SUBJECT: Approve Delegation of Authority to the City Administrator to Approve
Administrative Items Related to the Financing or Subleasing of City
Leases.
Statement of Issue: City Council is asked to delegate authority to the City Administrator
or his/her designee to approve administrative items related to the financing or subleasing of
City leases.

Analysis: At various times throughout the year, City staff receives requests fromlessees to
approve minor administrative items which deal with the financing or sub -leasing of City
owned facilities. These timely documents, such as estoppel certificates or sub -leasing
agreements, are currently required to be approved by City Council.
One example at hand is the sub -leasing of the Waterfront Beach Cabana. The Robert Mayer
Corporation has asked the City to approve a Sub -Lease Agreement pursuant to the terms in
their Agreement, which currently requires City Council to provide written approval of any Sub -
Lease Agreement the lessee may enter in to.
The Economic Development Department, along with Community Services and the City
Attorney's Office, are in the process of reviewing this Sub -Lease Agreement to verify that it
coincides with the same lease terms as the Waterfront Beach Cabana Agreement. This
review time could be reduced by delegating the approval of this Sub -Lease Agreement
authority to the City Administrator.
In order to provide a more business -friendly approach to these processes, City Council is
being asked to approve the delegation of this authority to the City Administrator or his/her
designee to approve minor administrative items related to the financing or sub -leasing of City
owned facilities.
If approved, this will allow these businesses to obtain approvals from the City in a more
timely fashion, and take advantage of financing opportunities which may become available in
order to keep their businesses viable.
