It became law this year. It is, essentially, the State's effort to codify a "no cooperation law" with the Federal Immigration efforts. The problem is, like with so many other recent State laws, it is un-Constitutionally overreaching. Setting aside any Immigration policy arguments or debate, SB54 is simply a State overreach of local control. There are provisions of this new State law for instance that prevent local municipalities from taking certain action and preventing local municipalities from spending their own general fund monies in certain law enforcement ways. As a City, we should fight all efforts meant to encumber our local law enforcement. This is an un-Constitutional overreach in so many ways, especially for Charter Cities like Huntington Beach. RECOMMENDED ACTION: Authorize the City Attorney to prepare and file a lawsuit against the State and Attorney General challenging the legality of SB54 on Constitutional grounds to preserve our right and ability in Huntington Beach to continue to exercise local control. Additionally, allow the City Attorney to work with the County or other municipalities that wish to join our efforts. My family and I will be out of town and unable to attend that meeting, but I wanted to inform you that I strongly support the position.presented by the mayor in the March 23rd article about Sanctuary State Law, I am 55 years old and this is the first time I have ever contacted any government entity about any political issue, but the arrogance and lawlessness of our governor, Kevin de Leon,.Miguel. Santiago, Anthony Rendon, attorney general Xavier Becerra and others compels me to do so. Although these California politicians repeatedly (and disingenuosly)purport and infer that they represent the viewpoint of ALL Californians, they are not considering or expressing my (and many millions of other U,S. citizens') viewpoint _- contrary to Xavier Becerra's statement of"trying to be a state where everyone participates". SB54 makes it clear that "everyone" means only "everyone who agrees with their viewpoint". I also used to take my grandchildren to Central Park as well as occasionally walk the park for exercise and view the wildlife including the nesting owls. I now hesitate to use the park. due to occasional encounters with erratic behaving people which appear to be homeless. Again, if the BOS moves to place a homeless encamping in HB the council should strongly resist. I also feel strongly that the City of Huntington Beach should join the lawsuit with several. other cities in Orange County and Orange County itself against the "sanctuary state" status announced by Gov. Jerry Brown. This should also include an ordnance (as has been done by Los Alamitos and follow federal law)to ignore the recent laws put in place to prevent law enforcement from notifying ICE when the city has in custody someone who is in the US illegally. I find it an unnecessary use of our general fund and staff time. The federal government is currently suing the State of California on three laws that they feel obstruct federal immigration laws, and they should be allowed to run their course before any other lawsuit is even considered. I look upon the Sanctuary law (SB-54)to be comparable to when the Southern States succeeded from the nation United States, the move resulted in the Civil War. Any law, even a partial one like (SB-54), that illegally separates and removes itself form the United States Government, is Unconstitutional. However, I believe these concerns fear-mongering and not based on facts. Repeated studies have shown that having immigrants - both documented and undocumented - actually DECREASES crime in a community. Recent studies have shown that being a sanctuary county has positive impacts on communities. There are, on average, 35.5 fewer crimes committed per 10,000 people in sanctuary counties compared to nonsanctuary counties. This is largely due to the fact that there is increased trust between immigrants and law enforcement, so they are more likely to report crime and cooperate in investigations. Additionally, because law enforcement resources are not being used to help with federal investigations, and instead are being used to help with local crime, law enforcement officers have the time and resources necessary to solve and prevent crimes. Additionally, the law is not unconstitutional because federal courts have repeatedly found that the federal government cannot force local law enforcement to detain immigrants. Compliance with federal requests is voluntary. It would be a significant use of resources that could be better allocated toward helping our community in other ways. It costs approximately $150 a day per person to put them in a detention facility - a cost that is a burden of the city/county/state. Huntington Beach should not spend it's resources on on these, when we can use the money to investigate more serious crimes and ensure our police officers have up to date equipment. I sincerely hope you actually read the entirety of the California Values Act or have counsel read it - after reading the agenda item for tonight, it does not appear that the authors have read the bill. There is no language in the agenda item that provides any explanation as for why the council believes that the California Values Act is inconsistent with the US constitution or federal