RE: CONDITIONAL EXCEPTION - UV #870.
Gentlemen:
Herewith is the Planning Commission recommendation for
approval o; UV #870 for Decon Corporation, 1833 East 17th
Street, Swita Ana, California. Said request involves various
deviations to the R-4 Multiple Family Residence District re-
quirements and the Huntington Beach Ordinance Code for Tentative
Tract trap No 5813.
The property involved is located on the north side of Highway #1
and west of Andertion Street.
The applicants request is to construct an air —space condominium
development with various exceptions to the Huntington Beach
Ordinance Code.
Use Variance No 870 was ipproved and recommended to your
.Ionorablc 0udy for approval upon the following conditions:
1. The development plan received November ?Q, 1965, shall
be the approved layout.

a. Recreation areas within the davelopment shall
be reserTed for the exclusive use of residents
within the project and their non-paying guests.

abide by association rules and there shall he
penalties for violation of said rules.
c. Any interest in the common area, including
private streets, held by the individual parcel
or condominium unit owners can not be devised,
conveyed or dedicated separate and apart from
the devise conveyance, and/or dedication of
the individual parcel or condominium unit for
a life in being plus 21 years, excepting this
may be accomplished under the same conditions
or grounds as are available under judicial
partition.
4. All rights for development and construction of
any structures within the common area not included
in the approved development plan shall be dedicated
to the City.
5. All streets xithin the development shall be privatm
streets.
5. A complete plan of trash pick-up shall be filed for
approval by the Department of Public Works.
7. A plan of grading shall be submitted to the 'Department
of public Wo.As and the Department of Building and
safety for approval.

submitted to the Department of Public Works prior to
issuance of any building permits.
