The Mayor announced that this was the day and hour set for a public hearing on
which decision had been continued from June 4, 1990 to consider the following:

LOCATION: Shopping center at the southwest corner of Edinger Avenue and Sher
Lane
ZONE: . C2-FP2 (Community Business District-Floodplain)
REQUEST: To permit the construction of a freestanding sign that exceeds the
Code permitted maximum height (29 feet in lieu of 7 feet) , maximum area (250
square feet in lieu of 30 square feet) and does not comply. with the minimum
distance required between other freestanding signs on the site (approximately
60 feet in lieu of 200 feet) .
The Community Development Director presented the staff report.
The City Attorney stated there appeared to be technical defects in the origi-
nal permit application because of the failure to get the landowner' s signature
on the permit application and stated that Council had the right to have a
revocation hearing and require removal of the sign.
The Mayor declared the public hearing reopened.
Ron Phadnis, applicant, stated he had read the legal opinion of the City
Attorney and he urged Council to consider the sign as it stands with Sav-On
going above the Kids-R-Us sign. He explained his proposal by using the wall
renderings.
Discussion was held between Mr. Phadnis and Council regarding alternative
solutions. He gave a copy of an alternative solution to the Community
Development Director.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the
Mayor.
A motion was made by MacAllister, seconded by Erskine, to grant the appeal and
overturn the Planning Commission action on Special Sign Permit No. 90-1 as
modified by staff with the following findings and conditions of approval :

Findings for Approval :
1 . Strict compliance with Section 9610.5 will result in a substantial hard-
ship to the applicant. The depth of the lot permits more "major tenants"
than would usually be located on a parcel with a frontage of 855 feet.
Permitting only four secondary tenant signs does not provide adequate
exposure to those "major tenants" located at the rear of the subject pro-
perty; therefore, additional signage is required.
2. The sign will not adversely affect other signs in the area. The sign is
to be located where an existing 25 foot high pole sign is located. No
additional negative impacts are anticipated.
3. The sign .will not be detrimental to properties located in the vicinity.
The sign is located approximately 230 feet from the nearest adjacent pro-
perty on the south side of Edinger Avenue. No additional negative
impacts are anticipated from the construction of the subject sign.
4. The sign will not obstruct vehicular or pedestrian traffic visibility and
will not be a hazardous distraction.
Conditions of Approval :
1 . The site plans and elevations received and dated February 8, 1990, shall
be the conceptually approved layout with the following modifications:
a. The sign shall have a maximum height of 25 feet. The tenant panel
configuration shall be modified to include four tenant panels with a
maximum area of 180 square feet as shown on Attachment No. 5 in the
Planning Commission staff report dated April 17, 1990.
2. Prior to issuance of building permits, the applicant/owner shall complete
the following:
a. Submit copy of the revised elevations pursuant to Condition No. 1
for review and approval and inclusion in the entitlement file.
b. The property owner shall sign, notarize, and record with the County
Recorder a "Letter of Agreement" assuring that if the public
right-of-way is . expanded, the property owner shall be responsible
for the cost of reconstruction, relocation, and/or demolition of the
subject sign.
C. The existing Winchells sign shall be modified to have a maximum
height of 8 feet. and to eliminate the "Edinger Plaza" panel (see
Attachment No. 6 in the Planning Commission Staff Report dated April
17, 1990) . .
3. The applicant may submit plans for a center identification sign to be
located at the main entrance to the retail center for approval . Said
sign shall be subject to Design Review Board approval .
4. The Planning Commission reserves the right to revoke Special Sign Permit
No. 90-1 if any violation of these conditions or the Huntington Beach
Ordinance Code occurs

within one (1) year of the date of final approval , or such extension of
time as may be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days prior to

STATEMENT OF ISSUE•
Transmitted for your consideration is an appeal by Watt Commercial
Properties, Inc. to the Planning Commission' s denial of Special Sign
Permit No. 90-1, a request to construct a freestanding sign in
excess of the maximum allowed height and with square footage greater
than permitted for the retail center near the southwest corner of
Edinger Avenue and Sher Lane.
RECOMMENDATION
Motion to "Uphold the Planning Commission' s action and deny the
appeal of Special Sign Permit No. 90-1. "