law. California has the authority under the Tenth Amendment to ensure that state and local resources are not used to enforce federal immigration laws that fuel mass deportations, separate families, and spread fear through immigrant communities. It is not California's responsibility to use state and local resource to enforce immigration law, that is the federal government's purview. Which is why the California Values Act was written specifically to completely comply with federal law. Additionally, I hope you also actually read the Sessions lawsuit (as it appears you have not read that either). The lawsuit has no legal merit and only challenges 3 provisions of the law's extensive requirements. The filing of the lawsuit does not halt these provisions nor the non-contested provisions from having binding effect on Huntington Beach. The lawsuit also does not challenge the California Values Act's requirement for public schools, public libraries, public health facilities, court houses, and other public institutions to implement policies limiting assistance with immigration enforcement to the fullest extent possible. Even if Sessions's lawsuit ultimately prevails, Huntington Beach would still be required to follow these provisions of the California Values Act. Most troubling, as reported in the OC Register, OC cities have been receiving pressure from the Immigration Reform Law Institute (IRLI) , the litigation arm of the Federation for American Immigration Reform (FAIR), i which the Southern Poverty Law Center and Anti-Defamation League have designated as a hate group. FAIR leaders have ties to white supremacist groups and eugenicists and have made many racist statements. I love where I live, but I am not surprised by the racist, anti-immigrant sentiment from its residents and elected officials. I sincerely hope you reconsider being part of a movement that aims to harm immigrant communities and families. As Ms. Hardy so eloquently stated,while the item may have been written with the intentions of ensuring local control,clearly that was not the message being delivered Monday evening. Based on the distraught look on Ms. Delgleize's face when she mentioned that she hadn't experienced anything like what she experienced that night in her 45 years of participating in this community,it seemed she would also vote against the lawsuit. So what happened? Why did she follow suit? Was it blind loyalty to party? Was it the claims that Sacramento will"take over"if they are given an inch this time? Was it claims that what happened that night was simply free speech? Was it claims that this shouldn't be an "emotional"decision? First,claiming to want to sue the state now not because you're 100%sold on this issue but because you want to send a message to officials in Sacramento that they cannot control Huntington Beach,is simply a vote out of fear,and that's an emotional decision. We should not act like defiant teenagers who are upset at our parents telling us what to do,especially if they are wanting us to do something that is actually in the best interest of humanity. Second,what we experienced Monday evening was anything but"free speech." It was"hate speech," and the prevention of free speech. I waited patiently for hours to be granted my measly two minutes of"free speech,"which turned out to be anything but,as I was continuously disrupted by hateful shouts from the audience. And hate was the theme all night. Rabbi Einstein simply tried to discuss peace and unity but was undermined by lewd shouts about circumcision. Congressional candidate Omar Siddiqui was similarly drowned out by bigots screaming words about Allah. When one woman simply mentioned the word"feminism"at the podium,she was verbally attacked,as was another woman for simply mentioning that she's a social worker. Community leader,Victor Valladares,had to endure constant loud shouts of"Go home,Victor,"throughout the night. There is no way the council members did not hear this. And this does not include all of the side conversations going on,like the women behind me in the side room where I sat for a while who laughed about burning Victor in the flag he was wearing. The list of hate speech could fill a book,and it was all made possible by the poor leadership of our city council. Mr. Posey,I ask you to take a lesson from Lieutenant Governor Gavin Newsom. When he presided in the same chambers over the meeting involving the hot topic of the Poseidon desalination plant,he showed true leadership. Knowing the crowd could get unruly,he set rules from the start. We were not even to clap. We could simply use silent hand gestures. And at one point when the audience did make noise, Mr. Newsom threatened to end the meeting right then and there,and people listened to him and were silent. That was good leadership. The only time you stopped the meeting,Mr. Posey,was when a speaker called you out personally. Perhaps you felt attacked,but so did we. I appreciate that you are all seemingly on board with moving Huntington Beach toward being a toxin- free city,and I appreciate your 7-0 vote on agenda item#13. I only wish you would see metaphorically that Round-up is toxic horticulturally as well as interculturally. We have a much faster road to peace and tolerance on this earth if our environment and all of its inhabitants are treated with respect and kindness.
