We have not been able to meet with all the relevant parties with whom we need to discuss this issue. We feel that another 30 days will give us the time needed to arrange these meetings. In addition, the description of the sign given in the staff report needs to be amended to reflect the sign approved by the mall merchants. We will clarify this matter with staff such that the staff report for the July 16th meeting will reflect the merchants approved sign copy. Attached are copies of the agreements reached between the applicant and the Malta Circle Property Owners at our meeting of July . 30th. Also attached are copies of the configuration of our street to the triangle where the existing sign lives. Should you decide to allow the sign to be elevated to 16' or any other combination or configuration these are the minimal things that would give us a little relief from the impact of guch a sign. We have just received the information that the two large trees within the triangle have suffered a bad infestation of mites. The bugs have departed but the prognosis of the trees i.s unknown at this time. This should bring the Parkway Maintenance Agreement between the Dunlap Co. and the City into prompt attention and allow us to request that those trees be monitered and given special care. Shoul.A they die then they should be replaced with 36" box trees or larger if there is enough space to r.ep.lant them. We have not discussed this with the Dunlap Company because we only found out about the trees yesterday. This packet is submitted to you to bring you up to date on the negotiations between its and the Ma11 and hopefully save a lot of repetition from the podium at the public hearing. The maintenance could probably he mitigated by including it in your existing maintenance agreement with the city . The city recently installed an 8 foot block wall for about $70 per foot . We fer__1 very strongly that the wall. height must be increased because as trees grow the lower foliage disappears and you end up wi. th a 6-8 foot trunk . Strict compliance with Section 9610.5 of the Huntington Beach Ordinance Code will not result in a substantial hardship to the applicant . The existing center is located 500 feet north of the nearest arterial highway, Warner Avenue, however, not permitting modification to a sign off-site will not result in the commercial center not having the exposure to vehicular traffic required to attract customers. r ! P10 5/85 2. The proposed sign is unsightly and will be detrimental to properties in the vicinity. The height, area and location of the sign are not compatible with adjacent properties. 3 . The proposed sign is oversized and will obstruct vehicular or pedestrian traffic visibility and poses a hazard. 4 . The proposed sign contains an excessive number of tenant panels and may be distracting and hazardous to passing motorists . Alternatives to Recommendation: 1. Motion to "Approve the appeal and overturn the Planning Commission' s action on Special Sign Permit No. 89-5 ' as modified by staff with findings and conditions of approval" (Design Review Board Recommendation) . 2 . Motion to "Approve the appeal and overturn the Planning Commission' s action on Special Sign Permit 89-5 as requested by the applicant with findings and conditions of approval" . The existing sign is a 6 foot by 14 foot (84 square feet) internally illuminated monument sign on a 2 foot base (8 feet high total) . The sign has 21 individual tenant identification signs as well as a center identification panel on the top. The original proposed modifications to the existing sign included replacing the center identification panel with six additional tenant identification panels (27 total) and the construction of a 50 square foot internally illuminated center identification panel above the existing sign. Additionally, a space frame structure was to be constructed around the entire _sign to match the architecture of Huntington Harbour Mall . The maximum height of the proposed sign was to be 16 feet and would-- have had a total sign area of 134 square feet. Since the Planning Commission' s denial of Special Sign Permit 89-5, the applicant has modified the request. Although the height and area of the proposed sign have not changed (16 feet and 134 square feet respectively) , the proposed sign now consists of three tenant panels, two panels would be "Major Tenant" signs of 21 square feet each with the other being a 42 square foot changeable copy panel featuring various groups of tenants on a monthly basis . The proposed sign still has a 50 square foot internally illuminated center indentification panel above the tenant panels . Staff has heard testimony that a sign of the size proposed may interfere with intersection visibility. Additionally, a number of the neighbors who live on Malta Circle spoke at the Planning Commission Hearing in opposition to the request. In general terms, they were concerned that a larger sign would have an negative impact on their properties as they could already see the existing sign from their second story bedroom windows . Staff believes that concerns with proposed sign are valid and that the signs as proposed should not be approved. Rather, staff would recommend that a modified version of the sign, as recommended by the Design Review Board should be approved instead. A description of that modified version is as follows . RCA - 6/18/90 -2- (5991d) Design Review Board Status : On February 1, 1990, staff presented the proposed sign to the design Review Board for the purpose of making a recommendation to the Planning Commission. Several alternatives were discussed. The Design Review Board approved a modified version of the proposed sign in which the sign would have a 2 foot base, a 2 foot by 10 foot (20 square feet) internally illuminated display area allowing 2 tenant identification panels as well as directional information, and the center identification sign area done in space frame only (no