Re: Revised Letter for California Environmental Quality Act Public Resources Code
section 21080.3,solid. (b) ; California Assembly Bill 52,Request for Formal Notification of
Proposed Projects within the geographic area that is traditionally and culturally affiliated
with the Soboba Band of Luiseno Indians.
The purpose of this letter is to request formal notification of proposed projects within the
geographic area that is traditionally and culturally affiliated with the Soboba Band of Luiseno
Indians, in accordance with Public Resources Code Section 21080.3.1, subd.(b).As of the date of
this letter,you have been formally notified that the boundaries of your local government's
jurisdiction fall within the area that is traditionally and culturally affiliated with the Soboba Band
of Luiseno Indians. Attached to this letter you will find a traditional use area map that can be used
for reference. Due to dual ancestry here at Soboba,which includes both Cahuilla and Luiseno
descendants,you will find that our traditional use area map depicts an area that encompasses both
territories. Additionally,the Soboba Band has created the following specific requests and formal
procedures in accordance with California Assembly Bill 52:
- Formal notice of and information on proposed projects for which your agency will serve
as a lead agency under the California Environmental Quality Act(CEQA), Public
Resources Code section 21000 et seq. Pursuant to Public Resources Code section
21080.3.1,subd.(b) shall be sent to The Soboba Band
- Within 14 days of determining that an application for a project is complete or of a
decision by your agency to undertake a project, a lead agency must provide formal
notification to Cultural Resource Director,Joseph Ontiveros, who is the designated
contact and tribal representative for the traditionally and culturally affiliated Soboba
Band of Luiseno Indians regarding notifications pertaining to California Assembly Bill
52

We request that all notices be sent via certified U.S. Mail with return receipt.
This notice shall consist of a formal written letter that includes:
• A description of the proposed project
• The project's location
• The lead agency contact information
• A clear and definitive statement that the tribe has 30 day to request
consultation
Once the Soboba Band has received the notification,we will respond within 30
days as to whether we wish to initiate consultation as prescribed by Public
Resources Code section 21080.3.1, subd. (d), the Soboba Band may request
consultation, as defined by Public Resources Code section 21080.3.1, subd. (b),
pursuant to Public Resources Code section 21080.3.2 to mitigate any project
impacts a specific project may cause to tribal cultural resources.
- The lead agency shall begin the consultation process within 30 days of receiving
the Soboba Band's request for consultation and prior to the release of a negative
declaration, mitigated negative declaration, or environmental impact statement.
Once a review of inadvertent discoveries has been completed by the Cultural
Resource Director, all information will then be transferred to the Soboba Tribal
Council for a final decision and directive.
In the event that human remains are uncovered, all work in the immediate vicinity
will halt and standard procedures will be followed as set forth by law.

considerations and willingness to effectively carry out all requirements associated with

LAND DEVELOPMENT FEE SURVEY
THE FAIR SHARE PRINCIPLES
It is recommended that Jurisdictions:
1. Notice. Provided sixty (60) days notice if effective date of any fee
increases.
2. Public Hearing. Publish notice and hold hearing prior to consideration of
fee increase along with mailed notice to any petitioning party pursuant to
Section 54992 of the Government Code.
3. Resolutions. Do not amend enabling resolutions. Work for the inclusion
of all development fees in one new, comprehensive resolution.
4. Volume Adjustment. Adopt reduced rates for subsequent plan check
and inspection of identical buildings.
5. Source Documents. Insure that the actual fee authorization document
with official signature is available for distribution by development services
agency or city clerk upon request.
6. Other Agencies. Publish, and clearly display, contact list of any other
known agency that may claim regulatory jurisdiction.
7. Payment Timing. Honor deferred payment rules under Government code
Section 53077.5.
8. Nexus and Need. Provide evidence of fee nexus and identified need
through generation of nexus study and a needs assessment in
accordance with State Law.
9. Establish Specific Benefit Areas. Assessment fees are within clearly
defined boundaries for benefited properties and not be utilized to
subsidize other tax-supported facilities or services. An adopted plan of
expenditures and implementation schedule should be in place prior to
adoption according to State Law.
10. Documents Kept Current. Cost-of-living increase is documented in
newly published schedules. No undisclosed, intermediate calculations are
required to determine one's probable liability.
11. School Fees. School fees only be implemented with a school facilities
master plan, adopted budget, and specific spending plans adopted after
public hearing.

Hello & happy new year! It's that time of the year again when I send out my request for
notification if you have any fee increases. Please let me know if you need any additional
information.
Pursuant to section 66016 of the Government Code, written notice is requested of all public
meetings convened by the City to consider new or increased fees or service charges. Section
66016 requires that such notice include the time and place of the meeting, a general
explanation of the matter to be considered, and a statement that the data required by section
66016 is available. The law also requires that such notice shall be mailed at least 14 days prior
to the meeting to any interested party who files a written request for mailed notice of the
meeting.
