Tr&nsttitted herewith is a report on Use Permit No. 71-37 and Tentative
Tract Map No. 7555. The Planning Commission took action on these
matters at their September 21, 1971 meeting. Their action was appealed
by Coui uc i loran Ma they.

"Because the proposed use is compatible and to h�gher standards of
development (Article 931) than the allowable uses of the subject

Planning Commission Action: Approved upon the following conditionss
1. The tentative tract map and plot plan received August 20, 1971,
shall be the approved layout.
2. All streets within the project except the street separating
lots 1 and 2 shall be private. The design of the intersection
of private streets with iLe public streets sball be approved
by Department of Public Works.

3. Tree planting equivalent to one 30 inch box tree per.
unit ;hall be provided.

be approved by the Planning Department.
4. Provisions. shall be made to provide f&C: ilities for storage
of equipment and materials required by the association for
maintenance of the project. Such area shall be shown on
the plot plan prior to the issuance of building permits.
5. The 40,000 sq. f t. parcel of land abutting this parcel on
the no and owned by Huntington Harbour Corp. shall
be included in this project as open space.
6. All standard condi+:ions of 4pproval for tentative tracts
that are applicable shall be complied with.

Additional Inforaation; Don Byrnes, representii.g the applicant, explained
theiropoosa. One person spoke in opposition on grounds that he did not

for a continuance to allow their association time to review the proposal.

No. 71-37 • n4 offers the following information for your consideration:
1 These requests have been filed to allow a 234 unit apartment development .411 ch
is Presently under construction to be subdivided as a Planned Residential
Development and sold as individual units in lieu of a rental type development. i
2. The 234 unit apartment complex was originally approved by the Board of Zon'ng
Adjustments in 1969. Upon expiration of the original approval, the Board
reap,,roved the plan in 1570 and 1971. Each approval was subject to the 1969
Apartment Standards as adopted by the Planning Commission.
3. Property to the north is Toned R3 and is vacant. Property to the east is toned
,2 end is vacant. The properties to the south and west are zoned commerci.nl
with some development on the C2 portion across Pacific Coast Highway.
. 4. The tentative tract is a two lot subdivision to be m-me.d in conuron by the owners
of earh of the 234 residential units. Such common area will be npirrtnined by
• a homeowners a.5sociatlon.
The t,,.-o lots are divided by u public street which will provide access to the
properey between this parcel and the main channel in Huntington Harbour. %Il
other drivewny3 within the development will be private.
5. Land use tabulations for the project are as follows:
Cross area 10.95 acres
No. of units proposed 234 (23.3 units per gross acre)
No. of units permitted 291 (29 units per gross acre)
Parking provided: 242 covered spaces, 93 open spaces - Total 335 on site
16 guest parking spaces have been provided in the public streets
which was permitted when the project was first approved.

Current marketing analysis indicates that this particular apartment com--
nlex will be more suitable for inJividual ownership use (condominium).
At this time the developer, willing to satisfy,the indicated need, }proceeded
to proce-s,the project as a condominium by filing'the Use Permit and Ten-
tative . Tract Map of reference. During this processing it became apparent
that by the strict application of current City ordinances and policies, the
:no%v required. amount of open space is 70,000 sq ft and that by specific
application of the rules set forth on the "Standards for Apartment Develop-
ments," adopted March, 1971 , the qualifying open space within the project
' amounts to 40,1500 sq ft.
We feel, . However-•, that the granting of the Use Permit in this case is
fully justified because oU the additional amenities included in the proposed
ownership, such as the use of marina facilities, beach club, tennis courts..
re stairant, beach bar, sauna bath, etc.; all within walking distance from
each dwelWig unit, which amenities will-certainlyL compensate for the
above mentioned apparent shortage `of open space.

It is our opinion that ocean-orientated developments such as this project
should be permitted the use of ocean-oriented amenities to offset open
space area presently reguir,:d by City ordinance and policy. We under--
stand the City is presently discussing an ordinance for ocean-Oriented
developments along the same line of thinking.
Attached you will find a list of statistical data for this project, as presently
constructed, for your use in considering the Tentative Tract and Use
Permit. Your favorable action will be greatly appreciated.
