Program in order to
receive additional time for display of temporary signs . The Planned
Sign Program is intended to encourage coordinated and quality sign
design as well as permit more flexible sign standards for commercial
and industrial standards . However, the Planned Sign Program is not
intended to circumvent the objectives of the sign code, and total
signage permitted through a Planned Sign Program cannot exceed the
code by more than ten percent (10%) . Because many of the automobile
dealerships have signage in excess of new code requirements, the
preparation of a Planned Sign Program, which would likely require
the removal of some of their existing signage, presents an economic
hardship for the dealers .
Environmental Status
This project is categorically exempt under the provisions of CEQA.
FUNDING SOURCE:
No funds required.
ALTERNATIVE ACTION:
The City Council may deny Code Amendment No. 90-8 or modify it as
deemed appropriate.

8 . 0 ISSUES AND ANALYSIS:
Code Amendment No. 90-8 is intended to amend the sign regulations,

9 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Code Amendment
No. 90-8 and forward the proposed ordinance to the City Council for
adoption based upon the following findings:
FINDINGS FOR APPROVAL:
1 . Code Amendment No. 90-8 creates regulations which recognize the
nature of impulse buying generated by temporary signage for
automobile dealerships . These signs, because of their location
on Beach Blvd. will not be detrimental to existing and proposed
uses .
2 . Code Amendment No. 90-8 will not adversely affect the goals and
policies of the General Plan. Automobile dealers have unique
businesses in that there are several businesses in one.
Automobile dealers consist of new car sales, used care sales,
major repairs, service, financing and outdoor sales .
10 . 0 ALTERNATIVE ACTION:.
A. The Planning Commission may modify Code Amendment No. 90-8 as
desired; or
B. The Planning Commission may deny Code Amendment No'. 90-8 with
findings .

Dear Mr. Uberaga:
The retail automobile business has become extremely competitive
in recent years. The proliferation of new makes and models,
non-stop factory incentives, over production, and the .development
. of niche markets has created a buyers market. Profit margins
are shrinking, . expenses. are rising, and there is an intense
battle for market share amongst the manufacturers. Locally,
we have experienced increased competition from the advent of
auto malls over the past several years. Santa Ana, Irvine,
Cerritos, Buena Park, La Mirada, Garden Grove, Tustin, Anaheim,
Santa Fe Springs and Yorba Linda all have .auto malls in place
or in some stage of development . Consumers have found these
auto malls to be a convenient way to shop for a car._ The cities
involved have viewed the auto mall as a way to attract additional
sales tax revenues and in many cases have made special concessions
to auto dealers within their city.
The Huntington Beach Automobile Dealers Association was formed to
,present an auto mall image to the- public. Our 11 dealers sell 20
makes of cars and trucks and are all located within 2� miles of
Beach .Blvd in the City of Huntington Beach. We are currently
Advertising on local radio and television with focus on the Beach
Blvd Auto 'Dealers, Huntington Beach. Our members were polled
and agree that advertising brings in 15% to 20% of our business
with the. majority of sales coming from "drive by" traffic. . It
would seem that consumers generally don ' t intend to go out and
buy a car, they merely stop by to shop.
Herein lies our problem:
How do we do a more effective job of attracting attention to our
cars at our dealerships? We look to the city for solutions with
this problem in the form of .a code amendment allowing for. . the
special circumstances with regard to -retailing automobiles.

