BOX 190 CALIFORNIA 92648 TO: Honorable Mayor and City Council FROM: Planning Commission DATE: April 25, 1973 RE: CODE AMENDMENT NO. 73-14 Code Amendment No. 73-14 proposes to amend Article 976 (Sign Code) to provide review and approval action by the Board of Zoning Adjustments prior to issuance of any permits for combination, freestanding, ground, identification, pole and freeway signs, or temporary on-site feature signs located within model homes and sales office complexes. This is an interim measure to grant authority for review of said signs by the Board of Zoning Adjustments until such time as the sign code is fully revised and amended. The Planning Commission held a public hearing on April 3, 1973 but continued action to April 17 , at which time the public hearing on Code Amendment No. 73-14 was reopened and sub- sequently approved by the following vote: Ayes: Bazil , Kerins, Wallin, Boyle, Higgins , Geiger, Porter Noes: None Absent: None The proposed code amendment was reworded prior to approval on April 17 to specifically grant review authority to the Board of Zoning Adjustments at the suggestion of the City Attorney' s office. At the April 3, 1973 public hearing, Mr. Jerry Shea was present and opposed the proposed revision. Mr. Shea stated that signs meeting the requirements of the existing sign code should not be subject to review by the Board of Zoning Adjustments. Public Hearing closed April 3 , 1973. Continued for decision. Code Amendment No. 73-14 was originally scheduled for review by the Planning Commission at the April 3, 1973 meeting. Action was continued to allow the staff time to reword the amendment to grant specific authority to the Board of Zoning Adjustments for sign review. Section 9761. 9 has now been amended to accomplish review of all signs that are detached or free standing. Although there is a 10 day appeal period, we suggest that the matter be set for the earliest possible City Council meeting, because the purpose of any appeal is to have a hearing before the City Council and this is already being accomplished. We further suggest that you not accept any appeal, as it will serve no purpose. If approval has been recommended other than as requested, the City Council will be required to hold a public hearing on this matter. However, there is a possibility that the Planning Commission's decision will be appealed; therefore, we suggest that publication be held off until the 10 day appeal period has expired. If denial has been recommended, the City Council may summarily deny the request. However, we suggest that the matter not be scheduled on the City Council agenda until the 10 day appeal period has expired. However, an important adverse affect of this proposed code amendment is that the types of signs referred to are presently goverened by numerous sign code sections as to size, height, location, etc. , all of which are specific standards and fairly under- standable, but if these signs are to be reviewed for approval by the Board of Zoning Adjustments, such Board, pursuant to Code Section 9761.9.1 must consider additional "Criteria" which are quite subjective and seemingly impossible to determine, i. e. , that the sign will not adversely affect other signs, shall not be detrimental to property in the vicinity, shall be in keeping with the character of the neighborhood, etc. Because of such vague "Criteria", it is submitted that an applicant will not be able to determine what are the code requirements or standards to be complied with in designing such signs or in processing an acceptable application for a. permit for such a sign; NOW, THEREFORE, the Huntington Beach Chamber of Commerce hereby resolves as follows: That the Board of Zoning "Criteria11 provision, Code Section 9761.9.1 be deleted or that it be made specifically not applicable to combina- tion, free-standing, ground or pole signs, all of which have specific existing standards with which they must comply. In this manner, the Board of Zoning Adjustments would still be the approving authority, but fairly definitive stan- dards would apply for the guidance of both the Board and the applicant.
