Gentlemen:
Transmitted herewith is the. Planning Commission recommendation
for denial of Use Permit No 72-21 . The Planning Commis::1on
took action on May 2 , 1.972. Their action was appealed by
William A. Tookey, attorney for the applicant.

To permit an establishment for multi-
colored paper products within an existing
80,000 sq. ft. building on a 5 .47 acre
parcel of land.
Planning, Commission Action: Denied.
Reasons given by the Planni& Corrimission for their action:
1. The proposed printing establishment would be in-
compatible with commercial uses.

2. Use is of a manufacturing nature.
3. Said proposal is not in Zonformance with the
Master Plan of Land Use .
4. A newspaper facility, which is a similar operation
is not allowed in this zone.
5. This request eppears to be in a twilight zone
between manufacturing and commercial uses which
needs to be defined.

Additional Information: Thirteen people spoke in opposition.

1. Use -Permit No. 72-21 is before the Pl.enniiig Commission
because.•the -City Administrator requested the Boar'd of. Zoning
Adjustments to refer. ;the • a�ppl.i.cation to the Cosnnission 'for
.'; a decision. . This request was Made bedaU*v! a niinber of
pproperty, owners in the area requested a xiigt'`= meeting. The
Hoard took this aotion at their April 19th meeting.

2. Uee Permit .No. 72-21 was filed to allow a printing estab-
lishment .for Milti-colored paper 3.47

located on the north sid« of Terry Drive approximately 200 ft.
east of Beach Boulevard in the C4 Highway Commercial District.
3. Printing shops are permitted uses in the commercial district
c erd printings plants are permitted in the industrial districts .
However, the code does not define a printing plant or print-
ing Shop. Because of this , the applicant submitted a letter
outlining the nature of their operation. (A cdpy of this
letter Is attached for your review) . The City Attorney' s
Office reviewed the proposal and submitted their opinion
on the smatter. (The City Attorneys memo is attached) .
4. A map has been attached showing surrounding zoning and land use.
5. There is a limited amount of retail sales associated with this
operation.
6. It is the consensus of the staff that the main question before
the Planning Commission is whether thie operation is a print-
iing plant or a printing shop. If it is deemed a printing
pliant and therefore restricted to the industrial zone, a
conditional exception application will be required to permit
the relEail sales .
7. If the Plan»ing Commission feels the use is permitted in the
C4 zone, the staff 'recommends that the application be .
referred back to the Board of Zoning Adjustments to establish
such conditions as deemed necessary.

19 This appeal is made on the grounds that the City Planning
20 , Department of the City or Huntington Beach made certain errors of
21 ! law and fact in arriving at the decision to deny Applicant its
22 i Use Permit .

28 definitions of "shop" as it appears in.. the Dictionary.
A "Plant.+' 'in the fourth"preferred definition in the same I

3 iiidustrial process , factory, 1racliinery for intellectual work, etc,. "
. :` 4. It: .is submitted, therefore:, that on the basis of these two
_'definitions there is no logical distinction between a plank and a

17 � ily done by sophisticated multicolored printing presses , all of
18.. 1which imst' be maintained within close tolerances and in a scrupu-

21 Finished product deliveries are to customers on gasolene
22 � driven trucks ,• thre.e .in number , and all deliveries from the plant
23 are made only in daylight hours .
24 There= would `be no .objectionable noise , and in fact the present
25 moderate traffic noise emanating from Beach Boulevard and heard
c6 1by residents whose properties and homes abut the . subject property,
27 would *Hake any noise resulting, from' the operation of' the, presses
28 an:. auxilliary equipment inaudible.

2 prink or a department store , or as a bowling alley, since the pro-

3 { posed use 'of the building will involve the entry and exit of about
4 145 vehicles owned and operated by employees on a regular b--!sis

5 daxing the five working days of the week . An additional night
6 shift employing approximately twenty people will be operating durin
71each of the five working days and approximately ten employee owned
811vehicles will be entering and leaving the premises . The plant will
9 �!not be in operation and there will be no production employees in
;OIthe plant on the week--ends . All employees ' and guests ' cars will
1111be parked on the west side of the building away from abutting

Noise measurements have been made at the Consolidated/Eureka Paperbox

Company, in I,os Angeles, and at the proposed new location of this
printing operation in lluntinF_,ton Beach. The measurements and rnalysis
provided in this report, clearly indicate, that the operation at the
proposed site will not create an annoyance at residential locations
to the north and east of the new location.

