WHEREAS, Subdivider io the owner of a trace of land In the City of
Huntingtor. Botch, California, which it in seeking to subdivide into lots and to j

dedicate certain streets, allays, and other improvements therein to the: public

WHEREAS, as a condition to the approval of said subdivision map and
the acceptance of the dedication of the streets, atleys, and other improvements
in skid subdivision, said subdivider is required to enter into r.n agreement with
the City of Huntington Beach to do and perform the work hereinafter specified and
to execute and deliver to the City of Huntington Reach, bonds for the faithful
performance of said agreement and for the payment of all labor and material in
con;rection therewith, as required by Sections 66499 and 66499. 3 of the Government
Code of the State of California and Article 997 of the Huntington Beach Ordinance
Codes i
NOW THEREFORE, in consideration of the promises and agreements of
the parties as herein set forth, the parties agree as follows;

5. The Subtlividt-r agrees it) furnish to the City and maintain in
force until the completion of the work herein agreed !o be done by Subdivider,

at Subdivider's expense, a protective liability policy in which the City is named
as an additional insured. The policy shall insure the City, its officers and
employeer while actin; within the scope of their duties, against all claims arising
out of or in connection with tite work to be performed. The policy shall provide
for not le9S than the followiuK .an►ounts:
Combined single limit bodily injury and/or property damage
including products liability: $1, 000, 000 combined sing lc
limit per occurrence.
Such policy shall provide coverage at least as broad as that provided
In the Standard Form approved by the National Bureau of Casualty Underwriters
together with such endorremente as are required to cover the riEks involved.
The Subdivider shall arrange for the policies to be so conditioned
as to cover the performance of extra or.unforeseen work should such work
become necessary.
Prior to the recordation of the Final Tract Map, evidence of insurance
shall be furnished in a form satisfactory to the City. In adJition, the Subdivider

shall furnish evidence of a commitment by the insurance company to notify the

City of the expiration or cancellation of any of the insurance policies required
jhereunder not less than 30 dLys before each expiration or cancellation is
effective.

G. That said City shall not, ror shall any officer or employee there-
of, be liable or responsible for any sccident, loss or damage happening or
occurring to the works specified in this contract prior to the completion and j

be liable for any persons or property injured by reason of the nature of said work.

but all of said liabilities shall be assumed by said Subdivider. Said Subdivider
further agrees to protect said City and the officers thereof from all liability
or claim because of, or arising out of, the use of any patent or patented article
in the construction of said work. +
7. That it is further agreed that said Subdivider will at all times j
from the acceptance by City Council of the highways offered for dedication ir. 1

'said tract up to the completion and acceptance of said work or improvement by i
said Council, give good anti adequate warning to the traveling public of each and
every dangerous condition existent in said highways or any of them, and will
protect the traveling public from such defective or dangerous conditions. That

it is understood and agreed that until the: completion of all the improvements

shall be under the charge of said Subdivider for the purpose of this contract,
and said Subdivider may close all or a portion of any street whenever it is
necessary to protect the traveling public during; the making, of the improvements
herein agreed to be made. And the Subdivider hereby agrees to pay for such
inspection of highways as may be required by the City Engineer of the City
of Huntington Beach.
8. That in the event suit is brought by the City to enforce the terma
and provisions of this Agreement or in any bond given to secure the performance:
hereof, a reasonable attorney's fete, to be fixed by the Court, shall be paid by
the Subdivider.

credit and subdivision Agreement for Tract 10447 as provided for in

Recommendation:
It Is recommended that trj City Council accept Letter of Credit No. 41171
and two copies of the Subdivision Agreement and instruct the City Clerk
to file the Letter of Credit with the City Treasurer. It is further
recontmented that the City Council accept the Subdivision Agreements and
instruct the City Clerk to file one copy and return the second copy to the
fsubdivider.

Transmitted for consideration is the Planning Commissicp' s recommenda-
tion regarding an appeal filed by Councilman Thomas to the imposition
of Conditions of Approval Nos. 4 and 12 of T,;ntative Tract no. 10447.

