In I 1972, both May 26th and August 18th, I requested the assistance of Pat Spencer and Bruce Crosby to aid me in cleaning up this problem, as for one thing the files remaining actire, cluttered up NW system. I gave up at that time, but recent work on the files has brought the impropriety to aW attention. If it is necessary, I cao. list the tracts that have not been foully accepted. In 1972 it was 7 and to date it could be in the area of 30. I will have that i l information next week if needed. I hava checked and every tract is on the 1 City% Final Tract Map. Tract 10067 contains 194 single family detached units. Tract 10068 contains 186 townhouse units of which 149 are two -bedroom units and 37 { are three--bedroom units. Tract 10069 contains 153 single family � . detached units. The 450 affordable units are proposed to be two-t zdroom condominiums. According to the City' n Park Dedication formula which was in effect when the tracts were approved, the following acreages should be dedicated: Tract 10067 3.44 acres Tract 10068 2.30 acres Tract 10069 2.72 aches I 8.46 acres To date, 10.28 acres have been set aside for dedication for the first } three tracts. The EIR analyzes impacts of and alternatives to the proposal by Pacific Coast Homes to demolish th: nistoric metal buildings at the southeast comer of Lake Street and Yorktown Avence. and .,create six tingle--family residential lots. Among the Planning Commission's concerns is the Redevelopment Agency's position on the project alternatives outlined in the EIR. ' RECOISENDA'd91Y: Staff recommends that the Redevelopment Agency find that theproject alternatives as P g y outlined are not feasible and are not consistent with the objectives of the Yorktown-Lake Redevelopment Project Area. AN�LX�; i EIR 89--3 analyzes the following alternatives to the proposed six-lot-single-family subdivision: 1) No project; 2) Onsite retention and reuse of the structures; 3) Alternative locations for the subdivision; and 4) Relocation of the historic buildings. The alternatives analysis suggests that the Agency could acquire the site, and'or relocate the structures to another site. The alternatives, however, are not consistent with the Yorktown-Lake Redevelotment Plan for the following reasons: 1) The no-project alternative (preservation of the site as is) would allow the structures to remain in a state of disrepair, and possibly dangerous to the public health, safety, and welfare. A stated goal of the Redevelopment Plan is to eliminate blighting influences, including deteriorating and obsolete buildings. The applicant's proposal for six, single- family homes is a logical extension of the approved tract immediately to the south. P10/tlds � i I' 2) At the tiro►e the Redevelopment Plan was adopted (1992), the Agency did not anticipate rehabilitation of any structures within the Project Area. Where economically feasible, the Agency may move structures to alternative locations. 3) A preliminary anelysis by Keyser Marston of the reuse options outlined in the EIR, versus planned development of single-family homes. shows that the reuse options would not provide a return on investment. Development costs would exceed project values by amounts ranging from approximately$600,000 to approximately$2.8 million. 4) A possible lard swap alternative whereby the city would obtain the site in exchange for land west of Lake Street is not feasible because the expansion of the Civic Center parking lot is under construction west of Lake Street. 5) All uses within the Redevelopment Area are mandated to conform with existing zoning and GenerAi Plan designations. Some reuse options however, such as multi-family hwising, would require a zone change to allow higher density. Similar high intensity laru: use scenarios south of the Civic Center have-bean consistently denied by the Planning, Commission and City Council over the past seven years. 6) The yearly tax increment revenue cap for the Yorktown-Lake Redevelo ment Area is j $250,000. The expansion of the Civic Center and related improvements have priority at this time, and the Agency will not have sufficient funds available to undertake acquisition or relocation of the metal buildings. The EIR analyzes impacts of and alternatives to the proposal by Pacific Coast Homes to demolish the historic metal buildings at the southeast corner of Lake Street and Yorktown Avenue, and to create six single-family residential lots. Among the Planning Commission's concerns is the Redevelopment Agency's position on the project alternatives outlined in the EIR. REC MM:EI!1 IO ti Staff recommends that the Redevelopment Agency find that the project alternatives as outlined are not feasible and are not consistent with the objectives of the Yorktown-Lake Redevelopment Project Area. ANALYSIS: EIR 89-3 analyzes the following alternatives to the proposed six-lot-single-family subdivision: 1) No project; 2) Onsite retention and reuse of the structures; 3) Alternative locations for the subdivision; and r 4) Relocation of the historic buildings. The alternatives analysis suggests that the Agency could acquire the site, and/or relocate j the structures to another site. The alternatives, however, are not consistent with the Yorktown-Lake Redevelopment Plan for the following reasons: 1) The no •-project alternative (preservation of the site as is) wouid allow the structures to remain in a state of disrepair, and possibly dangerous to the public health, safety, and welfare. A stated goal of the Redevelopment Plan is to eliminate blighting influences, including dete,iorating and obsolete buildings. The applicant's proposal for six, single- family homes is a logical extension of the approved tract immediately to the south. P10l1/05 ►s.. A 2) At the time the Redevelopment Plan was adopted(1982), the Agency did not anticipate rehabilitation of any structures within the Project Atea. Where economically feasible, the Agency may move structures to alternative locations. 