Gentlemen :
Transmitted herewith is a report regarding the Planning
Commission' s denial of Conditional Exception No . 72- 38 .
The Planning Commission took action on July 5 , 1972 . Their
action was appealed by I•Ir . E. Briesemeister of Heath and Co.

Keasons given by the applicant: ( In brief)
Signs are a permitte%i use. The site could have been
created into numerous parcels and conceivably have
more free standing signs . This could go on Springdale
Street without this request . The maior thoroughfare
is Edinger Avenue and the street businesses must
identify themselv6s to. The location,as requested,
will be an aid to the public welfare and will not
create any public nuisance . It will be out of the way
of traffic flow. (� '-�

The staff has reviewed Conditional Exception No . 72- 38 and offers the
following information for your consideration:
1 . This application is before the Plannin Commission because the
applicant has appealed the Board ' s decision for. denial .
2 • This application was filed Lo permit the erection of a fourth free-
standing sign of 167 sq. ft. within the setback along Edinger !Avenue .,
and to locate said sign within 2 ft . of the side property line of
the adjacent service station. This request is in lieu of the require-
ment that only one free standing sign be pern!,tred within the set-
Lack for each free standing building facing Ed 1,t�gge r Avenue . Also to
allow said sign to encroach into the required ;;Ide yard setback.
The sign is to be located within the shopping center at the southwest
corner of Eding er Avenue and Springdale Street in the C2 Community
Business District . It
3 . The Board denied CE 72-38 at their May 17 , 11172 meeting because of
the applicant' s willingness to consolidate the proposed sign with
one or more of the existing signs within the setback on Edinger
Avenue , The Board informed the applicant that it is City policy to
encourage consolidation of signing wherever possible to reduce the
number of non-conforming signs . The applicant stated that he did
not have authority to bind the owners of the existing signs to
any additional cost or revisions and requested n decision nL that
time.
4 . It should be noted that within this center there are ftve ( 5) free-
standing
signs which front on Edinger Avenue . Three ( 3) c-,f these
signs are within the required setback (Orange Julius , Marina Village
Entrance sign, and the Security Bank sign) . In addition to these
three signs , there are two free Standing Signs located behind the
required SO ft . setback (Vans identification sign and the Sav-On
Drug sign) .
5 . A map has been attached showing surrounding zoaIng and land use .
6 . The applicant ' s letter or appeal has been attached for your review.
A point that should be noted is that the applicant has expressed a
Sri lingn,ess to consolidate the proposed Brentwood sign with the
Marina Village sign on the Springdale frontage . In keeping with
this alternative location as proposed by the applicant , it should
be noted that S. 9764. 3. 1. 2 of the Sign Ordinance a:-: lows lots that
have frontage on two or more streets , one pole sign for each of the
street frontages .
In view of the above information , the staff recommnds denial of the
apppeal as crigin*lly stated. However the utaff further recortaaendsa that
tl�te 191
icant be given consideration for the proposed alternative loce-
ti.anich is a consolidation of the proposed Brentwood sign with An
existing Marina Village Entrance sign on Springdale Street.

AS mentioned in our letter of May 26 , 1972 to your Planning
Commission , we feel there are exceptional circumstances
applicably: to this business, that approval will not create a
special privilege not now enjoyed by others , that approval
is necessary to preserve a property right ar:d to permit this
sign as requested would nat be a detriment to the public welfare .
Enclosed is our check #1813 to cover Appeal fee .
It is requested that our appeal be heard at the earliest
