Jones, C ► Clerk ' t Was the undersigned matabsrs of the congregation or the Calvary Baptist Church of Huntington Beach, take this method of registering our protest against the decision handed down by the City Council of Huntington Basch on November 19, 1965, denying the Calvary Baptist Church ogress and ingraas on Gregory Lane. This protest is made Without malice toward any individual at group of Individ- uals, and With full sympathy toward the rights and privileges of all the citi- zens of the City of Huntington Beach. Our request that the City Council i - scind its decision Which denies us the privilege of using a city ■treat Is ` based on the following reasons: k1. Calvary Baptist Church is a duly organized church, Incorporated under the I" of the State of California and wsth Articles of Incorporation recorded in Orange County, Calvary Baptist Church was organized two years Igo and has a substantial membership of home-owning, tax-paying citizens of Huntington Beach. 2, The decision of the City Council denying us the right to use a dedicated street was rendered after the Planning Commission of Huntington Beach had ap- proved a plot plan for Calvary Baptist Church. This plot plan made "cific reference to ingress and agrees on this dedicated street, nem43y, Gregory Lene. The Planning Commission and the Traffic Department anticipated no traffic prob- leer in granting this variance. This is a matter of record. 3. Calvary Baptist Church closed escrow on the good faith that the decision of the Planning Commission Would be respected by the other agencies r:f the City of Huntington Beau h. 4. Gregory Lane is a dedicated street and is not a private drIvewny, Gregory Lane was dedicated to the City cf' Huntington Beach in Tract 3534, accepted by tha City Council on September 21 , 1959, recorded March 1, 1960 and therefore belongs to all the citizens of Huntington Beach, It is, therefore, a street that is supported and mafntained by the taxes of all thn citizens of Hunting- ton Basch, 5. The block Wall on the kk'nt side of Gregory Lane is not a privately owned wall* This wall is the property of the City of Huntington Beach, having been dedicated to the City, accented by the City Council September 21 , 1959 and re- corded March 1 , 1960. b. The easement along the Cast side of the property belonging to the Calvary Baptist Church is of absolutely no consequence or concein in this matter. 7. Traffic analysis, presented as a retsult ref a study by in untieagd traffic engineer, givers assurance that no hszerdous traffic problem will be unposed upon anyone through the use of Gregory Lane by Calvary Captist Church, 8. We feel that as citizens, voters, and tax-peyers of the City of Huntington Beach, we are bating denied the use of a dedicated street which borders our property and arc baring derded the use of a City-owned street which We help to support and maintain and are thereby being denied our gust rights and privil- eges.
