Although when` the settlement arrangements were made with Huntington Harbour there appeared to be little, if any, prospect of- further drilling on` behalf of the oil owners; in about June, 1964, Mr. Grover Collins and Mr. John Richardson requested that we subm' it to' the oil owners a form of oil rnd gas lease ,to;.enable hem to drill .for a limited period of time into • and. under the Huntington Harbour property from the Warner Avenue ` drillsite. We-.u6ders tand Mr. Richardson conferred with representatives of the- City of-, Huntington Beach and was advised that the Warner Avenue drillsite appeared to be a veryy good location for such drilling purposes in view of its use try the Water Company and the existing .water tank, its contiguity to Warner Aver►ue., etc: , and that,. there should be no difficulty in obtaining a permit Ito ; drill. Accordingly, we submitted to the oil owners not only the Hunting- ton Harbour settlement offer involving the drillsxte .exchange ` but also the proposed oil and gas lease with Grover. Collins . Prior to execution of the oil and gas lease. by the required number of owners , ,Huntington Harbour commenced the proceedings to have the Warner Avenue drillsite property rezoned in accordance with the residential oil drilling zoning ordinance of.,the, City of Huntington Beach. These proceedings were, coax- menced by Hunt,dmgtoa Harbour for the reason that Huntington Harbour was anc; ,is the owner of this drillsite property and the oil and gas lease with Grover Collins had not yet been made. After, approv► it of the rezoning by t1he Planning Comrsissicn `,the Council disapproved it and it was suggested that a Lase 'variance would be more appropriate. This proceeding was then begun. Applicant deems itself aggrieved by the afore- said denial on the following grounds : (a) Said Commission denied ApplicanO is assignees` the right to use the property described in said applicatidu for oil and gas drilling and extraction purposes altbough numerous other similar properties located in the immediate vicinity of said property are being used. fortuch purposes ; (b) Applicant will receive no direct monetary consideration for the use of said property for the pur- poses proposed and does not otni the oil and gas sought to be extracted. Such oil and gas is oumed by the co-- tenants described Exdiibit A; cotenants have entered into an oil and gas lease with one Grover Collins whereby Grover Collins was granted the right, subject to all ' of the restrictions imposed by the ordinances of the City of Huntington Beach, to extract said oil and gas.
