Coastal Act prohibiting the sale of a unit in an overnight visitor serving
commercial facility from being sold for individual ownership
The Intergovernmental Relations RCA on the May 7 Council Agenda includes a
recommendation to oppose AB 1459.
As this bill was moving quickly through the legislature and had the potential to impact
development in the city, I, in consultation with the Mayor Pro Tern and City Administrator,
determined that the need to take fast track action on this bill was warranted. In conjunction with
that action, a letter of opposition was sent to the Assembly Natural Resources Committee, and a
trip to Sacramento to testify in opposition to the bill was planned.
I am pleased to report be that because of our action AB 1459 died in committee.

Analysis:
1. SUPPORT SB 645 (Correa) - Giving the Orange County Sanitation District authority to use
a design build process for projects over $10 million
Existing law requires public entities to comply with certain procedures in soliciting and evaluating bids
and awarding contracts for the erection, construction, alteration, repair, or improvement of any public
structure, building, road, or other public improvement. The Orange County Sanitation District is
seeking authority to use a design-build process on projects of over $10 million as a means of
expediting and reducing the cost for certain projects.
SB 645 would authorize, the Orange County Sanitation District to enter into design-build contracts in
excess of $10,000,000, as defined, according to a specified procedure, until January 1, 2013.
The Intergovernmental Relations Committee is recommending that the City Council support SB 645.
2. OPPOSE AB 1459 (Levine) — Amending the California Coastal Act of 1976 to prohibit, in
the coastal zone, a unit in an overnight visitor-serving commercial facility from being sold for
individual ownership or part-time private occupancy
The California Coastal Act of 1976 provides that the use of private lands suitable for visitor-serving
commercial recreational facilities designed to enhance public opportunities for coastal recreation shall
have priority over private residential, general industrial, or general commercial development, but not
over agriculture or coastal-dependent industry.
AB 1459 would prohibit in the coastal zone a unit in an overnight visitor-serving commercial facility
from being sold for individual ownership or being used for part-time private occupancy. AB 1459
would also prohibit in the coastal zone the conversion, in whole or part, of an overnight visitor-serving
commercial facility to a full-time or part-time private residential facility.
Because the existing process with local review and review by the Coastal Commission provides many
opportunities for concerns regarding the make up of a project to be addressed, and because AB 1459
would preempt that process, the Intergovernmental Relations Committee is recommending that the
City Council take a position opposing AB 1459.
A letter opposing AB 1459 was sent to the Assembly Natural Resources Committee utilizing the
Legislative fast track process.
3. APPROVE a Resolution of the City of Huntington Beach in support of the Orange County
Water District's Groundwater Replenishment System.
In March of 1999, the City Council approved a resolution supporting the Orange County Water
District's plan for a groundwater replenishment system. The Water District has been moving forward
with this system, and they are about to begin implementation. Since it has been a number of years
since the city adopted its original resolution, the Water District is requesting that the city renew its
support for the program with this new resolution.
The Intergovernmental Relations Committee is recommending that the Council approve this
resolution.

Existing law requires public entities to comply with certain
procedures in soliciting and evaluating bids and awarding contracts
for the erection, construction, alteration, repair, or improvement of

Existing law authorizes specified state agencies, cities, and
counties to implement alternative procedures for the awarding of
contracts on a design-build basis.

SECTION 1. Section 20785 is added to the
Public Contract Code to read:
20785. (a) Notwithstanding any other provision of law, the Orange
County Sanitation District may use the procedures described in
Section 20133 for the construction of projects in excess of ten
million dollars ($10,000,000) , including, but not limited to, public
wastewater facilities.
(b) In addition to the requirements of subparagraph (A) of
paragraph (3) of subdivision (d) of Section 20133, the Orange County
Sanitation District shall also establish a procedure to prequalify
design-build entities and all subcontractors, including, but not
limited to, mechanical and electrical subcontractors using a standard
questionnaire. The questionnaire shall include a list of all
partners, general partners, or association members known at the time
of bid submission who will participate in the design-build contract,
including, but not limited to, mechanical and electrical
subcontractors.
(c) For purposes of this section, all references in Section 20133
to "county" and "board of supervisors" shall mean the Orange County
Sanitation District and its board of directors, respectively.
(d) This section shall remain in effect only until January 1,
2013, and as of that date is repealed, unless a later enacted
statute, that is enacted before January 1, 2013, deletes or extends
that date.

SEC. 2. Due to the unique circumstances of the Orange County
Sanitation District with respect to its mandate with the federal
Environmental Protection Agency and the State Water Resources Control
Board for the completion of an additional secondary treatment
facility within the district by December 2012, the Legislature hereby
finds and declares that a general statute cannot be made applicable
within the meaning of Section 16 of Article IV of the California

Constitution. Therefore, the special legislation contained in Section

AB 1459, as introduced, Levine. California ,Coastal Act of 1976:

The California Coastal Act. of 1976 provides that the use of
private lands suitable for visitor-serving commercial recreational
facilities designed to enhance public opportunities for coastal
recreation shall have priority over private •residential, general
industrial, or general commercial development, but not over
agriculture or coastal-dependent industry.
This bill would prohibit in the coastal zone .a unit in an
overnight visitor-serving commercial facility from being sold for.
individual ownership or being used for part-time private occupancy.
The bill would also prohibit in the coastal zone the conversion, in
whole or part, of an overnight visitor-serving commercial facility to
a full-time or part-time private residential facility.
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1.. Section 30222 .3 is added to the Public Resources Code,

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH IN SUPPORT OF
THE GROUNDWATER REPLENISHMENT SYSTEM,
A JOINT EFFORT OF THE ORANGE COUNTY WATER DISTRICT
AND THE ORANGE COUNTY SANITATION DISTRICT
WHEREAS, within the next 20 years, Orange County's population is expected to
increase by more than 15 percent, and Orange County's need for safe, reliable drinking
water also will increase. We must find innovative ways to secure safe, new and locally-
controlled alternate sources of high-quality water; and
The Orange County Water District (OCWD) and the Orange County Sanitation
District (OCSD) have embarked on what is intended to be a cost-effective solution to
future water needs with a supplemental water purification project, known as the
Groundwater Replenishment (GWR) System; and
The GWR System will take highly-treated sewer water from the Orange County
Sanitation District that is currently sent to the ocean and purify it to near-distilled quality
water using the state-of-the-art technologies of microfiltration, reverse osmosis, and
ultraviolet and hydrogen peroxide disinfection; and
The GWR System will produce a new supply of water that will expand our
seawater barrier to protect our groundwater basin from ocean contamination, and also
help replenish our groundwater basin, minimizing the impacts of future droughts; and
The GWR System will produce near-distilled quality water using less energy than
is required to import water from Northern California; and
The GWR System is environmentally sound and reuses a precious resource -
water- in an arid, drought-prone region; and
The GWR System is also diversifying our water supply portfolio with a new,
reliable and locally-controlled source of high-quality water that may be cheaper than
future imported water; and
The GWR System water will be available regardless of rainfall levels or drought
conditions to help support our growing economy and enviable lifestyle; and
The GWR System is a model water project for other communities tlu-oughout the
United States and around the world, and OCWD and OCSD are recognized as innovative
leaders in water reuse,

NOW, THEREFORE, the City Council of the City of Huntington Beach does
hereby resolve as follows:
1. That the City of Huntington Beach hereby SUPPORTS the GWR System
and the efforts of OCWD and OCSD to identify and develop alternative sources for safe,
reliable water supplies for Orange County's future.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach
at a regular meeting thereof held on May 07, 2007.
