Additional right-of-way shall be provided through an easement agree-
ment at the east end of the cul-de-sac. Said easement agreement
shall be approved by the Department of Public Works and it shall
provide for a future street extension to the north, when required.

Council to re-
consider their decision of November 7 , 1966 , in approving UV with con-
ditions.
On notion by Coen, Council opened Use Variance No. 66-35 for reconsideration .
Notion carried .
Mr . Jaws Rubble , a representative of Mr . CAtes , addressed the Council and pro••
sented some facts concerning this Variance .
Mr. Fred Edmunds , a member uY the Hospital Planning Association of Southern
California , addressed the Council and presented reasons for the approval of
the Use Variance .
Mr. Paul Vhite, member of the Hospital PlanninE Association of Southern Cali�-
ornia, Grange County Board , addressed the Council to inform them of procedure
required to obtaii-. appcoval from the Association . He stated the Hospital
Planning Association gives only reco zendations and not a cart i f icote of
approval .
On motion by Kaufmon, Council directed to amend the motion of the last watin
approving UV 66-35 subject to approval of the Hospital Planning Acsoci.ation of
Southern California , by substituting the word "recoammaemmndatio:i" for the word
"approval . " Motion carried .
On motion by Kaufman, Council rescinded the previous motion . Motion carrion .
On notion by Kaufman Council directed that the ratter be continued until the
applicant has applies to the Hospital Planning Board for a recommendation, and
until applicant requests said ram tte3r to be placed upon the agenda by written

4. Without becoming legal or eonstitutional, the" exists

Gentlemen:
We have been the owner and operator of The Garfield Convalescent
Hospital , 7781 Garfield Avenue, Huntington Beach, California since
November I , 1965.
This facility was purchased from the builders, Mr. Lawrence Gates,
and Mr . John Daulley, who had operated the convalescent home for the
prior eleven r..onths with a high of approximately 25% cens!ss.
It has recently come to our attention that the City of Huntington
Beach is processing a petition for a new convalescent hospital . We,
ai experienced owners and operators, urge careful consideration of
this application inasmuch as there is no need for ao,:itional beds in
this area. This is further verified by the Hospital Planning Commission
who have consistently refused application by others.
At the time of our acquisition of the Garfield, we did not require a
non-competition clause, inasmuch as we felt the seller would not consider
building another facility in the area which is so over extended with
convalescent beds.

Before proceeding, I want to again thank oach of you for your eonpideration.
I purposely avoided approachire you with my point or view pr!or to this
hearing. because of ory various connunity activities and the possibility
of a conflict charge being rsised,
"he first enclosure is a list of the Orange County Hospital Planning
Association eomittoo nenbors. The proponont of Ul,1 66-35 suggested a
possibility of"conflict of interest" bocauso I happened 'to be a member of
this coemittee. The ir.tngrity of this group, notwithst nding q membership,
is, I believe, beyond quooLion.
The second enclosure docwnun's the runber of bola. with occupancy pereentatest
of nursing homes within s 5 mile radius or the rctw horpitAl as well as our
entire hospital service area. It should bo notod that our "Approved"
(third enclosure) new 140 bed facility wss no-t in:luded in the 5 all* radius
figure.
The fourth and fifth enclosures are copies, of the proronents claimed
"Certificate of Need". Please note the urdorlined and the dates. The
proponent claimed h• ha-1 a certificate for a currant need of 129 beds but
this figure is actually an estimated need for IQ69. Enclosure f2 shows a
current actual bed count of 743- Lrra!dde than the state's im estimated
need, with an additionally proposer,! 1027 bads which in_lude our 140 plus

I regret that the pressure of work delayed my reviewing the
working drawings on yocr proposed 140-bed funtington Beach
Sanitarium, I have now completed the clan review and have
found that the drawings comply with the regulations of thin
Department. May I congratulate you on what we feel is an ex-
cellent design for a Long-Tarn Facility.
I would like to recornierd that toilets for male and female
patients be located on the to-.•-er level near the patient acti-
vity areas. This will enable patients , who are utilizing
those areas, to have toilet facilities immediately available
to then. Total storage area well exceeds our requirements a
ten (10) square feet per bed, so you may want to locato such
toilets in the storage roams across from the activity areas.
Enclosed is an application and two fingerprint cards to be
completed by you and four partner, Mr. Lee Brown . We will
also need the names and addresses of three (3) parsons as re-
ferences for Mr . Brown -- plus ;:is personal financial state-
ment. Also requested is a cope of your partnership agreement.
If we can be of -urther service to you in the development of