The Planninq Commission and staff recommend that Tentative Tract No. �
10447 be approved subject to findings and conditions of approval re- ,
fleeted in the Planning Commission's action.
ANALYSIS:
PLANNING COMMISSION ACTION (July 18, 1970) :
On motion by Higgins and second by Russell Tentative Tract No. 10447
was conditionally approved with the following vote:

DISCUSSION:

Tentative Tract No. 10447 is a •19-lot subdivision designed to convey
' previously approved building sites into separate ownerships. i
Administrative Review No. 78-49, approved by the Hoard of Zoning
Adjustments on May 31, 1978, entitled the development of 164, 899 square
feet of industrial building area divided among 20 buildings.
In its approval of the subdivision, the Planning Commission added
Conditions of Approval Nos. 4 and 12 as follows to address concerns
which were identified as a result of a traffic study prepared for the
aio ane proposal:

Condition No. 4: Vehicular access rights shall. be prohibited along
H-e Avenue except for the Burke Street opening and a driveway
previously approved located between Burke Street and Gothard Street.

l Condition No. 12: The Burke Street/Heil Avenue intersection shall
e desIgnea to prohibit left turns for west-bound traffic on Heil
Avenue into Burke Street and left turns from Burke Street onto
Heil Avenue.
These additional conditions of approval satisfactorily mitigated
concerns raised by the Planning Commission in the following areas:
A. Possible impacts of truck traffic on Heil Avenue resulting from
I ' the opening of a north/south street (Burke Street) intersectlr
with Heil Avenue.
' B. Safety of Burke Street/Heil Avenue intersection in terms of
adequate sight distance from the raised elevation in Heil Avenue
east if the project site.
C. Safety of Burke Street/Heil Avenue intersection upon Heil Avenue
bicycle traffic.
The results of the traffic study indicated that the subject tract
should have access from both Heil Avenue and Gotthard Street. Condi-
tions of Approval Nos. 4 and 12 were suggested based on the report
as a measure to reduce potential traffic conflicts in the immediate
area of the Burke Street/Heil Avenue intersection.
The imposition of the appealed Conditions of Approval would require
the developer to design a raised island precluding left turns in and
out of Burke Street (see graphic) . Likewise, the developer would be
required to eliminate a drive opening to Heil Avenue from the most
easterly building site abutting Heil Avenue and reroute onsits
traffic to Burke Street.
ENVIRONMENTAL STATUS:
Negative Declaration No. 78-32 was adopted by the Board of Zoning
Adjustments on April 5, 1978. The environmental documents pertained
to a development proposal that was substantially similar in total
buildi:g area and associated impacts as the developments plan approved
under Administrative Review 78-49. Therefore, a determination waa
made that no further environmental documents were necessary. Since
the proposed subdivision only divides the preapproved development into
lots, the tentative map is deemed to be exeept from further
environmental review.
FUNDING SOURCE.: Not applicable.
ALTERNATIVE ACTIONS:
1. Remove conditions of approval from the entitlement.
2. Other action deemed necessary by the City Council.

mectiiig based upon a forthcoming traffic engineering study of the
proposal .
2. 0 GENERAL INFORMATION:
The subject items were continued from the July 5, 1978 regular Planning
Commission meeting to allow the staff tim,-, to investigate concerns raised
in the following areas:
(a) Impacts of truck traffic on Hell Avenue resulting from the opening
of a north/south street (Burke Street) intersecting with Heil Avenue.
(b) Safety of Burke Street/Heil Avenue intersection in terms of adequate
sight distance from the raised elevation in Heil Avenue east of the
project site.
(c) Safety of Burke Street/Heil Avenue intersection upon Heil Avenue
bicycle traffic.
These concerns were the principal issues resulting from the -Planning
Commission's discussion and oral comments received during the public
hearing from Howard Subtlick, a resident in the abutting residential
tract to the east of the project area.
The staff has since met with Mr. Subnick and discussed the nature of
the project proposal as well as discussing his concerns in more detail.
The staff requested the developer to employ a ,traffic engineering con-
sultant to address those concerns as previously noted. Emphasis was
placed upon developing measures which could possibly be employed to
mitigate potential traffic problems. Since this report was not com-
pleted prior to distribution of the Planning Commission agenda information,
the staff will report on the findings of the study and state their recom-
mended action the night of the Planning Commission meeting.

has been attach-ad for the Planning Commission's review.

2.0 GENERAL INFORMATION:
Tentative Tract Nos. 10447 and 10446--X have been filed in conjunction for
the purpose of coordinating improvement plans for the entire area of
industrially zoned land southeast of Gothard Street and Heil Avenue.