ANALYSIS•
The applicant proposes to replace an existing 25 foot tall, 200
square foot, 2 tenant panel, freestanding sign with a 29 foot high,
250 square foot, pylon sign including 4 major tenant panels, 4
smaller minor tenant panels (8 total) and a center identification
sign.
The subject property is over 600 feet deep which allows more anchor
tenants than would typically be located on a parcel with 885 feet of
frontage. Therefore, staff and the Design Review Board recognize
that additional signage from what is permitted by Code is desired to
provide exposure for the major tenants located to the rear of the
property.
Minor tenants are not permitted by Code to have freestanding
signage. The Code does permit, however, a tenant directory which
may have a maximum height of 7' and a maximum area of 30 square
feet. Further, the directory must be oriented to pedestrian and
vehicular traffic on site (not to the traffic on Edinger Avenue) and
be setback a minimum of 30 feet from the exterior property line.
Redevelopment Status :
The subject center is located within the Huntington Center
Redevelopment Project Area. The Redevelopment Agency is currently
proceeding with a precise plan of street alignment study which may
ultimately result in the right-of-way being expanded. The Agency
has commented that, if the sign construction cannot be deferred
until after the study, that the applicant submit a letter of
agreement stating that they are aware that the sign may require
relocation at a later date and that they will be responsible for the
cost of reconstruction, relocation or demolition of the proposed
sign.
Environmental Status:
The proposed project is categorically exempt pursuant to Section
15311, Class 11, of the California Environmental Quality Act .

Design Review Board Status :
On May 11, 1989, the Design Review Board approved Planned Sign
Program No. 88-4 for the wall signs at the subject retail center.
The conditions of approval included the requirement that the
Winchells sign be modified to eliminate the "Edinger Plaza" panel
and to have a maximum height of 8 feet and that a center
identification sign be provided at the main entrance. The applicant
was informed that the proposed 25 foot high double pole sign (the
applicant now proposes the sign to be 29 feet tall) would require
the granting of a special sign permit by the Planning Commission.
The Design Review Board did, however, vote to recommend approval of
the proposed 25 foot high sign to the Planning Commission.
Staff believes that a 29 foot tall sign as requested by the
applicant is not appropriate for the site. Instead, staff feels
that the sign should remain - at 25 feet in height, and have a maximum
of four major tenant panels, and a maximum area of 180 square feet.
An illustration of the staff recommendation is included as a part of
the attached Planning Commission staff report .

Special Sign Permit No . 90-1 is a request to construct a

permitted by the Sign Code. Additionally, the sign is proposed to
be located approximately 60 feet from an existing freestanding sign
in lieu of the Code required minimum separation of 200 feet .
On April 17, 1990, the Planning Commission continued Special Sign
Permit No . 90-1 so that staff could present additional information
regarding the existing signage at the center .
STAFF RECOMMENDATION:
Approve Special Sign Permit No. 90-1 as modified by staff with
findings and conditions of approval .
THE PUBLIC HEARING WAS OPENED
Ron Phadnis, Watt Commercial Development, gave a brief history of
the shopping center and reiterated the reasons for his original
request for a freestanding sign. He said the alternative
recommendation for maximum height of 25 feet with a reduced sign
area does not satisfy the expressed desire of his tenants to have
their businesses included on the sign.
George Arnold, Third and Walnut, spoke in opposition to the
request . He feels there is too much sign clutter at the existing
center which interferes with the required landscaping .
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Commissioner Williams stated that he visited the site and, although
the center is situated on a very deep lot, there did not appear to
be any special land-related circumstances .

The retail center currently has four freestanding signs located
adjacent to Edinger Avenue. As can be seen in the matrix above,
each is legal-nonconforming as the height, area, and/or required
distance between other freestanding signs . The Denny' s sign is 6"
above the maximum height of 7 ' permitted by Code. The
Weinerschnitzel sign is 1 ' 3" above the 7 ' maximum height limit and
21 square feet over the maximum permitted area of 30 square feet .
The Winchell ' s sign is 16 ' 6" above the maximum height of 7 '
permitted by Code and 39 square feet over the maximum area of 30
square feet . The Design Review Board/staff recommendation includes
that this sign be modified to have a maximum height of 8 feet and
that its area be reduced proportionately. Finally, the existing
Phil & Jims/Kids R Us sign is to be replaced by the proposed four
tenant pylon sign.
The wall signs for the center comply with existing Code requirements
and are addressed in Planned Sign Program No 88-4 approved by the
Design Review Board on May 11, 1989 . Briefly, the Code permits 1. 5
square feet of wall sign per lineal foot of leasehold width, maximum
200 square feet. A copy of approved Plan Sign Program No. 88-4 is
attached to this report for reference.

