You will. find enclosed a check in the amount of $75 .00 which
is tendared herewith under the order of the City of Huntington
Beach.
This letter is for the purpose of insti.Luting an appeal of the
decision made on August 17, 1971 by the Planning Commission
of Huntington Peach on permit No. 71-29 to the lionoyab?e City
Council.
This appeal is made because the subject decision denied,
without cause or reason, the use permit sought by Fredicks
Development Corporation and, is against the law. The plan
proposed is in full accordance with the existing ordinances
of the City of Huntington Beach and it is thus contended
that the Planning Commission does not have the right to
withhold such permit; that to do so would be a violation of
due process .
This a'-peal is made on behalf of Wellman B. Mills and Jean M.
Mills , the owners of the sub ' ct property , who have a contract
of sale with the subject devopers .

Transmitted herewith is a report on Use Permit No. 71-29. The
Planning Commission took action on this matter at their
August 17, 111'71 meeting. Their action was appealed by Edward
W. Rhodes, agent for the applicant.

This project complies with all Imown and ewisting
zoning and building department regulations, including
parking spaces and layout, yard requirement, etc.

Gentlemen:
The following comments are those of the writer and do not necessarily
reflect the thoughts of any of the other commissioners.
On August 17, 1971 , the Planning Commission unanimously denied
U. P. 71-29, an application by Fredericks Development Company to
permit construction of an apartment project at Atlanta and Newland.
Although the project did comply with the Ordtnarc:e.
Several of the more influencing arguments for denial of the Use Permit
were:
1 . Developers whose apartment projects have been approved by
the City since the Apartment Stanc'7rds were approved by the
Planning Cnmmission on March o, 1971 , complied with the new
Apartment Standards. Fredericks does not comply with these
new Standards.
2. The Planning Commission approved at a public hearing on
March 9, 1971 , and recommended for adoption as an ordinance,
the new Apartment Standards. Since the Fredericks' project
did not comply with the anticipated ordinance which was being
processed through the Council, the Use Permit was denied.

wtth`tFie P1ann;ng;Department anti the City Attorney's Office. I found `that
neither;onx: is valid.
There have been,, apartment.proiects approver this year that comply with
the new Standards. They, may cor.iply in some part, but not entirely. In
almost all cases the density of the projects exceeded the. Standards, . Tiie
Klien'project at Warner and Edwards is an example. The original application
for a Use Permit expired October 15, 1970. A new application was filed
February 18, 1971 , and first her:.rd by the Planning Comrmtsaion on March 23,
1971 . It was approved April 3, 19 71 . The density is about 34 units per acre.
The City Attorney's Office offered the foilowing comment relative to the
second argument. The placem3nt of more s�ringent limitattons on the use
of land subiect to a set or standards expected to become an ordinance in lieu
of the existing ordinance is an invalid attempt to enforce an ordinance that
is not in effect.
Thus, because the principal reasons for denial are invalid and because the
project complies with the Ordinance, it should be approved.