3) A preliminary analysis by Keyser Marston of the reuse options outlined in the EIR, versus plarured development of single-family homes, shows that the reuse options would not provide a return on investment. Development costs would exceed project values by amounts ranging from approximately$600,000 to approximately $2.8 million. 4) A. �)3ssible land swap alternative whereby the city would obtain the site in exchange for land west of Lake Street is not feasible because the expansion of the Civic Center parking lot is under construction west of Lake Street. 5) All uses within the Redevelopment Area are mandated to conform with existing zoning and General Plan designations. Some reuse options however, such as multi-family housing, would require a zone change to allow higher density. Similar high intensity land use scenarios south of the Civic Center have been consistently denied by the Planning Commission and City Council over the past seven years. 6) The yearly tax increment revenue cap for the Yorktown-Lake Redevelopment Area is $250,000. The expansion of the Civic Center and related improvements have priority at this time, and the Agency will:tot have sufficient funds available to undertake acquisition or relocation of the metal buildings. ' A revised fee schedule was adopted by the Council by Ordinance No. 2545 on September 7, 1982, anc: Resolutions 5071and 5072 were adopted August 16, 1982. Original Tentative Tract Map No. 11417 was filed prior to that time, along with Conditional Use Permit 81-9. The issue is whether the schedule of fees to be paid in lieu of dedication of land for park or recreation purposes applies to the current tentative tract map. T'ne ma subject tract subj P was originallyfiled in 1981, but wa-* rejected and then later refiled in 1982. The Planning Commission denied the map at that time, and that denial was upheld on June 26, 1982, by the City Council. At the hearing Richard Harlow, a reprebsentektive of the applicant, then asked Council to refer the map back to the Planning Commission so that there would not be a need to duplicate the environmental analysis upon the filing of a subsequent map. The Minutes reflect that council directed that denial of the appeal "included the referral of the matter to the Planning Commission." The chronology supplied by the Director of Development Services is attached and reflects that a revised map was filed on April 5, 1983. The tentative map ultimately approved was filed on June 30, 1983. A further revision was filed on duly 5, 1983. At this time new fees were paid for the Conditional Use Permit, On August 2, 1983, the tentative map "received and dated June 30, 1983, " was approved, subject to conditions adopted April 5, 1983. We are informed, but do not have specific factual details, that there have been final parcel maps (No. 83-562) recorded covering some portions of Tentative Map No. 11417, and that the full park and recreation fees under the new schedule have ieither been paid or bonded under protest. There is apparently no dispute thak the new parcel map was filed after the new fve ordinance was adopted. Recently an application for an extension on the tentative map ! was approved by the Planning Commission, subject to the 1 condition that the fee schedule adopted in September, 1981, apply to the development. . a i There are a number of issues, which will be addrer.sed sequentially. 1. Does the fee schedule adopted in September, 1982, apply to the approved Tentative Map No. 11417 ? jGovernment Code section 66477 allows a city to'require dedication of land or payment of fees in lieu thereof. for neighborhood and community park or recreational purposes as a condition to the approval of the tentative map or parcel ;nap. The statute requires that the ordinance be in effect for thirty (301 days prior to the "filing of the tentative map" and that the ordinance include definite standards for determining the amount of the fees to be paid. Development c^r.vices has taken the position that the tentative map that was tiled on or about March 21, 1983, was the "filing of the tentative map" for purposes o': this section. We concur with the Director that submission of the revised map, some nine (9) months after denial by the City Council, constitutes "filing" under section 66471 . The action of the City Council on June 28, 1962, appears to have been a final action on an appeal from the Planning Commission. We are informed that the Development Services Department treated the rasp that was later filed as a new map, initiating consideration with the Subdivision Committee, notwithstanding the fact that no fees were paid. it is not diapositive that the same map number was applied to the new map, since it is apparently standard practice to continue using a map number until a final map using that number is ultimately recorded. On the other side of the coin, there is some room for argument that the city did not treat the map as a new filing, in not charging a filing fee, in calling it a "renewal map, " and in the ambiguous Council action in referring the earlier map back to the Planning Commission. However, Government Code section 66452 .1 Which requires action on a map within 5u.'ays "after the filing thereof" uses essentially the same languace as section 66477 . It seems feasible to analogize that each filing of a new tentative map triggers both a new 50 day period and new fee calculations and that a tentative map once rejected is "dead" after denial by the Council. Because of the final action by the City Council and the length of time that elapsed before filing a new map, we concur that the city has a reasonable case for deeming the current tentative map to be filed on or about June 30, 1983. 