At the last meeting, several of the minor tenants within the center
expressed their desire to have signage on the proposed pylon sign.
Since the last meeting, the applicant has modified their proposal to
include four additional (4) smaller tenant panels (eight (8) tenant
panels total) on the pylon sign and to incorporate a center
identification sign into the sign' s base. Minor tenants are not
permitted by Code to have freestanding signage. The Code does
permit, however, a tenant directory which may have a maximum height
of 7 ' and a maximum area of 30 square feet . Further, the directory
must be oriented to pedestrian and vehicular traffic on site (not to
the traffic on Edinger Avenue) and be setback a minimum of 30 feet
from the exterior property line.
4 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Special Sign
Permit No . 90-1 as modified by staff with the findings and
conditions of approval contained within the attached April 17, 1990
Planning Commission staff report .
5 . 0 ALTERNATIVE ACTIONS:
A. The Planning Commission may deny Special Sign Permit No . 90-1
with findings;
or
B. The Planning Commission may approve Special Sign Permit No.
90-1 as proposed by the applicant .

Dear Mr. Phadnis:
The Planned Sign Program No. 88-4 for the center at the southwest corner of Edinger
Avenue and Sher Lane, Huntington Beach, has been reviewed and approved by the
Department of Community Development. It shall serve as the document for design and
installation of all signs. Unless otherwise specified and authorized herein, the City of
Huntington Beach Ordinance Code, Article 961 entitled "signs" will fully apply.
General Requirements
Prior to installation of any sign a detailed drawing shall be submitted to the City of
Huntington Beach for review and approval. Any drawing submitted to the City must be
approved by the landlord. Two (2) copies of detailed drawings indicating the location,
size, layout, design, materials and color of the proposed sign, including all lettering and
graphics with sufficient architectural drawings depicting the exact relationship with the
stores design shall be submitted.
MAJOR TENANT WALL SIGNS
Major tenants are Osco Drugs, Phil.& Jim's, Kids R Us and Michaels. Proposals for the
major tenant wall signs will be evaluated separately by the staff, taking in consideration_
compliance with the sign code, approved colors and integration to the design of other wail
signs approved by this Planned Sign Program for the rest of the in—line shops.
Discrepancies between staff and the developer will be resolved by the Design Review
Board (a formal application will be required).
WALL SIGNS
SIGNAGE to consist of pan—channel lighted letters attached to building, letter height to
be no more than 24 inches and not lees than 18 inches.

(1) All Channel letters are to be fabricated 22 GA. sheet metal with welded seams -
filled and buffed prior to painting. Fabricated full welded aluminum letters will
be permitted providing they adhere to specifications as outlined for metal
channel letters. Channelume, Channel Classic and LET—R—edge type letters
will not be permitted due to raped deterioration factor — (NO EXCEPTIONS).
(2) Letter faces shall be minimum 1/8" thick, flat surface colored Plexiglas as
manufactured by. Rohm & Haas. Painted Plexiglas will not be permitted.

(3) A. Retainer trim cap shall be 3/4" Black Jewelite brand trim cap edge.
Retaining screws shall be #7 x #3/8" Phillips type sheet metal screws. All
trim cap retaining screws must be painted Gold to match trim cap color.
B. 5" deep letter returns shall be painted minimum of two coats of acrylic
enamel medium bronze.
Two (2) line signs are permitted with an overall height not to exceed 30 inches.
Any changes, alterations or revisions to Planned Sign Program No. 88-4 shall be reviewed
and approved by the Department of Community Development. This Planned Sign Program
is subject to change pursuant to subsequent amendments to the sign code (Article 961) of
the Huntington Beach Ordinance Code or based upon any future remodeling of the
buildings or change in use.
Please find attached a copy of the Design Review Boards action. Be aware that no
monument or freestanding sings have been approved under this Planned Sign Program.

The applicant proposes to replace an existing 25 foot tall, 200
square foot , 2 tenant panel , freestanding sign with a 29 foot high,
230 square foot, pylon sign including 4 tenant panels .