Tentative Tract Map No. 10447 is a 19 lot subdivision designed to convey
a previously approved building site into separate ownerships. Admini-
strative Review No. 78-49, approved by the Board of Zoning Adjustments
on May 31, 1978, entitled the development of 164 ,899 square feet of
industrial building area among 20 buildings. Most of the developments {
upon the property would share reciprocal easements ftr vehicular ingress
and egress. �r
Tentative Tract No. 10446-X establishes a attest configuration serving a ,,,,
16 acre parcel of land as well as linking the two maps with access to
Heil Avenue and Gothard Street.
Precise Plan of Street Alignment No. 78-3 reflects the intended design
of the industrial streets depicted upon Tentative Map Nos. 10446X and
10447. The staff initiated the precise plan to insure than an acceptable
intertying Street design is achieved whether or not the property en-
compassed within Tentative Tract No. 104•. .-X is developed at this time.
3.0 SUMMARY OF ISSUES:
The foiiu*:- ing issues are raised as a result of the project proposals:
(A) Sewer rapacity to accommodate the projects.
(B) Timing of construction of interior streets.
Other issues of concern addresv&d by the staff and ~Subdivision Committee
have since been solved by revised designs or through the institution of
appropriate conditions of approval.
420 ENVIRONMENTAL STATUS:
4.1 Tentative Tract No. 10447:
Negative Declaration No. 78-32 was adopted by the Board of Zoning Adjust—
ments on April 5, 1978 . The environmental documents pertained to a
development proposal that was substantially similar in total building area

and associated impacts as the development plan approved under Administrativ
Review No. 78-49 . Therefore, a determination was made that no further
environmental documents were necessary.
Since the proposed subdivision only divides the preapproved development
into lots, the tentative map as deemed to be exempt from further environ-
mental review.
4.2 Tentative Tract No. 10446-X:
Negative Declaration No. 78-58 was posted on May 25, 1978 and as of the
10 day posting period of June 5, 1978, no comments were received. A corn- 1
munication from the Environmental Council dated June 5, 1977 was received �
registering opposition to dividing the industrial acreage into smaller ;
lots. Section 7.0 of the staff report addresses the concern.
Based on an analysis of the initial study, the staff recommends approval 11
of Negative Declaration No. 78-•58.

4.3 Precise Plan of Street Alignment No. 78-3:
The proposed precise plan of street alignment reflects the street configu-- �
ration of the proposed tentative maps. Based on this premise and previous
environmental documents, the precise plan is exempt from further environ-
mental review.
5.0 PRESENT LAND USE, ZONINGS, AND GENERAL_PLAN DESIGNATION: i 1
The subject properties are presently vacant and toned Ml Light Industrial. } �
The General Plan designation for the property is Light Industrial. There-
fore, the subject property is in compliance with the General Plan and
zoning. j
Property to the north is developed with industrial uses within the M1 zone., i
Property to the east across the railroad rifht-of-Way is developed With
single family homes in the Rl Low Density Residential District. The Warner
Avenue drive-in is located to the south across the County Flood Control
District Channel within the M1 District.
Property to the west across Gothard Street contains an apartment develop-
ment in the R3, Medium Nigh Density Residential District and vacant land
in the M1 zone. An approved industrial subdivision/development is in the
construction stage upon thin vacant land.
6.0 SUBDIVISION COMMITTEE:
The Subdivision Committee (with Commissioners Fin .ey and Stern in attend-
ance) reviewed the Proposed maps at their .Tune 9, 197S meeting. The fol-
lowing issues were discussed:

development on the southwest corner of Hell Avenue and Gothard Street,

Relief Sewer was operational. Consequently, this issue was not a major
item of discussion.
Further flow line measurements by the Depa anent of Public Works revealed
that previous measurements of sewers in thr area were not accurate because
of what is believed to be a settled manhole. based upon a re-examination
of the Heil Avenue Sewer,average and peak flow volumes do not warrant con-
struction of the relief sewer at this time. The relief sewer must txmver be
eventually aonstructed in vier, of the anticipated build-out under existing zoning desig=
nations in the area. A =unication from the Department of public Works addresses this
issue.
6.2 Timing of Construction of Interior Streets:
The interior street shown on Tentative Tract No. 10447 will be constructed
immediately to serve the developments which have already been approved
and is under construction.
The developer of Tentative Tract No. 10446X anticipates a probable develop-
ment schedule of proceeding six months after occupancy of the tenants
of buildings within Tentative Tract No. 10447.
Since the two tracts will not necessarily develop concurrently, a temporary
means of insuring through access from Heil Avenue to Gothard Street has
been required. A 40-foot wide east-west ingress and egress easement (the
equivalent of 2 travel and 2 parking lanes) between Burke Street and
Gothard Street at the common property lines of the two tentative tracts
Would by provided to carry traffic through during this interim period.
The terminus of "Burke Street" would be barricaded during this period
of time. Precise Plan of Street Alignment 78-3 would set a street pattern
for the eventual build-out of the property south of Tentative Tract No.
10447.
The "X Map" process is a means in which the street configuration among
other planned improvements is set on the tentative map but lot confia+l-
rations are established later through the parcel map process. This
process provideb flexibility to the developer where desired parcel co.
figurations are unknown at this time and eliminates the need to submit parcel
maps, adjusting tot lines later.
This treatment was acceptable to the Subdivision Committee. The Committee
also reviewed the access points of the development in significant detail. The
` Traffic Engineer has since addressed .several questions regarding these
access points and concurs in the developeris approach. Minutes of the
Subdivision Committee meeting are Excerpted for the Planning Commission's
information.
7. 0 ADDITIONAL INFORMATION:
The Environmental Council's coiamunication of June 5, 1978 (attached)
recommends denial rc Tentative Tract No. 10446-X. Their recommendation
is based on the need to provide large parcel single user sites rather
than smaller lot subdivisions.

While large lot industrial subdivisions are encouraged, the zoning
ordinance currently allows for the division f land into 10,000 square
foot sites in the M1 zone. This minimum lot area must therefore be
considered acceptable until the City Council enacts code changes.
If the Planning Commission wishes to consider a code change, the staff li
recommends that such a position be reported to the City Council for
direction and priority.
8.0 RECOMMENDATION:
The Subdivision Committee recommends approval of Tentative Tract 10447 , j
10446-X, and Precise Plan of Street Alignment No. 78-3 based upon the
following findings and subject to the following suggested conditions of

The object of this report is to respond to questions raised in
regards to Tentative Tract No. 10447 which is an 11.7 acre
parcel situated at the southeast corner of Iteil Avenue and
Cothard Street in the City of. Huntington Beach (see Figure 1
for Location Map) . The tract includes a. 46 foot wide north/
south street which extends fron Heil Aventte on the north to ;
the southerly property line of the tract, a distance of aFprox:-
mately 750 feet.
The questions raised relate to the effet-c of traffic generateC
by the proposed tract using Burke Street as an ingress and '
egress point at Iieil Avenue. These- questions are:
(1) Possibility of increased truck traffic on Heil
Avenge.
(2) Effect on safety of bicyclists using bike lane
on south side of Iieil Avenue.
(3) Effect of hump at railroad tracks crossing Heil
Avenue on vehicle sight distance.
(4) Possibility of traffic generated by tract using
residential streets to reach
San Diego Freeway.
(5) Effect on traffic of driveway between Burke
Street. and railroad tracks.

Alternative: Street Conficlurations
There are three different configurations that have been discussed
for Burke Street in Tentative T-act No. 10447. rPhese configura-
tions are:
1. Cul-de-sac- .)r dead end Burke Street at southerly
boundary of the tract and allow access to the tract
from Heil Avenue only. This --onfiguration has beer
approved and could be constructed.
2. Cul-de-sac Burke Street at Heil Avenue and allow
access from Gothard Street only by way of Herrman
Way, which is a proposed street in Tentative Tract
No. 10446-X which lies southerly and adjacent to
Tentative Tract No. 10447.
3. Construct Burke Street. and Herrman Way and allow
access from both Heil Avenue and Gothard Street.
Although Alternative #1 could be constructed now, it has several
negative aspects. First, the length of the street from the
centerline of Heil Avenue to the southerly end of Burke Street
would be approximately 750 feet which exceeds the maximum length
of 550 feet recommended by the Fire Department. Another problem
would be that all traffic to and from the development would use
Heil Avenue only. Also, this configuration would offer extremely
poor circulation.
In Alternative #2 the same problem in regards to length of cul-
de-sac exists, except in this rase the length would be in the
range of 1100 feet. Again, this configuration would offer poor
traffic circulation.
A1_ternaL _; ve 43 would offer the best situation in regards to
traffic circulation and does not have the cul-de -sac problem
which the other two alternatives have.
Existing Conditions
Tentative Trr,ct No. 10447 is bordered on the west by Gothard
Street, an arterial street which has an ultimate right of way
width of @0 feet and a curb to curb width of 64 feet., Gothard
is a desiunated truck route from Edinger Avenue on the north to
a southerly terminus at Main Street. The present traffic count
on Gothard Street is estimated at 10, 1'-0 , and the speed limit is

