[ ] Yes [ ) New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE• Transmitted for your consideration is an appeal by Councilman Wes Bannister of the Planning Commission' s denial of Special Sign Permit No. 90-5, a request to permit a freestanding sign 20 feet in height in lieu of the maximum 7 foot high sign permitted by code for Campbell ' s Saturn Auto Dealership located at 18801 Beach Boulevard. RECOMMENDATION: Motion to "Uphold the Planning Commission' s action of July 24 , 1990 and deny the appeal of Special Sign Permit No. 90-5 with findings as indicated in Attachment 1" . ANALYSIS• The applicant has indicated that the granting of this special sign permit is necessary in order to: 1) maintain parity with other auto dealerships that currently exist on Beach Boulevard that have free standing signs in excess of the height permitted by code; 2) maintain the full value of his property; and, 3)to not be deprived of the privilege- normally enjoyed by similar uses on Beach Boulevard because of the narrow frontage of his lot. On the issue of parity with other auto dealerships along Beach Boulevard, the signage that many of these dealerships enjoy were granted prior to the enactment of the current sign code and as such are existing non-conforming structures subject to the amortization procedures established by the Huntington Beach Ordinance code. As the owners of these signs begin to request revisions to sign copy and structure design, as appropriate, Limited Sign Permits or Special Sign Permits must be applied for. P10 5/85 Limited Sign Permit applications, when approved, allow change of copy to existing freestanding signs but require removal of the sign - after a maximum period of two years . Special Sign Permit approvals usually result in the removal of very large non-conforming signs in exchange for one that is less non-conforming. This process, though sometimes appearing exceedingly slow, gradually is bringing about the change that is desired and is the goal of the current sign ordinance. The applicant ' s situation, however, does not fit the above described situations . There is presently no existing non-conforming sign on the site. Rather, the applicant is requesting to establish an entirely new non-conforming sign on the site without helping the City accomplish any of the goals outlined above. As such, staff does not feel that the appropriate situation exists for the granting of a Special Sign Permit. With regards to maintaining the full value of his property, it can just as easily be established that the strict enforcement of the sign ordinance will serve to enhance the value of his and surrounding properties as has been demonstrated by communities that have established similar strict standards such as Irvine, San Marino and Beverly Hills . In terms of the deprivation of the privilege enjoyed by similar uses on larger lots, the sign code states that lots of 400 feet frontage or greater may have a maximum 15 foot tall freestanding sign, and lots of less than 400 feet are limited to a freestanding sign of a maximum 7 foot height . The applicant has a lot frontage of 160 feet and is requesting a freestanding sign of 20 feet in height. Design Review Board: The entire signage program for this project was reviewed by the Design Review Board at their meeting of April 26, 1990 . At that meeting the applicant was advised that the freestanding sign should be made to conform to the sign code and be reduced to a maximum height of seven (7) feet. Environmental Status : The proposed project is categorically exempt pursuant to Section 15303, Class 3 , of the California Environmental Quality Act. Strict compliance with 9610 . 5 will not result in a substantial economic hardship to the applicant because the location on Beach Boulevard adjacent to other auto dealerships serves better to attract customers than does an oversized sign. 2 . The 20 foot freestanding sign may adversely affect other signs in the area by increasing the visual clutter in the area . Strict compliance with Section 9610 . 5 will result in a substantial hardship to the applicant since competing auto dealers presently have larger signs . 2 . The sign will not adversely affect other signs in the area since other auto dealers have similar signs . 3 . The signs will not be detrimental to other properties located in the vicinity since other properties have similar signs . 4 . The findings are as follows : - Strict compliance with Section 9610 . 5 will result in a substantial hardship to the applicant . - The sign will not adversely affect other signs in the area . - The sign will not be detrimental to properties located in the vicinity. - The sign will not obstruct vehicular or pedestrian traffic visibility and will not be a hazardous distraction. The applicant has indicated that the granting of this special sign permit is necessary in order to : maintain parity with other auto dealerships that currently exist on Beach Boulevard that have free standing signs in excess of the height permitted by code; maintain the full value of his property; and, to not be deprived of the privilege normally enjoyed by similar. uses on Beach Boulevard because of the narrow frontage of his lot . On the issue of parity with other auto dealerships along Beach Boulevard, the signage that many of these dealerships enjoy were granted prior to the enactment of the current sign code and as such are existing non-conforming structures subject to the amortization procedures established by the Huntington Beach Ordinance Code. As the owners of these signs begin to request revisions to sign copy and structure design, as appropriate, Limited Sign Permits or Special Sign Permits must be applied for. Limited Sign Permit applications, when approved, allow change of copy to existing freestanding signs but require removal of the sign after a maximum period of two years . Special Sign Permit approvals usually result in the removal of very large non-conforming signs in exchange for one that is less non-conforming . This process, though sometimes appearing exceedingly slow, gradually is bringing about the change that is desired and is the goal of the current sign ordinance. In this respect, the applicant ' s site does not have an existing non-conforming sign that would enable him to justify his request . Staff Report - 7/24/90 -3- (6449d) With regards to maintaining the full value of his property, it can just as easily be established that the strict enforcement of the design guidelines for signage as embodied in the sign ordinance will serve to enhance the value of his and surrounding properties as has been demonstrated by communities that have established similar strict standards such as Irvine, San Marino and Beverly Hills . In terms of the deprivation of the privilege enjoyed by similar uses on larger lots, the sign code states that lots of 400 feet frontage or greater msy have a maximum 15 foot tall freestanding sign, and lots of less than 400 feet are limited to a freestanding sign of a maximum 7 foot height . The applicant has a lot frontage of 160 feet and is requesting a freestanding sign of 20 feet in height . A freestanding sign to a maximum height of 15 feet is permitted for properties with lot frontages of 400 feet or greater only. Design Review Board: The entire signage program for this project was reviewed by the Design Review Board at their meeting of April 26, 1990 . At that meeting theapplicant was advised that the freestanding sign should be made to conform to the sign code and be reduced to a maximum height of seven (7) feet . The balance of the signs depicted in the sign plans for this site were approved as displayed in the attached plans . 10 . 0 RECOMMENDATION: Staff recommends denial of Special Sign Permit No. 90-5 based upon the following findings : 1 . Strict compliance with 9610 . 5 will not result in a substantial economic hardship to the applicant because the location on Beach Boulevard adjacent to other .auto dealerships serves better to attract customers than does an oversized sign. 2 .