On May 11, 1989 , the Design Review Board approved Planned Sign
Program No . 88-4 for the wall signs at the subject retail center .
The conditions of approval included the requirement that the
Winchells sign be modified to eliminate the "Edinger Plaza" panel and
to have a maximum height of 8 feet and that a center identification
sign be provided at the main entrance. The applicant was informed
that the proposed 25 foot high double pole sign would require the
granting of a special sign permit by the Planning Commission. The
Design Review Board did, however, vote to recommend approval of the
proposed sign to the Planning Commission.
The subject property is over 600 feet deep which allows more "major
tenants" than would typically be located on a parcel with 885 feet of
frontage. Therefore, staff and the Design Review Board recognize
that additional signage from what is permitted by Code is needed to
provide exposure for the major tenants located to the rear of the
property.
Staff believes that a 29 foot tall sign as requested by the applicant
is not appropriate for the site. Instead, staff concurs with the
Design Review Board that the sign should remain at 25 feet in height,
and that, if four tenant panels are needed, existing panels on the

sign should be reduced in size in order to accommodate the new
panels . Staff has prepared Attachment No . 5 to illustrate the staff
recommendation for the proposed sign. Attachment No . 6 illustrates
the staff recommendation for reduction of the existing Winchells sign.
10 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Special Sign
Permit No . 90-1 as modified by staff with the following findings and
conditions of approval . (Modifications include reducing the sign' s
height to 25 feet and requiring the Winchells sign to be modified as
shown on Attachment No . 6 . )
FINDINGS FOR APPROVAL :
1 . Strict compliance with Section 9610 . 5 will result in a
substantial hardship to the applicant . The depth of the lot
permits more "major tenants" than would usually be located on a
parcel with a frontage of 855 feet . Permitting only four
secondary tenant signs does not provide adequate exposure to
those "major tenants" located at the rear of the subject
property; therefore, additional signage is required .
2 . The sign will not adversely affect other signs in the area . The
sign is to be located where an existing 25 foot high pole sign
is located. No additional negative impacts are anticipated.
3 . The sign will not be detrimental -to properties located in the
vicinity. The sign is located approximately 230 feet from the
nearest adjacent property on the south side of Edinger Avenue.
No additional negative impacts are anticipated from the
construction of the subject sign.
4 . The sign will not obstruct vehicular or pedestrian traffic
visibility and will not be a hazardous distraction .
CONDITIONS OF APPROVAL:
1. The site plans and elevations received and dated February 8 ,
1990 , shall be the conceptually approved layout with the
following modifications :
a . The sign shall have a maximum height of 25 feet . The tenant
panel configuration shall be modified to include four tenant -
panels as ' shown on Attachment No . 5 .
2 . Prior to issuance of building permits , the applicant/owner shall
complete the following :
a . Submit copy of the revised elevations pursuant to Condition
No . 1 for review and approval and inclusion in the
entitlement file.

b. The property owner shall sign, notarize, and record with the
County Recorder a "Letter of Agreement" assuring that if the
public right-of-way is expanded, the property owner shall be
responsible f.or the cost of reconstruction, relocation,
and/or demolition of the subject sign.
C. The existing Winchells sign shall be modified to have a
maximum height of 8 feet and to eliminate the "Edinger
Plaza" panel (see Attachment No . 6) .
3 . The applicant may submit plans for a center identification sign
to be located at the main entrance to the retail center for
approval . Said sign shall be subject to Design Review Board
approval .
4 . The Planning Commission reserves the right to revoke Special
Sign Permit No . 90-1 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs .
5 . Special Sign Permit No . 90-1 shall become null and void unless
exercised within one (1) year of the date of final approval, or
such extension of time as may be granted by the Planning
Commission pursuant to a written request submitted to the
Planning Department a minimum 30 days prior to the expiration
date.

The commercial shopping complex located at the southwest
corner of Edinger and Sher serves the entire neighborhood
around the project.
North of the project site across Edinger is a mall with
Montgomery Ward and on the south side there is a large
housing project.
Some of. the major tenants for Huntington Beach No. 1
include Sav-On Drugs, Phil & Jim' s,t Kids R Us and
Michael ' s . Other tenant uses on the site are general
retail in nature .
The 35 , 000 square feet originally designed market area was
split up between two tenants . To accommodate these two
tenants (Kids R Us and Michael ' s) , we had to remodel the
canopies . This work was completed within the last quarter
of 1989 by our company.
Because the center pylon sign is centrally located and is
the only major pylon sign allowed by the City of
Huntington Beach, each of the major tenants have expressed
strong interest in obtaining a visible _ location on this
pylon sign. These major tenants are the sole anchors to
this shopping center , and thus , we feel that to accommo-
date their needs would serve the interests of the City of
Huntington Beach, as well as the surrounding community.

