Use Permit No . 86-2 is a request to permit beer and wine sales in conjunction with an existing drive-through dairy business located at 15492 Edwards Street . RtCOMMENDATION: Planning Commission action and recommendation on March 4 , 1986 : ON MOTION BY ERSKINE# SECOND BY WINCHELL, THE PLANNING COMMISSION DENIED THE APPEAL AND UPHELD THE BOARD OF ZONIVG ADJUSTMENT' S DENIAL OF USE PERMIT NO. 86-2 WITH rFINDINGS BY THE FOLLOWING VOTE: AYES: Rowe , Winchell , Livengood , Fiskine , Porter , Mirjahangl NOE : None ABSENT: Schumacher ABSTAIN: None FINDINGS FOR DENIAL : 1 . The proposed use permit to allow the sale of beer and wine in conjunction with a drive-through dairy is inconsistent with the City 's intent to prohibit beer and wine sales in conjunction with drive-through or drive-up uses . 2 . The dairy site is nonc:ontorning to the requirements of the Zoning code ode regarding landscaping and the drives through lane . The sale of beer and wine would constitute an expansion of a nonconforming use . 3 . Granting of the use permit would be detrimental to the surroundinq neighborhood . Staff recommendation : Deny the appeal and uphold the Planning Commission 's action to deny Use Permit No . 86-2. ANALYSIS: on February 51 1986, the Board of zoning Adjustments reviewed and denied Use Permit No. 86-2 , a request by Linda Frith Kien, dairy operator , to add beer and wine sales to an existing drive-through dairy located at 15492 Edwards Street just north of Edinger Avenue . Subsequently , the applicant appealed the decision to the Planning Commission . The Planning Commission upheld the Board of Zoning Adjustment ' s action and denied the appeal on March 4 , 1986, based upon the concept of drive-through beer and wine sales as being inconsistent with the city' s intent- to prohibit beer and wine sales in conjunction with drive-through or drive--up uses . Last December , the City adopted an ordinance prohibiting concurrent sale of alcoholic beverages on the same premises as gasoline sales . This was to limit the availability and ease of procuring alcoholic beverages which could easily be consumed in the vehicle and to eliminate the convenience or purchasing packaged consumable alcoholic beverages when buying gasoline . This principle applies to the applicant. e request to sell beer and wine in conjunction with a drive-through dairy . Received at the Planning Commission Meeting were letters and a petition signed by 16 neighbors who oppose the project . Their main objections are ( 1 ) alcoholic beverages sold in conjunction with a drive-thru dairy would promote drinking and driving; ( 2 ) there are five sources of liquor sales already existing in the vicinity; ( 3 ) there are many schools and churches within wnlring distance of the proposed facility; and ( 4 ) another liquor e.t; t %blishment in the vicinity would be detrimental to their neighborhood . The apr-Aicant 's representative has submitted an appeal to the Planning Commission ' s denial with a response to each finding fo;: denial (see attached ) . She has indicated that the City 's prohibition. of beer and wine sales in conjunction with gasoline sales is desireable but inapplicable to this request . Although the prohibition does not expressly include drive-thru dairies , the intent was to limit the ability to purchase alcoholic beverages in conjunction with drive-thru facilities . 1 f kcA 4/7/86 -z- ( 4536d ) 1 If the request is approved, the applicant has indicated that all proper inmprovements to the property regarding parking and landscaping will be made . ENVIRONMENTAL STATUS: The proposed project is categoricdlly exempt pursuant to Section 15301 from the provisions of the California Environmental Quality Act . FUNDING SOURCE: Not applicable . ALTERNATIVE ACTION: Reverse the decision of the Planning Commission and approve Use Permit No . 86-2 based on the following findings and conditions : FINDINGS FOR APPROVAL: 1 . The establishment , maintenance and operation of the drive-thru dairy with beer and wine sales will not be detrimental to: a . The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building . 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach . 3 . The proposal is consistent with the City 's General Plan of i,and Use . 4 . Improvements to the site will be made which will bring it in conformance with current zoning code requirements . SUGGESTED CONDITIONS OF APPROVAL: I 1 . A revised site plan shall be submitted depicting the modifications described herein : a . Drawn to scale I b. Dimension all setbacks , parking stalls , proposed planters , etc. I, c . Designate drive-thru lane and pick-up area , and dimension properly. d . Prior to issuance of building permits , the applicant shall submit the following plans : a . Landscape and irrigation plan to the Department of Development Services and Public Works for rev.ew and approval . b . Landscaping shall comply with Article 979 of the Huntington Beach Ordinance Code . 3. Installation of required landscaping and irrigation systems shall be completed within ninety ( 90 ) days . 4 . The development shall comply with all applicable provisions of the Ordinance Code , Building Division , and Fire Department . 5 . The major identification sign shall be removed or altered to comply with Article 976 within ninety ( 90 ) days . 6 . Prior to the sale of beer and wine , the subject property shall enter into irrevocable reciprocal driveway easement between the subject site and adjacent easterly and southerly properties . A copy of the legal instrument shall be approved by the City Attorney as to form and content and , when approved, shall be recorded in the Office of the county Recorder and a copy filed with the Department of Development Services . If such easements currently exist , a copy must be submitted to the Development Service Department . 7 . Cit, 0 inance #9730.84 -- Sale of alcoholic Beverages Prohibited - Applies only to service stations selling gasoline. Although this prohibition is desirable, in the case of this dairy this prohibition is inapplicable. As its name clearly indicates, the dairy is in the business, of selling milk and milk products and has nothing to rio wi to gasoline or car repair j Sales. Additionally, air this is the only drive-through dairy in Huntington Beach, any additional policy the city may adopt regarding drive-through dairies would discriminate against this one individual business directly; 2. The owner is willing to comply with all suggested conditions of npproval contained on page : of the Staff Report dated Harch 4, 1986. There specifically include requirements that the use meet all of the zoning code requirements regarding landscaping and the drive-through lane. 3. Granting of this use permit would be beneficial to the surrounding neighborhood . (Cont 'd. ) The only objections to the Use Permit made at the Board of Zoning meet:,ig or at the Planning Commission hearing were brought by pr.ople associated with Chalet Liquor. Indeed, Mr. M. Disokeyl. spoke at the Planning Commission hearing and represented himself as the owner of Chalet Liquor . The preservation of Chalet Liquor 's business advantage is not proper grounds for the City of Huntington Beach to deny this Use Permit Application. GROUND3 FLOP. APPROVAL Some discussion concerning the safety of alcoholic beverage sales from this dairy occurred nt the Planning Commission meeting. The alcoholic beverage commission will grant licenses to drive-through facilities only on the specific conditions thrat purchasers must exit L,ie vehicle before sales can tic made. I The AK Regulations and the threat of loses of the ABC license certainly wit ! guarantee that they dairy will make no sales to l driver; or their passengers within cars. The Planning Commission hearing further heard objections regarding the density of alcoholic be-verage permits in this area. Sales of beer sand wine from the dairy Will be made solely for the convenience of milk liurchnsers. The peak hours of sales are immediately after school and Immediately after work. The entire datrN closes at 8:00 p.m. Obviously , concerns about loitering teenapv gangs rani parking problems are inapplicable t() this dairy as the late-night loitering occurs long after the dairy is; closed for the evening. The Applicant , Linda Prith Kien, requests Huntington Beach City Council to grant this Permit. It will allow it valuable community resource -- a dairy with 15 years history in providing milk products to this community -- to continue to operate.
