SUBJECT: Adopt resolution designating the Director of Building & Safety or the
Director of Public Works as the City's Agent authorized to execute and
file applications for Federal and State Financial Assistance.

Statement of Issue: In September 2005, the City of Huntington Beach was successful in
obtaining a $3 million FEMA Grant to seismically strengthen the Administration Building at
City Hall. In order to submit required documents and receive reimbursement payments, the
City of Huntington Beach must have a valid Authorized Agent Resolution on file at the State
Office of Emergency Services (OES).

Motion to:

Huntington Beach designating the Director of Building & Safety or the Director of Public
Works as the City's agent authorized to execute and file applications for Federal and State
financial assistance."

REQUEST FOR ACTION

Analysis: Since the City was successful in competing for the FEMA Grant to seismically
strengthen the City Hall administration building, we are now working to comply with all the
requirements of this grant. The first requirement is the City must have a designated
authorized agent for this project. The authorized agent is responsible for executing the
approved project in accordance with the statutes, regulations, guidance, Office of Emergency
Services State & Administrative Plans and OES Assurances that govern this grant program.
In other words, the State requires we have someone designated to manage the State and
Federal regulations concerning this grant.
The type of documents that will need to be signed by the Authorized Agent include; requests
for reimbursement, requests for changes in scope, time or budget, receipt of all official OES
and FEMA correspondence, receipt of reimbursements, submittal of quarterly reports,
accounting for the project's expenses and providing close-out documentation after
completion of the project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH DESIGNATING THE
DIRECTOR OF BUILDING & SAFETY OR THE DIRECTOR OF PUBLIC WORKS AS THE
CITY'S AGENT AUTHORIZED TO EXECUTE AND FILE AN APPLICATION
FOR FEDERAL AND STATE FINANCIAL ASSISTANCE
WHEREAS the City of Huntington Beach desires to complete a seismic retrofit of the
City Hall administration building located at 2000 Main Street in Huntington Beach; and
WHEREAS the City of Huntington Beach desires to obtain available federal and state
financial assistance for the costs of the seismic retrofit; and
WHEREAS the City is required to designate an agent authorized to execute and file an
application for federal and state financial assistance with the Office of Emergency Services for
the purposes of obtaining certain federal financial assistance under P.L. 93-288 as amended by
the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state
financial assistance under the California Disaster Assistance Act.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Huntington Beach, a public entity established under the laws of the State of California, that the
City's Director of Building & Safety or the City's Director of Public Works is hereby authorized
to execute for and on behalf of the City of Huntington Beach an application, and to file it in the
Office of Emergency Services, for the purpose of obtaining certain federal financial assistance
under P.L. 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency
Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance
Act.
BE IT FURTHER RESOLVED that the City of Huntington Beach, a public entity
established under the laws of the State of California, hereby authorizes its agent(s) to provide to
the State Office of Emergency Services for all matters pertaining to such state disaster assistance
the assurances and agreements required.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 6th day of February , 2006.