' •` `• The A-weighed sound pressure level is a recogni?ed standard for meas-
uring the annoyance of noise, Appi!ndix I. Additional information
regarding the potential annoyance of noise is obtained by a measure of
the octave band sound pressure levels. Both of these quantities have
been measured nt the existing; location in Los Angeles and the proposed
location in Huntington Beach, and arc. reported in Sheet_- 1 and 2. In '
addition, an analysis is provided, Sheet 3, which translates the infor-
motion obtained at positions in and adjacent to the Los Angeles oper-
ation, to the proposed site in Huntington }leach.
The A-weighted sound pressure level, at a position five-feet in front
of the .large windows, of the plant in Los Angeles, «as found to be
64 dB(A). This measurement was taken with all machines in operation.

Translation of this rneasurcmenL, to positions fifty-feet from the
exterior wnlls of Lite proposed :site in Huntington Reach, is acco-mplished
by cons-Idering Lilo following: 1'
(1) Spreading loss of Lhe noise from a position five feet from the
windows to the Nifty-foot eistance. This is approximately
a 12 dB loss.
(2) The difference in noise reduction of the four-inch thick
concrete wall, of the Huntington Beach bulldingi versue the
one-quarter inch thi,:'k glass windows in Los Angeles. In
addition, the difference in interior- volumes of the two
buildings is a factor in the amount of sound propagated to
the exterior. The Huntington Beach building is substantially
larger than the building in Los Angeles. These two factors,
wall transmission loss, (TI,) and room size , have been
conservatively estimated to provide a noise reduction of
26 d1l.
When the above noise reduction factors are subtracted from the measured
value, 64 dB(A), .in front of the building in Los Angeles, an estimate

of the noise created by the printing; operation when moved to
Huntington Beach is found as follows;
Measured level , 5-fact 64 dB(A)
Reduction to 50-feet -12 dB
Reduction flue to T1. d )am size -14 dB
Calculated level at Huntington peach 38 O(A)
Hence, it is concluded that the existing operation will create no more
than 38 dB(A) at positions fifty-feet from the walls of the building
in Huntington Beach. It should be noted, that the estimates presented
4 ' herein are conservative. It is very likely that the noise propagated
to the fifty-foot location, by the printing operation, will he less
than 38 dB(A).

Measurements of the mid-af-tfrrnoon ambient sound pressure levels, were
taken in Huntington Bench, as ittflicated in Sheet 2. The lowest ambient
i
sound pressure level was found to be 52 dB(A) at positions fifty-feet
from the walls of the proposed building. This ambient level was prod-
uced- primarily from light traffic on Beach Blvd. It is unlikely that
the ambient sound pressure levels at these locations is below 45 d3(A)
even duringf, the late hours of the evening.
Comparing; the calculated noise level of the operation to the anbicnt
noise levels measured in Huntington Brach, it iF; evident that the
noise produced by the printing operation is at least: lk dB below the
ambient noise level and therefore, will not produce annoyance to the
nearby residential locations. The same conclusion may be drawn by
examining each of the octave band sound pressure levels as is done in
the Noise Assessment Analysis, Sheet 3.

It may be concluded also that the existing size of the operation,
(number of machines) , could double without creating; annoyance to the
surrounding residential locations. A doubling sizn will create
approximately a 3 dtl increase in sound pressure levels. Hence, there
will be adequate margin between the ambient sound pressure levels
existing at the Huntington Beach location and those estimated to be
created by the printing operation.
4 Point of Caution. . .
A number of accesses doors exist along; the east site of the building in
Huntington I:eatch. The doors Oat are not to be used for personnel
t
access, or are required as fire doors, hould be sealed with a caulking '
compound. The remaining doers should be inspected for tightness of
fit. In addition roof vents, or other roof openings, should be either
sealed or provided with a sultahle snuffler arrangement, see Sheet 4.

The low frequency characteristic of the printing operation readily A
• propagates through inadequately unsealed doors or urmuffled vents and �
may invalidate the estima! s provided herein.

Utilisation of the existing loading ramps and docrs, on the south side
of the building, in Huntington Reach, should not create any more noise
than the activities produced by trucks servicing the previous tenant.
However, to Insure- that the printing opc-ration noise sloes not propagate
to residential Locations tltroua,h these large doors, a partition should
be placed between th-. shipping; area and the printing operation within
the building.

A-WEIGHTED SOUND LEVEL

The scale of measurement which is most useful in industrial and co--n-
unity noise measurement is the A-weighted sound pressure level , cor:r,only
called d]1(A) . To establish the dB(A) level the acoustic: signal is Jet-
octet] by the: microphone and then filtered, heavily weighting those por-
tions of the noise which are most annoying and damaging to the hearing

prnces.s. The root-mean-square (rrms) value of this weighted signal is

in]; to note that the A-weirhtcd filter characteristic, shoccn below,
actually amplifies the signal at frequencies between 1000 and 5000 11z.
