Staff Recommendation: Denial Planning Commission Action: Denied Reasons given by the Planning Commission for their action: 1 . There is an over-abundance of service stations in this area with three stations existing � mile to the north at the intersection of Warner Ave . and Goldenwest St . 4 * Service stations should be located at 1 mile inter- sections according to the service station standards adopted by the Planning Commission on July 21 , 1970 . After reviewing Ssction 9841 . 4 of the Huntington Beach 4rdinance . Code pertaining to grounds for denial of a use permit application, the Planning Commission made the fol- lowing observations : 1 . Commmercial :�oni.ng on the subject property was based on a freeway alignment that never materialized . It is no longer city policy to zone � mile inter- section-- for C2 or C4 commercial uses . A plot plan eticompassing the entire parcel and delineating all structures proposed for initial and future construction was not filed with the city as requested by the Planning Commission. All :uses on the subject property should be com- patible with surrounding uses ir. the area and with the central city park . i Respectfully submitted , K. A. Joni: The above referenced Use Permit and Division of Land pro- -pose to permit the construction of a service station on the southeast corner of Slater Ave. and Goldenwest St . and to permit a division of land to facilitate the sale of the property. Both applications were heard by the Plan- ning Commission at the September 15, 1970 meeting at which time the staff requested that both items be continued to the October 6, 1970 meeting because the realtors represent- ing the property owner submitted an offer to the City for the purchase of the property. The City Council considered this offer at their September 21, 1970 meeting at which time they requested a letter appraisal of the property, because it was the consensua that the price asked by the property owner was considerably higher than that paid by the City for other park property. Indications from the City Administrator' s office are that it will take approxi- mately 2 to 3 months for the letter appraisal to be sub- mitted. r In view of the above information the staff wishes to re-affirm their position and recomendation for denial of the Use Permit application. With regard to the division of land , it should be noted that if the proposed division meets all City ordinances, the Planning Commission should approve the request; however, to subdivide the property based upon presupposed uses may be unwise for the applicant . There- fore, this should be discussed with the applicant prior to a decision being made. A copy of the original staff report has been included for your consideration. ' "TAFF RJEPORT. Ap'pl i.cfint : Atlantic-Richf i.eld Tate: .'uly 21, 1970 The staff has ;•eviewed Use Permit No. 70-6 and offers the fcllowinr information for your consideration. 1 . This .application was referred to the Planning Commission by the Board of Zoning Adjustments at the Commission' s request that all applications for service stations be referred up until such time as Service Station Standards are adopted . 2 . The property is situated on the southeast corner of Slater Ave . and Goldenwest St . It is zoned C4 highway Commercial District . The parcel in question is 150 f.; . by 150 ft . and is a portion of a 5 . 5 acre C4 parcel of land . 3 . A Division of Land application to divide the C4 parcel into four separate parcels is presently before the Board of Zoning Adjustments . Action on the Division of Land was continued until July 22 , 1970, pending a decision by the Planning Commission on this application. 4.• The 5 . 5 acre C4 property is adjacent to the north boun- dary of the Huntington Central Park. 5 . Although the Service Station Standards have not been � adopted, the Planning Staff has been instructed by the proposed standards and to indicate that the Commission would be enforcing these standards . 6 . Slater Ave . is a secondary arterial highway. Goldenwest Street is a primary arterial highway. The proposed Service Station Standards will not allow service stations to be located at this type of intersection inasmuch as they are to be limited to the intersectior.s of primary and major arterial highways . The applicant was informed of this requirement several months ago when they were investi- gating the possibility of tosating a service station Gt this corner. 7 . It is the consensus of the staff that this is not the proper location for a service station. Therefore , the staff recommends denial of Use Permit No. 70-26 . If , ' h6wever, the Planning Commi:;sion feels that the ser- vice station should be permitted , the staff recommends that the applicant be required to construct a service station similar to the one situated at: the northeast corner of NuriL•ington St . and Pacific Coast Highway and that a shake roof or similar type of roofing material be installed . Also, the staff recommends that the appli- cation be referred to the Board of Zoning Adjustments to establish such conditions of approval as deemed necessary. z l_ r. Box 2304 Term Annex Los Angeles , •Cai iE . 90054 1( .l t MEMO R A N D U M J1 ~ TO: Honorable Mayor and City Council FROM: Recreation and Parks Commission DATE: December 14 , 1970 SUBJECT: SLATER PROPERTY RECONSIDERATION • REVIEW The subject property was first discussed at the Commission meeting of September 9 , 1970 wherein the staff was directed to acquire the 6 . 08 acres through appropriate procedures . Subsequent actions brought the matter to the attention of the City Council with resultant instructions to the City Administrator to have the property appraised and report back with a recommendation . This has been accomplished with an appraisal for the total parcel. of commercially zoned property far exceeding the City capability for purchase . In the meantime , the City Planning Commission denied a use permit involving a service station which was sustained by City Council without bvvefit of in-depth discussion on benefits , terms and legal recourse of the owners . Representatives of the property owners have therefore been seeking a. way in which the property could be utilized in support of the Central Park project , i . e . , visual amenities , access , parking and drainage easement , etc . The owners have agreed to sell 4 . 58 acres of property for the Central Park project at a price under $100 , 000 and further agreed to the following conditions recommended by the Commission and concurred in by the City Administrator : 1 . That the property be apportioned as described on the attachment with a thirty foot parkway on both streets to include park project 'landscaping . 2 . That design of all structures include emphasis on environmental considerations compatible with those structures of the park project and natural landscape . 3. That the Board of Zoning Adjustments exercise the following specific conditions in addition to their standard critiera : i Honorable Mayor and City Council December 14 , 1970 Page Z I'I a . No adjunct uses shall lac allowed . I b . The architecture , landsaping , site layout and design shall. be approved by the Design Review Board. c. Ground identification signs shall be the only j free-standing signs on the service station or nursery sites . 4 . That the Design review Boardapprovals will require the following specific conditions in addition to their critieria : a . All signs will be grouped and placed in land-• sLaped planters . b . Vending machines will not be visible . c . Trash areas will be screened . d. Landscaping will, comprise 10 to 15 0 of the site over and aboire the parkway planting .
