with. applicable general and specific plans.

It was the staff ' s position that the plan as submitted, did not
meet the Planned Residential Development standards in that it
was deficient in required open space and parking. It was the
staffs recommendation that the plait be revised to conform to the
requirements for a planned unit development. It was noted that

73. unlit apartment complex on October 25, 1972 and building permits
were issued on January 30, 1973. One unit has since been added,
Addltional Information:
Mr. Richard 'Tom, agent and applicant for K-MAW, Inc. spoke in favor
of t::4e Use Permit. Mr. 'Tom stated that at the time of original
application, the plan conformed to planned residential development
standards , however, the code requirements have since been changed.
Also speaking in fa-.or of the project was i1r. Kenneth J. Golden
representing the builder and Mr, Floyd Jones , General Manager for
K-MAW, Inc. was present to answer any questions.

Tentative Tract No , 8106 was originally scheduled for review by the
Planning Commission at the April 3 mtetin;f , however , said snap was
continued to be heard in conjunction with Use Permit No. 73- 11
which has been filed to allow the conversion of an approved apartment
complex into a condominium development .
PRESENT LAND USE AND ZONING:
Subject property is zoned R2 Medium Density Residential Development
and is presently under consti-uction with the 73 unit apartment
complex. Properties to the east and north are zoned R2 and are
vacant for the most part . The property to the west is also zoned
R2 and is vacant , however , there has been a 75 unit planned develop-
ment approved for construction on ! ubject property. The properties
to the south are toned R3 and is vacant . (Map attached herewith . )

SUBDIVISION CO?4MITTEE REVIEW:
The Subdivision Committee reviewed Tentative Tract No. 8106 and
Use Permit No . 73- 11 at their March 9 meeting . At that time , the
Committee ' s major discussion was the parking and open space . It
was noted that the plan was deficient by 16 parking spaces and 'roll
short of having the required open space by 43 ,030 sq . ft . It was
a consensus of the Subdivision Committee that because the plan
provided less than 1/3 of the required open space that the plan
would have to be revised to comply with the provision of Article
931 for• open space or that a conditioned exception could be filed
for a reduction of 43 ,000 sq . ft . in the required open space .
The Committee did not discuss to any great degree the other aspect
of -the plan its it was felt that a second Subdivision Committee
meeting would be needed on s revised plan . However , to date no
revised plan has been filed nor has a conditional exception been
filed for the reduction of open space .

he plot- plan 1however , from scaling said plan it would appear
that neither the minimum dimension nor the required square
footage meets the provision of Article 931 .
ADDITIONAL INFORMATION:
The Board of Zoning Adjustments approved this development as a 73
unit apartment complex on October ZS , 1972 . It should be noted that
the plot plan submitted on February 14 now as the development showy,
ap a 74 unit proposal .

Dear Mrs . Wentworth:
This is to supplement ourletter of April 18 , 1973, which we Nave
discussed with you by phone.
The Planning Commission failed to take into account the area and
the. Intent of the planned Residential Develpement Ordinance.

Appellant feels the Planning Commission did not properly consider
the factors regarding the former P.R.D. Ordinance and the changing
of t' -:.s project from an Apartment Complex to a Condominium.

If Appellant were allowed to change fron Apartments to Condominium,
there would be no increase- in density. There would be a more stable ,
desireable neighborhood , because ovmers of a Condominium would have
pride of G%4nership and would not be as transient as renters would be.
No objection was made by any member of the public at thr. Planning
Commission hearing.
A Condominium is being approvod next door to this project , under the
former P.R.D. Ordinance, which has greater O?nsity, leis green area ,
fewer covered parking and its overall. design is not as functional and
desireable as this project.