internal illumination) a maximum of 6 feet high. The sign would have a total height of 10 feet. The top portion of the sign would be illuminated by external light sources only. This sign configuration is attached to this report as Alternative A (Attachment 3) . He said a screening of trees would be added between the sign and adjacent homes to avoid any visual impacts to the neighborhood. He further stated that business identification was greatly needed by the tenants in the center . There were no other persons present to speak for or against the request and the public hearing was closed. The Commission felt that the number of tenants in the center requiring identification were so numerous that to 'include all of them on the sign would cause a visual distraction to passing motorists . They also felt that the recommendation made by the Design Review Board would be the best possible solution. Jim Evans, 3626 E. 7th Street, Long Beach, said he has recently taken over maintenance of the parkway landscaping and feels it has greatly improved and beautified the site. Cozette Thalman, Representative from the Merchant ' s Association, said she represents the 30 tenants in the center and they need more visibility. She said since the residents are concerned with illumination that plans have been made to put signs on a meter to shut off automatically at 10 : 00 PM. She feels the space frame and awnings will be an improvement . Jack Leverenz, 17071 Malta Circle, spoke in opposition to the proposed sign. He feels the sign should only contain directional information. He said the existing. sign was a mistake and urged the Commission to not make another. He said the existing sign is clearly visible to all residents and also feels the west wall should be raised for protection to the residents . R. E. Stiles, 17021 Malta Circle, urged denial of the proposed sign and said the mall is used primariy by local residents and does not feel there should be any directional signs on Warner Avenue and that most of the adjacent neighbors also object to an additional sign height of 8 to 10 feet . June Economakas, 17051 Malta Circle, presented photographs of problems being .caused by the existing sign. She said the sign has everything possible on it and feels the height and location is detrimental to adjacent homes . She feels the lights will shine directly into the master bedrooms of two story homes and says from the second story residents can see the sign. One possible alternative the Commission may wish to consider would be to adopt the sign dimensions recommended by the Design Review Board ' s recommendation, yet allow the center identification portion on top of the sign to be internally illuminated in lieu of space frame. Additionally, the space frame surrounding the structure could be eliminated . This sign configuration would have a maximum height of 9 feet, a center identification panel of approximately 40 square feet, and 20 square feet of tenant and directional information (see Attachment No . 1) . 3 . 0 RECOMMENDATION: Staff recommends that the Planning Commission approve Special Sign Permit No . 89-5 as recommended by the Design Review Board with the findings and . conditions of approval contained in the March 6, 1990 staff report (attached) . This site is approximately 500 feet from Warner Avenue, the nearest arterial highway to the center, and is oriented in such a manner that visibility from Warner Avenue is impossible. The center ' s location resulted from the anticipated Route 1 Freeway and Warner off-ramp which was being planned by the State at the time the center was constructed. If the proposed freeway would have been constructed, the center would have Staff Report - 3/6/90 -2- (4969d) r been located adjacent to the Warner Avenue off-ramp and would have had adequate exposure to the anticipated traffic volumes . The State, however, deleted the proposed freeway leaving the center on a residential collector street which does not provide adequate exposure. The Planning Commission originally approved the existing location of the off-site sign through Conditional Exception (Variance) No . 76-05 . In 1985 , the subject sign was demolished by an automobile. The sign, in its existing configuration, was approved through Special Sign Permit No . 86-8 . A condition of that approval was that the applicant execute a Parkway License Agreement with the City to maintain the landscaped planter where the sign is located . Said agreement was approved by the City Council on May 20, 1987 . Project Description/Discussion: The existing sign is a 6 feet by 14 feet (84 square feet) internally illuminated monument sign on a 2 foot base (8 feet high total) . The sign has 21 individual tenant identification signs as well as a center identification panel on the top. The proposed modification to the existing sign includes replacing the center identification panel with six additional tenant identification panels and the construction of a 50 square foot internally illuminated center identification panel above the existing sign. Additionally, a space frame would be constructed around the entire sign to match the architecture of Huntington Harbour Mall . The maximum height of the proposed sign is 16 feet and would have a total sign area of 134 square feet . The applicant has stated that the sign modifications as proposed are required to accommodate the tenants of the new retail building and to be more representative of the new look of Huntington Harbour Mall . Staff has concerns that the addition of more individual tenant identification panels will further clutter the sign. The existing tenant identification signs are too numerous and small to be safely read from a moving automobile; adding six more will worsen the situation. Additionally, a sign of that size may interfere with the traffic signals at the intersection. The concept of making Huntington Harbour Mall the main focus of the sign, however, is desirable and has staff