Weatherly Pursuant to the City Council 's request , attached herewith are conditions of approval that the Planning Commission feel should be imposed on Use Permit No. 73-7 and Administrative Review No . 72-151. These recommended conditions of approval were formulated by the Planning Commission at a regular meeting held March 20 , 1973 , by the following vote : AYES: Bazil , Kerins , Wallin , Boyle , Higgins NOES: None ABSENT: Geiger, Porter The subject use permit and administrative review were denied by the Planning Commission. on February 6 , 1973 pursuant to Section 9811 . 2 . 1 of the Huntington Beach Ordinance Code. Although not a part of the motion to deny , the Commission made the following findings : 1. The granting was not necessary to serve the enjoyment of one or more substantial property rights . 2 . The granting would adversely affect the Master Plan of the City of Huntington Beach. 3. The proposed use is not compatible with other uses in the area. Chairman Porter directed the staff to inform the City Council that they are opposed to the granting of Use Permit No . 73-7 and Administrative Review No. 72- 151. It is the Commission' s opinion that because the :property is higher at the rear , an eight foot wall will not screen the facility from Talbert. This is an important factor since Talbert *venue i:; a major street to and through Huntington Central Park. Further, the Planning Commisslon has instructed the Planning Depart- ment to investigate the possibility of attaching a Civic District Suffix to the major chroughfares to and through Central Park and/or : possibly rezoning the industrial property on these streets to afford greater setbacks and additional landscaping . Weatherly City Council Meeting July 2 , 1973 Dear Members of the Council: I am enclosing a copy of my letter to Assistant City Attorney Willis Mevis of May 31, 1973, outlining the agreement between the City and Mr. Weatherly as determined at th.e regular meeting o: the City Council on May 7 , 1973 . One of the ur oses of this letter is to advise the Council purposes that Mr . Weatherly has done everything possible to cooperate with the City on entering into the written agreement. I believe that in the event we do not have the written agree- ment by the City Council meeting of July 2 , 1973, that the terms as set out my letter will suffice . The main points are the dedication by Mr . Weatherly of the roadway, the bond for the sewer improvement and the deletion of the planning commission 's requirements for complete sewer connection at the present time and improvement of the dedicated street. All of these should be covered by the order of the council and the remaining requires-en-ts are all set forth in the conditions as specified by the planning commission. The second purpose of this letter is to advise the Council of the purpose of certain changes in the revised plot plan as submitted by Mr. Weatherly to the environmental review board and the planning department of the. City. The building was moved to the western edge of 'the property for visual blocking purposes at the suggestion of the environmental and planning department. (Attorney s opinion attached. ) PRESENT LAND USE AND ZONING : Subject property is presently facant laL,d and is zoned Ml Light Industrial District . All surrounding properties are vacant and are zoned MI as was the school site to the south until it was redesignated by the City CF-E Community Facility:Education. (See attached map. ) ANALYSIS : These applications have been filed to facilitate the construction and operation of an automobile dismantling facility. The Administrative Review application is to allow dismantling within � a fully enclosed building and the Use Permit is to allow storage of tho automobiles prior to said dismantling. It should be noted that the Planning Commission has approved in the past similar type uses in the Ml District , however, all prior uses of this nature were processed by conditional exception as the dismantlin was proposed to be conducted outside the building. Following are the conditions of approval as required by the Planning Commission on one dismantling yard : 1 . The use shall conform with requirements of S. 9533 . 1 , Motor Vehicle Storage Yazd, except the recuired masonry wall may be constructed of metal baked aluminum subject to review by the Board of Zoning Adjustments on o:: before March 4 , 1972 , to insure permanence and maintenance of said wall . 2 . Vehicular access shall be approved by the Traffic Engineer. 3 . A Division of Land application shall be fixed and approved prior to the issuance of building permits . 4 . Gothard Street shall be dedicated and fully improved to City Standards . Improvements shall include street lights , street trees , fire hydrants , sewer and water main extensions . S . A plot plan depicting off-street parking, landscaping, sales and storage areas , setbacks , etc. shall be submitted and . approved by the Planning Department prior to issuance of permits . ' 6 . The Commission should pursue relocation of the facility westerly and adjacent to the railroad right of way. Mr. Rus Calisch, 27152 Pacific Coast Highway, City, addressed Council and stated, that he was speaking for Mr. LeRoy Grannis. He re-submitted the communication prepared by the comnittee and spoke regarding their proposal to legalize surfing between the hours of 11:00 A.M. and 5:00 P.M. during the summer months when inclement weather existed, make tle use of helmets during the U. S . Surfboard Championships optional, and the possible reduction of fees for parking meters along Pacific Coast Highway between 12th Street and Balsa Chica State Beach. He also submitted and read a communication which he had received frotr the Department of Beaches , County of Los Angeles, regarding surfing regulations at Hermosa Leach. Mr. Max Bowman, Assistant Director of Harbors, Beaches and Development, spoke regarding the City' s present ordinance -elative to the permitted hours for surfing. Mr. Jerry Smith, 217 Elmira Street , City, spoke in opposition to the fee for the parking meters between 12th Street and Bolsa Chica State Beach. He suggested that the parking meter fee be reduced to no more than 1.4 per hour.