The reason we have come up with a special sign pylon
design is to assist the City of Huntington Beach in
overcoming a mistake in the issuance of sign permits for a
portion of the sign pylon to two separate entities .
The Kids R Us store opened for business in August,
1988 and they evidentally installed a sign face without a
sign permit.
Sav-On Drugs was issued a sign permit on March 3 ,
1989 for the bottom half of the Kids R Us sign face
location . Sav-On Drugs was in the process of having the
sign prepared and installed and they had six months to do
so, which gave them through September 3 , 1989 to install
their sign.
Meanwhile, Kids R Us applied for a sign permit for
their sign faces and a sign permit was issued to them on
May 10 , 1989 long before the expiration of Sav-On Drugs'
sign permit.
The solution we have suggested will allow Sav-On
Drugs the same size of sign face above the Kids R Us sign
which is acceptable to them and will solve any legal
problems , both for the City of Huntington Beach and the
Developer, as Huntington Beach No. 1 , who is the

Owner/Developer, has a legal obligation to both Kids R Us
and Sav-On Drugs to provide sign space on the p�'Lon'• ;'•
In . addition to
sign face for Michaels ' Store , a newly-opened tenant in
the shopping center , who , due to the size of their store,
requires a sign spot on the pylon.
As such, in a spirit of cooperation with the City of
Huntington Beach, we have come up with this design and
hope that we can both solve this embarrassing situation by
modifying the sign pylon design and building a new pylon
of the proposed design.
Therefore, we feel that this request will preserve
the property rights of the tenants without being material-
ly detrimental to the public welfare.

Mr . Phadnis explained to the Board the proposed changes using a
site plan and colored detailed elevations . After some
questions on the project were clarified by Mr . Phadnis , Board
member Smith made a motion to approve the project as proposed.
Higgins seconded and the motion passed 6-0 .
Staff member Martinez explained to the Board that the second
part of the application concerned the building signs on the
rear buildings and the freestanding signs along Edinger Avenue .
The Board shall review Planned Sign Program No . 88-4 as part of
this application and make a recommendation to the Planning
Commission on a twenty-five (25) foot freestanding sign,
containing four panels, proposed adjacent to Edinger Avenue .
This will require the approval of a special sign permit .
After clarifications and discussions between Mr . Phadnis and
the Board members , Adams made a motion to recommend to the _
Planning Commission the approval of Planned Sign Program No . -
88-4 with a special sign permit, including the following
stipulations :

Dear Mr. Simmons:
This letter will confirm our intent to appeal the
decision made by the Planning Commission on Agenda Item
B-2, Special Sign Permit No. 90-1 , in which the Commission
denied the Staff' s recommendation and our project request
for a 29 foot pylon as a shopping center pylon.
Enclosed please find our check in the amount of $200
which is the fee applicable for the filing of this appeal.
We understand that there is no formal appeal application;
therefore, this letter will indicate our intention to
appeal the Planning Commission decision.

Dear Ms. Brockway:
In addition to the appeal letter dated May 7 , 1990
which we submitted on May 9 , 1990 , please note the follow-
ing reasons for appealing the Planning Commission decision
on SSP-90-1 :
(1) The shopping center is extraordinarily deeper
than the normal parking lot depth which creates a necessi-
ty for additional pylon signage on the street frontage.
(2) The lot size is also substantially larger than a
typical parking lot, and again, this necessitates the
additional signage.
(3) The City of Huntington Beach has issued overlap-
ping sign permits for the same space to two major tenants.
Both of the tenants are insisting upon their right to
install their sign pursuant to the issued sign permits.
At present, Sav-On Drugs does not have a sign on the pylon
because Kids R Us has been issued a sign permit taking
Sav-On' s spot. What we are requesting is that Sav-On
Drugs ' sign be added above the Kids R Us sign to facili-
tate this awkward situation, as well as to avoid a possi-
ble legal battle between the City and our major tenants,
i.e. , Sav-On Drugs and Kids R Us.