support . On February 1, 1990 , staff presented the proposed sign to the Design Review Board for the purpose of making a recommendation to the Planning Commission. Several alternatives were discussed. The Design Review Board approved a modified version of the proposed sign in which the sign would have a 2 foot base, a 2 foot by 10 foot (20 square feet) internally illuminated display area allowing 2 tenant identification panels as well as directional information, and the center identification sign area done in space frame only (no Staff Report - 3/6/90 -3- (4969d) i internal illumination) a maximum of 6 feet in height . The sign would have a total height of 10 feet . The top portion of the sign would be illuminated by external light sources only. This sign configuration is attached to this report as Alternative A. The applicant has submitted a letter stating the reasons that he believes that the Design Review Board ' s proposal is unacceptable. First, if space frame only (no background) is permitted for the center identification portion of the sign, the sign becomes one-way only. Those. motorists who would approach the sign from the rear would see the sign backwards . The existing sign can be read from both directions . Second, with only 20 square feet of internally illuminated signage and the space frame on top, the applicant argues that the sign would draw less attention than the existing sign. For the applicant to convince the tenants of Huntington Harbour Mall to eliminate their personal identification panels, the center visibility needs to be improved. Third, the applicant is concerned about possible liability as the sign as approved by the Design Review Board would constitute a "jungle gym" , encouraging youth to climb on the structure . Staff believes that the sign could be designed to accommodate space frame letters on both sides of the sign making -it readable from both directions . Some type of background between the two sides of the letters on the sign would be required. Staff believes that such a configuration with adequate external illumination would create adequate visibility from Warner Avenue without sacrificing public safety concerns . The problem of liability from people climbing on the sign does pose a concern. Perhaps the landscaping surrounding the sign could be designed to discourage potential climbers from approaching the sign. A possible compromise between the applicant ' s request and the Design Review Board ' s recommendation (Alternative A) would be to adopt the sign dimensions recommended by the Design Review Board, yet allow the center identification portion on top of the sign to be internally illuminated as proposed. As such, the sign would have a maximum height of 10 feet with 20 square feet of tenant and directional information on the bottom with approximately 40 square feet of center identification area on top, all internally illuminated. With this option, the City' s concerns would still be met by significantly reducing the number of tenant identification panels (2 in lieu of 21) helping to reduce the amount of information on the sign. This would be less distracting to motorists on Warner Avenue. Additionally, the focus of the sign would be Huntington Harbour Mall itself with directional information, '-which was the original intent of the off-site sign. The applicant would achieve that goal of having the sign architecturally match the newly remodeled mall and would focus the attention of the observers primarily to the mall as a whole. Staff Report - 3/6/90 -4- (4969d) 10 . 0 RECOMMENDATION: Staff recommends that the Planning Commission approve Special Sign Permit No . 89-5 as recommended by the Design Review Board with the following findings and conditions of approval : FINDINGS FOR APPROVAL: 1 . The Parkway License Agreement between the City and the applicant shall remain in effect. 3 . The sign shall only be illuminated during the hours in which the center is open for business . In no case shall the sign be illuminated after 12 : 00 PM. 4 . The maximum number of tenants on either side of the sign shall be limited to two (2) . 5 . The existing nonconforming pole sign on the Huntington Harbour Mall site shall be removed prior to issuance of building permits . 6 . The Planning Commission reserves the right to revoke Special Sign Permit No . 89-5 if any violation of these conditions or the Huntington Beach Ordinance Code occurs . We object to their proposal for the following reasons: 1) The space frame as proposed could not- be utilized for two sided exposure. Due to the transparency of the space - frame, lettering could only be placed on one side. The sign is intended to face traffic from both directions on Warner. 2) The proposed 20 square feet of illuminated sign face would draw less attention to the center than the existing sign which has a much larger sign face. 3) We have a major concern over the safety ramifications of the Design Review Board's proposal. A space frame with maximum .height of 10 feet and minimum height of 5 feet could -become an appealing "jungle gym" for children in the area. I had addressed this concern with you previously wherein I stated that our original proposal would be engineered in such a way as to minimize unwanted and unsafe usage. In summary, we feel that our original proposal serves the purpose of identifying and attracting more customers to our center much mo—cc o t11GLia the.es Ti2$ign review Board's prC��iOSai. Since the original positioning of the center was based upon changes in street patterns which never came about, the sign now serves as our only means of identification to Warner traffic. We feel that increasing our exposure and attraction to this traffic would correlate into increased sales for our Tenants thereby increasing sales tax revenue to the City of Huntington Beach. Perhaps you could propose a solution which might better address the needs of our center as well as the City of Huntington Beach.
