RECOMMENDATION Authorize the Chairman and Secretary of the Parking A thority to execute and record said deeds . The report also provides recom- mendations on how to eliminate this problem. Briefly, it seems these properties were purchased with $577 ,000 of City funds that were to be reimbursed when Parking Authority bonds were sold. Since the Top of the Pier Plan is defunct, we should consider transferring title back to the City of Huntington Beach. Attached is Resolution No. authorizing reconveyance to the City of Huntington Beach these parcels of land which were to -be used in the Top of the Pier Plan. Also attached is a map designating these said properties . Exhibits A through E, Contracts of Sale and recorded Grant Deeds on said properties , are available in my office should Council members desire to review these documents. RECOMMENDATION Adopt Resolution No. /6'50' reconveying to the City parcels of land which were to be used in the Top of the Pier Plan. MOORHOUSE, DIRECTOR CITY ADMINISTRATOR HARBORS, BEACHES & DEVELOPMENT Subject PARKING AUTHORITY PROPERTIES Date MARCH 4, 1977 DOWNTOWN HUNTINGTON BEACH Pursuant to your request, Mr. Arguello, Finance Director, and I have researched the City files and financial records and have provided a list of Exhibits A through E concerning properties that were acquired by the City with City funds, but recorded under the grant deeds to the Parking Authority of the City of Huntington Beach. As you are aware, this has resulted in a multiple of problems in recent years. Per your instructions, this report will provide you and the City Council with a cursory overview of the problem and how it came about and our recommendations on how to mitigate this vexing problem. Most important is that we record for historical purposes what took place and rectify the problem by legislative action of the Council. Overview In 1970-71, the City adopted a development plan for the downtown area called the Top of the Pier plan. In that plan it was proposed to acquire property for the purpose of parking bounded on the property from 6th Street to Lake Street and Ocean Boulevard to Walnut Street. From the period of 1971 to 1974 the City acquired certain properties within those boundaries and therein lies the problem. The City acquired the property with City funds and had the property deeded in the escrow transactions to the Parking Authority. The reason that administration took this action was on bond counsel's recommendation and advice at the time the project has been authorized by the City Council and the community. The intent of the City was to acquire the property through friendly negotiation and then, ultimately, condemnation for those parcels whose owners would hold out. All of the properties that were acquired were through friendly negotiations. The City expended $577,000 from 1971 to 1974 in this land acquisition. Bond counsel recommended that we acquire the first parcels with City funds and this would be reimbursed when the Parking Authority bonds were sold to acquire the entire parcel. Obviously, the Top of the Pier plan is now history. The City has since replanned the area and been heavily committed to the VTN plan, the Downtown plan and, most recently, concluded public hearings for redevelopment of the downtown area via redevelopment agency. Of primary concern is the $577,000 invested by the City in the Parking Authority. The City Council is, in fact, the Parking Authority. It is recommended that this matter be brought to the attention of the City Council and the Parking Authority while they are separately conducting business and that the matter be thoroughly aired publicly in order that the Parking Authority can transfer Floyd G. Mr. Arguello and I both recommend that this matter be resolved at the earliest date possible in order to: (_1) Clear up the official records, (2) Make these properties and resources more readily available to the City in the event the redevelopment process is activated in the next few months, and (3) Allow the Council to dispose of this property if they so desire. Moorhouse City Administrator Director, Community Services Subject City-owned Property - Downtown Date April 5 , 1983 Recently, the City Council requested information concerning property in the downtown area that was originally purchased by the city for the Parking Authority. To provide that information, I have attached a copy of my memo of March 4 , 1977, and other material which resulted in subsequent reso- lution by Council clarifying the whole matter. In essence , all of the property in the downtown area was purchased with $577 ,000 in city funds that were to be reimbursed when the Parking Authority bonds were sold. Although the Top of the Pier Plan was not implemented, the property remained in the Parking Authority ' s name because all of that property was negotiated under friendly conditions. When it was purchased, the Parking Authority' s name was put . on the deeds rather than the ci`y' s . This was all done based on Bond Counsel 's recom- mendation which- took place between 1970 and 1.974 . In 1977 , we recommended that Council adopt a resolution transferring all of the deeds to the city because, in actuality, .the Parking Authority did not have funds in the property at all. Since the Council and the Authority are one and the same, it was felt that this matter should be rectified by resolution. Also included is a memo to Council from Mr. Belsito and a map show- ing the areas where those properties were purchased. I would like to note that the City Clerk has copies of all of the grant deeds . In fact , Alicia Wentworth is to be commended for assisting in recovering all this material .
