This property consists of approximately thirty (30) a,,res located nt the southeast corner of Talbert and Edwards 1,n the amity of Huntington Beach. Approxira3tely ten (10) acres of the property is in the forte of an existing lake belonging to Perpetual and the balance of the lake is owned by the County of Orange,,. S The Use Variance was denied by the Planning; Commission on the basis that � (a) the variance requested did not conform to the R- 1 Ordinance, and (b) negotiations on Park Fees , Drainage "ees, and Lake acquisition should be a City Council responsibility. The Tentative Tract Hap was disapproved on the s trungth nr the Use Variance denial. Our request for approval and review of the Tentative Tract Map and UBe Variance is made because of the unique fertures of the property uhich can be utilized for the nnutual benefit of the City of Huntington Beach and the applicant. Conditions on the Tentative Tract Map 5518: 1 . The Tentative Map received July 5 , 1967 , shall be f the approved layout . 2 . Approval of this Tentative Map shall be null and void unless Use Variance 67-38 is approved by the City Council . 3 . All utilities shall be installed underground . 4. The tract shall be approved for construction of sing family homes only, 5. A petition for rezoning to RI shall be filed prior to acceptance of the final map by the City Council . 6. Lot No. 107 shall not be permitted as a legal building site . 7 . Parcel "A" and Lot 106 shall be enclosed with a 6 foot high fence wherever possible. Said fencing shall be done only in the event the City acquires the entire Huntington Lake and elects to fence its entire bounderies . Said fence shall comply with all applicable provisions of Sec- tion 5551 of the Huntington Beach Ordinance Code-Standirig Water. 8. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with . 9. That a standard reimbursement agreement will be entered into covering drainage structure costs , which must be accept- able to the City Council. ;: t 14 - T 4 i i; Conditions on the Use Variance: 1 . All Streets shall, compy with standards proposed by the Department of Public Works and approved by bath the Planning Commission (August 3 , 1965) and City Council (September 7 , 1965) . 2. A tree, equivalent to a 30 inch box tree , as approved by the Street Tree Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner :lot . 3 . The minimum front vard shall be 10 feet , except the minimum front yard for garages entered directly from the street shall be 22 feet. This condition of approval is not general in nature and a prec:.se plan shall, be sub- mitted to the Plannii Department fov approval prior to issuance of any building permits . Said Plan shall delin- eate the house locction on each lot. 4 . An 18 inch wide easement for utility purposes shall be provided adjacent to all sidewalks . Construction of any vertical structure within said easement shall be app---oved by the Department of Public Works . 5 . Parcel "A" shall be offered for dedication to the City and the City shall accept the same concurrently with the acceptance of the dedication of the streets in Tentative Tract 5518 ; provided conditions on Tentative Tract Map 5518 (except Item No. 7) and the Use Variance have been net., The portion of parcel "A" abutting "D•" drive shall be landscaped per plans approved by the City. 6. Lot 106 shall be offered for dedication to the City for park purposes and the City will accept the same concurrently with the acceptance of the dedication of the streets provided conditions in Tentative Tract Map 5518 (except Item No. 7) and the Use Variance have been met .