ANALYSIS:
Code Amendment No . 90-8 is intended to amend the sign regulations,
Article 961, of the Huntington Beach Ordinance Code, to allow the
automobile dealerships located on Beach Boulevard to display 18"
helium balloons on all weekends , large inflatables for a maximum of
twelve weekends per year, and flags, pennants, banners and car-top
signs year round. The code amendment has been requested by the
Huntington Beach Automobile Dealers Association.
There are presently a total of thirteen new car dealerships located
on Beach Boulevard, including Huntington Beach Chrysler-Plymouth,
Huntington Beach Dodge, Campbell Nissan, Huntington Jeep Eagle,
Maxey Toyota, Beach Lincoln Mercury, Huntington Beach Acura, Delillo
Chevrolet, Performance Mitsubishi , York Ford, Roger Miller Honda and
Beach Motors , and South County Volkswagon. In addition, this
proposed code amendment would affect three used car dealerships
located on Beach Boulevard .
Temporary banners, flags , or pennants are presently permitted for
al,l businesses for a maximum of three (3) times per year for a total
of ninety (90) days each calendar year to identify a special event
such as a grand opening or anniversary sale. A cash bond to
guarantee removal of the temporary signs is required. Sites with
electronic readerboards are permitted to have temporary signs
displayed a maximum of fifteen (15) days per calendar year.
Automobile dealerships are presently subject to a six-month maximum
time period for display of temporary signs provided that a planned
sign program for the site has been approved by the City. Balloons
are not presently allowed by the City' s Sign Ordinance. Large
inflatables are only allowed in conjunction with a special event
permit .
The automobile dealers are a significant source of revenue for the
City of Huntington Beach. Each year, the City receives
approximately 2 . 7 million dollars of sales tax revenue from the
dealers . Recognizing the importance of automobile dealerships to
the City, the Economic Development Department is presently exploring
long-term permanent solutions which will enable the automobile
dealers to be competitive with dealers in other cities . The City
will also be preparing an Urban Design Element of the General Plan
which will look at future design criteria for Beach Boulevard. This
code amendment is intended to assist in the promotion of the
automobile dealerships until such time as a permanent arrangement
for auto dealers is implemented .
According to the Huntington Beach Automobile Dealers Association,
seventy percent (70%) of their sales come from the "impulsive
buyer . " Balloons, flags, pennants, banners and car-top signs are
important advertising and attention-getting devices used by the
automobile dealers to generate walk-in traffic .

Proposed Code Amendment No . 90-8 would grant time and temporary
signage to the new and used car dealerships located on Beach
Boulevard . Specifically, the code would be amended to allow these
businesses to fly 18" helium balloons on all weekends and large
inflatables for a maximum of twelve weekends per year provided that
they do not project over the public right-of-way. In addition, the
new and used car dealerships would be permitted to display .flags,
pennants, banners and car-top signs' throughout the year.
The proposed code amendment also deletes the requirement that
automobile dealerships prepare a Planned Sign Program in order to
receive additional time for display of temporary signs . The Planned
Sign Program is intended to encourage coordinated and quality sign
design as well as permit more flexible sign standards for -commercial
and industrial standards . However, the Planned Sign Program is not
intended to circumvent the objectives of the sign code, and total
signage permitted through a Planned Sign Program cannot exceed the
code by more than ten percent (10%) . Because many of the automobile
dealerships have signage in excess of new code requirements, the
preparation of a Planned Sign Program, which would likely require
the removal of some of their existing signage, presents an economic
hardship for the dealers .
Environmental Status
This project is categorically exempt under the provisions of CEQA.
FUNDING SOURCE:
No funds required.
ALTERNATIVE ACTION:
The City Council may deny Code Amendment No . 90-8 or modify it as
deemed appropriate .

FINDINGS FOR APPROVAL:
1. Code Amendment No. 89-14 creates regulations and procedures to

scenic and environmental values are maintained within the City
of Huntington Beach.
3 . Code Amendment No. 89-14 will not adversely affect the goals
and policies of the General Plan.

ANALYSIS•
Code Amendment No. 89-14 is intended to amend the sign regulations,
Article 961, of the Huntington Beach Ordinance Code, to allow
changeable copy signs . This item was generated at the request of
the City Council to allow churches, hotels, entertainment
establishments, etc. to have changeable copy signs which are in
conformance with sign code regulations .
Currently, changeable copy signs, except theater marquees and
electronic readerboards, are prohibited (S. 9610.4h) . However, fuel
price signs and tenant directory signs are permitted (S.9610 . 5) .
Although changeable copy signs are prohibited, several businesses in
the City have signs with changeable copy. These include grocery
stores, florist shops, schools, hotels, churches, and menu boards
for drive through restaurants .
Code Amendment No. 89-14 has been prepared to reflect changeable
copy signs in the permitted sign matrix Sections 9610. 5(b) and
9610 . 5(e) . The provisions will allow a changeable copy wall sign in
addition to the permitted wall sign. This sign may be used to
display calendar of upcoming events, menus, and directories .
Section 9610. 7 requires approval of a special sign permit for
theater marquees; therefore, this type of sign is not included in
the sign schedule.
The changeable copy area on a freestanding sign will be limited to
30 percent of the total allowable sign area in order to ensure that
the changeable copy area will not be the dominant portion of the
sign. To prevent a proliferation of changeable copy signs, this
sign type will be subject to planned sign program approval . By
utilizing a planned sign program approach, staff will evaluate
changeable copy signs for compatibility with surrounding uses .
Staff will also evaluate the ability of the sign to effectively
communicate its message in a manner consistent with a high quality
visual environment.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development posted Negative Declaration
No. 89-61 for 21 days, and written comments were received from the
Environmental Board supporting the negative declaration. The staff,
in its initial study of the project, has recommended a_ negative
declaration be issued. Prior to any action on Code Amendment No.
89-14 , it is necessary for the City Council to review and act on
Negative Declaration No. 89-61.

approval of a planned sign program.