45 mph (see Appendix for Traffic Volume Ilap) . Gothard has two
lanes of traffic and a six foot bike lane in each direction, with
a left turn lane at the intersection of Heil Avenue. Curbs and
gutters have not been constructed south of Heil Avenue.
The tract is bordered on the north by Heil Avenue, an arterial
street which has an ultimate right of way width of 80 feet and a
curb to curb width of 64 feet. The present 24 hour traffic count
is estimated at 8,625. Curb and gutter have been constructed on
the north side of Heil Avenue at their ultimate locations. The
edge of the existing pavement on the south side is six feet north
of the ultimate curb location. At the easterly property line .of
the tract Heil Avenue crosses an existing railroad track. There
is one travel lane and one six foot bike lane in each direction.
Also, opposite the proposed Burke Street intersection there is a
two way left turn lane which changes to a traffic inland as it
approaches the railroad tracks to the east and to a left turn
lane at Gothard Street to the west.. The speed limit on Heil
Avenue is 40 mph.
Possibility of Increased Truck Traffic on Heii Avenue
A typical traffic generation rate from an industrial development
similar to that proposed for Tentative Tract No. 10447 is 100 to
200 trips per acre per day'. If an average figure of 11510 trips
per acre per day is used for the 11. 7 acre parcel, 1755 trips per
day would be expected. Also, from studies of similar industrial
` developments it has been found that typically 5% of these total
f trips are generated by trucks which would give a total of Be
truck trips for this development per day.
Trucks would be expected to vary in size from a pickup to a semi
truck and trailer, with the major portion expected to be: of the
pickup or single unit type which have operating characteristics
closer to a passenger car than a truck.
Heil Avenue is not designated a truck route (see Appendix; for
City Truck Route Map) which means that trucks over three: tons
dross rate are prohibited. Therefore, if• trucks over three tons
gross weight were found using Heil Avenue, the solution would be
to increase police enforcement of the code.
By using the street configuration #3 discussed previously , the
larger trucks could use Herrman Way off Gothard Street which is
designated a truck route. Also, construction of the Center

Street connector between Gothard Street and the San Diego Freeway
would probably offer the most desirable route for people using
the San Diego Freeway (see Figure 1 -- Vicinity Hap) .
Therefore, the truck traffic problem on Heil Avenue would appear
to be mitigated by police enforcement and by construction of the
Center Street connector.
Effect on Safety of Bicyclists Using Bike Lane on South Side of.
Heil Avenue at Bur)ce street
The effect on saf4ty of the bicyclists at Durke Street would be
expected to be no different than any other street intersecting
Heil Avenue and, in fact, would be expected to be less than at
a major intersection such as Gothard Street.
The existing traffic at Burke Street would be controlled by a
stop sign which means they have to yield for any cross traffic
including bicyclists.
The only way to mitigate this problem on Heil Avenue is to use
configuration 12 where access would be from Gothard Street only.
But all that does is move the situation from Heil Avenue to
Gothard Street.
Effect of Hump at Railroad Tracks crossing Heil Avenue
on Veit cle Sa.q t sistance
The basic question is whether there is sufficient sight distance
for vehicles approaching D urke Street from the east being able
to see vehicles turning left from Burke Street into the west-
bound lanes of IIeil Avenue; or, in reverse, if there is suffi-
cient sight distance for a vehicle turning left out of. Burke
Street to see oncoming traffic from the cast.