2. Is the condition attached to the extension of the I tentative map that the applicant pay the fees imposed by the September, 1983, ordinance, a valid condition? The Subdivision Map Act permits the life of tentative parcel maps to be extended if permitted by local ordinance. Government Code section 66452 .6 provides that a tentative map 0893L --2- 7 l •.J expires twenty--four (24 ) months after approval or such l additional time as may be prescribed by local ordinance, not to 4� exceed an additional twelve (12) months . We have an 6rdinance � which appears to permit extensions of up to two (2) years And to permit conditions to be imposed on the ex tens ion: •••. (S.9941) . The question is whether the fee conditiop ~imposed by � the Planning Commission on the extension is valid, :and that is the subject of the appeal before the City Council. It does not appear that a substantive condition may be imposed upon extension of a parcel map under the current case law. In an analagous case, El Patio v. Permanent Rent Control i Board of the City of Santa Mon Ica 1950 169 CR 276, t e ^ourt } eld that the city could not impose additional conditions after the conditional approval of a tentative map. The court j reasoned that thu Government Code section permitted conditions only as to time, and that there was no provision which suggested that the legislative body may reconsider its j substantive findings in considering the extension. The holding i of the court was also founded on Youngblood v. Board of Supervinors 150 C.R. 242, which held that: the governing body must render decision on what conditions to impose when it act, i upon the tentative map. Based upon the E1 Patio caae, it is our recommendation that the Council delete the condition. i� 3. May the City Council deny the extension of time: 1 on the tentative parcel map? i The Court in E1 Patio expressly recognized that the decision whether to grant UHe`extension of a tentative map was a discretionary decision with a legislative body. The matter of the extension is now before the City Council for de novo consideration, and the Council has discretion to grant or deny the application for an extension of the map without Conditions . We are uncertain as to the, practical. effects of such an action, since we have not as yet been able to ascertain. from Development Services just what portions;, if any, of the subjcZ1 ' i tentative tract map have been subject to a final map at this i point. CONCLUSION Based on our review of the applicable codes;, it does not appear that any extension of the map may be conditioned upon payment of the fees established under the September, 19 3 Ordinance and fees established by Resolution No. 5072 . however, the city has a good argument that the fee schedules thus adopted apply to i . 0893L the subject development, since the current map can be deemed a new filing following a final action of denial by the City Council on June 20, 1982. Condition number two states that the project shall be subject to current park and recreation fees (Resolution No. 5072) . As stated in the staff report dated July 16, 1985, Section 9941, Cif Subdivision Ordinance, allows the Planning Commission to impose new cons t ons or rev se existing conditions when an extension of time is requested. The practice of imposing new conditions on the granting of an extension of time for a tentative tract has been applied to other tentative tracts within the City and the practice is based on local ordinance. This application was approved by the Planning commission on August 2, 1983, permitting a one lot subdivision for condominium purposes on a 46.6 gross acre site .located on the south side of Clay Avenue between Main and Huntington Street. The zoning on the property is R2-0-PD-CD and R2-0-CD. The expiration date for Tentative Tract No. 11417 ',Revised) is August 2, 1985. An extension of time is not necessary for Conditional Use Permit No. 83-21 (approved on August 2, 1983) because actual construction has commenced within one year from the approved date. The applicant has indicated that a one-year extension is necessary to complete the Final Map phasing plan for the project. Section 9941(a) , city Subdivision Ordinance, specifies that a subdivider may request an extension o the tentative map approval date. Section 9141 (a ) also contains a provision which allows the Planning Commission to impose new conditions or revise existing conditions when an extension of time isrequested. Section 9941 (b) , City Subdivision Ordinance, specifies that the Planning Commission may expend t e approva dateiof a tentative map not to exceed one year, with a maximum of three one -year extensions of. time. RECOMMENDATION: Staff recommends that the Planning commission grant a one-year extension of time for Tentative Tract No. 11417 subject to' the following condition: CONDITIONS OF APPROVAL: 1.