A survey of nearby cities revealed that only seven specifically
address changeable copy signs in their zoning code. A summary is

Article 961
SIGNS
9612 . 2 Permit procedure. A sign permit shall be required prior
to the placement, erection, reconstruction, alteration or display of
any sign, unless expressly exempt by this article.
(a) The approval of a planned sign program pursuant to section
9610 . 6 shall be required prior to application for a sign permit for
the following requests :
(1) Existing developments with five or more activities or
dive or more identification signs where there is a request for a new
freestanding sign.
(2) A special sign permit or limited sign permit request
at a commercial or industrial center. Such planned sign program
shall be a condition and be approved prior to issuance of sign
permit.
(3) Exposed neon conduit, tubing, or raceways, and lit
fascia panels. with or without sign copy.
• (4) Signs which do not conform to all specific
regulations of this article may be authorized by a planned sign
program.
Changeable copy signs as allowed by section
9610.4(h) .
(b) A complete sign application submittal shall include three
(3) sets of fully dimensioned plans drawn to scale. Planned sign
program packages shall be a maximum of 8-1/2 x 11 inches .
(1) A letter from the property owner approving the
proposed signs and authorizing the applicant to submit the sign
application in his/her behalf.
(2) Sign elevations indication overall square footage and
letter/figure dimensions, letter style, color (indicate standard
color number if applicable) , materials, proposed copy and
illumination method.
(3) Building elevations with signs depicted.
. (4) For wall signs, method of attachment; for
freestanding signs, foundation plan. Sign support and attachment
plan.

(5) Type and method of electrical insulation devices,
where applicable.
(6) Site plan indicating the location of all proposed
signs, as well as any existing signs on the site and their square
footages . Photographs should be submitted if available.
(7) For planned sign programs, it may be necessary to
include a written set of design standards. (Ord, 2832, 20 Aug 86)
9610 .4 Prohibited signs . The following signs are prohibited
within the city of Huntington Beach:
(a) Flashing, moving, pulsating, or intermittently lighted
signs, including searchlights, except public service signs such as
those for time and temperature.
(b) Signs which conflict with any traffic control device due
to color, wording, design, location or illumination, or with the
safe and efficient flow of traffic, both vehicular and pedestrian.
(c) Animals or human beings, live or simulate, utilized as
signs .
(d) Loudspeakers, .or signs which emit sound, odor, or visible
matter.
(e) Mechanical movement signs . .
(f) Roof signs as defined by this article.
(g) Projecting signs as defined by this article.

(i) Banners, flags, kites, pennants, or balloons, except if
permitted as temporary signs pursuant to section 9610 . 9(a) .
(j ) Signs which constitute a nuisance or hazard due to their
intensity of light .
(k) Billboards or advertising structures, including any
off-site signs installed for the purpose of advertising a project,
subject or business unrelated to the premises upon which the sign is
located, except subdivision directional signs pursuant to section
9610 . 9 (c) .
(1) Signs which no longer identify a bona fide business
conducted on the premises. Such signs shall be removed by the owner
of the sign within sixty (60) days of the business ' closing date.
(m) Portable signs including "A-frame" . signs and those of a
similar nature which are not permanently attached to the ground of
building .
(n) Vehicle signs, signs addixed to automobiles, trucks,
trailers- or other vehicles on private or public property for the
basic purpose of advertising, identifying, or providing direction to
a use of activity not related to the lawful use of the vehicle for
delivering merchandise of rendering services. Any such vehicles
which have as their primary purpose to serve as a nonmoving sign
display.
(o) Signs on any public property or projecting within the
public right-of-way, expect political signs and those required by
law. This section shall not prohibit the placement of advertising
panels on public service items including but not limited to trash
receptacles, bicycle racks, bus benches, transit shelters, 'and
telephone booths, within public rights-of-way of in
publicly-operated beaches or parks provided such items are placed in
accordance with an agreement granted by the City Council or a
franchise pursuant to the City Charter. Any such advertising shall
be subject to the locational criterial contained in Chapter. 12.36 of
the Municipal Code and approval by the Planning Commission. (Ord.