Figure 2 shows a centerline profile of Heil Avenue for a distance
of approximately 300 feet easterly and 300 feet westerly of the �
railroad tracks. Plotted can this profile are two different
methods for calculating safe stopping sight distances (SSSD) for
vehicles passing over a rise such as that on Heil Avenue.
The first method is based on Figure 7-201. 4 from the California
Depurtment of Transportation (CALTHANS) , Highway Design Manual,
which indicates the SSSD on crest vertical curves . The CALTILANS
figure is based can a height a:' eye for a driver of a car at 3.75
feet above the roadway and ior an object on the opposite side of
the crest at a height of . 5 feet.

Based on this criteria it, was assumed that if an object were
located at the centerline of Burke Street a Arehicle approaching
from the east would be able to see the object for the first time
at a distance of approximately 310 feet from the cent,--rline of
Burke Street.
The second method is based on a publication titled, "Guidelines
for Driveway Design and Location, " published by the Institute of
Transportation Engineers (ITE) , which indicates the minimum SSSD
to the right for cars exiting from driveways onto two, four, or
six lane roads. The ITE data is based on height of eye for the
driver of a car at 3.5 feet above the roadway and a height of
object of 4.5 feet above the roadway.
Based an this criteria it was assumed that if an object or a
vehicle were located easterly of the railroad tracks and another
vehicle were turning left from Burke Street onto westbound Hail
Avenue, the driver of the turning vehicle would see the vehicle
approaching from the: iiast for the first time at a distance of
approximately 560 fe �t from the centerline of. Burke Street.
Two different vehicle speeds could be used to determine the .SSSD.
The first is the speed limit and the second is the 85th percentile
speed. * The speed limit on Heil. Avenue is 40 mph and the most
recent 85th percentile speed on Heil Avenue was determined Ly a
radar survey in November 1977 to be 46 mph.
Table I indicates the minimum SSSD for the two different methods
and For two different speeds.

As shcxwn in Table I, if the 40 mph :.peed limit is used to deter-
;nine the SSSD there is sufficient distance for vehicles to atop
safely. But if the 85th percentile speed is used, there is not
sufficient divtance to stop safely.
The question then arises as to which speed should be used. if
the speed of 40 mph is uned there should be little problem with
vehicles turning left from Burke Street onto Neil Aven-je, as long
as the speed limit is enforced; but the possibility of enforcing
tfiB speed limit is extremely difficult, especially considering
that at the present; time the Bath percentile speed, which is the
speed below which 95% of the vehicles are traveling, is 46 mph.
This indicates that 15% of the drivers are traveling faster than
46 mph.
Therefore, based on the enforcement problem and duo: to the fact
that the sight distance is somewhat restricted, it is recommended
In the interest of safety that the left turn from Burke Street
to westbound Ile 1 Avenue be prohibited.
One possible geometric solution to prohibiting the left. turn is
sho ni in Figure 3.
Possibility of Traffic Generated by Tract: Usinc Residential
Streets to Reach the San Diego Freeway
Evidently there is one particular street in question, and that is
the northerly leg of Rhone Lane which intersects l:_il Avenue just
east of the railroad tracks;.
To travel to the freeway from the proposed tract a peruon would
have to proceed easterly on Heil Avenue, turn left or northerly
on Rhzne Lane, and follow Intone Lane northerly and easterly until �
it terminates at Sher Labe; turn left on Sher Lana and proceed
northerly until it terminates at Edinger Avenue and turn right
on ldingc:r Avenue and proceed through the int;er�je ction of Beach I
Boulevard, which is the heaviest traveled intersection in the
City, to the. freeway.
It seems unlikely that nksny people would be aware of this route:
or would use it if they knew about it because of its circuitous
nature and the Fart- that these residential streets are fairly i
narrow and slow.
An alternative routes from the tract by way of Gothard Street,
which has a traffic volume of approximately one-third than: of
Edinger Avenue and the new Cenwer Street connector, would appear
to be consi.deralay less congested and quicker.

The driveway in question is located on Heil Avenue approximately
40 feet from the railroad tracks. Because of the close proximity
of the driveway to the railroad tracks and the possibility of
conflict with turning traffic at both Burke Street and Rhone Lane,
it: is recommended that this driveway access be relocated to Burke
Street.

Chamber of the Civic Center, Mmtington Beach, at the hour of

cons lder ing an appeal to conditions of approval Nos. 4 and 12 imposed by the
Planning Commission in approving Tentative Tract No. 10447 an July 18, 1978. Said
