Sane of these owners are widows. Others are business men and house- wives and others are banks and trust companies and one is California Institute of Technology. Nearly all. of them reside in and about the Southern California area. When Huntington Harbour Corporation purchased the surface rights in the Lomita Ranch property from Rancho Lomita, Inc. in October of 1960, rwo 5-acre drillsites were .treated by Huntington Harbour for the benefit of the oil owners . The right of the owners to use these drillsites was to expire on October 10, 1965 , unless the drillsites were then being used for drilling for or production of oil or gas . During the years 1963 and 1964 Hunting- ton Harbour Corporation abandoned a number of oil and gas wellla in which the oil owners had a substantial royalty interest, Such abandonment resulted in a serious controversy between Huntington Harbour and the oil owners, a controversy which was difficult to resolve by reason of the number of oil owners involved. The con- troversy continued until the forepart of 1964 wh&*n Huntington Harbour agreed to make a settlement with the oil owners in a reasonable amount provided the oil owners agreed to give up their then existing 5-acne drillsites in exchange for what is now the 1/2-acre Warner Avenue drillsite. We were advised that Hunting- ton Harbour's program of dervalop wnt rewired that the 5-acre drillsite along Algonquin Avenue and eltuated on the Huntington Harbour property be eliminated, and that this was in arccordmao with the Huntington Harbour Ladd Use plan As approved by the Planning Dopartaent of the City of Huntington Bosch amd was in the best interests of the City of Huntington Beach. We were r I w2- Members of the City Council, City of Huntington Beach 1-8-65 also advised that the Warner Avenue drillsite was a proper location for the drilling of several oil wells. Although when the settlement arrangements were made with Huntington Harbour there appeared to be little, if any, prospect of further drilling on behalf of the oil owners , in about Jute, 1964, Mr. Graver Collins and Mr. John Richardson requested that we submit to the oil owners a form of oil and gas lease to enable them to drill for a limited period of time into and under the Huntington Harbour property from the Warner Avenue drillsite. We understand Mr. Richardson conferred with representatives of the City of Huntington Beach and was advised that the Warner Avenue drillsite appeared to be a very good location for such drilling purposes in view of its use by the Water Company and the existing water tank, its contiguity to Warner Avenue, etc. , and that there should be no difficulty in obtaining a permit to drill. Accordingly, we submitted to the oil owners not only the Hunting- ton Harbour settlement offer involving the drillsite exchange but also the proposed oil and gas lease with Grover Collins . Prior to execution of the oil and gas lease by the required number of owners , Huntington Harbour coameic:ed the proceedings to have the Warner Avenue drillsite property rezoned in accordance with the residential oil drilling zoning ordinance of the City of Huntington Beach. These preceedings were com- menced by Huntington Harbour for the reason that Huntington Harbour was and is the owner of this drillsite property and the oil and gas lease with Grover Collins had not yet been made. After approval of the rezoning by the Planning Commission the Council diap?roved it and it was suggested that a use variance would be more appropriate. This proceeding was then begun. The lease with Grover Collins was made on or about December 1 19647 and the onl • drillsite useable and available to Mr. Collins and to the oil owners or eve opment o their m neral rights is the Warner Avenue drillsite. At this time Huntington Harbour is the applicant in name only and for all practical purposes has no interest whatever in whether the permit to drill on the Warner Avenue drillsite is or is not obtained. We understand that Grover Collins has expended a great deal of tiwa and money in geological studies and other work in obtaining the lease. Without compensation to us we have obtained execution of the lease by virtually all of the oil owners, more than 80% in internt being required, and the lease has been delivered to Kr. Collins. You have mom picures o installations similar to that proposed on the warner Avenue dri'llsite and it is evident that the installation and operation proposed in compatible with residential zoning and is considerably more pleasing to the eye than the present miaightly water tower. We understand that Mr. Collins is willing to limit: actual drilling and development operations to a period of two years. It is difficult for us to perceive wherein three or four property r -ners in the area who would not be: substantially prejudiced by L. granting of the permit but at most would be temporarily inconvenienced, should be permitted, in all fair- ness, justice and equity, to prevent other property owners from using their property for any purpose and also prevent the proper, efficient and expeditious development of vital and valuable natural resources . These three or four owners contend that because they pay taxes on unimproved property they are entitled to protection. These same three or four property owners know- ingly purchased their property which was and is virtually surrounded by oil drilling or production operations . In the past eight years the Lomita oil owners have paid property taxes on their mineral rights in excess of $80,000.00; total property taxes paid with respect to these mineral rights during the past eight years aggre8ate approximately $500,000.CO. The objecting property owners will not pay a minute fraction of such amounts in their lifetimes . Surely a valuable property which has contributed so L.uch in taxes to the community, is entitled, in all fairness, to be used for the only purpose for which it can a use , and surely the owners o t: a.t property should be permitted to use it when that use and only that use will result in the develop- ment of a valuable nature-. resource and will continue to generate substantial tax revenue, uad otherwise be useful and beneficial to the property owners and particularly to the community. Assignor and such other persons as Assignor may designate shall be furnished with keys to any locks on such gates and Assignor , its agents, employees , suc- cessors and assigns , shall at a.i ti.:as have a right o�: access to drillsice lands ; provided, however, Assignor , its agents , cmpl .yees , successors and as - signs shall not unreasonablf in,:erfere with operations of Assignees , t,.+Pir successors and assigns , in progress on dril:site lands . Suitable , ade- quate and sanitary toilet and was::ing facilities shall be installed on drillsite lands when in use and such facilities , the drillsite lands and all permanent in- stallations thereon shall be maintained in a neat , clean and orderly condition. (g) All operations conducted by Assignee6 , or their oper- ator or lessee on drillsite lands shall be conducted at Assignees ' sole risk, cost and expense in a good, work<n,anlike and ef-icianc manner and in accordance with good oil field practice All equipment mach- inery, facilities , materials and supplies used on drill- site lands shall be of a good and first class condition and shall be at all times maintained in such condition. N;otwithscanding anything to the contra=y in this paragraph 8 contained, Assignees shall have no duty to make any improvecares on drillsita lands or expend any funds with respect t"arato until such time as Assignees enter upon drillsite lands 7 . for tha purpose of conducting drilling operations therefrom. 9.
