On 'arch 27, 1962 Carpenters Local No . 1453 purchased a 1 86 acre parcel of land described as : Lot Number Three (3) of Tract No. Eight hundred and Eleven (811 ) for• the expi,ess purpose of erecting a Union Hall . Miiu parcel was zoned M-1--A-0 at the time of plulchase . The parcel was subsequently re--zoned, on an Interim basis , as R--A-0. Carpenters I Local Number 1453 rt-cently made application for a Use Variance in connection with said parcel (also Variance Number 802) to allow the construction of an office and assembly building in the I-A-O district located on the South side of Atlanta Avenue and 1600 feet East of Beach Boulevard and legally described as. Lot 3, Tract 811 . A departmental staff report was prepared on February 16, 1965, recommending denial of the requested use variance on the grounds that the proposed use dial not conform to the 14aster PlaD of Land Use and it does not fall within the permitted use of an R-2 or R--3 Zona . The Staff Report stated, ho-rrever, that if the 'PlanniM ComfiLission determined that the use was acceptable, that certain conditionB be met . 1 .. . ,rr To : City Council. of Huntington Beach February 24, 1965 The above legal reasons have been set forth as the primary basis for ap peal ., ha addition thereto the appli.cant: .sets , forth the follo+-ling reasons for affirmation of the requested use variance: (1 ) Local No . 1453 has a membership of ,in excess 'of two, thousand men, the majority of whcm reside in the territorial confines of Huntington Beach, ' California . The Local takes -within its ' scope the beach area from Seal Beach on the North to Corona Del filar on the South . Lot 3. Tract 811 is centrally located. (2) There is 11ttle, if any, doubt that had permit: been file and construction begun a year or tyro ago prior to re-zoning, there would. have been little opposition. Within the last year, hoy.tever, various parcels contiguous to Lot 3, Tract 811' have been re--zoned (althoughtthe land has never been improved), possibly for speculation purposes . It has, however, always been the intent of" applicant to uct upon the property that for which it was expressly purchased. (3) Applicant 's architects , Reagan and Shoemaker, 542 ,Nest 19th Street, Costa Mesa, California, have prepared and submitted to the Planning Commission t: the proposed design. Comes now the applicant for Use Variance No . 802 and files this, its ' appeal, with the Mayor and City Council of Huntington Beach ,. and petitions the City Council give reconsideration to the requested use varivnce for the following reasons : ,3 (1 ) ' ng Commission.'hat if the majority of the Planni of Huntington Beech relied upon the staff ,.report in support of its ' denial, then this was error inaemuch as the intent of the R•-A--0 zone does not contemplate the exclusive use of R-2 and R-3 Zone use. (2) Chapter 96 (miscellaneous 1)istricto ) of the Huntington Beach Zoning ordinances : S. 2600 reflects the intent of the R-A Zone to . . . 'provide a transition between the present agricultural activl ties and possible development of the faze land to residential and other uses , It (emphasis added) . (3) Article 968 of Chapter 96 (Miscellaneous Districts) S . 9080 states an follows: "Z t is the .Entent of this article to establish a category of combining oil. districts . in. which . present I : and future oil development and operations will. be perrrltted under some limitations for the purpose of making possil-le compatible recreational, 'recreational-- residential, vesidential, institutional and commercial developments .
