Gentlemen:
Herewith is the Planning Commission recommendation for
approval. of UV #842 for Chrysler A •ouSchaltter, 3345
Aev"rt Blvd., Newport Beach, California. $aid request
involves various deviations to the 8-5 Prefossional, Motel
and Trailer Park District and the Subdivision Ordinance
for tentative Tract Map To 3274.
The property involved is located on the south side of
Detroit Avenue an3 want of Delaware Street.
The applicants intend to ovnstruct a 62 unit planned
residential development with various exceptions to the
Huntington Beach Ordinance Code. Thic item was considered
by your Honorable Body on July 19, 19659 &Ad then referred
back to the Planning Commission for more study and report.
"Gies Variance No 842 was reconsidered and recomaended to your
Honorable Body for approval upon the following conditions:
1. The development plan dated August 9, 1965, shall
be the approved layout.
2. The CC's Articles of Incorporation, By -Laws
and Management Contract shall be submitted to the
Planning Director and City Attorney for approval.
3* The CCAit's shall contain at least the following

a. Recreation areas within the development
shall be resorved for the exclusive. use of
residents v " ' ;Un the project and their non—
paying gue r.
b. Owners and/or tenants shall be required
to abide by association rules azd there
shall be penalties for violation of said
rules.
c. Any interest in the common area (including
private streets) held by the individual parcel
or condominium unit owners can not be devised,
conveyed or dedicated separate and part from
the devise conveyance, and/or dedication of
the individual parcel or condominium unit for
a life in being plus 21 years, excepting this
may be accomplished under the rase conditions
or grounds as are available under judicial
partition.
d. if the development is constructed in in-
crements or several final saps reciprocal
COM'a and reciprocal management agreements
o:A&7.. be established that will cause a merging
of increments ae they are oompleted. 'ihe end
result shall be one homes association with
common areas to all and one management for they
entire project.
4. All rights
for development
and
construction of any
structures
not included in
the
approW development
plan shall
be dedicated to
the
City.
5. All streets within the development shall be private
streets.

6. There shall be no fence, structure, or lond-
ocaping constructed or eraintained over q fret
high within a 25 f t. by 25 f t. triatYgular area
at the intersection of any street.
7. The maximua building coverage shad not exceed
40% of the land area being detelopedg exclusive
of all vehicular access -ways.
So A complete plan of laadeaapi,ng, screening,
re creational facilities, and trash pick-up
shall be tiled for approval by the Planning
Department.
y. A plan of grading and bank protection shall be
submitted for approval by the Department of
Public Works and the Director of Building and
Safety.
10* fehicular access rights along the west side of
tho parcel designated "Not A part" shall be
dedicated to the City of Huntington Beach.
11. The proposed subdivision shall be developed
as a statutory condominium.
