Lambert Address Huntington Beach , California Dear Councilman , At the meeting of December 7 , 1954, under Planning Transmittals , your Honorable Body acted unanimously to grant Conditional Exception - Use Variance No. 759 as requested by S. V. Hunsaker & Sons , Irwindale , on property located on the west side of Oushard Street , approximately 1000 feet sputh of Adams Avenue. At the time of this action, there was no on* in the audience wishing to address the Council and speak on the scatter. 'there are two kinds a.+ Use Vuriat:ce■ with a technical difference between them, which allows the granting of denial of one type by the Planning Commission, with a possible appeal to sane allowed to t:�e City Council. The other type can only be recom- mended for approral or denial by the Planning Costmission , and the City Council makes the decision in the granting or denying of name . Use Variance No. 759 falls in the latter category. As happens two or three times a year, the first of the Month fell on Tuesd�,;, , staking that the date' for the Plaanit�g Com- mission meeting. City Council , meeting on the first �'Io�nday of the month had their meeting fall on December 7th. At the Plan— nimg Commission meiti on December 1st , the Planning Cammiawloa reaaremdod, approval of Use Varlanem No. 730 and it was tms-- tiitted to the City Council for their heating of December ?tb.. Page #2 U.V . #759 December 11 , 1964 Homeowners in the area of the Sea Haven Tract , believing that the Use Variance would not be acted upon by the City Council for almost two weeks , failed to be present at the meeting of December 7th to register their objections . I believe , that due to the circumstances , the people were honestly not aware that the matter would be acted upon so soon. Mr . Langlois appeared in our office this morning to file an appeal to the granting by the Planning Commission of this variance. I informed him that the action was made by the City Council, not the Planning Commission, and that there is no appeal to the action of the Council , which is the highest tri- bunal of the City. I further informed him that I would accept a letter on behalf of the Council , requesting a reconsideration and a public hearing in th1s; matter, and that this would be governed by the action of your Honorable Body. On advice from the Assistant City Attorney , I would not accept an appeal Pee of S75.00 in the matter because it -ras not an appeal to a decis- ion of the Planning Commission. The matter will be placed ba"ore you for your consideration at the next regular meeting December 21 , 1964. This letter , although lengthy and rambling , is being written to advise you of the facts in the case in order that you may know the circumstances when discussing it with people , Involved. I am enclosing herewith a copy of the letter requesting recon- sideration and a hearing submitted by Langlois. Also enclosed is a copy of a letter from Dale Heinly requesting reconsideration and rehearing in the denial of Use Hermit No . 256 , covering a proposed gasoline station at the southwest corner of Banning Avenue and Aushard Street.
