Location: West of Saybrook Lane, north of Morning Star Drive. UV Requests Construction of a statutory condominium development containing 62 units and related parking and access facilities ka the R-3 ,Limited Multiple Family Rooidence District. Reasons given b9 applicant (In Brief): 1) The 7.,4 acre tract offers an exceptional opportunity for the development of a statutory condominium. 2) The proposed development in similar to an existing development on Warner Avenue. 3) Planned development will provide water- front living for more families than would be possible under existing zone clisei- fications while providing an adequate parkin% and ample street widths. Pianning,Commission Action: Approved an.d reeomneaded for a pproyal by the Gity Oouncil upon the following con9itions: 1) The develo ent plan received July► ' 170 19679 shall be the approved layout. E•r WN 2) All parking areas along Saybrook Lane shall be screened with a combination of fencing and landscaping. 3) The placement of Building 5 shall be remi-ranged to avoid the excessive curb break on Morning Star -Driv&. Rearrangement, of such building shall be approvod by the Planning Department. 4) Recreation facilities shell be installed within the development according to Planning Commission Standards acid a plan specifyirLS such facilities shall be submitted for approval by the Planning Department. 5) The CC&R's Articles of Incorporation, By -Laws and Management Contract ©hall be submitted to the Plax niug Director and City Attorney for approval. 6) The CG&R's shall contain at least the following, provisions: a. RecreRtion areas other than waterways within the development shall be reserved for the exclusive use of rouldents within the project and their non-pa.Ying gueuts. b. Owners and/or tenants shall be required to abide by association rules and there shall be penalties for violation of acid rules. c. Any interest in the common area hold by the Individual parcel or condominlum unit owners can not be devised, conveyed or dedicated separate and part from the devise conveyance, and/or dedication of the individual parcel or condominium unit for a life in being plus 21 years, excepting this'hay be accomplished under the same conditions or grounds as are available under ju:icial partition. d. If the development is constructed in increments or several final maps reciprocal CC4_R'a and reciprocal management agreement shall be established that will cause a merg4ae of increments as they are completed. and result shall be one home association with common aroas common to all and one management for the entire project. • w 7) The water, sewer, and,fire hydrant systems shall be apprcved by tie Department of Public Work® and Fire Department. 8) There shall be no fence structure, or landscap- ing constructed or maintained over 0 feet high within a 10 ft. x 10 ft. triangular area at the intersection of drives and streets or within a 25 ft. x 25 ft. triangular area at the intersection of streets exoept as otherwise approved by the Traffic Engineer. 9) All rights for development and construction of any structures within ;:he common area not included in the approved development plan shall be dedicated to the City. 10) No structures, other than those shown on the approved plot plan, shall be construct-ed within the project. 111 All slips, docks and/or cause ways shall co�rorm to the Huntington Beach Fire Rrevention Code' regarding fire Protection and access to ouch docks or slips.
