Jcne n , City Clerk Gentleman: At the April 71 19699 City Council meeting, the Planning Commission was inntructed to reconsider their, action to deny Tentative Tract 6674 and Conditional. Exception No. 69-5. According to this request , the Planning Commission reconvidered their action to deny the tenta- tive map however , upon the advice of the City Attorneys Office , no consideration was given to the conditional oxception. Recon- sideration or -the tentative map wan based on the fact that the applicant made minor modifinations in the lot nizea and agreed to comply with the conditions of approval auggaoted by the Subdivision Committee. The change: resulted in the lot; size being increased from 35 £t. in width to 40 ft. Thia results in lot sizes that average 40 ft.. x 135 ft . (5400 sq . ft. ) . Planning Commission Action : Approval of the revised map dated FLY e , 1969, subject to the following conditions : 1 . The Tentative Map received May 27, 1969, shall be the approved layout. 2. Approval of thin Tentative Map shall be null and void unless Conditional Exa,'iption No. 69--5, is approved by, the City Council. 3. fte water and fire hydrant stems shall be approved by the Depsrtuent of Puhilie iorke and the lire Dppartaint'. , 4. A lighting system shall be installed on the private streets with illumination at least equal to lighting on public streets. Said lighting shall be approved by the Department of Public Works. 5. Private street structural sections shall comply with Department of Public Works requirements. 7. Previsions for a community association to assure perpetual maintenance of the private street shall be approved by the Planning Director and City Attorney. 8. Said plan shall : a. provide 5 ft. minimum side yard setback for all dwellings , and b. conform to city standards with respect to all required setbacks and site development. 15. A satisfactory arrangement shall be worked out with the Dept. of Public works with respect to disposition of the sewer line prior to recordation of a final map. 16. Traffic circulation over the private st:reot shall not be controlled or restricted. 17. Placement of the Mock wall shall be approved by the Board of Zoning Adjustments. They felt that concrete bulkheads should be constructed for the abutting channel . Additional information: The majority cf the Coamissionern voting or approval of the subdivision felt this was a problem piece of property due to its config- uratlon. As a result of this request Council directed that the appeal to the denial by the Planning Commission of the Tentative Tract and Conditional Exception be referred back to the Planning Commission, without ever opening the public gearing.
