AND CONDITIONAL USE PERMITSIN CONJUNCTION WITH TENTATIVE MAPS.
Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments:
STATEMENT OF ISSUE:
Transmitted for your consideration is Code Amendment No. 82-4, a revision
to Article 983., Section 9843, and Article 990, Section 9940,. of the
Huntington Beach Ordinance Code. This revision would extend the time
limitations for the expiration of tentative tract maps, tentative parcel
maps, and conditional use permits filed .in conjunction with tentative
tract maps from 18 months. to 24. moriths.
RECOMMENDATION:
The Planning Commission and Planning. staff recommend .that the City
Council approve Code Amendment No. 82-4 and adopt the attached ordinance.
ANALYSIS:
Applicant: City of _Huntington Beach
Location: City-wide
Request: A code amendment -which would extend the time limitations
for the expiration of tentative tract maps, tentative
parcel maps, and conditional use . permits filed in con-
junction with tentative tract maps from 18 months to 24
months.

DISCUSSION:
As identified. in. the ordinance, the proposed revisions would extend
the limitations for the expiration of tentative tract and tentative
parcel maps and conditional use permits in conjunction with tentative
tract maps from 18 months to 24 months. Said revision would bring the
ordinance code into conformance with the California State Map Act.
.This revision became effective January 1,. 1982, mandating that tenta-
tive tracts be approved for a period of 24 months .
ENVIRONMENTAL STATUS:
Pursuant to the provisions set forth in the California Environmental
Quality Act, Code Amendment 82-4 is exempt from environmental review.
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
Deny .Code Amendment No. 82-4 . This action would have the effect of
making, the City' s ordinance -inconsistent with*, the California State
Map Act.

1 . 0. SUGGESTED ACTION:
Staff recommends that the Planning Commission approve Code Amend-
ment. No. 82-1,. and recommend it to the City Council for adoption,
2.0 ENVIRONMENTAL STATUS:
Pursuant .to the California Environmental Quality Act, code amend
ments are categorically exempt from environmental assessment.
3. 0 ANALYSIS•
Attached is Code Amendment No. 82-1, a revision to Article 984,
Section 9843 and Article 990, Section 9940 of the Huntington Beach
Ordinance. Code. As identified in the Code Amendment, the proposed
revisions would' extend the time limitations for the expiration of
tentative tracts and tentative tracts in conjunction with condi-
tional use permits from 18 months to 24 months. Said revision
would bring the Ordinance Code into conformance with the California
State Map Act. This revision became effective January 1, 1982,
mandating that tentative tracts be approved for a period of 24
months .

BY AMENDING SECTIONS 9843 AND 9940 RELATING
TO TIME LIMITS ON TENTATIVE , TENTATIVE PARCEL
AND FINAL MAPS
The City Council of . the City of Huntington Beach does ordain
as follows
SECTION 1 . The Huntington Beach Ordinance. Code is hereby
amended by amending sections 9843 and 99110 to read as follows :
9843• TIME LIMIT. Each conditional use. permit authorized
under the provisions of this article .shall become null and void
unless. actual construction has commenced within .one ( 1) year from
the date of final approval . In the case of conditional use per-
mit .applications' for planned residential dev.elopments ,. said ap-
proval shall become null and void unless a .final map has been re-
corded with the county recorder ' s office within eighteeetwenty
four ( 1924) months from date of final approval .
9940 • EXPIRATION OF TENTATIVE AND TENTATIVE 1'ARCET, MAPS .
.The approval or conditional approval of a tentative or tentative
parcel map shall expire eighteentwenty-four (1924 ) months from
the date the map was approved or conditionally approved.
SECTION 2 . This ordinance shall take effect thirty days
after adoption.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the

of the City of Huntington Beach, in the Council Chamber of the Civic Center,
Huntington Beach, at the hour of 7;30 P.M. , or as soon thereafter as
possible on Monday the 17th day of May 19 82 .
for the purpose of considering Code Amendment 82-4, a proposal by the City of Huntington
Beach to amend Sections 9940 and 9843 of the Huntington. Beach Ordinance Code, increasing
the time limitations for processing tentative tract maps.