(4) This shopping center has more than the normal
number of major tenants which requires additional sign
space. For example, Michael' s has been added as a major
tenant and they need exposure on the sign pylon, as well.
Based upon the above, we hope the City Council will
be sympathetic to the issues we have highlighted in this

Stores , Inc.

those "major tenants" located at the rear of the subject
property; therefore, additional signage is required.

sign is to be located where an existing 25 foot high pole sign
is located. No additional negative impacts are anticipated.
3 . The sign will not be detrimental to properties located in the
vicinity. The sign is located approximately 230 feet from the
nearest adjacent property on the south -side of Edinger Avenue.
No additional negative impacts are anticipated from the
construction of the subject sign.
4 . The sign will not obstruct vehicular or pedestrian traffic
visibility anp will not be a hazardous distraction.
CONDITIONS OF APPROVAL:
1. The site plans and elevations received and dated February 8,
1990, shall be the conceptually approved layout with the
following modifications :
a. The sign shall have a maximum height of 25 feet. The tenant
panel configuration shall be modified to include four tenant
panels with a maximum area of 180 square feet as shown on
Attachment No. 5 in the Planning Commission staff report
dated April 17, 1990.
2 . Prior to issuance of building permits, the applicant/owner shall
complete the following:
a. Submit copy of the revised elevations pursuant to Condition
No. 1 for review and approval and inclusion in the
entitlement file.
b. The property owner shall sign, notarize, and record with the .
County Recorder a "Letter of Agreement" assuring that if the
public right-of-way is expanded, the property owner shall be
responsible for the cost of reconstruction, relocation,
and/or demolition of the subject sign.
c. The existing Winchells sign shall be modified to have a
maximum height of 8 feet and to eliminate the "Edinger
Plaza" panel (see Attachment No. 6 in the Planning
Commission Staff Report dated April 17, 1990) .
3 . The applicant may submit plans for a center identification sign
to be located at the main entrance to the retail center for
approval . Said sign shall be subject to Design Review Board
approval .
4 . The Planning Commission reserves the right to revoke Special
Sign Permit No. 90-1 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs .
5 . Special Sign Permit No. 90-1 shall become null and void unless
exercised within one (1) year of the date of final approval, or

NOTICE IS HEREBY GIVEN that the Huntington Beach City Council will
hold a public hearing in the Council Chamber at the Huntington Beach
Civic Center, 2000 Main Street, Huntington Beach, California, on the
date and at the time indicated below to receive and consider the
statements of all persons who wish to be heard relative to the
application described below.

Dear Mr. Simmons :
This letter will confirm our intent to appeal the
decision made by the Planning Commission on Agenda Item
B-2 , Special Sign Permit No. 90-1 , in which the Commission
denied the Staff' s recommendation and our project request
for a 29 foot pylon as a shopping center pylon.
Enclosed please find our check in the amount of $200
which is the fee applicable for the filing of this appeal .
We understand that there is no formal appeal application;
therefore, this letter will indicate our intention to
appeal the Planning Commission decision.

Dear Ms . Brockway:
In addition to the appeal letter dated May 7 , 1990
which we submitted on May 9 , 1990 , please note the follow VWVW
-
ing reasons for appealing the Planning Commission decision
on $SP-90-1 : .
(1) The shopping center is extraordinarily deeper
than the normal parking lot depth which creates a necessi-
ty for additional pylon signage on the street frontage .
(2) The lot size is also substantially larger than a
typical parking lot, and again, this necessitates the
additional signage.
(3) The City of Huntington Beach has issued overlap-
ping sign permits for the same space to two major tenants.
Both of the tenants are insisting upon their right to
install their sign pursuant to the issued sign permits.
At present, Sav-On Drugs does not have a sign on the pylon
because Kids R Us has been issued a sign permit taking
Sav-On' s spot. What we are requesting is that Sav-On
Drugs ' sign be added above the Kids R Us sign to facili-
tate this awkward situation, as well as to avoid a possi-
ble legal battle between the City and our major tenants,
i.e. , Sav-On Drugs and Kids R Us.

(4) This shopping center has- more than the normal
number of major tenants which requires additional sign
space. For example , Michael ' s has been added as a major
tenant and they need exposure on the sign pylon, as well .
Based upon the above, we hope the City Council will
be sympathetic to the issues we have highlighted in this
letter. A separate letter is forthcoming from Sav-On Drug
Stores , Inc.
