The City Council at its meeting of December 6 , 1976 approved the above
referenced code amendment. The Planning Staff at this meeting recommended
some additional minor revisions to the proposed ordinance which were
ultimately approved by the City Council. These included the following:
1. Section 9760. 7 (b)

The Planning Department recommends approval of the attached ordinance.

As the mutual representatives of your merchant community, we
are contacting you to remind your office that recently adopted
Coastal Commission legislation requires your city to prepare and
submit a Master Plan for state approval within the next two years .
There is great concern by merchants that an unaware community
could accept Coastal Commission recommendations that would unrea-
sonably restrict or even prohibit the use. of the "On-Premise Electric
Business Sign" in your city.
Many people do not realize that this form of identification is
generally a merchant' s sole means of advertising his place of busi -
ness and if inadvertantly curtailed will have an affect upon his
business success , employment of local citizens , motorist conveniences
or needs and therefore a reduction of highway taxes into your city.
Interestingly enough. . .your community depends upon that business
sign for its success .

RE: CODE AMENDMENT NO. 73-31: "Rewrite of the Sign Ordinance"
Transmitted herewith is proposed Code Amendment No. 73-31, generally
referred to as a "Rewrite of Article 976 - the Sign Ordinance. This
proposed amendment was previously transmitted to the City Council for
review and discussion at its study session of May 25, 1976. The matter
was referred back to the Planning Commission and staff in an effort to
resolve the differences and concerns that were expressed by various
members of the Sign Committee.
Therefore, the staff and Sign Committee representatives met on a number
of occasions and agreed on a revised draft of the proposed ordinance.
The only resulting changes to the ordinance previously approved by the
Planning Commission included the following:
1. Freestanding signs located in the C2, C3 , and C4 districts would have
an increase in the proposed maximum sign height from 10 ft. to 20 ft.
for those signs located within 12 feet of the public right-of-way, and
an increase from 60 square feet to 100 square feet of sign area.
2. The inclusion of provisions for an appeal process to decisions by the
Planning Director of "planned sign programs. "
The Planning Staff and Sign Committee recommended approval of this revised
ordinance to , the Con miss ion: at :its .meeting of, Oct. 5', 1976.. However, a
majority consensus of the Commissioners ' present could not be reached
either for approval or denial of the staff recommendation as indicated
by the following Planning Commission actions :

denial to allow the Code Amendment to be transmitted to the City Council
for action.

Based on the above actions , the Planning Commission recommends approval

It should be noted by the Council that representatives of the Huntington
Beach Chamber of Commerce and Huntington Beach/Fountain Valley Board of
Realtors were present at the October 5, 1976 Planning Commission public
hearing. They addressed the Commission and spoke in favor of the recom-
mended staff revisions.
ENVIRONMENTAL STATUS :
The proposed Code Amendment has been granted Notice of Exemption No. 76-52
with a finding that the proposed regulations will not have a significant
effect upon the environment.
