Statement of Issue: Adoption of an ordinance requiring members of City boards,
commissions and committees whose positions are designated under the City's Conflict of
Interest code to file a Statement of Economic Interests identifying potential conflicts of
interest
Funding Source: N/A
Recommended Actions: It is recommended that the Council approve Ordinance No.
requiring members of City boards, committees, and commissions to file Statements of
Economic Interests as a condition of membership on such bodies.
Alternative Action(s): The Council can determine that the present system of fines which
may be imposed by the City Clerk and/or referral of the failure to file to the District Attorney,
the Fair Political Practices Commission, or both, is sufficient to insure the filing of such
Statements.

Analyses: State law mandates that the City adopt a conflict of interest code requiring
members of certain designated City boards, commissions and committees to file a Statement
of Economic Interests, with the exception of members of the Planning Commission, which
are covered by the state law. The City has required designated members of such other
bodies to file such Statements. At present, the only enforcement tool for failure to file is the
discretion of the City Clerk to fine such individuals and/or referral of the matter to the District
Attorney, Fair Political Practices Commission, or both.
Adoption of the proposed ordinance would condition membership on designated City boards,
commission, and committees on requiring such members to file a Statement of Economic
Interests within thirty (30) days of their appointment, annually each April 1st, and after
leaving such office. Failure to file within the time required would cause the person to
automatically vacate the office.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA
RELATING TO THE FILING OF
STATEMENTS OF ECONOMIC INTERESTS
BY MENT IBERS OF BOARDS, COMMISSIONS AND COMMITTEES
The City Council of the City of Huntington Beach does ordain as follows:
Section 1 Section 2.100.065 shall be added to Chapter 2 100 of the Municipal Code
of the City of Huntington Beach, said section to read as follows:
Section 2.100.065. Statements of Economic Interests Every person appointed
to a board, commission, or committee designated by the City Council resolution
adopting the City's Conflict of Interest code, shall file a Statement of Economic
Interests with the City Clerk on forms provided by the City Clerk. Statements of
Economic Interests shall be filed upon taking office, annually no later than thirty
(30) days after the date specified bylaw, and upon leaving office Any such
person who fails to file a Statement of Economic Interests as provided in this
Section shall automatically vacate the office.
Section 2. This ordinance shall become effective 30 days after its adoption.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 20th day of July 1998.

The City Council of the City of Huntington Beach does ordain as follows:
